Oggetto di questo saggio sono le novelle che parlano del diritto e della politica comprese nelle importanti raccolte composte a Firenze tra il 1360 e il 1430 (Trecentonovelle, Il Pecorone, Paradiso degli Alberti). A Firenze era il momento di massima fioritura per la narrativa in volgare e un periodo di esperimenti politici e istituzionali. Il testo delle novelle viene analizzato con gli strumenti della critica letteraria strutturalista (facendo riferimento a classici come Greimas, Lotman, Todorov, Genette), per far emergere i contenuti politici e giuridici. Le novelle, infatti, sono farcite di riferimenti al diritto, alle istituzioni, ai personaggi e alle vicende dell'attualità politica. In apparenza sono solo allusioni, ma in realtà costituiscono rimandi molto precisi, che possono permettersi di essere rapidi perché il lettore sapeva di che cosa si stava parlando. La narrazione vuole dire qualcosa di significativo riguardo al diritto e alla politica e lo fa con racconti avvincenti e accattivanti per catturare un pubblico vasto. Al centro dell'attenzione è l'amministrazione pubblica, in particolare la giustizia e i processi, ma anche la fiscalità. Emerge la polemica contro i poteri monarchici e le signorie, intesi in luce molto negativa, ma apprezzati per l'efficacia e la capacità decisionista di incidere nella società. Il contesto in cui si colloca questa narrativa è dato dalle vicende e dalla cultura politica e giuridica a Firenze fra Trecento e Quattrocento. L'esigenza fondamentale condivisa dagli autori e dai primi lettori di queste novelle era garantire la partecipazione di tutti al governo e l'efficienza del potere pubblico, di fronte a problemi come la corruzione e l'incompetenza dei funzionari, le storture del sistema giudiziario e tributario, le divisioni e le contrapposizioni politiche. I valori fondamentali che la politica e il diritto dovrebbero tutelare sono la pace e la libertà. Libertà vuol dire che le leggi devono essere fatte nell'interesse di tutti e che tutti devono obbedire ugualmente alle leggi. Questo studio è scritto col rigore della ricerca universitaria, ma si rivolge a un pubblico di lettori formato non solo da specialisti, dal momento che affronta problemi di sei secoli fa che sono tali anche oggi: costanti dell'esperienza italiana del diritto e della politica. Questa ricerca si colloca a cavallo tra discipline diverse: narratologia e critica letteraria, storia politica e istituzionale, storia del diritto.
