1. Alternative Considerations for Professional Negotiations in Education for the State of Alabama.

Abstract

The course of collective bargaining for public employees (including teachers) in the state of Alabama is examined in this study. Although Alabama currently has no state legislation providing for bargaining for teachers, the trend nationally, as well as in the state, seems to be toward establishment of bargaining units for public employees. The author interviewed representatives of Alabama organizations that indicated interest in and influence on employer-employee relations in the state. These organizations included business and employer groups such as the Chamber of Commerce, as well as employee groups such as the Alabama Education Association. He also surveyed school district personnel and selected legislators and mayors. The results of the survey indicate that Alabama is not yet a good nesting place for public employee collective bargaining. Also included is a summary of labor legislation for other states and a brief review of the history of collective bargaining. The author concludes that since some form of professional negotiations for teachers and other public employees is inevitable, the state should take immediate action to prepare for the passage of a collective bargaining law. The appendix contains the text of Washington's Educational Employment Relations Act and Public Employment Labor Relations Act, a section analyzing typical negotiations proposals, a model emergency strike plan, and a glossary of important employee relations terms. Because much of the booklet is addressed to the specific provisions of Washington state laws, it will be of limited value to school officials in other states. (JG)

The intent of this volume is to inform boards of education about the collective negotiations process so that the board can proceed to improve board-staff relations as well as achieve its goals at the bargaining table. Although much of the information in this book applies to all public employee collective bargaining, the author chooses to focus on teachers' unions and their interaction with the negotiating team of the school board. Metzler describes the bargaining process, focusing on negotiating teams, bargaining techniques, communication during bargaining, and negotiability. The book also includes chapters on grievance procedures, mediation, strikes, arbitration, and fact-finding. A specific analysis of New Jersey labor legislation governing public employee bargaining is appended, along with the text of the New Jersey Employer-Employee Relations Act and relevant court cases. 5. Legal Issues in Experience Based Career Education.

Abstract

The report of first-year problems and potential solutions, based on a study of legal issues which arose in the development of employer based career education (EBCE) programs, is presented as a working draft from which certain policy questions and priority issues may be delineated. Federal statutes and the statutes of Pennsylvania, West Virginia, California and Oregon, where EBCE programs are in operation, were researched, and issues are confined to only those of reasonable importance to current projects. Five chapters examine public versus private school sponsorship; financing; forming a career education program (compulsory education, licensing and accreditation, curriculum requirements, course requirements and choices, students' rights and responsibilities, student protection, employer liability, transportation, teacher certification and responsibilities); labor issues in EBCE programs--the student's status on an employer site; experiences with legal issues of current EBCE programs (including organization patterns, workman's compensation, student reimbursement, child labor laws, curriculum, physical facilities, school lunch, and student records. A summary and conclusions are presented in chapter 6. A summary of compulsory attendance regulations and the Far West Laboratory Agreement with Oakland Schools are appended. (NH)

6. Child Labor Laws in Mississippi.

Abstract

Child labor laws have not attracted much attention in recent years. Much of the basic legislation and the case law dates from the early part of the 20th century. This paper discusses the Mississippi statutory law on the subject, compares that law with legislation in five other States, and discusses case law in Mississippi and in other States. Several discussions address themselves to implications for the employment of children during the school year by schools and school districts, as well as by outside employers. The author also makes recommendations for changing Mississippi laws. (Author/JF)

This document discusses priority problems and identifies possible solutions with regard to the existing system for delivery of services to children and youth. The study involved 250 individuals representing child and youth services throughout the state of California. Each task force study focuses on one major subject area relating to young people: (1) coordination of public and private service for children and youth; (2) education; (3) public attitudes; (4) child advocacy; (5) juvenile Justice; (6) financing of services; (7) problems of training young people for employment; (8) changing family structures; (9) health services; (10) child protection; and (11) child care. Recommendations presented for improving child services include: (1) a review of priorities by the federal government in conjunction with complete renovation of their budget systen; (2) uniform standard programs at the state and county level; and (3) more emphasis on treatment as opposed to prevention. 9. An Appraisal of the Manpower Training Programs Established by Congress in the 1960's. Project Baseline Supplemental Report.

Abstract

Offering an overview and informal appraisal of the Manpower Development and Training Act (MDTA) and its amendments since 1962, the study focuses on the vocational education program and the development of its legislation and administration. The 12 years of manpower training legislation from MDTA to the Comprehensive Employment and Training Act (CETA) of 1973 and a parallel chronology of legislative history of vocational education since 1963 is analyzed in chapter 1 and the diversity of current interpretations and definitions of career education discussed. The following section deals with group impressions of manpower training issues related to evaluation, training, and the need for national interagency coordination. The third section examines the mixed perceptions and attitudes of vocational educators toward the status of vocational education and manpower training. Examining Project Baseline data and information, conclusions and recommendations of the 1972-73 reports are summarized. The report concludes that vocational education and manpower training and development are not antithetical and competitive; they are compatible and both are dedicated to the same objective of training in the nation's policy for manpower. An appendix offers selected tables; a bibliography; Congressional reports; and a list of evaluation, research, and related studies. (MW)

10. A Plan to Provide Education in Collective Bargaining for Community College Personnel at Pensacola Junior College.

Abstract

The purpose of this practicum was to develop an educational presentation in collective bargaining for the faculty, administration, and board of trustees at Pensacola Junior College. The report includes the background of collective bargaining in post secondary education, the status of collective bargaining in Florida under the recently enacted Florida Public Employee Relations Act, and a comparison between the Florida and Michigan experiences in collective bargaining. The procedure involved developing the educational materials (a summary of the Florida Public Employee Relations Act, a summary of the Public Employees' Relations Commission, and an outline of How Collective Bargaining Works) and implementing the program (one-hour presentations followed by open discussions in the academic division). Consensus of the participants was that the materials were informative and that they increased general understanding about collective bargaining. It is recommended that these materials be shared with other Florida community colleges in order to promote better understanding of collective bargaining with the aim of making better decisions in this area of concern. 11. Compulsory Education: Keep, Change or Abolish?

Abstract

The existence of compulsory school attendance at the secondary level may help to assure school attendance for some students, but it does little to assure that any will learn. Both the laws requiring attendance and the basic high school programs offered in most states must be remodeled. Arizona's system provides a good example. Although Arizona's attendance laws require only that a child attend school through the eighth grade, most students stay through high school. A number of factors account for the schools' retention of students. One is the state's child labor laws that limit the number of available worthwhile jobs for youths under age 16. Another is the state's program of work-study courses, vocational education, and career education. It is hoped that a student's exposure to these kinds of courses and programs will help him set a personal goal or develop an idea of what he wants for the future. The state also has an extensive special education program for meeting the needs of students who have difficult learning experiences and who are prime candidates to become dropouts. Finally, societal pressure and self-respect help keep students in school until they have acquired enought education to enable them to be self-supporting and productive. (Author/IRT)

This document contains edited presentations given during a conference on teacher negotiations and solutions to impasse in Rhode Island. The principal speakers were Henry J. Nardone, chairman of the Elementary and Secondary Education Sub-Committee of the Board of Regents; Julius C. Michaelson, Attorney General for Rhode Island; and Dr. Peter Feuille, Assistant Professor of Organization and Human Resources at the State University of New York at Buffalo. Nardone discussed the Regents' ideas on impasse resolution, Michaelson discussed the current state legislation concerning teacher strikes and argued for the advantages of binding arbitration over strikes, and Dr. Feuille discussed a number of negotiation impasse resolution alternatives that are in use outside of Rhode Island. Abstract

A provision of the 1974 amendments to the Fair Labor Standards Act (FLSA) prohibited children under the age of 12 from working in agriculture, except on their parents' farms. Purpose of this provision was to codify as a matter of national social policy that children under 12 should not work for hire in agriculture or any other industry, where they may be exploited or abused. The provision was designed to improve Federal law banning sweatshop practices and abuses in migrant labor situations. Opponents of the provision suggested that there may be situations where the very valid reasons behind this new law simply did not apply. For instance, Aroostook County (Maine) relies heavily on the potato industry which relies heavily on the labor of schoolchildren. Yet, there is no exploitation or abuse since the children are considered an important and willing part of the labor force. Focusing on children under 12 picking potatoes in Maine, this hearing examined the intention and practical effect of the provision. Testimony was heard from educators, students, parents, and representatives from the Maine Department of Manpower Affairs, Maine Employment Security Office, Maine Potato Council, Agricultural Bargaining Council, Aroostook County Farm Bureau, Aroostook Farm Labor Association, National Committee on the Education of Migrant Children, and North American Blueberry Council. Abstract

In its report accompanying the 1974 amendments to the Fair Labor Standards Act (FLSA), the Senate Labor Committee concluded that in general child labor in agriculture was physically and mentally detrimental to the health and well-being of participating children, acting as a social depressant, stunting their intellectual growth and capacity, and resulting in economic exploitation negatively affecting the local adult wage rate. Congress, therefore, adopted legislation prohibiting the employment in agriculture of all children under the age of 12 except those working on farms owned or operated by their parents or guardians, or with the consent of their parents or guardians on farms exempt from the minimum wage and overtime provisions of the act by virtue of the 500 man-day test. In both exceptions, the children must be employed outside school hours in the school district where they reside. Opponents of the legislation suggested that the amendments have created isolated situations of severe economic hardship which could be legislatively remedied without any negative side effects on those children being protected. This hearing examined the arguments both pro and con for this position within the framework of the 3 premises on which the decision was made to prohibit the agricultural employment of children under 12--the physical effects on the children, the social effects on the community, and the economic impact on the area's wage structure. The hearings consider a bill, H.R. 8618, to amend the Occupational Safety and Health Act of 1970 (OSHA) which would provide on-site consultative services to employers desiring to comply with OSHA standards. H.R. 8616 was introduced to strengthen OSHA by providing an additional program that would encourage employers to voluntarily comply with safety and health standards established under the act. The testimonies presented include comments from the following: (1) State representatives from Illinois, Missouri, Nebraska, and Wisconsin; and (2) representatives from the Chamber of Commerce, National Federation of Independent Business, National Society of Professional Engineers, National Association of Manufacturers, Department of Labor, American Federation of Labor and Congress of Industrial Organizations, AFL-CIO, and the United Steelworkers of America. Other prepared statements came from the National Association of Wholesaler Distributors, Automotive Service Industry Association, Can Manufacturers Institute, National Small Business Association, National Society of Professional Engineers, and a State representative from Texas. The status of unionism among librarians in public and academic libraries, with emphasis on the years 1972 to 1975, is the subject of a report based on a search of the literature. The first section gives an indication of the frequency and mood of comment in the current professional literature. There follows a brief summary of library union development from 1914 through 1970, and more detailed reports on activities in specific libraries from 1970 to 1975. Specific libraries are also targeted in the sections on the agency shop and strikes. Three tables provide data on public library unions without collective bargaining contracts, strikes by library workers (1958-1968), and state anti-strike provisions as of 1972. 18. A Working Woman's Guide to Her Job Rights.

Abstract

Because of the growing number of women in the work force and the many recent changes in legislation affecting women's rights related to jobs and jobseeking, a need was felt for a publication which presents general information about Federal legislation which affects women when they are seeking a job, while they are on the job, and when they retire. Much of the information in the leaflet is also applicable to other minorities and to workers in general. It presents a brief description of the relevant laws and executive orders in three areas: (1) job seeking as it relates to employment services, apprenticeships, protection against sex and age discrimination; (2) on-the-job provisions relating to pay and promotion opportunities, garnishment, maternity leave, tax deductions for child care and household help, occupational health and safety protection, compensation for injuries, unemployment insurance and unions; and (3) the retirement issues relating to social security benefits and private pension plans. To assist the user in lodging complaints or finding further information, it includes a nine-page list of addresses of national offices of Federal agencies, State offices of the Wage and Hour Division of the Department of Labor, and State labor offices and human rights commissions. The carpentry work standards contained in the guide cover basic requirements for effective apprenticeship and are offered to assist local organizations of contractors and journeymen in establishing local systems of apprenticeship and improving existing systems. Twenty-five items to be considered when adapting national standards to local use are detailed. Federal laws and regulations affecting the employment of apprentices are summarized. The procedures for using joint training funds and for keeping apprenticeship records are briefly outlined. The appendix (21 pages) includes; detailed schedules for work experience and related instruction with recommended texts and reference materials for carpenter, millwright, and cabinetmaker-millman apprentices and for piledriver and interior systems trainees; a sample application for apprenticeship in carpentry; a sample apprenticeship agreement form; a list of regional offices of the Bureau of Apprenticeship and Training; and a list of state and territorial apprenticeship agencies. Abstract

The number of farms in rural America continued to decline. In 1974, 23,420 farms went out of business. Farm subsidy payments, originally designed to assist small farmers, contributed little to the survival of the small farmer. The 1974 increased costs in fuel and fertilizer alone reduced net farm income by $5 billion--approximately a $2,500 reduction in net income per farm. Although farm prices declined during 1974, prices paid by consumers at the supermarket continued to climb. Yet, the farmer received less than 41 cents of every food dollar spent by consumers. Evidence showed that market concentration (the lack of competition) led to higher food costs. Agribusiness not only contributed to increased food costs but threatened the existence of the independent farmer as well. Nearly 25 percent of all food production was "vertically integrated" through outright corporate ownership or through contracts. Farmworkers also suffered from low wages, seasonal work, limited coverage under protective labor legislation, increased mechanization, poor education, and critical health and housing needs. However, organizations such as the National Sharecroppers Fund, farmer and craft co-ops, and land-reform groups are working on these problems, showing that reform and revitalization in rural America are possible. This document is a discussion draft intended to lead to the formulation of a set of guidelines by the state board of education concerning three areas of teacher negotiations: scope, good faith bargaining, and prohibited practices. It has been prepared in the form of an organized data base that focuses on summarizing the present state of the law rather than on suggesting changes in the law. Although treated separately, scope, good faith bargaining, and unfair labor practices are interdependent. For example, a refusal to bargain on a subject within the mandatory scope of negotiations and a violation of good faith bargaining can both be treated as unfair labor practices. Abstract

This document explores some of the interrelationships between the collective bargaining process and equal employment issues. The National Labor Relations Act, the federal collective bargaining statute, is the focal point of the labor law discussion because it has had significant impact on the drafting and interpretation of state labor legislation and stands on an equal footing with federal equal employment laws. The federal labor statute, applicable to private colleges and universities is discussed, underscoring the Act's application to discrimination in employment based on race, sex, religion, national origin or color. Next, four federal equal opportunity laws -- Title VII of the 1964 Civil Rights Act, the Equal Pay Act, Executive Order 11246 as amended, and Title IX of the 1972 Educational Amendments -- are briefly described, emphasizing their impact on labor relations matters. Finally, some suggestions for higher education collective bargaining in the context of equal employment obligations are given. To the extent possible, an attempt is made to shape the principle of law, which arises in an industrial setting, to conceptually fit a situation involving faculty organizing or collective bargaining and campus equal employment issues. 29. Registered Apprenticeship Training in New York State. A Joint Report.

Abstract

For occupations demanding a great deal of skill, such as trades and crafts, apprenticeship has long been used as a training mechanism. A system requiring supervision under a master craftsman and some classroom theory, depending upon the level of job difficulty, an apprenticeship can involve training time from 2 to 7 years. Realizing the need for such training, Federal ad State laws have been initiated to increase the development and insure the proper operation of such programs. Presented in this report are legislative laws regulating registration, promotion, maintenance and service, completion requirements, veteran eligibility, and a list of those trades classified as apprenticeable by the State of New York. Appendixes listing program data on existing apprentice training and instruction are included to facilitate further comprehension. (SN)

This report highlights negotiations and trends occurring in the major collective bargaining in the province of Ontario, Canada in 1972. Bargaining during the year was centered primarily on non-manufacturing industries and in the public sector. Major issues negotiated were wages, improved working conditions, job security, and length of work week. Of significance was the fact that fewer work stoppages occurred in 1972 as opposed to the greatly increased number of strikes of 1970 and 1971 Man days lost, however, were greater in 1972. However, the law provides some specific exemptions from these requirements as to employees employed by certain establishments and in certain occupations. 46. The Condition of Farm Workers and Small Farmers. Report to the National Board of National Sharecroppers Fund and Rural Advancement Fund.

Abstract

Discrepancies in the U.S. Department of Agriculture (one of America's largest industries) and its relationship to farmworkers and small farmers are discussed in this report. Statistics supporting this are: (1) although 60% of all substandard housing is in rural areas, less than 25% of all Federal housing has been allocated for these areas; (2) approximately 50% of the nation's poor live in rural areas, and 70% of these individuals survive on less than $2,000 per year; (3) almost half of America's 2.7 million farmers earned less than $2,500 in 1972; and (4) the average annual wage for 270,000 migratory laborers was $1,830, while the average farmworker earned $3,170. All these figures are well below the Federal poverty standard. The discussion focuses on achieving rural revitalization through a comprehensive Federal policy which would maintain a common direction in its programs and provide for coordination and cooperation between governmental agencies. Other topics included in this discussion on the indifference of large corporate farming are the land-grant university's concern with industry rather than farmers and racial discrimination in the Extension Service. 47. American Labor Unions: An Outline of Growth and Structure.

Abstract

This publication attempts to explain, through historical description, the organizational structure of labor unions in the U.S. and the influence of major unions over the initiation of decision making policies governing their membership. Begun in 1792, with the unification of a group of Philadelphia shoemakers, labor unions spread from local to national by 1860. Competition of products side by side in the same market or town as well as that experienced from immigrants entering the country in increasing numbers, soon led to the development of the American Federation of Labor (AFL), an organization which brought together national trade unions. The enactment of federal legislation in 1930 which protected the worker caused a tremendous increase in union membership. In 1938 the Committee for Industrial Organization (CIO), which was later changed to the Congress of Industrial Organizations was established as a result of confusion and differences of opinion within the AFL. A merger between the two groups produced the currently existing AFL-CIO from which state and city-wide organizations have emerged, each having a certain interdependence, yet maintaining a great degree of autonomy. 49. Review of the Rural Manpower Service, 1972.

Abstract

In response to a public complaint filed with the Secretary of Labor alleging discriminatory practice by the Rural Manpower Service (RMS), an investigation of the charges was conducted. The petition was filed on behalf of 16 organizations and 398 specifically named individuals, and it accused the RMS of exploiting migrant farm workers. The methodology of the review included an initial analysis of the alleged problem, the accumulation of background information, field visits, and the organization and analysis of the information gathered. The overall findings and conclusions of the review in the initial major section are divided into 2 parts, dealing with the role of the RMS and the role of worker advocacy. The findings are discussed by topic under 3 sections: (1) economic and legal condition of the farm worker, including discrimination, certification of foreign workers, social security, wages, child labor, and labor law enforcement; (2) services to workers, including referral control, job order specifications, employment services to workers, conflict of interest, farm labor contractors, statistics and staffing, and day haul; and (3) working conditions, including housing, safety and pesticides, field sanitation and drinking water, and transportation.
