3. NATIONAL REPORT ON AUTOMATION IN DECISION-MAKING IN CIVIL PROCEDURE IN THE CZECH REPUBLIC.

- Abstract
The paper focuses on the issue of automated decision-making in civil proceedings. First of all, attention is given to procedural institutes that direct and facilitate automated decision-making, in particular the digital court file and the legal framework of videoconferencing equipment, without focusing on electronic service of documents, which should be a separate paper. A single case of legal regulation of automated decision-making in the form of an electronic payment order is then analyzed (cf. Section 174a of the Code of Civil Procedure). For each of these fields, an analysis of digitalization to date is given, which is followed by a consideration of further developments. - Abstract
The development of information technology and its use in everyday life must inevitably have an impact on public administration and its decision-making. Progress in artificial intelligence is also opening up wider opportunities for the use of automation of decision-making processes in public administration. Decision-making processes that once had to be handled by humans can now be automated. However, there must be a sufficient legal basis for this, setting out the legal limits of such automated decision-making. In this paper, the legal possibilities of automation of decision-making processes in the field of public administration in the Slovak Republic were examined, the obstacles that hinder the use of this tool were defined, as well as certain legal solutions eliminating or minimizing the consequences of these obstacles were outlined. The purpose of this paper was not to exhaustively describe and solve the problems with the automation of decision-making processes in public administration in the Slovak Republic. 5. On becoming the subject of health screening: a case study in 'Conditioned Freedom'.

The paper mobilises a personal experience of participation in a population-based health screen to explore wider aspects of subjectivity, choice and freedom. The screen is a familiar feature of contemporary society and represents a broader 'health imperative'. It intrinsically enforces a binary choice and thus, within its own remit, produces two reductive modes of being its subject characterised, respectively, by assent and refusal. Merleau-Ponty's account of a 'conditioned freedom' operating within a primordial, embodied subjectivity, however, allows a recuperation of aspects of my enactment of choice that tend otherwise to be eclipsed within the screen's binary logic. The thinking of two more recent writers deepens my understanding of how this freedom might play out within experience. David Abram helps me grasp the extent to which I encounter the screen as an ageing animal. Meanwhile a contrast with a very different historical and inter-cultural confrontation explored by Eduardo De Castro raises far-reaching questions around the bindingness of decision and the self/other relation. This research analyzes the problem of choosing a location for conducting infantry river crossing using the aluminum boat M70, applying the multicriteria decision-making method. It has been found that the use of these models significantly accelerates and simplifies the decision-making process, contributing to efficiency and speed in the process itself. At the same time, a comparison was made between the results obtained using multicriteria decision-making methods and the opinions of experts in the field of overcoming water obstacles. The research conclusions emphasize that multicriteria decision-making methods are highly reliable for decision-making, especially in the context of military operations. The focus of the research is on the significance of applying multicriteria methods, which opens up new perspectives for analyzing and improving the application of such models in real conditions. The applied multicriteria decision-making model consists of two phases. The first phase involves defining the weighting coefficients of criteria using the DIBR (Defining Interrelationships Between Ranked criteria) method. In the second phase, the best alternative is chosen using the TOPSIS (Technique for Order Preference by Similarity to Ideal Solution) method. This research not only supports efficient and comprehensive planning in military operations but also further confirms the relevance and usability of multicriteria decision-making methods in wartime conditions. Decision-making in Construction Project Management (CPM) involves numerous ambiguous information and uncertainties due to the nature of construction project. The Soft Computing (SC) approach, which offers several data processing strategies under uncertainty, has been extensively researched in CPM studies for decision problem solving. Decisions that cannot be adequately handled by conventional computer systems are facilitated by the SC approach. The SC approach encompasses a variety of SC techniques that are constantly developing and becoming more widely used to address real construction challenges. This study aims to conduct Systematic Literature Reviews (SLR) on the development of mainstream SC techniques and their current application in construction projects. Using an inventive SLR technique, 83 CPM papers covering the years 2018 to 2023 were selected for this study and then classified into four primary application themes of SC in CPM. The research trend was then described using bibliometric analysis. Afterwards, a topic-based qualitative analysis was conducted to investigate the application of SC approaches in the construction field. Several potential challenges to current research were then elaborated. 11. Review of Poliovirus Transmission and Economic Modeling to Support Global Polio Eradication: 2020–2024.

Continued investment in the development and application of mathematical models of poliovirus transmission, economics, and risks leads to their use in support of polio endgame strategy development and risk management policies. This study complements an earlier review covering the period 2000–2019 and discusses the evolution of studies published since 2020 by modeling groups supported by the Global Polio Eradication Initiative (GPEI) partners and others. We systematically review modeling papers published in English in peer-reviewed journals from 2020–2024.25 that focus on poliovirus transmission and health economic analyses. In spite of the long-anticipated end of poliovirus transmission and the GPEI sunset, which would lead to the end of its support for modeling, we find that the number of modeling groups supported by GPEI partners doubled and the rate of their publications increased. Modeling continued to play a role in supporting GPEI and national/regional policies, but changes in polio eradication governance, decentralized management and decision-making, and increased heterogeneity in modeling approaches and findings decreased the overall impact of modeling results. Meanwhile, the failure of the 2016 globally coordinated cessation of type 2 oral poliovirus vaccine use for preventive immunization and the introduction of new poliovirus vaccines and formulation, increased the complexity and uncertainty of poliovirus transmission and economic models and policy recommendations during this time. Conclusions. | (Abstract) The reform of epidemic surveillance in the European Union as a reaction to the Covid-19 pandemic attracts attention to one sporadically discussed phenomenon. Following the usual meaning of this term in legal settings, many decisions address individual cases. Nevertheless, a new category of decisions establishing rules has emerged in the past decades, i.e. “standardising” (“normative”, “norm-setting”, or “general”) decisions. These decisions have addressed the cooperation between the EU and national authorities, funding programmes and assistance to foreign countries. The European Parliament and the Council approved them. Theoretical reflections on these decisions are rare, but their pitfalls are identifiable. Namely, their possible effects on individuals are limited. The definition of unaddressed decisions provided by the Lisbon Treaty did not clarify the situation. Therefore, the recent tendency to replace these decisions with regulations deserves attention.

- Abstract
Dealing with acute cholecystitis in high-risk, critically ill, and unfit-for-surgery patients is frequent during daily practice and requires complex management. Several procedures exist to postpone and/or prevent surgical intervention in those patients who temporarily or definitively cannot undergo surgery. After a systematic review of the literature, an expert panel from the Italian Society of Emergency Surgery and Trauma (SICUT) discussed the different issues and statements in subsequent rounds. The final version of the statements was discussed during the annual meeting in Rome (September 2022). The present paper presents the definitive conclusions of the discussion. Fifteen statements based on the literature evidence were provided. The statements gave precise indications regarding the decisional process and the management of patients who cannot temporarily or definitively undergo cholecystectomy for acute cholecystitis. Acute cholecystitis management in high-risk, critically ill, and unfit-for-surgery patients should be multidisciplinary. The different gallbladder drainage methods must be tailored according to each patient and based on the expertise of the hospital. Percutaneous gallbladder drainage is recommended as the first choice as a bridge to surgery or in severely physiologically deranged patients. Endoscopic gallbladder drainage (cholecystoduodenostomy and cholecystogastrostomy) is suggested as a second-line alternative especially as a definitive procedure for those patients not amenable to surgical management. Trans-papillary gallbladder drainage is the last option to be reserved only to those unfit for other techniques. Delayed laparoscopic cholecystectomy in patients with percutaneous gallbladder drainage is suggested in all those patients recovering from the conditions that previously discouraged surgical intervention after at least 6 weeks from the gallbladder drainage. 15. Research on Green Development Decision Making of Logistics Enterprises Based on Three-Party Game.

The concept of green logistics entails minimizing the ecological impact of logistical resources, enhancing the environmental quality within the logistics sector, and optimizing resource utilization to foster sustainable development in social economic production and consumption. Promoting green transportation is not only a positive reflection of the concepts of environmental protection and green development, but also an effective means for traditional logistics enterprises to reduce operating costs, win competitive advantages, and achieve transformation and upgrading. This paper takes logistics enterprises facing green transformation and development decisions as the research object, and puts forward an evolutionary game model between logistics companies, government, and community. The evolution path of logistics enterprises' green transformation development strategy choice under different conditions is analyzed in detail. The results show that, under the conditions of the government's incentive and supervision and the public's choice of green consumption, logistics enterprises are more inclined to green transformation development. Different levels of public choice and different levels of government regulation also make different corporate strategy choices. Therefore, it is suggested that the government provide policy, technical channels, funds, and other support for logistics companies promoting green logistics, and actively publicize the concept of green consumption in the market. The paper discusses issues not touched upon in legal literature, namely the legal status and consequences of comfort letters issued by the European Commission in State aid cases. The European Commission has exclusive competence to examine the compliance of support provided by Member States to domestic undertakings with State aid rules. Under EU law, the Commission's final position on the State aid character of the assessed measure must take the form of a decision. However, sometimes, the proceedings are concluded not by a decision but by a comfort letter. It presents the final position of the European Commission and, in many cases, ends the procedure. However, the legal character of the Commission's comfort letters may raise doubts. The article explains the concept of comfort letters issued in State aid cases, their legal status, and the consequences they bring to interested parties. [ABSTRACT FROM AUTHOR]

22. Management of the Traffic Networks Transportation in Supplier-Customers Services by Strategic Games.

- Abstract
This paper presents an innovative approach to optimize traffic networks in a supplier-customer system based on specific strategies of game theory. The traffic network is represented as a routing configuration in which the arcs represent various possible roads between supplier and customer entities, each route having an associated transport cost for the product unit. The game structure is defined by a matrix of transport costs between the players, supplier and customer, with their corresponding strategies. Based on these costs, the game matrix is built to which the existing quantities in warehouses are added, respectively the quantities requested by the final customers. By solving the game associated to the transportation traffic network, the different strategies are proposed for choosing the optimal solution. The simulation results confirm the effectiveness of the proposed approach and recommend some performant procedures for solving the game, such as Hurwicz, Laplace and Savage, close to optimal solution. This research opens new directions for management optimization in other domains such as comunication, electrical and administrativ networks. [ABSTRACT FROM AUTHOR]

We see the stock market constantly responding to changing signals. These inputs are perceived to be highly structured in both space and time. Such regularities in the environment allow expectations about the future to be formed, facilitating current investment decisions. Perceiving the continuous stability is exploited by the brain, creating a bias in perception to generate serial dependence. Therefore, stock price dependence may be simply a result of the behavioral dependence in the decision process. The empirical evidence presented in this paper confirms that the dependence in every facet of an investment decision process has contributed to the observed stock price dependence. The largest contributor is by far from investors' memory dependence, exceeding 80%. If history is the record of past decisions going through the brain's neural pathways, the memory dependence or "memory of the memory" occurs when people follow the same old neural pathway over time. As paying attention to history is an obvious mental visit to the memory neural pathways, those who study the history are doomed to repeat it. [ABSTRACT FROM AUTHOR]

27. How to Make Impossible Decisions: jacques derrida and ruth chang on the ethics of rational choice.

In this paper, I propose that Derrida's writing on the impossibility of justice has the potential for fruitful dialogue with Ruth Chang's contemporary account of practical rationality. For Derrida, making a just decision must always come with a moment of undecidability, a "leap" into the unknown with an experience of doubt and anxiety that continues to "haunt" the decision-maker. By contrast, in her work on rationality, Chang proposes that hard decisions are difficult to make because the alternatives are "on a par," such that there are no rational differences between the alternatives that would contribute to choosing one over the other. Hard decisions are made by expressing one's own rational agency, generating will-based reasons to commit to or "drift" into one of the alternatives. Derrida writes of anxiety, doubt, and impossibility, yet Chang writes of commitment, agency, and rationality. Despite these differences, there are important comparisons and connections between the two accounts that are worth exploring. I suggest that the moment of the decision which Derrida describes as heterogeneous to knowledge can be understood as a moment of parity in which there is a lack of given reasons, as explained by Chang. Chang's account of rational agency provides an interpretation of how decision-making is possible despite the undecidability as described by Derrida. This notion of commitment and agency as explained by Chang is not incompatible with Derrida's insistence that the responsible decision is haunted by anxiety and doubt. Instead, I suggest that Derrida's writing highlights uncertainty as central to understanding the nature of hard choices and how to navigate the demands of justice. [ABSTRACT FROM AUTHOR]

This paper delves into the deconstruction of the notion of responsibility, drawing a correlation with the process of decomposition of the concept of sovereignty as discussed by Derrida in his last research works. We explore Derrida's consideration of absolute responsibility as no longer passing through the figure of the sovereign. Derrida's thought takes its distance from the philosophical and hegemonic determination of the notion of responsibility, for the conceptual system of its axiomatic defines responsibility based on the sovereign individual's freedom and makes responsibility the effect of his power. Yet, this definition condemns ethics to failure, since it does not account for the other supposed in the idea of response. Derrida incorporates absolute singularity, and consequently secrecy, into the structure of responsibility, enabling thought to encounter the absolute other. The text outlines the influence of Nietzsche and Celan in Derrida's thought and develops an approach that sees in his work the effort to create a poetic revolution in the history of philosophy and knowledge by opening thought to radical alterity. The dynamic environment in which healthcare systems operate highlights the importance of the decision-making process, especially considering the fact that it influences the quality of services and the well-being of patients. The aim of this research is to examine the conceptual link between the concepts "decision", "decision making process", "healthcare", and "management" and how they interact in the literature. Thus, the research aims to identify common trends and patterns in these areas. The research carries out scientific mapping using a three-stage methodological approach: bibliographic data collection through refined searches in the Web of Science database, data analysis using Biblioshiny, and subsequent bibliometric analysis of the 259 scientific documents collected. The main results of the analyses carried out illustrated an increase in scientific publications over time, especially in 2023, when most academic materials were published. International collaboration is in its infancy, with the US and China leading such collaborations. The theoretical implications are centered around the methodological approach to research in the healthcare field. Regarding the practical implications, the research provides information to decision-makers in the medical sector by identifying current contexts in the lives of organizations, but also to academics, with the research having the role of revealing publication sources and other information of interest to them. Background: Breastfeeding is the gold standard in infant nutrition. Successful breastfeeding depends on many factors, including the help of medical personnel in teaching breastfeeding, the need for professional work, and breastfeeding-friendly places in public spaces. The main goal was to identify various barriers among mothers to breastfeeding. Methods: This study used a quantitative descriptive research design. We recruited 419 mothers aged at least 18 years old through social media. Results were analysed using Pearson's chi-squared and Fisher's tests of independence for pairs of dependent and independent variables. Results: Most often, women gave birth at the age of 25–30, had one or two children, and attended higher education. Almost half of them lived in a large city and gave birth to a child by caesarean section. A total of 83.1% of mothers planned to breastfeed, but not all of them were able to do so for various reasons. One-third of them felt sorry for themselves that they had to change their feeding method. The majority of mothers did not receive sufficient help in the hospital in terms of learning how to breastfeed (61%), did not use the help of a lactation consultant (67%), and answered that there was no lactation consultant in their place of residence (65%). Only 43.2% of mothers returned to work without ceasing breastfeeding. A total of 42% of mothers experienced feelings of embarrassment when breastfeeding in a public place. The most frequently indicated barrier to breastfeeding in a public place was the lack of a suitable location where a woman would feel comfortable, calm, and intimate. Conclusion: There are various barriers towards breastfeeding: too few lactation consultants, problems with breastfeeding when the mother wants to return to work, and unfriendly places for breastfeeding in public spaces. Introducing a novel categorization, we trace the trajectory of efforts aimed at surmounting practical challenges encountered by autonomous vehicles through innovative RL techniques. To guide readers, we furnish a quantitative analysis that maps the volume and diversity of recent RL configurations, elucidating prevailing trends. This article problematizes the recent comeback of the exceptionalist jargon as it is conjured by both critics and sympathizers. While in the last decades governments across the globe had recourse to emergency measures to cope with far-reaching emergencies, from terrorism to the COVID-19 pandemic, the received view has it that political power takes advantage of states of emergency as they put themselves in the position to circumvent constitutional limitations. Carl Schmitt is claimed to be the major advocate of this conception of emergency politics in that he elaborated on the concept of the state of exception as the heart of the state political power. This article contends that the received view is doubly wrong. First, soon after his espousal of exceptionalism, Schmitt realized that emergency legislation is an ineffective and costly governmental device that should be transitory and is as unstable as the crisis it is meant to overcome. Second, the received view neglects how Schmitt came to his model of ultraconservative substantive constitutionalism as he maintained that the main task of politics is to protect the normative life of a limited set of state-sponsored institutions as well as the substantive contents they produce. The study aims to identify factors influencing Micro, Small, and Medium Enterprises (MSMEs) in utilizing peer-topeer lending as an alternative business financing. The object of this research is Palembang City MSME players. This type of research is descriptive quantitative using primary data obtained through a questionnaire instrument to 90 respondents. While the data analysis technique uses Structual Equation Model-Partial Least Square (SEM-PLS) with the help of SmartPLS 4.0 software. The results showed that the variables of Information Quality (IQ), Perceived Ease of Use (PEU), and Perceived Risk (PR) had a significant effect on Perceived Trust (PT). Meanwhile, the variables Perceived Risk (PR) and Perceived Trust (PT) have a significant effect on Decision (DEC). The managerial implications indicate that using peer-to-peer lending as an alternative financing can provide new benefits for MSMEs. However, users must consider several factors that will influence the decision to use peer-to-peer lending. One that must be understood is knowing valid information to make the right decision; the second is understanding the risks associated with using peer-to-peer lending, such as privacy and data security. Perceptions of convenience and trust explain that the greater the level of convenience felt by MSMEs in using peer-to-peer lending fintech, the greater the trust felt by MSMEs when using peer-to-peer lending. Artificial intelligence (AI) has drastically changed many facets of contemporary society, including the legal system and its ramifications. The legal ramifications of AI technology growth are examined in this abstract. The capacity of AI to make decisions on its own poses serious concerns about responsibility. It may be difficult for traditional legal theories to determine who is responsible for harm caused by AI systems that operate without human input. Legislators and courts throughout the world are having difficulty coming up with legal guidelines that would hold AI itself, its users, or even its creators liable for damages. As AI offers previously unheard-of capacities for data collecting and processing, privacy problems are a major concern. Strict guidelines on data handling procedures and openness are imposed by laws such as the CCPA in California and the GDPR in Europe, which aim to strike a balance between innovation and individual rights. AI-generated content presents new problems for intellectual property laws, igniting discussions about copyright and ownership. It is getting more and harder to define authorship and ownership in the age of automated content generation and algorithmic creations. The legal environment surrounding AI is further complicated by ethical issues. Robust legal dealings are necessary because of issues like algorithmic bias, prejudice, and the ethical application of AI in sensitive fields like criminal justice. In conclusion, even if AI has the potential to be a game-changer, its legal ramifications demand that privacy, liability, intellectual property, and ethical norms be carefully considered. To ensure AI's incorporation into society is in line with core values of justice, fairness, and accountability, addressing these issues requires interdisciplinary collaboration between legal scholars, legislators, technologists, and ethicists. 40. Influence of Factors on Career Intentions: A Cross-Sectional Study of Female Medical Students Pursuing Anesthesia Careers in Saudi Arabia.

Background: The decision to pursue a medical career is influenced by a multitude of factors, including gender, family background, and socioeconomic status. Despite the multifaceted role of anaesthesia in critical care and disaster response, physician anesthesiologists remain underrepresented in Saudi Arabia and other developing countries, posing challenges to healthcare systems. This study explores the factors influencing career intentions among female medical students in Saudi Arabia regarding pursuing a career in anaesthesia. Aim: This study aims to identify factors influencing the career choice of anesthesia among female undergraduates, exploring associations with other sociodemographic variables. Methodology: A cross sectional study was done by using comprehensive questionnaire-based approach employed to gather data on demographic profiles, experiences during anaesthesia rotations, postgraduate training preferences, and perceptions of the field. Logistic regression analysis was applied to investigate associations between demographic variables and attitudes towards anaesthesia as a career choice. Results: Varied age distribution (9.9%-54.5%), predominantly Saudi nationals (90.4%), and diverse parental occupations, mainly in healthcare, including medicine (6.8%-47.7%), were observed in the study. Regression analysis identifies non-Saudi nationality as associated with a positive attitude (Odds Ratio = 4.9247, p = 0.050), while increasing undergraduate years correlate with decreased positive attitudes. Factors linked to negative attitudes include older age (>27) (Coefficient = 1.2668, p = 0.248), and non-Saudi nationality with higher log odds (Odds Ratio = 5.0054, p = 0.130). Key influencers include financial considerations, perceptions of respect and patient care, mentorship, and misconceptions. Attitudes towards anaesthesia evolved with advancing education years. Conclusion: This study sheds light on the nuanced factors shaping career intentions within the anaesthesia field among female medical students in Saudi Arabia. By understanding these influences, healthcare institutions and policymakers can develop tailored strategies to attract and retain talent, addressing the underrepresentation of physician anesthesiologists and promoting anaesthesia as a rewarding career path. Our study emphasizes the pivotal role of cultural context, clinical experiences, and tailored support mechanisms in shaping the career intentions of Saudi Arabian female medical students towards anaesthesia. The prohibition of being liable to be tried or punished again in criminal proceedings for the same offence ne bis in idem - is one of fundamental criminal proceeding principles and a basic human right. It protects the defendant from reopening the proceedings for the same criminal offence in respect of which the proceedings were finalized. Primarily, the effect of this principle is related to final court decisions. Regarding the decisions of the public prosecutor, there is a legal gap. As the reformed criminal procedure provides broader jurisdiction to the public prosecutor, it has seemed a necessity to consider in this paper what status is given in practice to the decisions of this procedural entity regarding the prohibition of ne bis in idem. During the review, the views of the European Court of Human Rights and the Court of Justice of the European Union are presented, which plays a key role in defining the principles and setting standards for the application of the principle, as well as domestic case-law. The author believes that a broader interpretation should be accepted so that the effect of the ne bis in idem principle is not limited only to court decisions but also to include the decisions of the public prosecutor. In this way complete legal certainty is achieved and uncertain legal situations are eliminated.

Continued investment in the development and application of mathematical models of poliovirus transmission, economics, and risks leads to their use in support of polio endgame strategy development and risk management policies. This study complements an earlier review covering the period 2000–2019 and discusses the evolution of studies published since 2020 by modeling groups supported by the Global Polio Eradication Initiative (GPEI) partners and others. We systematically review modeling papers published in English in peer-reviewed journals from 2020–2024.25 that focus on poliovirus transmission and health economic analyses. In spite of the long-anticipated end of poliovirus transmission and the GPEI sunset, which would lead to the end of its support for modeling, we find that the number of modeling groups supported by GPEI partners doubled and the rate of their publications increased. Modeling continued to play a role in supporting GPEI and national/regional policies, but changes in polio eradication governance, decentralized management and decision-making, and increased heterogeneity in modeling approaches and findings decreased the overall impact of modeling results. Meanwhile, the failure of the 2016 globally coordinated cessation of type 2 oral poliovirus vaccine use for preventive immunization and the introduction of new poliovirus vaccines and formulation, increased the complexity and uncertainty of poliovirus transmission and economic models and policy recommendations during this time.
