2005 yılında Birleşmiş Milletler Dünya Zirvesi'nde onaylanan koruma sorumluluğu kapsamında öncelikle her devletin kendi halkını korumakla yükümlü olduğu BM üye devletleri tarafından kabul edilmiştir. Koruma sorumluluğuna göre eğer bir devlet kendi halkını koruyamıyor ya da korumakta isteksiz ise o zaman halkları koruma sorumluluğu uluslararası topluma geçmektedir. Feminist perspektiften koruma sorumluluğu değerlendirildiğinde, öncelikle kadınların koruma sorumluluğunun karar verici süreçlerinden dışlandıkları ve koruma sorumluluğunda aktör olarak değil de mağdur olarak görüldüklerinin belirtilmesi gerekir. Koruma sorumluluğunun insan güvenliğine değil de devlet egemenliğine/güvenliğine odaklanması da feminizmin eleştirdiği bir diğer nokta olarak göze çarpmaktadır. Feminist analizler bağlamında koruma sorumluluğunda silahlı güç kullanımına karşı çıkılmakta ve hem silahlı güç kullanılmamasına hem de daha kötü sonuçlar olmaması adına önleme faaliyetlerine önem verilmesine odaklanılmaktadır. Bu çalışmada, feminizm bağlamında koruma sorumluluğu Libya örneği üzerinden analiz edilmiştir. Koruma sorumluluğu kapsamında Libya'ya yönelik müdahalenin insanların korunması amacıyla yapıldığı söylense de gerçekleştirilen müdahalenin devletlerin realpolitik amaçlarına hizmet ettiği görülmektedir. Bununla birlikte Libya örneğinde tecavüzle ilişkilendirilerek mağdur olarak görülen kadınlar, müdahalenin meşru hale getirilmesi için de ön plana çıkartılmışlardır. Koruma sorumluluğu kapsamında Libya'da gerçekleşen barış inşa süreçlerinde ise kadınların temsilinin yetersiz olması koruma sorumluluğunun maskülen yapısını ortaya koymaktadır. Feminizmin belirttiği gibi, barış süreçlerinde kadınların rol alması beklenirken gerçekte durumun hiç de öyle olmadığı Libya örneğinde de kendini göstermektedir. In 2005, the responsibility to protect was approved at the UN World Summit, and UN member states recognized that each state is primarily responsible for protecting its people. According to the responsibility to protect, if a state is unable or unwilling to protect its people, then the responsibility to protect people passes to the international community. When the responsibility to protect is analyzed from a feminist perspective, it becomes clear that women are excluded from the decision-making processes of the responsibility to protect and are seen as victims rather than actors. The fact that the responsibility to protect focuses on state sovereignty/security rather than human security is another point criticized by feminism. In the context of feminist analyses, the use of armed force in the responsibility to protect is opposed, and the focus is on both not using armed force and giving importance to prevention activities to prevent worse consequences. In this study, the responsibility to protect in the context of feminism is analyzed through the case of Libya. Although it is said that the intervention in Libya was carried out for the protection of people within the scope of the responsibility to protect, it is seen that the intervention served the realpolitik objectives of the states. In the case of Libya, women, who are associated with rape and seen as victims, are also brought to the forefront to legitimize the intervention. The inadequate representation of women in the peace-building processes in Libya within the scope of the responsibility to protect reveals the masculine nature of the responsibility to protect. From a feminist perspective, women are expected to play a role in peace processes, but the Libyan example shows this is not the case.

Bu çalışmanın konusu, Osmanlı Erken Modern Çağında egemenliğin sürekliliği sorunu ve bununla bağlantılı olarak devlet tüzel kişiliğinin gelişimidir. Çalışma, egemenlikte sürekliliğinin sağlanması ile devlet tüzel kişiliğinin gelişimi arasında bir ilişki olduğu ve bu sürekliliğin, devlet tüzel kişiliğinin gelişimine zemin hazırladığı hipotezine dayanmaktadır. Çalışmada öncelikle Osmanlı’da egemenliğin kimde olduğu tartışılmıştır. Buna göre önceleri hanedanda tecessüm eden egemenliğin Erken Modern Çağda padişahın şahsında toplandığı ortaya konmuştur. Ardından, devlet tüzel kişiliğinin gelişim seyrini gösterebilmek için Osmanlıların kendine verdikleri isimler tahlil edilmiştir. Böylece devlet tüzel kişiliğinin ortaya çıkışına dair ipuçları gösterilmiştir. Bu süreçte yaşanan tarihsel gelişmelere değinilerek devlet tüzel kişiliğinin ortaya çıkışında ve gelişiminde etkili olan temel faktörler ele alınmıştır. Son olarak egemenliğin sürekliliği sorunu bir padişah öldüğünde yerine geçecek olanın kim olacağı ve nerede tahta cülus edeceği örneği etrafında tartışılmıştır. Çalışmanın sonunda, Osmanlı Erken Modern Çağında önce hanedandan bağımsız ve mutlak saltanat anlayışının ve daha sonra sultandan bağımsız ve müstakil bir devlet anlayışının geliştiği ve dolayısıyla süreklilik sorununu belli ölçüde aşıldığı, kıymeti kendinden menkul bir devlet tüzel kişiliğinin oluşmaya başladığı sonucuna ulaşılmıştır. The subject of this study is the problem of the continuity of sovereignty and the development of the state legal entity in connection with this in the Ottoman Early Modern Age. The study is based on the hypothesis that there is a relationship between ensuring the continuity of sovereignty and the development of the state legal entity, and this continuity lays the groundwork for the development of the state legal entity. In the study, first of all, who was the sovereign in the Ottoman Empire was discussed. Accordingly, it has been revealed that the sovereignty, which was once embodied in the dynasty, was gathered in the person of the sultan in the Early Modern Period. Then, the names given by the Ottomans to themselves were analyzed in order to show the development course of the state legal entity. Thus, clues about the emergence of the state legal entity are shown. By referring to the historical developments experienced in this process, the main factors influencing the emergence and development of the state legal entity are discussed. Finally, the question of the continuity of sovereignty is discussed around the example of who will replace a sultan when he dies and where he will conquer the throne. At the end of the study, it was concluded that in the Ottoman Early Modern Period, firstly, the understanding of absolute sultanate and independent from the dynasty and then an independent and separate state understanding from the sultan developed and therefore, it was concluded that the problem of continuity has been overcome to a certain extent and that a state legal entity has started to form.

Bu çalışmanın amacı ilk dönem İslam toplumunda var ise denetim uygulamalarını tespit edip değerlendirmektir. Bu bağlamda, Hz. Peygamber ve Râşid halifeler dönemindeki denetimle ilgili olan veriler doküman incelemesi yapılarak oluşturulmuştur. Toplanan veriler içerik analizi yoluyla yorumlanmıştır. Gözetim ve toplumsal denetimin etraflıca anlaşılabilmesi için kavram farklı açılardan ele alınarak genel çerçeve oluşturulmuştur. Araştırmada, denetimin sosyal, iktisadi ve idari alanlardaki uygulamaları irdelenmiş, elde edilen bulgular bu kapsamda ortaya konulmuştur. Hem modern öncesi hem de modern dönem pratikleri ile ilk İslam toplumundaki denetimin farklılaşan ve benzeşen noktalarına dikkat çekilmiştir. Çalışmada yer verilen uygulamalar, denetimin kavramsal çerçevesinin dışına çıkılmadan değerlendirilmiştir. Hz. Peygamber ile Hulefâ-i Râşidîn döneminde, zamanın ihtiyaçları ve şartlarıyla örtüşen, yönetici tarafından dahi olsa tecessüs sınırını aşmayan ve sistematik olmayan toplumsal denetim ve gözetim pratikleri görülmektedir. Elde edilen veriler neticesinde, ilk dönem İslam toplumunun hususi bir denetime sahip olduğu sonucuna ulaşılmıştır. This study aims to establish and evaluate social control practices in the first Islamic society, if there is any. Accordingly, documentation relevant to control practices at the periods of Prophet Mohammad and Rashidun was investigated and analyzed by employing descriptive analysis method. To fully define the scope, we established conceptual framework of surveillance and social control mechanism and discussed various aspects of the definitions. Findings of the study were reported within this framework by analyzing social, administrative, and economical aspects of social control practices. Similarities and differences of control practices in the first Islamic society to the pre-modern and modern practices were highlighted. The examples given in the study were analyzed in accordance with the conceptual framework of social control. Obtained findings indicated the presence of social control practices that are characteristic to the first Islamic society. Such practices that matched with the requirements of the time and conditions were observed during Prophet Mohammad and Rashidun. Even when practiced by ruling class, social control was not inquisitive and systematic.

Dövüş Kulübü, insanları konfor ve eşyalaşma ile köleleştiren tüketim toplumuna karşı başkaldıran bir beyazyakalının hikayesidir. Bir direniş odağı olarak dövüş kulübünü ilginç kılan şey, burada sergilenen şiddetin karakteri ve mahiyetidir. Dövüş Kulübü’nün hikaye ettiği şiddet, ilk bakışta Georges Bataille ve Walter Benjamin’in tanımladığı şekliyle bir egemen-şiddet anlatısı olarak gözükmektedir. Ancak dövüş kulübündeki bu spontane, söylemsiz ve dolayımsız şiddet tanındıkça (recognition), egemen olma vasfını yitirerek, kanunkoyucu şiddete dönüşmeye başlamıştır. Dövüş Kulübü’nün dile getirdiği şiddetin doğasını inceleyen bu çalışma, Bataille ve Benjamin’in şiddet ve egemenlik üzerine olan görüşlerinden yola çıkarak, bir Dövüş Kulübü okuması sunmaktadır. Çalışmanın birinci bölümünde, Dövüş Kulübü’nün egemen-şiddet ve tanınma paradoksu bağlamında genel bir incelemesi sunulacaktır. İkinci bölümde, Benjamin ve Bataille’ın egemenlik ve şiddet üzerine olan görüşleri, Dövüş Kulübü ile ilgili olacak şekilde ortaya konacaktır. Üçüncü bölümde, Benjamin ve Bataille’ın ortaya koyduğu yaklaşımlar ve görüşler doğrultusunda, Dövüş Kulübü’nde sergilenen şiddetin, egemen-şiddet olup olmadığı meselesi ele alınacaktır. Fight Club is a story of a white-collar who revolts against the system that has enslaved human-beings with comfort and commodification. This study, which aims at analyzing this revolt, suggests that Bataille’s and Benjamin’s views on sovereignty and violence have a critical importance to understand the nature of violence displayed by Fight Club. Considering Benjamin’s and Bataille’s views on sovereign violence, this study concludes that Fight Club falls short of bringing about the sovereign violence it promised. In the first part of the study, Fight Club is to be placed within the context of sovereign violence and recognition paradox. In the second part, what Bataille and Benjamin understand as sovereign violence and sovereignty is to be analyzed. In the last part, the issue of whether Fight Club is a case of sovereign violence or not is to be taken into consideration.

Meşruiyetini dayandırdığı halk egemenliği bağlamında toplum sözleşmesi kuramına dayanan modern devlet anlayışı, klasik siyaset felsefesinden farklı olarak bireyi siyasal özne olarak görmektedir. Osmanlı düşüncesinde de bilhassa Meşrutiyet anlayışı ile birlikte dillendirilen toplum sözleşmesi kuramı ve dönüşen “halk” kavramı ulus-devlete giden süreçte meşruiyetin dayanağı olarak karşımıza çıkmaktadır. Makalede toplum sözleşmesi bağlamında egemenliğin meşruiyet kaynağı olarak beliren halk ve halkçılık anlayışının Osmanlı düşünürlerinden başlayarak Cumhuriyet dönemindeki algılanışı ve etkileri ele alınmaktadır. II. Meşrutiyet’le birlikte halka nispet edilen aşkın niteliklerin Millî Mücadele sonrasında irşada muhtaç niteliklere dönüşümü egemenlik bağlamında değerlendirilmektedir. The concept of the modern state, based on the social contract theory in the context of popular sovereignty on which it is based, regards the individual as a political subject, unlike classical political philosophy. In Ottoman thought, the concept of the social contract and the transformed notion of the people, especially when mentioned alongside the Constitutional Monarchy, are the basis of legitimacy in the process leading to the nation-state. This article deals with the perception and the effects of the concept of the people and populism, starting with Ottoman thinkers, which emerged as the source of legitimacy of sovereignty in the context of the social contract. This paper evaluates how the people who were granted transcendental attributes in the Second Constitutional Monarchy, were transformed, right after theNational Struggle, to having to be trained to the true path in the context of sovereignty.
