Evictionism is a compromise position between the pro-life and pro-choice positions on abortion. The former prohibits killing or removing the fetus from the womb apart from the mother's health considerations at any time during the pregnancy; the latter allows for both. Evictionism splits this particular "baby in half" by legally permitting the ejection of the pre-born baby at the mother's discretion, but not killing this very young person. Given present medical technology, the fetus is viable in the third trimester, very rarely before that. Thus, evictionism resembles to the pro-life result at this stage of development of the fetus, in that the mother has the reject to eject or evict the fetus from her body, and the latter is viable outside of the womb. However, in the first two trimesters, the results of evictionism and the pro-choice position overlap: when evicted, the fetus will not survive. However, as medical technology improves, and the pre-born baby is viable outside of the womb earlier and earlier, evictionism will more and more come to resemble the pro-life position. However, evictionism will always, at any level of technology, remain separate from these two other more extremist positions. Evictionism is thus the moderate position between these two extreme perspectives. Block in a series of publications supports evictionism; Wisniewski rejects this theory. Context and background Umoja, is the Swahili philosophy of unity. Its principles underscore the significance of cooperation and communal solidarity. Umoja has historically been associated with various aspects of African social and political life, accentuating the influence of communal synergy in traditional land tenure systems. The Umoja philosophy encourages individuals to consider collective-wellbeing as being complementary to individual interests, thereby fostering a profound sense of social responsibility in traditional approaches to land holding. In contemporary African society, Umoja continues to wield substantial influence in facilitating social cohesion and the establishment of robust and supportive communities. Notwithstanding, the principles of Umoja remain relatively uncharted in the context of modern approaches to land reform policies. Goal and Objectives: The primary objective of this paper entails an in-depth examination of prevailing land tenure systems throughout the African continent, with a concurrent aspiration to formulate a novel land-holding system that harmoniously integrates with and encapsulates the diverse cultural and contextual intricacies inherent in Africa. At its core, this endeavor seeks to leverage the proposed land-holding framework as a catalyst, with the ultimate ambition of elevating substantial segments of the African populace from multidimensional poverty to a state of enduring prosperity. Methodology: The methodological approach employs a secondary analysis, focusing on African communal land and resource management case studies. The paper assesses their achievements and shortcomings, emphasizing the 'Gestion de Terroir' model in West Africa and the less successful Community Land Trust Experiment in Voi, Kenya. Drawing from successful and unsuccessful cases, the paper develops a comprehensive blueprint for effective communal land tenure systems, guided by Elinor Ostrom's principles for successful management of communal resources and the principle of Umoja, for equitable and sustainable land management in Africa. Results The findings from this study highlight critical issues within existing communal land systems across Africa. Specifically, the primary challenges identified are the absence of formalized communal land titles, as well as issues stemming from the inability of attempted communal land holding projects to align with local idiosyncrasies, capacities, and objectives. Public–Private Partnerships have been implemented globally as a key procurement strategy for addressing the issue of funding gaps amidst the immense pressure to deliver new major infrastructure projects. However, in current practice, procurement selection is applied to the entire bundle of project activities. This often leads to unduly large bundles of externalized project activities that create unduly large PPP contracts and attempt to transfer too much risk. To address this gap, this paper presents the development and testing of an implementable model that embodies a range of microeconomic theories—namely, transaction cost and resource-based theories—and property rights theory. This paper presents the first empirical testing of this model based on two road and two health projects, using competition as an independent measure of the validity of the recommended procurement strategy. The results provide compelling evidence that a rigorous application of the model will enable a substantial improvement of existing procurement approaches, such as identifying the most suitable bundle to be procured using a PPP approach. The paper evaluates the adaptation of neoliberal policies in the Indian urban housing policy sector. While completing the objectives of this paper, the article also appraises the expression of neoliberalism as it unfolds in the literature. Neoliberalism is considered a loose set of philosophical, institutional, and political principles to safeguard individual and collective freedom like private property rights, goods and services exchange, movement of capital and labor, etc. Neoliberal policies promote open markets and trade to unbound creative potentials and entrepreneurial skills through efficient utilization of resources and upbringing of human well-being. In a neoliberal regime, cities compete to attract talented people, capital, and resources to achieve newer economic and social benchmarks. However, the constant pursuit of excessive achievements lets some negativities grow within. Large-scale inequality, deprivation, social unrest, and meager quality of life affect the sustainable and holistic development of seemingly most developed cities worldwide. It has been argued that technologies such as blockchain could provide financial systems and societies with a better infrastructural solution to process information and identify illegal transactions. Building on this idea, this paper argues that if payment systems are to take advantage of the properties that define distributed ledger technologies, they must build on those models that have delivered improved trust in our economies. Accordingly, the model presented in this paper is based on a universal digital ID that could be interoperable among different jurisdictions. Such a digital ID would rely on an explainable framework structured around an understanding of the role played by central banks, intellectual property rights and personal data protection in the processing of information. Understanding the interaction between these elements may be the first step towards a better understanding of the infrastructures employed to tackle illegal activities, which could in turn contribute to the successful development of the standards on which the next generation of suspicious transaction or order reports will be based. The simplicity of the so-called triangle method allows estimates of evapotranspiration and soil water content to be made without ancillary data external to the image and with just a few simple algebraic calculations. Drawing on many examples in the literature showing that the pixel distribution in temperature/fractional vegetation cover (NDVI) space closely resembles a right triangle, this paper shows that adoption of a right triangle shape further simplifies the triangle model. Moreover, it allows one to mostly avoid the problem of sparse or low-resolution data. A time dimension can be included showing that trajectories inside the triangle can provide additional information on root zone soil water content. After discussing some of the ambiguities in the triangle method, and the advantageous properties of the right triangle, a proposal is made to illuminate the relationship between thermal/optical measurements and root zone water content within the right triangle framework. Heritage-making's intrinsic dissonance has been thoroughly established in the field of critical heritage studies, and yet it is a reality that continues to be obscured in heritage practice in settler colonial cities. Authorised heritage discourse continues to project existing state-led systems of heritage-making as a self-evident 'public good' for current and future generations. In settler colonial cities, this increasingly includes attempts to incorporate Indigenous views and values into its framing. However, existing statutory processes that uphold normative approaches prove resilient to change. Continued prioritisation of tangible artefact amid private property rights impairs the heritage field's ability to acknowledge alternative possibilities and to genuinely engage in decolonising transformation. This paper examines three cases where heritage dissonance has erupted into protest and protection action outside of the authorised heritage discourse: the Old Swan Brewery in Perth, Western Australia; Ihumātao in Auckland, New Zealand; and the West Berkeley Shellmound in Berkeley, California. It analyses the contestation of values that led to protest action, what 'authorised' attempts were made to heritagise each case and to what result. This study illustrates the linkages between the ISO's Land Administration Domain Model (LADM) and the UN's sustainable development goals (SDGs), highlighting the role of the LADM in promoting effective land administration suitable for efficient computation of land/water (space)-related SDG indicators. The main contribution of this study is the formalization of SDG indicators by using the ISO standard LADM. This paper proposes several SDG-indicator-related extensions to the multi-part LADM standard that is currently under revision. These extensions encompass the introduction of new procedures for calculating indicators, the integration of blueprints for external classes to fulfil additional information needs and the design of interface classes for presenting indicator values across specific countries and reporting years. In an innovative approach, this paper introduces the Four-Step Method—a powerful framework designed to formalize SDG indicators within the LADM framework. Detailed attention is devoted to specific indicators, including 1.4.2 (secure land rights), 5.a.1 (women's agricultural land rights), 14.5.1 (protected marine areas) and 11.5.2 (valuation as a basis for direct economic loss). In short, the Four-Step Method is pivotal in eliminating ambiguities, enhancing the efficiency of indicator computation and securing more accurate indicator values that more truly reflect the progress towards SDG realization. As an important measure to achieve high‐quality economic development in China, the implementation of low‐carbon city pilot policy (LCCP) will inevitably have an impact on enterprises' environmental protection behavior, but the empirical evidence in this field is limited. Therefore, based on the data of Chinese A‐share listed industrial enterprises in Shanghai and Shenzhen from 2008 to 2020, this paper empirically tests the impact of LCCP on corporate environmental performance (EP) and its mechanism of action by using the multiperiod difference‐in‐difference (DID) method. The results show that (1) the implementation of LCCP has significantly improved EP, and after a series of necessary tests such as parallel trend and placebo, the conclusion remains robust. (2) LCCP promotes enterprises to improve their EP mainly through the pressure of environmental supervision, financing constraints, and market competition. (3) The policy effect of LCCP varies with the nature of enterprise property rights, pollution attributes, and technical level. State‐owned enterprises, heavily polluting enterprises, and high‐tech enterprises respond more positively to LCCP, and the effect of EP improvement affected by the policy is more obvious. Further analysis shows that facing the pressure of environmental policy, state‐owned enterprises mainly deal with it through two methods: increasing environmental protection investment and strengthening green innovation; heavy‐polluting enterprises tend to increase investment in environmental protection; high‐tech enterprises mainly benefit from the improvement of the green innovation level. The accelerated development of society and the rapid advancement of urbanization are among the reasons for the current shortage of land resources. In China, the pressure of land resource shortage, the increasing height and complexity of buildings in cities, and the inadequate spatial expression ability of two‐dimensional (2D) real estate data pose challenges to government departments that use 2D real estate data as basic management elements. Currently, an effective solution is to establish a three‐dimensional (3D) building property rights model. However, this approach has low modeling efficiency, and the model cannot be divided into floor and house, cannot be linked to property rights information, and has a large size and high input cost. To address these problems, this paper presents an automatic method of constructing a 3D building property model based on visual programming language (VPL). The compatibility of this method with several different building types is tested, and the differences in cost, efficiency, and model size between this method and other modeling methods are compared and analyzed. Results show that the average modeling time has been reduced to less than 2 min, representing an efficiency improvement of over 80%. Furthermore, the model size has been reduced by more than 90%. This method cannot only stereoscopize 2D real estate data but also obtain the building property rights model with floor and house and property rights information while ensuring the small model size and low cost. This essay uses a dialogue as a way of articulating complicated ideas on Li's (2014) paper to relate the notion of materiality of land-to-land grabbing and other dimensions of "materiality" invested by various lines of research on land. The work of Li is used as it mentions the idea of "inscription" and the use "title deed" that are "material" in a physical sense that conveniently articulates with the argument that the cadastral boundary is the "form" of land as real property rather than an open access resource, a situation which does not exist in most real-world situations. The treatment of a land boundary in terms of property rights in neo-institutional economics is discussed. The significance of land boundary re-delineation in global development, as a subject for those who employ the concept of "materiality", is highlighted by itemizing specialisms in the professional division of labour in the land market. Albanian customary law represents an unwritten set of rules, which were established ad hoc by courts of elders or assemblies and aimed to regulate social relations in various fields of life. The implementation of these norms, was provided by the force of tradition, social consciousness and the patriarchal authority of the people’s self-government bodies. It is created by people over the centuries, not from a particular person, or a special legislative body. It was a reflecion of the material conditions of life in human consciousness and therefore has a double character. The purpose of the research paper is to analyze that on one hand it preserves the characteristic rates of the old tribal order (common ownership), while on the other hand it regulates the category of private ownership with all its features (eg. property rights do not expire). The methodology I used for the research paper is the analytical method. The result of the research paper is that rates of Albanian customary law are summarized in canons, such as: the Canon of Leke Dukagjini (The Canon of the highlands), the Canon of Laberia, the Canon of Skanderbeg (Canon of Arberia), the Canon of Luma. These canons acted in different times and space: so the Canon of Laberia acted during 11th century in southwestern Albania, the Canon of Leke Dukagjini and the Canon of Skanderbeg acted during 15th century in the northern highlands, as well as central Albania, nonetheless they have many similarities. Women, according to these ancient rules, are considered to be of a lower social status: they do not share either the rights and privileges or the responsibilities of men. In conclusion, as severe and discriminating to women as it may seem, customary law has to be seen in a historical context. The preservation of customary law was one of the most important elements in helping the Albanian people to maintain their individuality over the centuries and under different invasions. Although customary law is inversely proportional to the rise and development of the modern state, it shows distinguished lawmaking capacities and laid the foundations of today’s positive law. To alleviate the contradiction between supply and demand of urban and rural construction land and improve the utilization efficiency of rural homesteads, the state has issued policies to guide villagers withdrawing their homestead with subsidies or compensation. Previous studies have found that differentiation is one critical factor in villagers' withdrawal from homesteads, but how differentiation affects the villagers' withdrawal is not well interpreted. To explore and examine the homestead withdrawal mechanism, this paper identified and condensed the influence factors of villagers' willingness to withdraw from homesteads from the perspective of differentiation, taking Kuikeng Village in Puning City, China, as an example. The results indicated that: (1) villagers' differentiation has a significant impact on their willingness to withdraw from homesteads, and the higher the income differentiation level, the lower the willingness to withdraw from homesteads; (2) the health status of villagers, whether they are willing to change their identity, the confirmation of homestead rights, the holding period of homestead property rights, and the understanding of homestead exit policy are positively correlated with their willingness to withdraw from homesteads; and (3) villagers' psychosocial characteristics, villagers' differentiation, and government policy characteristics have a significant impact on homestead withdrawal. From 1887 to 1934, the federal government broke up millions of acres of tribally owned reservation lands and allotted them to individual Native American households. The Bureau of Indian Affairs' local "Indian agents" oversaw this highly contingent conveyance of property rights. They initially managed the allotted land held in trust, and then later decided when and if to re-title it to fee simple. Building on and going beyond the literature showing that bureaucratic incentives matter greatly for policy implementation, our paper studies empirically to what extent individual agents' idiosyncratic preferences and discretion shaped this process. We find that individual agents were statistically important drivers of policy implementation, introducing an element of historical randomness into the legacy of allotment, which continues to shape the distribution of land titles on reservations to the present day. Background: In the realm of property matters, or more precisely, the infringement of property rights and the pursuit of adequate justice, Kosovo stands out as one of the most unique cases. Its uniqueness stems not from a singular circumstance, law, or period but from a complex interplay of events, laws, and historical periods. The primary objectives of this paper revolve around property disputes stemming from ethnic conflicts, discriminatory laws, and wartime circumstances. The paper is grounded in two fundamental hypotheses. Firstly, it seeks to examine the property disputes that have arisen because of these conflicts, discriminatory laws, and war, particularly targeting certain segments of the population. Secondly, it aims to explore strategies for avoiding such consequences in the future and recovering material damages incurred. The context under observation is also important because of the significant involvement and influence of the international administration. In this sense, the case of Kosovo can serve as a typical example, theoretically and practically, for other societies and countries facing similar challenges. Lessons from the positive aspects of Kosovo's case should be considered while avoiding repeating numerous mistakes to prevent these countries from experiencing the consequences of such oversights. Methods: The foundational sources used to develop this paper encompass scholarly works such as textbooks and scientific papers, legislative acts including international conventions, and judicial practice. Given the paper’s unique nature and the problem it addresses, it further draws upon a range of research and reports from reputable international organisations that have systematically monitored the situation as impartial observers. The paper adheres to a specific methodology, with the historical method being indispensable in matters related to property. Through this method, the evolution of ownership, ideas, community consciousness, political and social movements that influenced the law, and international missions approaches that contributed to shaping distinctive legislation in Kosovo known as 'UNMIK Regulation’ are unveiled. This study predominantly employed the analysis method, synthesis method, and comparative method. The analysis method scrutinises relevant legal provisions and case law, while the synthesis method has been utilised within the framework of comparative methods. To a certain extent, the descriptive method was also employed to furnish readers with a clear overview of the events and relevant implementation mechanisms related to property rights. Results and Conclusions: The paper delineates three major types of property disputes arising from the unique circumstances characterising Kosovo: property claims deriving from ‘repressive measures’ (1990-1998), property claims deriving after the war (27 February 1998 - 20 June 1999); and property claims caused by the system of social property (after 1945)– subsequently deriving from its privatisation after 1999. For each of these violations of property rights, their causes, circumstances, and underlying purposes are examined and argued. The paper also discusses approaches for addressing these disputes. While it is concluded that addressing property claims deriving after the war (27 February 1998 - 20 June 1999) has been satisfactory, the same cannot be said for the other two categories of property disputes. In these instances, modern law remains largely silent. Therefore, although this paper is titled ‘justice’ in property matters it primarily grapples with the prevailing of ‘injustices’ in property matters. The integration of the advanced manufacturing industry and the modern service industry is an important direction for the transformation and upgrading of China's manufacturing industry. However, the existing research focuses more on the level, motivation, and economic effects of the integration of manufacturing and producer services, and less on its environmental effects. In this paper, based on the panel data from 30 provincial regions in China from 2005 to 2019, an evaluation system for the integration of manufacturing and producer services (IMP) is constructed, and the carbon emission efficiency (CEE) is calculated through the super-efficiency SBM model. Based on the analysis of the influence mechanism of IMP on CEE, the mediation effect model and the spatial Durbin model are used to test the influence of the IMP on CEE. The results show that the IMP can significantly improve CEE, and indirectly promote CEE through four intermediary factors: value addition, cost reduction, industrial agglomeration and structure upgrading. Finally, we found the level of economic development, property rights structure and regional innovation can promote CEE to varying degrees. The intensity of environmental regulation, opening level and the energy consumption structure inhibit the efficiency of carbon emissions. The total impact of the IMP on CEE is greater in the western region than in the eastern and central regions, and the western region shows a more significant spatial spillover effect. Context and background Sustainable growth and development in Africa will continue to depend mainly on how land and land-related resources are secured, used, and managed, which is extremely important for the socio-economic development of women and men. Equitable land rights support the eradication of poverty, increase food security, and respond to climate change. However, women's land rights are strongly gendered across many regions of the globe, especially in Africa, where access to and control over land and productive resources is affected by customary norms, usually discriminatory against women. Goal and Objectives: This paper focuses on Mozambique's legal reform and institutional capacity-building efforts, with special attention to social institutions, to promote equitable land rights and enhance land tenure security. It is based on specific practices in documenting customary and statutory access, control, and ownership of land, considering both the ongoing legal reform and the systematic land registration program the country has been promoting over the past decade. This paper intends to document these efforts and good practices so that they can be used as a reference and others can benefit from them. Methodology: The research follows a pragmatic value-driven philosophy, focusing on practical solutions and outcomes to improve future practice, taking gender inequality in land access as a starting point. The approach to theory development is abductive, moving from theory to data (deduction) and from data to theory (induction). Multi-methods, qualitative and quantitative, are used to ensure a richer approach. Results: Mozambique's legal framework has been reformed to accommodate several improvements related to gender equality. The family and the succession laws, are a clear break from the past merely patriarchal vision cemented in inequality. The recently approved land policy and the land law provide gender equality and protection of women's land rights. The Constitution and the land law recognize legal pluralism, having statutory and customary norms co-existing in land management and land administration, provided that the Constitution is not violated. Mozambique launched a massive systematic land registration, having designed and implemented its Fit-For-Purpose Land Administration approach, formatted to the country's context, intertwining three pillars: people, processes, and technology. There are still challenges to overcome, mainly due to complexity, contradictions, and overlaps within legal pluralism, as sometimes traditional and cultural norms prevent women from accessing, controlling, or owning land and participating in decision-making. According to the positive law of the Republic of North Macedonia, we observe that there are several types of industrial property rights regulated by the Law on Industrial Property as a lex specialis legal act. According to the legal regulations, industrial property rights include patents, industrial design, trademarks, indications of origin, and geographical indications. Trademarks, their civil protection, and the harmonization of Macedonian legislation on trademark law as part of industrial property rights with European Union law, are the focus of interest in this paper. Trademarks protect a sign that can be graphically represented and is suitable for distinguishing the goods or services of one participant in trade from those of another participant in trade. To become a part of the European Union on the one hand, and to align legal rules with European standards on the other, serious acceptance of proposals and implementation of reforms outlined in the negotiation framework for North Macedonia regarding industrial property rights are necessary. This includes establishing protection and guaranteeing the rights of industrial property following generally accepted rules and principles. Greater engagement of the State Office for Industrial Property is needed in terms of institutional cooperation with EUIPO and WIPO, as well as de facto enforcement of standardized rules, procedures and principles that indicate modern protection of industrial property rights. On the other hand, for the expedient protection of industrial property rights, it is necessary for the judicial authorities to more often apply the decisions made by the European and international judicial authorities through which standardized judicial practice is established at the European and international level. The purpose of this research is to point out the importance of the adequate protection of the guaranteed trademark rights, which is a prerequisite for fully harmonizing the domestic law of industrial property with the law of the European Union, as the main goal of our country during the negotiation process. Digitally enabled firms such as Alphabet, Amazon, and Meta achieved rapid growth in part through business model innovations that challenged the existing norms and regulations of the markets they entered. Research has explored aspects of their norm-breaking behavior—for example, getting users to behave differently, or offering free services to forestall competitors. I focus on their tactics for getting through or around regulatory infrastructure designed to protect consumers and other stakeholders. Specifically, I examine the relationship between large digital firms and three sets of institutional structures—competition policy, employment law, and individual property rights. I identify three tactics firms have used to overcome potential resistance: some have finessed regulations by identifying gaps and inconsistencies they could take advantage of, some have sidestepped regulations by arguing that those regulations do not apply to their situation, and others have nullified those rules by denying their existence altogether. I discuss regulatory responses to these tactics, from providing a free pass on one extreme, to doubling down on existing rules on the other extreme, and negotiating a new set of rules in themiddle. This paper presents a methodology for a low – cost 3D visualization of property rights in multi – storey urban buildings using available and other relevant open geometric and legal data. An online, free platform is created, named "CadaSPACE", to support the homogenous visualization of volumetric property units and open property rights included in 2D cadaster. The platform is directly interconnected with open – access pages such as the National Cadastral Portal, Autodesk Online Viewer, Tandem, Google Earth and Online 3D Viewer. It offers a wide range of statistical tools such as tables and diagrams to present, filter and manage the sematic information of the 3D property volumes. An application is presented for the Greek Cadaster. Legal information about the property rights is collected from the open - access cadastral records; building footprints are digitized on the available Orthophotos; architectural floor plans of each individual property unit are either taken from the documents included in the electronic building identity records (under construction) or are provided by the owners, and an approximate BIM (Building Information Model) is created for each building using additional approximate geometric information derived from Google Earth Pro and Streetview. The 3D property units are modelled and visualized as volumes. The whole 3D neighborhood model is uploaded online for further categorization and management through various visual and semantic filters. As China's urbanization process continues to accelerate and the price of traditional commercial property continues to rise, a number of small property rights houses without construction permits and approvals have appeared on rural land. Although small property rights housing does not have the validity of property rights or the legal attributes of ordinary commercial housing, and the Chinese government has repeatedly introduced corresponding laws and regulations to regulate its purchase and sale, small property right housing is still purchased by many consumers because of its price advantage, and the number of disputes arising from its purchase and sale is on the rise every year. In addition, the phenomenon of developers building on rural land in violation of the law and real estate agents guaranteeing property without authorization has led to a waste of judicial resources and the infringement of property rights. This paper analyzes the actual situation and the main problems surrounding the governance of small property rights housing and constructs a quadrilateral evolutionary game model with the government, consumers, developers, and real estate agents as the main players. By analyzing various equilibrium points corresponding to different stages of small property rights housing governance, a simulation analysis is conducted using Matlab2016a software to examine the strategic choices of each stakeholder. By adjusting and simulating various parameters, this study investigates the key factors influencing the governance of small property rights housing. This study revealed the following points: (1) at different stages in the governance of small property rights housing, the choice of a strategy by each subject is affected by the expected benefits and costs; (2) the relevant government fines will regulate the strategic choices of developers and real estate agents; (3) consumers' purchasing tendency is affected by the price of small property rights housing and the risk estimation; (4) the governance of small property rights housing needs a long-term standardization of practice, and the government not only needs to improve the reward and punishment mechanism but also needs to provide positive guidance to the consumers. Through numerical simulation, we explore the impact of the main parameters of the current small property rights housing governance process on the strategic selections made by the game players, which is of great significance for the current policy and future governance of small property rights housing. This paper contributes additional insights to the existing body of theoretical literature through quantitative analysis. Nonetheless, there is a need for the further refinement of the parameter settings used in the study. This Special Feature explores the negotiated bureaucratic politics shaping urbanization in South Asia. City drafting refers to the flexible and contextual practices, procedures and policies required to haul diverse property regimes into order and provisionally render urban land clear and settled. The drafted city, we argue, is necessarily provisional and uneven, left open to politicised remapping, redrafting and resettlement by a host of institutionally embedded brokers, bureaucrats, clerks and surveyors each wielding their own political and socio-technical vision of land. These drafting practices, not only shape a politics of uneven urbanisation in South Asian cities, but also help to explain the persistent fractal morphology of urban property in South Asia; spanning categories of public, private, non-private, commons, unauthorised, regularised, agrarian, urban and so on. While the South Asian city is commonly understood through the high-resolution imagery of masterplanners, policymakers and investors, city drafting methodologically focuses on the grounded bureaucratic struggles of the map, plot, record and title, through which claims to property rights, exclusions and access are shaped. This paper highlights the role of government in boosting the private space sector and proposes that public-private linkages and state support are critical for the success of private space endeavours, such as the fledgling asteroid mining one. The economics of high costs in tandem with outsized risks, and the long time-horizon for the investment to reap a return, have been big obstacles for companies that want a stake in asteroid resource extraction. Such factors necessitate the state stepping in to share the burden. Government funding, technological help, and the state's underwriting of high-level risks, along with ensuring private property rights, are critical for the viability of the asteroid mining infant industry. This paper shows that without enough government backing, the possibility of success for such an enterprise is compromised, as seen in the dismal outcomes of the asteroid mining companies that emerged in recent times. Legally Libyan women are entitled to inherit land, yet many women are discouraged by family members from claiming their inheritance. This paper explores this discrepancy between norms and practices, by first offering a general legal, historical, and cultural context of women’s rights to land and inheritance in Libya. Then, it details the case of one elderly woman, Um Aliz. Like many Libyan women, she initially felt that she ought not claim her right to inherit land. But in recent years, Um Aliz has changed her mind due to her deteriorating health, children’s encouragements, relatives’ pioneering efforts to claim their rightful inheritance, society’s changing ideas on women’s land rights, and rising land prices. Although Um Aliz’s justice journey is not complete, she has ended her silence and the case has entered the court system. Together with reflections from legal professionals, Um Aliz’s case illustrates the limits of legal reform and the persistence of inheritance practices which are legitimised by reference to tradition. Yet the paper also suggests that amidst great and worrying societal turbulence some Libyan women are emboldened to claim their inheritance. [ABSTRACT FROM AUTHOR]

With the focus of urban regeneration gradually shifting to the community level, community regeneration has become an important path for improving residents' quality of life and the governance of grassroots society. How to innovate the governance model and how to improve the community public space utilization efficiency become vital questions. From the perspective of property rights regime, this paper puts forward the theoretical framework of "property rights regime governance model space utilization," and argues that the property rights regime can be adjusted through the subdivision of property rights, which can change the governance model of public space and affect the space utilization efficiency. Through an in-depth investigation of the community regeneration of Shanghai KIC Garden, this study finds that different property rights regimes affect the process and results of collective action in public space governance, and the monocentric governance model formed by the concentration of governmental power can easily lead to the governance dilemmas such as rent-seeking, ineffective supervision, and information asymmetry. By subdividing and decentralizing property rights, social organizations, and community residents can be introduced to participate in the process of spatial governance, so as to facilitate the sinking of governance centers to the grassroots level and form a polycentric governance model. Moreover, multiple stakeholders can be motivated to make full use of public space through the property rights regime adjustment, and the public space utilization efficiency can be enhanced as a result. Horizontal, multilateral and polycentric forms of governance, albeit important in reality, represent a challenge for the now dominant use of the 'market and hierarchy' continuum of structural alternatives. This paper proposes a broader characterisation of both poles of the continuum of governance forms that would enhance the understanding of both intra- and inter-organisational governance. One side of the continuum would encompass examples of ' societas ', for example, legal entities (among which firms) unifying property rights and deliberately coordinating actions through a wide set of voice-based mechanisms, including non-hierarchical ones. The other side of the continuum would encompass 'polyarchies', that is, forms of decentralised coordination among nodes deciding autonomously, but not necessarily linked by transactions of goods and services coordinated by prices, such as market exchanges. This paper uses several cases from the agri-food sector to show that many 'strange' unclassified forms can be described, explained and assessed as hybrids between polyarchy and societas. The final section of the paper proposes some refinements in the independent variables to be used in the comparative assessment of organisation forms and new propositions that can be derived for future research. Although forest devolution, as a type of decentralization, is a high priority in the policy agendas of developing countries, recentralization has also occurred. In this paper, we focus on emerging recentralization within the devolution process of Collective Forest Tenure Reform (CFTR) in China's southern provinces and conceptualize this process as "recentralized forest devolution." In this paper, we update a key framework for analyzing decentralization and recentralization in governance processes based on the "policy arrangement approach." Case studies were conducted in four counties of the Fujian and Yunnan provinces by tracing governance dynamics from 2001 to 2019. Our study found that the central government has tightened upward accountability and recentralized power for environmental conservation since 2012 under the discourse of "Ecological Civilization." At the local level, recentralized forest devolution was expressed in terms of the restricted timber harvest levels for the purposes of environmental conservation. Therefore, forest devolution could be more vulnerable than expected by researchers and potentially interwoven with recentralization processes. Discourses, actors, property rights, and power are, therefore, considered to be interwoven in the complex dynamics of decentralization and recentralization. [ABSTRACT FROM AUTHOR]

This paper seeks to answer a pivotal question: Can the Al-Aqsa Flood change the regional and international equations of conflict? The paper attempts to foresee paths towards peace post-Al-Aqsa phase, viewing the projection of the Palestinian-Israeli conflict as closely linked to past events and negotiations. The paper deconstructs its contents and statements to reveal their failure and collapse. It argues that the Al-Aqsa Flood brought the Palestinian issue back to the forefront of global attention after it was forgotten. It was an attempt to confront the Zionist project, and a direct response to Israeli policies, and a rejection of the shifting geography of normalization and its extensions in defense of Palestinian rights to land, Jerusalem, and the return of refugees. In light of the rapid urban and cultural renaissance in Dubai and the need to expropriate real estate owned by individuals, this paper discusses the protection of individual property in the Emirate of Dubai Real Estate Expropriation Law of 2022. It has sought to examine and investigate the process of expropriation of individual property under the Emirate of Dubai Expropriation Law No. (2) of 2022 and to show that the Dubai legislature has narrowed the concept of public benefit and defined the conditions and mechanism of expropriation, the body responsible for issuing expropriation decisions, and what procedures should be followed. This study is of great importance as it shows that property rights are protected under the UAE Federal Constitution of 1971 and the Emirate of Dubai Real Estate Expropriation Law of 2022. It contributes to illuminating the way for the expropriation committee to take the necessary measures that help determine the fair compensation that should be paid to the owner of the expropriated property. It has concluded that expropriation is one of the most dangerous interferences with property rights and this interference is restricted to exercise in the public benefit and exchange for fair compensation. Our findings, however, emphasise the need to set controls and standards for the concept of public benefit and introduce a right to appeal the expropriation committee's decision before the court. In China's rural land system, the collective owns the land, and farmers, as members of the collective, can acquire land contractual management rights through land contracting. With the second round of land contracts nearing expiration, the central government has announced that the term should be extended for 30 years. This paper introduces the theory of psychological ownership to explore the implementation paths of the 30-year extension policy. The study finds that (1) farmers generally exhibit strong psychological ownership towards the contracted land. (2) The Household Contract Responsibility System satisfies the three routes for the formation of psychological ownership—control, intimate knowledge, and self-investment. As the duration of farmers' possession of contracted land extends, their psychological ownership gradually forms and strengthens. (3) Farmers' psychological ownership has both positive and negative effects. The 30-year extension policy must adhere to the path dependence formed by the evolution of the land contract system, comply with the institutional constraints imposed by rural land collective ownership, and simultaneously meet the practical demands posed by urban–rural integration and agricultural development. Drawing on the complex effects of farmers' psychological ownership and considering the historical, institutional, and practical contexts of policy implementation, this study proposes the dual necessity of facilitating and restraining farmers' psychological ownership when extending for another 30 years and offers corresponding policy suggestions. Facilitation requires empowering farmers with more stable land possession and stronger land rights. When the relationship ends through divorce or separation, Muslim married women risk losing their share of the matrimonial property and other marital rights after divorce. As a result, Muslim widowed women lose the rights to ownership, control, and access to properties they enjoyed during their marriage life. The application of Muslim personal law (MPL) in the Kadhis' courts in Kenya, similar to other jurisdictions, is highly dependent on social customs that to a great extent hinders women's access to their rights after divorce. Previously, Muslim women appearing before the Kadhis' courts in Kenya would persevere their marital sufferings and submit to patriarchal norms of male priority, authority, and power. Current religious underpinnings of MPL in the Kadhis' courts in Kenya demonstrate a continuing change in Muslim religious courts toward expanding Muslim women's access to justice. Neo-Kadhis are influenced by contemporary Muslim legal opinions and conventional legal trends and constitutional instruments such as the Constitution of Kenya 2010 that provides for gender equality, including equality in ownership of property, and prohibits the state from making laws that arbitrarily deprive a person of property or the enjoyment of the rights/interests over property on any discriminatory grounds. The Neo-kadhis are pioneering the reform process that adopts a progressive approach in responding to emerging legal issues related to women litigants' rights to matrimonial property rights and divorce settlements rights in the form of Mata'a (consolatory gift) as opposed to the prevalent Islamic traditional approach in Muslim religious courts. Influenced by conventional court decisions, recent cases decided by the Neo-Kadhis in Kenya consider wives' day-to-day household activities and monetary contributions in assessing matrimonial property rights after divorce. This paper examines the dynamics of the progressive approach adopted by the Neo-Kadhis in Kenya toward enhancing women's access to justice rights and gender relations in Muslim religious courts in Kenya and beyond. This is a research-based publication. It compiles an up-to-date knowledge on the issues concerning easement law in Poland. The research framework for examining the principles of determining the easement right, as one of several limited property rights occurring in the Polish legal system, allowed the authors to develop the features of easement appurtenant, personal easement, and transmission line easement in a descriptive and graphical form. The authors pay particular attention to the differences in the formal and legal principles applicable to the establishment and enforcement of different types of easements in Poland. Therefore, this paper distinguishes and extensively discusses the two most common easement cases. The first one concerns the right-of-way easement, which according to formal and legal principles is a type of easement appurtenant. The second is an easement of habitation (which is a special type of personal easement). Furthermore, the paper analyses the formal and legal prerequisites for the creation of the easement appurtenant and personal easement. The aim of the research was to draw attention to the complexity of the easement law in Poland and to provide a thematic systematisation of related concepts. Methods based on the principles of descriptive-comparative analysis allowed to achieve the research objective. For a better understanding of the presented subject by the reader, the "introduction" section includes key definitions, formal and legal principles of establishing an easement, conditions of its termination, change in the content of the right, and transfer of rights to another entity. The study is based on the current state of knowledge, supported by extensive research of the subject literature on the presented research topic and the interpretation of the binding legal regulations. Since the mid-2000s, democratization has slowed, stopped, and even reversed across the world. At the same time, societies have become more oriented toward free markets as measured by indexes of economic freedom. Relying on a panel sample of 141 developed and developing countries between 2006 and 2017, this paper is the first to investigate whether the two phenomena are related by employing economic freedom data. It finds that there is no net-negative relationship between aggregate economic freedom and democracy in this time-period. Instead, mixed findings of both an overall positive and overall neutral (but not negative) association are uncovered in between-country and within-country analyses, respectively. In between-country analyses, using the disaggregated index shows that the legal system/property rights component drives most of the positive relationship between aggregate economic freedom and democracy in the developed world. The same between-country analyses in the developing world show that freedom of international trade is positively associated with democracy, while modest regulation has a negative relationship. However, additionally controlling for omitted variable bias using country-fixed effects, the paper does not find evidence for either a positive or negative relationship between subsequent changes in levels of economic freedom and democracy. Even though there is an increasing trend towards the ‘feminisation of agriculture’, especially among the small and resource-poor farm households due to the increasing long-term migration of men, women’s work on the family farm is invisibilised to a very large extent in most parts of the country. One of the reasons for the absence of gender issues in the literature on agriculture is that women are not even regarded as farmers due to the absence of property rights for them. This paper is based on fieldwork conducted in villages of Punjab, Rajasthan and Telangana. It brings to light lesser-known facts about women’s ownership of land and their changing status in rural India. Based on data collected through primary research from 100 households in each of the three states, this paper concentrates on the less researched aspects of women in agriculture in India. The study focuses on women’s role as farmers, their control over land, their participation in agricultural activities on family farms, and decision-making, including decisions relating to the family. The analysis of data shows that there are regional differences in these aspects, which are mainly due to the differences in cultural factors relating to women’s status in society. The concept of legalizing properties and constructions without permission is currently under debate in Kosovo's field of property rights. Efforts to establish an appropriate legal framework have led to the enactment of laws and by-laws aimed at addressing illegal construction. Constructions on "social" properties without permission, informal acquisition, failure of ownership transfer, and unresolved matters related to properties confiscated under the 1933 agrarian reform have not yet been dealt with, except for their inclusion on the waiting list, which denies legal certainty. The study finds that the main cause of the issues evident in the property legalization process and the exercise of development rights on these properties is Yugoslavia's agrarian reform of 1933. The research concludes that legalizing properties requires a normative approach and utilizing similar experiences from other Western Balkan contexts. Therefore, the objective of this paper is to analyze, using analytical, legaldogmatic, chronological, and qualitative methods, the policies for property legalization and thus recognizing citizen property rights. The research is of great importance for decision-making institutions because it can be used as an impetus for finding the right approach, aside from the normative one, to address the issue of property legalization. The relationship between external debt and economic growth has been extensively studied by researchers and policymakers. However, the link between external debt and domestic investment remains an underexplored area of research. Therefore, this paper investigates the nexus between external debt and domestic investment, using institutional quality as a moderator. The sample consists of 47 sub-Saharan African countries with data spanning from 1996 to 2021. The empirical findings from conventional and robust estimators indicate that external debt negatively and significantly hampers domestic investment, while institutional quality plays a significant moderating role in this relationship. Additionally, the benefits of debt can only be realized by the SSA region when the average quality of institutions is above − 1.174 on the scale of − 2.5 to 2.5. The in-depth analysis offers insights that high-quality institutions (above a certain threshold) can help countries leverage debt for positive outcomes by promoting efficient resource allocation and attracting further investment. Thus, policymakers are advised to uphold debt management strategies and institutional reforms, such as reducing corruption, improving property rights, and strengthening the rule of law, to ensure transparency in debt use and maintain a sustainable debt burden. This paper makes a case for viewing vacancy as "precarious property" (Blomley 2020; Antipode 52[1]:36–57), i.e. less a material object defined by absence of use than the property relation (understood as a bundle of social, economic, legal, and political relationships) put under strain by the visibility of non‐use. Focusing on Dublin's temporary urbanism moment (2008–2017), the paper has two aims. Firstly, it gives a critical account of this recent urban history of experimentation, documenting how the possibilities of the period following the crash were (fore)closed through governmental interventions. Secondly, the empirical case is used to make a wider conceptual argument about the conjunctural role that vacancy plays in urbanisation and urban politics, developing three main arguments: that vacancy is a vulnerable axis within the ownership model of property; that claims to vacancy are articulated in conjunctural and contextual ways; and that vacancy epitomises the dual nature of precarity. Relying on a micro-comparative analysis, mainstream comparative scholarship tends to be of the view that most modern legal systems place limits on both the number and the content of the property rights private parties can create. This paper takes a different angle, arguing that such conclusion, although correct and meaningful, is essentially incomplete, as it does not take account of the implications this ' numerus clausus principle' has for the institutional governance of legal systems. Adopting a macro-comparative approach, the paper analyses this principle from the perspective of its impact on the role of courts and their legal reasoning in modern Germany, England and the US. It concludes that the numerus clausus principle has materially different 'systemic effects' in each of these jurisdictions and that this has important implications both for the understanding of the principle and the development of property law more broadly. Unlike in Western countries, land ownership in China is overwhelmingly vested in the state, and individuals cannot directly own private lands and build houses. Therefore, developers will contract the land to the government and build it into collective apartments. Against this backdrop, a different kind of multi-story, high-density self-built residential buildings is widespread in small towns along the southeast coast of China. These buildings were built between 1980 and 2000 by residents who acquired land-use rights from the government for compensation. The uniqueness of these buildings is what makes them incompatible with the most mainstream, government-led urban renewal model in China, resulting in a large area of dilapidated and aging areas. Zherong County, Ningde, Fujian Province, is a typical example town, with a large number of such self-built houses, known locally as Liu Houses. In this study, these residential areas were selected as typical research objects of "characteristics of residential small towns". Combined with the property rights of the sample cases, the methods of diagram and quantitative analysis are used to summarize the causes of the three types of residential areas from the aspects of regional planning, land division, building construction, and renovation. In the early days, the planning of the Liu House was greatly influenced by the residents, and the construction and renovation of the building was led by the residents, which strengthened the diversity of the style. In the middle period, the government had relatively dominant control over the planning of Liu Houses, and supervision was conducted during the construction and renovation process, resulting in a relatively balanced power between residents and the government. In the later period, the houses were built and operated by the developer, and the residents no longer directly participated in the construction and renovation, so the unity of style was strengthened. At the same time, the study finds that, in the process of the formation of the style of the residential area, on the one hand, the property rights directly affect the style through its own physical land attributes, and on the other hand, it becomes the basis of the game between the government, residents, and the county environment through its own property rights, thus indirectly affecting the style. In conclusion, this paper may provide theoretical support and design reference for the renewal of the characteristic features of residential small towns. [ABSTRACT FROM AUTHOR]

With the marriage, the married couple creates among themselves rights and obligations which they must fulfill towards each other. From the moment of marriage the partners in addition to creating a family union, necessarily also form an economic union. We say this from the fact that every gift of high value, every material investment and every purchase of movable and immovable items will be considered joint if all these are earned and made during the time when the partners are in the marital union. The issue of property relations of spouses has long been present in family law theory and in legislative practice in which, considering the way in which property relations are regulated in the marital union, two models have been differentiated: the regime of the community of property of the spouses and the regime of separate, that is separate property of the spouses. The first model, represented in its pure form, is a product of the patriarchal system, because it assumes the primary role of the man in the management of the common property. In the second model, in which the property between the husband and the wife is separated, the spouses are each the owner of their own property, regardless of the fact that they brought that property to the marriage or acquired it during the duration of the marriage union, through work, with a gift, inheritance, etc. Taking into account the above-mentioned models as well as the specifics of each of them, in this paper we will bring the aspects of property rights between spouses in the legal system of the Republic of North Macedonia, from a theoretical but also a practical point of view and in European jurisdiction [ABSTRACT FROM AUTHOR]

Historically, European Union (EU27) member states have held sway over the administration of aquaculture sectors. However, challenges have arisen within this regulatory framework, particularly concerning the implementation of sustainable conservation measures across the EU27 region. In response to perceived regulatory shortcomings, alternative strategies like economic and community‐based management have emerged. Thus, this study aims to investigate how global governance factors have influenced the growth of the aquaculture industry within the European Union (EU13) and European Union (EU14) from 1990 to 2023. To address endogeneity concerns, robust least squares, two‐stage least squares (2SLS), and ordinary least squares estimators were employed, yielding significant findings. Notably, the impact analysis reveals that property rights, economic stability, private sector quality, and private interest are pivotal drivers of aquaculture industry growth in EU14 developed countries compared to their EU13 developing counterparts. Conversely, the novelty of the paper shows that economic growth, social development, and aquaculture industry advancement hold greater significance in EU13 developing countries relative to EU14 developed ones, as indicated by the estimators. Given these insights, policymakers in EU13 developing countries are urged to prioritize initiatives aimed at fortifying property rights, economic stability, and private interest. Conversely, policymakers in EU14 developed countries are encouraged to focus on fostering economic growth, enhancing public sector quality, and promoting social development in blue farming. The agricultural land management under the household responsibility system (HRS) in rural China empowers farmers with land tenure rights, meeting the basic needs for their livelihoods and employment by cultivating the land. This paper investigates the pivotal role of agricultural cultivated land as a social safety net, ensuring livelihood security for farmers confronting a recession in off-farm employment. Our analysis is based on data collected from six provinces (Heilongjiang, Henan, Zhejiang, Yunnan, Shandong, and Anhui) in the rural areas of China from 2019 to 2020. We investigated the impact of the off-farm employment recession on the mental health of farmers and the moderating effect of land as a social safety net on the relationship between the off-farm employment recession and mental health. The analysis points to the following results: (1) The majority of farmers have significantly reduced off-farm working time during employment recession. (2) The off-farm employment recession has worsened farmers' mental health. (3) Farmers' land assets through tenure rights provide both income and employment security functions, which can mitigate the adverse effects of the off-farm employment recession on their mental health. The findings of this study highlight the crucial role of land assets to reduce the negative impact of unemployment in the context of economic recession, emphasizing the significance of the policies supporting the land rights among vulnerable rural groups. This paper explores and ultimately affirms the surprising claim that artificial intelligence (AI) can become part of the person, in a robust sense, and examines three ethical and legal implications. The argument is based on a rich, legally inspired conception of persons as free and independent rightholders and objects of heightened protection, but it is construed so broadly that it should also apply to mainstream philosophical conceptions of personhood. The claim is exemplified by a specific technology, devices that connect human brains with computers and operate by AI-algorithms. Under philosophically reasonable and empirically realistic conditions, these devices and the AI running them become parts of the person, in the same way as arms, hearts, or mental capacities are. This transformation shall be called empersonification. It has normative and especially legal consequences because people have broader and stronger duties regarding other persons (and parts of them) than regarding things. Three consequences with practical implications are: (i) AI-devices cease to exist as independent legal entities and come to enjoy the special legal protection of persons; (ii) therefore, third parties such as manufacturers or authors of software lose (intellectual) property rights in device and software; (iii) persons become responsible for the outputs of the empersonified AI-devices to the same degree that they are for desires or intentions arising from the depths of their unconscious. More generally, empersonification marks a new step in the long history of human–machine interaction that deserves critical ethical reflection and calls for a stronger value-aligned development of these technologies. This paper introduces the European journal of law and economics symposium on the "law and economics of indigenous and ethnic minorities." Indigenous and ethnic minority groups tend to endure economic, political, and social disadvantages resulting from discrimination, inequality, marginalisation and other pathologies. The disadvantaged status of indigenous and ethnic minorities is often reflected in, if not entrenched as the result of, legal specifications and practices that increase the costs of inclusion and widespread participation in socio-economic and political life. Law and economics literature suggests that the costs of discrimination are significant, but that indigenous and ethnic minorities have the capacity to develop their own economic strategies and institutional practices to help ameliorate some of the consequences of discrimination by majoritarian populations. The papers in this symposium consider the law and economics of indigenous and ethnic minorities in a range of historical and contemporary perspectives, including the cases of immigration restrictions, conflicts over land management and property rights, and resources access.
