Das Konzept ‚Mängelwesen‘ hat seine vielleicht bekannteste Formulierung auf dem Feld der Geisteswissenschaften durch die philosophische Reflexion von Arnold Gehlen gefunden. In seinem Buch Der Mensch. Seine Natur und seine Stellung in der Welt (1940) entwirft er die nicht unumstrittene These, dass der Mensch ein solches ‚Mängelwesen‘ sei, da er weder somatisch noch auf dem Feld der Instinkte eine adäquate Anpassung an die Welt aufweisen könne. Im Vergleich zu anderen Lebensformen und Spezies sei er zudem arm an Mitteln zur Befriedigung sinnlicher Bedürfnisse. Dies führt nach Gehlen dazu, dass der Mensch situativ stetig interagieren muss und somit seine Zwecksetzungen gestalterisch einholt, um die eigene perzeptive und instinktive Mangelhaftigkeit zu kompensieren und Erfahrungsmöglichkeiten zu modellieren bzw. ggf. erhöhen. Der grundlegend anthropologische Diskurs zur Mangelhaftigkeit scheint deshalb konstitutiv mit Formen – im Sinne von Konzepten, Praktiken und nicht zuletzt Kulturtechniken – des Gestaltens zusammenzuhängen, die sich historisch konkretisieren. Der Band Figurationen des Mangels in Ästhetik, Design- und Kunstpraktiken geht dieser Erkundung von singulären Entwürfen und theoretisch-historischen Konstellationen nach, den Erscheinungen der Mangelhaftigkeit und des gestalterischen Umgangs mit ihren medialen und sinnlich-somatischen Ausformungen. Dabei werden nicht allein traditionelle Konzepte und Denkfiguren der Philosophie wie etwa jene des Supplements, der Prothese oder der Entlastung neu analysiert, sondern auch zeitgenössische medienästhetische und designtheoretische Ansätze. In dieser Hinsicht werden gestalterische Erprobungen (auf dem Gebiet sowohl der Kunst wie des Designs) sowie Körper- und Medienkonfigurationen, die sich durch spezifische Praktiken ereignen, als Problemfelder eines Diskurses des ‚Mängelwesens‘ betrachtet.

Over the past few years,'fashion law'has emerged as a vibrant field of inquiry. The legal and policy issues affecting the fashion sector have been investigated with increasing intensity, while a growing number of private practice lawyers and in-house counsel regard themselves as practising fashion law. But what is fashion law? And what are the specific legal challenges facing the fashion sector, as well as related solutions? The Handbook of Fashion Law seeks to answer these questions by bringing together multiple voices, approaches, and jurisdictions. Its contributions are organized into four thematic areas. Part I considers the legal infrastructure of the fashion and luxury industries, addressing issues related to intellectual property (IP) as well as the demands of the circular economy, protection of cultural heritage, and freedom of expression and information. Part II maps the IP dimensions of fashion by reviewing the application of design rights, copyright, trade marks, geographical indications, plant variety rights, and trade secrets. Part III analyses specific contractual issues arising in the fashion sector. It examines the application of principles and rules found in regulatory frameworks, including those governing advertising, competition, consumer, and tax laws. Finally, Part IV dissects and evaluates the role of new and emerging technologies in the fashion sector from a legal perspective. It considers concepts such as e-commerce, 3D printing, counterfeiting, artificial intelligence, non-fungible tokens (NFTs), the metaverse, gaming, and wearable technology. The Handbook of Fashion Law offers readers a multidisciplinary and multijurisdictional understanding of legal challenges facing the fashion sector. Bringing together a diverse range of experts, its contributions offer readers an in-depth, critical, and strategic understanding of the fashion industry's legal intricacies.

This book offers a multidisciplinary analysis of the degradation process of an ecosystem, drawing upon the Mar Menor as a case study to highlight the damage human pressure causes to the environment.All ecosystems change over time, although in some cases, this variation is more dynamic and evident. The Mar Menor is a clear example of this “ecological transition”, as it is the largest coastal lagoon in the western Mediterranean and the first ecosystem in Europe to be granted legal personhood rights. This book provides an extensive overview of the history of its environmental degradation over the past 100 years, highlighting the subsequent succession of environmental crises including phytoplankton explosions, the disappearance of large areas of submerged meadows due to eutrophication, and episodes of mass mortality of aquatic fauna. Split into three sections to reflect thematic blocks, the book begins with a comprehensive description of the Mar Menor and its marine ecosystems, emphasizing its ecological value and unique space in Spain and Europe. It discusses intensive and globalized agriculture, surrounding agro‑export, and the laws that legislate it. In the second part, the book draws on a series of cultural concepts, theoretical frameworks, and participatory arts‑based research to enrich our understanding of the environment from multiple perspectives. Finally, in the third part, the book uses analysis gathered from the Mar Menor case study to discuss wider conclusions about the ways in which we can begin to undo our damage to the environment and restore ecosystems.This book will be useful for students, academics, and researchers interested in environmental justice, environmental history and anthropology, sustainable development, and environmental studies more broadly.

This book sets out to understand the ethical dimension of Black lives and deaths in the modern period. Recent events—from the brutal murder of George Floyd to the pervasive violence meted out daily on the streets of our cities—have demonstrated all too clearly the fundamental trait that shapes our contemporary moment: the Black condition is defined by indignity. Ajari takes dignity as his starting point because dignity is what white people try to abolish in their violence toward Black people, and it is what they deprive themselves of in exerting this violence. Dignity is also what Black people collectively affirm when they rise up against white domination. When a young Black man or woman's dignity is taken from them as the result of assault, rape, or assassination at the hands of the state, the roots of a long history of struggle, conquest, and affirmation of African humanity are exposed and shaken. Above all, dignity is the ability of the oppressed, trapped between life and death, to remain standing. Dignity or Death offers an uncompromising critical analysis of the European philosophical tradition in order to recover the misunderstood history of radical thought in Black worlds. Slave uprisings, Negritude, radical Christian traditions in North America and South Africa, and political ontology are all steps on a long and troubled path of liberation.

This book aims to develop an account of living together with difference which recognises the tension that we are inescapably with others – both human and non-human – but at the same time are always differing from and with those with whom we find ourselves.A concern for coexistence and questions over how we might live together have been raised and approached from a host of conceptual starting points in recent times, including via calls for a rethinking of communism today, the articulation of forms of ‘cosmopolitics'or ‘pluralism', the re-figuring of understandings of ecology as dark or feminist, amongst others. This book responds to such questions of coexistence by developing what it calls a ‘co-existential analytic'. In doing so, this book introduces a range of post-phenomenological thought which offers means for thinking about such questions of living together with difference. The thought of Emanuel Levinas on the face of the other, Jean-Luc Nancy on being as being-with, Roberto Esposito on the munis, and Michel Henry on pathic auto-affection are introduced and critically reflected upon in terms of what they offer for thinking about such coexistence. Alongside these conceptual starting points, a series of encounters - with cinema, everyday life, politics, and literature - are used to animate and illustration the discussion. Ultimately, the book argues for a ‘spacing'of subjectivities with that world and those encountered within it.This book is intended primarily for researchers and postgraduate students interested in questions of identity, difference, and subjectivity. It will be of interest to those in the fields of social and cultural geography, sociology, social theory, and cultural studies.

In this retrieval study David Van Brugge addresses how the current understanding of a homiletical use of imagination for expository preaching might be strengthened. The current need for strengthening becomes apparent when the various understandings of imagination and their implications for practical theology are realized. This is compounded as trends in homiletics seem to minimize the imagination or embrace it in modern or postmodern ways. The original contribution of this study is recognizing that the homiletical use of imagination can be strengthened by retrieving the Puritan baroque characteristics of Jonathan Edwards'imagination as evidenced in his sermons to the Stockbridge Indians of 1751–1758. Edwards drew on a rich background to display an imagination that synthesized thoughts and ideas, thought beyond the senses, and that, by the grace of God, transformed thought and practice. Through that creative thought, Edwards maintained Biblical exposition and appeal to the affections. Van Brugge further develops and evaluates the idea of Puritan baroque characteristics, concluding that it is a helpful characterization of Edwards'Stockbridge Indian sermons. In these sermons Edwards imaginatively used imagery, light, space, movement, and glorification for the ultimate goal of directing the affections of his audience towards God. Such a use of imagination for affective purpose becomes a key for the strengthening of a homiletical use of imagination today.
