It seems impossible to explain language choice and practice in the multilingual, understudied context of an asylum law firm by simply referring to official policy texts and linguistic (human) rights. Based on linguistic-ethnographic data (in the form of participant observations, recordings and interviews conducted in the Belgian context), this study integrates a top-down perspective (focusing on the influence of language management) with a bottom-up perspective (by eliciting the research participants' language attitudes and ideologies and by investigating what actually happens in practice). Approaching these different parameters of language policy from a discourse analytical perspective, shows how a clear framework of linguistic (human) rights to regulate lawyer-client communication is missing. Because of the lack of concrete stipulations on how to make language choice acts, interpretation of linguistic needs is left to the individual assessment of lawyers. This leads to highly situated decision-making practices, where lawyers draw on their own experience as well as the input of others to organise multilingual interaction. Although a top-down policy exists, practice shows a lack of regulation and transparency in the selection of linguistic strategies/support on the ground.

This article employs the method of prosopography to reach a deeper understanding of a group of 53 trailblazing Chinese students who were the first to enrol in American law schools between 1878 and 1911, during the waning years of the Qing era. Most of them contributed greatly to the subsequent development of China's legal and diplomatic institutions, playing instrumental roles in legal education, diplomacy, government and the judiciary. Given these accomplishments, this group of students is worthy of detailed study and research, and this article examines their characteristics, background, subsequent contributions and other key pieces of information.

This paper is based within the framework of step-by-step approach to teaching legal translation. The underlying philosophy behind this approach is that when specific aspects of legal translations are tackled in isolation and trainees become aware of the pitfalls involved and the possible solutions, this helps them in further training as well as in their professional practice. Drawing on this assumption, this paper introduces a case study dealing with understanding and interpretation of English legal texts from the classroom perspective. The paper presents a number of problems that pose difficulties to trainees and proposes exercises to help them overcome such problems in a systematic way. Although this paper uses Czech as a target language, the exercises can be adapted to teach legal translation from English into other target languages. The issues have been selected based on the author's experience with addressing recurring problems faced by legal translation trainees. Such issues include understanding complex sentences showing all-inclusiveness and syntactic discontinuities, legal cross-referencing expressions (e.g. "subject to" and "without prejudice to") or conjunctions whose meaning may not be transparent (e.g. "provided," "however," "that").

Educational psychologists (EPs) have a legal and ethical obligation to gain informed consent prior to any psychological involvement. As EPs work across the 0 to 25 age range, the person giving consent may vary according to the needs of the individual service user and so it is necessary to be aware of relevant legislation and case law. This study explored what might be considered best practice for EPs in gaining consent across the 0 to 25 age range by conducting semi-structured interviews with six professionals as part of an expert reference group. The interviews were thematically analysed using a hybrid inductive-deductive approach. Six main themes were identified: ethical obligations; children's rights; legal obligations; partnership; informed consent; and, barriers to best practice. There was considerable overlap between some of the main themes, reflecting the complexity of the issue. The findings are discussed in relation to literature in other areas of psychological practice. Implications for practice for individual EPs and EP services are considered, such as the possibility of developing a guidance document for use across the profession, as well as directions for further research.

This study introduces a new measure of ex ante litigation risk using scrutiny of SEC filings by the source of securities litigation (plaintiffs' lawyers) to reduce measurement error, relative to existing measures. We show that plaintiff-lawyer views proxy for the largely unobservable factors that make firms more likely to face litigation risk. Lagged views precede the public bad news revelation that triggers litigation and predicts future realized litigation risk (i.e., securities class actions filings and plaintiff-lawyer investigations) and stock market outcomes. Legal confidentiality, an integral aspect of European legal culture and legal services, plays a pivotal role in safeguarding the trust and privacy of professional-client relationships. This study focuses on the multifaceted dimensions of legal secrecy, particularly within the context of commercial lawyers in the European legal services market, using Polish legal advisers as an exemplar. The research explores evolving attitudes, expectations, and perceptions of legal secrecy amidst dynamic legal changes and discrepancies in interpretations among lawyers, public authorities, and citizens.A comprehensive mixed-method approach was used, including surveys, structured in-depth interviews, content analysis, and desk research, to investigate the diverse facets of legal secrecy. Findings reveal that while legal secrecy remains highly esteemed, its interpretation varies significantly across national and EU laws and among stakeholders. There are a multitude of types of legal secrecy, creating confusion and opportunities for public authorities to breach confidentiality.The study underscores the critical need for standardisation and unification of legal secrecy across European countries to enhance cross-border legal services, streamline justice systems, and bolster citizen protection. An emerging practice amongst lawyers in England and Wales is the use of clinical supervision, as used by counsellors and psychotherapists. This is a very different type of supervision to that traditionally used by lawyers. It is reflective and relational in nature. It aims to support safe, competent and ethical practice, and to contribute to sustainability, support and resilience including in relation to vicarious trauma and burnout. This study uses interviews with lawyers who are using clinical supervision to understanding why it is being sought, how it might be working and what its impacts are. The interviews provide an opportunity to examine interpersonal dynamics of lawyering. The study explores how supervision allows lawyers to develop their understanding of themselves in relation to others, their boundaries and legal professional skills, and how supervision can contribute to the best interests of the client, and to a lawyer’s career sustainability and wellbeing. This Article develops a new way of understanding the law in order to address contemporary debates about judicial practice and reform. The jurisprudential theory is "personal positivism," which holds that each judge's publicly known rules of decision are the law for that jurist and, therefore, part of the overall law of the legal system. This theory offers a richer and more useful account of law in the United States today, including its dependence on the views of individual judges. Personal positivism also recognizes that the law is increasingly constituted by the views of competing groups of judges--one liberal, one conservative, and each with its own set of personal rules. At the same time, personal positivism maintains that there is an abundance of genuine law--not just politics--even in contested cases. The problem facing the U.S. legal system, then, isn't that law is being replaced with politics, but rather that the law is too fragmentary. This paper presents two leadership training programs focused on redesigning schools to promote student character development and advocates for their suitability to promote character education in diverse cultural contexts. This is especially relevant for researchers, practitioners, and policy makers who are searching for replicable interventions to promote character development in schools, particularly in those countries where the character education movement has not arrived yet. It begins with the theoretical framework that lays the groundwork for these kinds of leadership programs. Second, it describes the PRIMED Institute in Character Education (PICE) and the virtual/video-based Leadership Academy in Character Education (vLACE) programs. This article examines continuing misunderstanding about memory function especially for trauma, across three UK samples (N = 717). Delayed allegations of child sexual and physical abuse are prevalent in Western legal systems and often rely upon uncorroborated memory testimony to prove guilt. U.K. legal professionals and jurors typically assess the reliability of such memory recall via common sense, yet decades of scientific research show common sense beliefs often conflict with science. Recent international surveys show controversial notions of repression and accurate memory recovery remain strongly endorsed. In historical cases, these notions may lead to wrongful convictions. The current study surveyed the U.K. public, lawyers, and mental health professionals' beliefs about repression, dissociative amnesia and false memories. Study findings give unique data on judges' and barristers' beliefs. Overall, the study findings reinforce international scientists' concerns of a science – knowledge-gap. Repression was strongly endorsed by lay, legal and clinical participants (> 78%) as was dissociative amnesia (> 87%). Moreover, suboptimal professional legal education and juror guidance may increase misunderstanding. The aim of this study was to investigate how legal professionals in Australia responded to the mental distress experienced by clients with insecure visa status in the Fast Track Assessment (FTA) process. This article reports on survey findings obtained from 38 legal professionals followed up by focus groups and interviews with 16 participants. The participants were all involved in providing legal assistance to refugees and asylum seekers with insecure visa status, the majority delivering that assistance via pro bono or community law centre settings. An inductive thematic analysis was used to analyse the data. The study uncovered a complex interplay of practical challenges, emotions, and ethical dilemmas that legal professionals encounter while assisting asylum seekers in the FTA process. The study participants' experiences highlight that a migration law practice frequently becomes the initial setting where asylum seekers disclose mental distress. Legal professionals found themselves simultaneously witnessing human suffering and endeavouring to prevent re‐traumatisation of their clients. Responding to distress was difficult to achieve as the operational setting in which they provided legal assistance and the prevailing hardline political messaging by the Australian government toward asylum seekers who arrived by boat was hostile and (re)traumatising. There is a pressing need for more trauma‐informed education and training for both current and future legal professionals. Increased usage of generative artificial intelligence (AI) within the legal profession has prompted responses from the judiciary, resulting in the issuance of various practice directives. The spectrum of these directives ranges from conservative recommendations to more radical measures demanding lawyers to disclose their use of generative AI in the preparation of legal documents or certify the absence of such software in their creation. This article explores the development of a comprehensive framework for judicial guidance on generative AI use in legal proceedings in Canada, highlighting key elements of such guidance. The author contemplates a ‘training’ approach to regulating generative AI use in legal proceedings, focusing more on the user than the technology itself. To promote open and safe access to court hearings for families and professionals during the COVID-19 pandemic, juvenile and family courts across the United States shifted towards virtual hearings in child welfare cases. Drawing on findings from a four state court observation study conducted pre and post emergence of the pandemic, as well as from a national survey of court professionals and a survey of parents, we reflect on the experiences of courts and court participants with virtual hearings in child welfare cases and specific impacts on hearing quality. Findings indicate that despite stakeholder perceptions, there is little difference in the quality of hearings with respect to judicial engagement and discussion. Differences were found however, in the attendance of fathers and relatives at hearings, with less fathers and relatives attending virtual hearings. Parents had mixed experiences with the virtual hearing process. On the question whether the Anglican Communion/The Episcopal Church has a theology of abortion, an important factor overlooked. It is the relationship between theology and law as understood in the Episcopal Church/Anglicanism. On reproductive choice, theologians, pastors, politicians, and activists rarely display an interest in the law, except on how to use it as a tool for a specific goals. I contend that the discourse on abortion (within the Church, and the body politic) would benefit from a more comprehensive understanding of the law. This practicing theology essay will introduce readers to the meaning and purpose of the law in a pluralistic and multiracial society. This article addresses the question of what strategic litigation means for workers and trade unions. Drawing on the existing literature and on a series of semi-structured interviews with union officials, lawyers with experience in representing them and other actors from across the labour movement, it explores how U.K. trade unions and actors within them understand and experience strategic litigation and legal mobilisation, what they seek to achieve, and what has been effective and ineffective for them. Uncovering both differences and commonalities between different unions, it suggests that the decision to devote union resources to – usually very costly – litigation is never taken lightly. The study of law as a social process should combine an analysis of structures from a political economy perspective with a sociological focus on the practices of lawyering in mediating social relations and conflicts through the formulation and interpretation of legal texts. This approach is applied here to software, which has become the oxygen of the world economy, powering the digitalisation that has transformed economic activities and social life. The forms this has taken have been moulded by lawyers, battling over intellectual property rights in computer programs, enshrining them in national law and international standards, as well as devising the international tax avoidance strategies that have helped propel the giant digital-tech transnational corporations to global dominance. These contests have taken place through processes of formulation and interpretation of the legal concepts that both reflect and shape social struggles over economic and political power, mediated by law, in contemporary corporate capitalism. Medical-legal partnership (MLP) integrates the unique expertise of lawyers into collaborative clinical environments. MLP teams meet the needs of individual patients while also detecting structural problems at the root of health inequities and advancing solutions at the institutional, community, and system levels. Medical-legal partnerships (MLPs) are well suited to address health-harming legal needs associated with the collateral consequences of mass incarceration in the United States, such as those that limit access to food, housing, employment, and family reunification postrelease. The objective of this study was focused on demonstrating the usefulness of using neutrosophic logic to determine and compare different personality traits in a sample of lawyers from the city of Santo Domingo. For this, a sample of 10 lawyers was taken, 5 of them specialized in the field of criminal defense, and 5 specialized in family defense. Neutrosophic correlation was used to select the most important personality traits to be analysed during the study. The results obtained allowed us to focus the analysis on 3 pairs of traits-anti-traits on which the sample was analysed. The study made it possible to determine that the sampled criminal lawyers turned out to be more extroverted and less sensitive than the family lawyers. The latter presented a lower average level of insensitivity than the criminal lawyers, and less rigidity. This paper explores how "Rivera's chair" and the "working room" became the melancholic and strangely literary objects that today make up the José Eustasio Rivera’s archive at the Universidad de Caldas in Manizales, Colombia. It examines the connection between some objects and four final moments in the writer's life: his relocation to the office-apartment of Editorial Andes; two speeches delivered in New York days before his death (one in the homage organized by Federico de Onís and another for aviator Méndez), and the repatriation of his body to Bogotá. The role of José A. Velasco, Rivera's friend, and John McDermott, his lawyer in New York, are highlighted. While researchers find that attorneys in CSA trials dedicate substantial time to questioning children about the plausibility of their reports, we know of no study to date that has assessed the types of plausibility issues attorneys raise, the relative frequency of different types, or if attorneys vary their plausibility questioning depending on case characteristics. In the current study we explored these questions. Guided by the story model of jury decision-making, we proposed defense attorneys would raise plausibility issues by (1) highlighting jurors' misconceptions about CSA dynamics; (2) highlighting confusing or implausible statements made by the child; and (3) offering alternative explanations for events. We conducted a content analysis of the cross-examinations of 134 children aged 5–17 testifying about alleged CSA. We found that attorneys raised all three proposed types of plausibility questioning, and they varied their plausibility questioning somewhat by age, severity, child-defendant relationship, and the number of victims in the case. Attorneys' preferred strategy was to highlight jurors' misconceptions about CSA. Prosecutors should address jurors' misconceptions preemptively in direct examinations of children or through expert testimony. Beyond implications for courtroom practices, our plausibility framework may apply to plausibility concerns raised in other crime types, something researchers should explore. [ABSTRACT FROM AUTHOR]

The Civil Rights Attorney's Fees Awards Act of 1976 allows courts to award attorneys' fees to the "prevailing party" in any "action or proceeding" enforcing several civil rights-related statutes. Yet, this statute fails to define the term "prevailing party," leaving the courts to define it over time. The Supreme Court's piecemeal, vague definitions of "prevailing party" have only complicated the legal landscape and caused more uncertainty for potential plaintiffs and their prospective attorneys. Without the relief offered by recovery of attorneys' fees, private litigants may be dissuaded from pursuing meritorious litigation due to overwhelming costs of representation, and attorneys may face a choice between accepting or denying an otherwise successful case solely due to a prospective client's ability to pay. In Sole v. Wyner, the Supreme Court held that a plaintiff who is awarded a preliminary injunction is not considered a prevailing party if "the merits of the case are ultimately decided against her." In deciding Sole, the Court declined to answer a separate but important question: Is a plaintiff a prevailing party if their case is mooted after obtaining a preliminary injunction? Courts attempting to answer this question struggle to find tangible guidance from the Supreme Court following its decision in Buckhannon Board & Care Home, Inc. v. West Virginia Department of Health & Human Resources, resulting in inconsistencies, overly complicated analyses, and in some cases, misguided rejection of prevailing party status. The legal analysis behind prevailing party status must be streamlined to preserve this critical and necessary litigation. This Note explores how, in the aftermath of Winter v. Lawyers, scholars, and activists have long sought to incorporate ecocide into the Rome Statute of the International Criminal Court to address corporate and governmental impunity for massive and severe ecological damage, including the hanms caused by climate change. This Article uses the framework of racial capitalism to examine and critique the proposed criminalization of ecocide. Coined by South African scholars and activists and refined by political theorist Cedric Robinson, the theory of racial capitalism offers valuable insights on the root causes of the elimate crisis and the manifold injustices it inflicts on marginalized states and peoples. While most discussions of climate justice focus on the disproportionate impacts of climate change on those who contributed least to the problem, this Article examines the processes through which racial capitalism plunders the land, labor, and natural wealth of states and peoples racialized as inferior to generate profits for global elites. These processes immiserate most of the world's population, subject marginalized communities to the "slow violence" of polluting industry, destabilize the planet's ecosystems, generate prodigious quantities of greenhouse gases, and deprive subaltern populations of the resources needed to adapt to climate change and other socio-ecological crises. In other words, the fossil fuelbased capitalist world economy that caused the climate crisis was sparked and sustained by slavery, colonialism, and neocolonialism (including its latest incarnation, neoliberalism). The Article highlights two core features of racial capitalism: its racial stratification of humans for the purpose of profit making and its eco-destructive logic. It explains international law's complicity with these core features through legal doctrines that construct nature as property and justify the subordination of non-European peoples by portraying them as the backward and barbaric "other" who must be civilized through continuous economic, political, and military interventions. Applying these insights to the proposal to codify ecocide, the Article concludes that the proposed definition ofecocide may reinforce rather than subvert racial capitalism's core features by ( 1) focusing on individual culpability and spectacular acts of ecological destruction while obscuring racial capitalism's inherently predatory, eco-destructive logic; (2) perpetuating international law's civilizing mission through the selective prosecution of the racialized "other'; and (3) devaluing nature, subaltern communities, and world views antithetical to racial capitalism through the incorporation of cost-benefit analysis into the definition of ecocide. Recognizing the interconnectedness of slavery, colonialism, neocolonialism, and climate change, the Article calls for reparative and restorative forms ofjustice instead ofpunitive approaches that scapegoat individuals for the structural ills of racial capitalism. The COVID−19 pandemic has impacted child welfare practice and outcomes. This study examines the perspectives of families and professionals on child welfare practice during the COVID−19 pandemic. Qualitative data from feedback surveys and focus groups were used to provide a comprehensive examination of the concepts being explored. Results of this study suggested positive outcomes of virtual meetings and trainings and raised attention to delays in achieving permanency during the pandemic. This study will provide important implications for navigating social work best practices and strategies for addressing children and families' needs to improve child welfare outcomes. Most countries that provide for compulsory treatment for mental illness have a system by which this treatment is subject to independent legal oversight. Many countries use a special type of legal body for this purpose, called a mental health tribunal. Mental health tribunals have been subject to criticism from the points of view of both legal professionals and mental healthcare practitioners. Similar themes have manifested in these criticisms and have been consistent across several decades; legal professionals tend to focus on the tribunals being biased toward the medical opinion, and acting as a 'rubber stamp', whereas healthcare practitioners tend to focus on the adversarial nature of the trial, and the adverse effect that this can have on clients. However, empirical studies of the tribunals have not separated and directly compared these perspectives. This study aimed to explore this dynamic between lawyers' views and healthcare practitioners' views of mental health tribunals. We used thematic analysis to re-analyse data from two previous research studies, one which looked at lawyers' views of the tribunals, and one which looked at healthcare practitioners' views. Our results are divided into three themes: views of the problems with tribunals, professional roles in relationship to the tribunals and professional values demonstrated through these views and roles. We then consider if the 'clash of values' represented by these findings, and found in the literature, may pose an impediment to tribunal reform. The article explores the requirements of the NextGen Bar and its correlation to several American Bar Association (ABA) for American Law School's Legal Education Programs. Cited are the areas and structure of the NG-Bar in relationship to ABA Standard 302, the nexus between the NG-Bar and ABA Standards 304 and 314, and recommendations to ABA accredited law schools in preparing future lawyers for the complex practice of law.
