Abstract Background Policies for next-of-kin (NOK) notification and disposition of remains surrounding death are unclear across the United States’ (US) carceral systems. The goal of this study was to collect data on carceral system policies pertaining to NOK notification and disposition of remains for individuals who are incarcerated. We collected publicly available operational policies for the Federal Bureau of Prisons, Immigration and Customs Enforcement, 50 state prison systems, and the Washington D.C. jail for a total of 53 systems. Results Approximately 70% of systems had available policies on NOK notification and disposition of remains. Few systems had information on time constraints for NOK notification, notifying parties or designated contacts person, and ultimate disposition of unclaimed remains. Several systems had no accessible policies. Conclusions Across the US, carceral systems vary in policies for notifying NOK after the death of an incarcerated individual and their processes for the disposition of remains. Carceral and health systems should work towards standardization of policies on communication and disposition of remains after death of an individual who is incarcerated to work towards equity.

The article analyzes conflicts in interpersonal relationships among women in prison in Spain. Three indicators of low conflict were identified: minimal number of sanctions, typology of crimes, and avoidance practices. The factors of incidence found are internal conflict, family/social conflict, and coexistence in a single module. The application of remission of penalty by reading: discourses and practices seek to present the policy of remission of penalty by reading in the state of Santa Catarina, through interviews with coordinators responsible for these initiatives in two prison units. They decide on the procedures taken, the operational dynamic, and select the books and evaluation criteria. In addition to bringing together and comparing the two projects of reference through reading, the work proposes to investigate the moral intentions and the ends envisaged and achieved in the coordinators' speeches. Abstract Crime concerns have deepened in Iceland in the new millennium. The number of criminal court decisions increased until 2013, when it temporarily levelled off before reaching a new peak in 2019. This development has put pressure on the prison system, as a long list of convicts awaiting completion of their sentences has accumulated. This paper uses official data, previous research and media accounts to examine the response of Icelandic authorities to this trend. One of the main questions addressed in the article is whether the criminal policy adopted by Icelandic authorities suggests a movement toward punitive or non-custodial measures. As it turns out, the Icelandic prison system has undergone major changes to meet this penal challenge. A new modern prison has recently been built close to Reykjavík to replace three smaller, older facilities that have been closed. This suggests a punitive turn. Yet at the same time, non-custodial sanctions have been increasingly introduced and implemented in lieu of sentences to closed security prisons. These non-custodial sanctions include electronic surveillance, additional community service work and an increased possibility to serve time in open prison units. It is contended here that a combination of practical budget concerns and rehabilitation sentiments lies behind this criminal policy development. Abstract Kriminaliteten i Island har skabt voksende bekymringer i det nye årtusind. Antallet af strafferetlige afgørelser var stigende indtil 2013, hvor det fladede ud for en tid. Men i 2019 nåede antallet nye højder. Denne tendens har skabt et pres inden for fængselssystemet, der bl.a. viser sig i ophobning af domfældte, der må vente på at afsone deres dom. I denne artikel undersøges de islandske myndigheders reaktion på denne udvikling på baggrund af officielle data, tidligere forskning og mediernes dækning. Et af de mange spørgsmål, der bliver stillet i denne artikel, går ud på hvorvidt den islandske kriminalpolitik går i retning af mere eller mindre indespærring. Det islandske fængselssystem har gennemgået gennemgribende ændringer. Et moderne fængsel er for nylig blevet opført i umiddelbar nærhed af Reykjavik, hvilket ville antyde en straffende tendens, mens tre mindre og ældre fængselsinstitutioner er blevet lukket. Samtidigt har myndighederne i stigende grad anvendt ikke-frihedsberøvende straffe som alternativ til de lukkede fængsler. Blandt de nye metoder er elektronisk overvågning, mere samfundstjeneste og øgede muligheder for afsoning i åbne fængsler. 10. Italian prison system facing coronavirus: between troubles and resilience

This contribution is an analysis on the consequences of the coronavirus spread in the Italian prison system, highlighting concerns and potential prospects of improvements. Like other extremely vulnerable contexts, prisons are affected by the spread of Covid-19, resulting however weaker in providing effective strategies to ensure prevention, health and safety. Due to structural flaws, unhealthy conditions and endemic shortfalls, penitentiaries see a high risk of an outbreak of the illness. The prison crumbling and chronic overcrowded state make social distancing impossible. In addition to this, the coronavirus impact exacerbates pre-existing difficulties of the prison system. In such a dramatic scenario, and in spite of the inadequate government response in providing efficient resources against the virus diffusion, some detention facilities seem to be resilient in fighting back the epidemic, adopting strategies and solutions which could be considered a valuable starting point towards a better way of conceiving punishment. Il carcere italiano di fronte al coronavirus: tra criticità e resilienza. Il contributo presenta un’analisi circa le ripercussioni della diffusione del coronavirus nel sistema penitenziario, mettendo in luce le criticità e le potenziali prospettive di miglioramento. Il carcere, come tutti gli altri contesti contraddistinti da un elevato grado di vulnerabilità, non è immune rispetto alla diffusione del Covid-19, ma si dimostra debole nel garantire efficaci strategie di prevenzione e sicurezza sanitaria. A causa delle carenze strutturali, dell’insalubrità e dei deficit endemici degli istituti di pena, appare concreto il rischio che i luoghi di detenzione si trasformino in vivi focolai di malattia. Le fatiscenti condizioni dei penitenziari e la cronica condizione di sovraffollamento rendono impraticabile il distanziamento sociale e, al tempo stesso, l’impatto del coronavirus esaspera i nodi critici preesistenti all’interno dei circuiti penitenziari. In questo drammatico scenario, per quanto i provvedimenti adottati dal governo risultino insufficienti nel fornire gli strumenti adeguati al contrasto della diffusione del virus, alcune strutture si mostrano resilienti nel fronteggiare l’epidemia, mettendo in pratica una serie di strategie e soluzioni che possono costituire un valido punto di partenza verso un modo migliore di intendere la pena.

Canadian federal legislation setting out the framework for medical assistance in dying (MAiD) in Canada came into effect in June 2016. Because of section 86(1) of the Corrections and Conditional Release Act, as soon as MAiD became available in the community, it also needed to be made available to federal prisoners. There are some good reasons to be concerned about MAiD in the Canadian corrections system based on logistical, legal, and moral considerations. Fortunately, Canada is not the first country to decriminalize assisted dying and so Canadian policies and practices can be compared to others and take some lessons from their experiences. Thus, by reviewing the legal status of assisted dying in prisons internationally, the regulation of assisted dying, demand for assisted dying from prisoners, and the process for prisoners accessing assisted dying, this article offers a comparative overview of assisted dying for prisoners around the world in an effort to inform Canadian and other jurisdictions' law, policy, and practice. Este trabalho procura apresentar a experiência prática da política de remição de pena pela leitura em Santa Catarina, por meio de entrevistas com coordenadores responsáveis por essas iniciativas em duas unidades prisionais. Eles decidem sobre os procedimentos tomados e a dinâmica operacional e selecionam os livros e critérios de avaliação. Além de aproximar e comparar os dois projetos de remição pela leitura, o trabalho se propõe a investigar as intenções morais e os fins visados e alcançados nos discursos dos coordenadores. Como resultado, foi identificado que ainda não há dados sistematizados sobre a reincidência dos participantes dos projetos de remição de pena. The goal of this article is to contribute to ongoing efforts to strengthen gender regimes theory by proposing a new sub domain within the institutional domain of violence that brings in the penal state – any part of formal politico-administrative structures that arrests and incarcerates women. Based on interdisciplinary research on gender, crime and punishment that shows the importance of understanding the penal state for women's rights and gender equality, the operational definition of the penality sub domain is proposed and developed in a case study of prison reform and gender equality policy in Spain. The concept development case study not only helps to define and empirically identify the seven dimensions of the new sub domain. It also provides the opportunity to make a larger theoretical reflection of what penality issues mean for the application of gender regimes theory more broadly speaking and future comparative studies of gender equality, prisons and gender regimes. • There is a lack of theorizing on the role of gender in institutions and practices of incarceration. • Gender regimes theory would significantly benefit from the inclusion of the penal power of the State. • The penal state includes the set of institutions, practices and rationales that deploy punishment. • The penal state should be brought into all feminist analysis of gender policy of the state. Esta pesquisa tem por objetivo identificar e analisar os atores que participam e como se relacionam na implementação da política penitenciária nacional. Parte-se da abordagem dos estudos de implementação que considera a natureza indeterminada destes processos, as especificidades do contexto político-institucional brasileiro e a necessidade de articulação entre os atores em arranjos institucionais. Assim, buscamos analisar a interação entre os atores em uma política específica e como a produção estatística é um instrumento que organiza estas relações para a execução de políticas. Para tanto, realizou-se extenso levantamento documental e 33 entrevistas semiestruturadas a partir da estratégia metodológica da resolução reiterada de problemas e da análise documental. Buscou-se a teorização dos dados a partir da comparação entre ligações e mecanismos entre os atores em períodos sucessivos separados por descontinuidades nos contextos institucionais. As principais conclusões apontam uma tendência de centralização da política penitenciária e a diversificação na adoção de instrumentos regulatórios, de incentivos e produção de informações estatísticas. Mas, a despeito desta tendência, os instrumentos existentes ainda são insuficientes para promover mecanismos de coordenação direcionada a objetivos comuns. Esta pesquisa traz contribuições teóricas, metodológicas e empíricas. Dialoga com os estudos recentes sobre arranjos de atores institucionais e instrumentos com a implementação de políticas penitenciárias, cuja produção é escassa na área. Adota a estratégia indutiva da resolução reiterada de problemas, cuja metodologia pode ser replicada para outras políticas públicas e fenômenos de longa duração. Por fim, traz como contribuição empírica a sistematização de eventos de uma política específica em um longo período da administração pública, além de extensa análise documental sobre a produção de estatísticas sobre pessoas custodiadas no país. This research aims to identify and analyze the actors who participate and how they relate to the implementation of the national penitentiary policy. It starts with the implementation studies approach that considers the indeterminate nature of these processes, the specificities of the Brazilian political-institutional context, and the need for articulation between actors in institutional arrangements. Thus, we seek to analyze the interaction between actors in a specific policy and how statistical production is an instrument that organizes these relationships for the execution of policies. An extensive documental survey and 33 semi-structured interviews were carried out based on the methodological strategy of repeated problem solving and documental analysis. We sought to theorize the data from the comparison between connections and mechanisms between actors in successive periods separated by discontinuities in institutional contexts. The main conclusions point to a trend towards centralization of penitentiary policy and diversification in the adoption of regulatory instruments, incentives, and production of statistical information. But despite this trend, current instruments are still insufficient to promote coordination mechanisms aimed at common goals. This research brings theoretical, methodological, and empirical contributions. It dialogues with recent studies on the arrangements of institutional actors and instruments with the implementation of penitentiary policies, whose production is scarce in the area. It adopts the inductive strategy of repeated problem solving, whose methodology should be useful to other public policies and long-lasting phenomena. Finally, it brings as an empirical contribution the systematization of events of a specific policy over a long period of public administration, in addition to extensive documentary analysis on the production of statistics on people in custody in Brazil.

The objective of this research is to document correctional institutions' policies regarding inmates' correspondence, visitation, and telephoning between 1971 and 2005. Data were gathered via mailed surveys in 1971, 1981, 1991, and 2005 from state correctional facilities for adults in maximum security institutions. The survey return rates were 93% (n = 64) in 1971, 96% (n= 66) in 1981, 81% (n=91) in 1991, and 84% (n = 162) in 2005. The findings suggest that prison communication policies are becoming more restrictive on visitation and inmates are assuming more of the expenses for correspondence. At the same time, policies regarding telephone usage seem to have gotten more lenient, with the financial obligations falling solely on the inmates. These results are informative as many state legislatures are becoming increasingly attentive to strategies that might reinforce inmate relationships with family and friends to reduce recidivism rates, lessening the financial strain of incarceration on state budgets. This article explains the evolution of prison policies in Argentina and Chile after the dual transition to neoliberalism and democracy addressing in particular the renewal of correctionalist prison rationalities propelled by human rights and managerialism expertise, their specific articulations and the differential institutionalization in the state. Going beyond objectivist descriptions of prison expansion, I delve into the emergence of a new symbolic order in democratic times that prompted the unexpected revival of rehabilitation programs and increased formalization of prisons regimes and account for their progressive subordination to security priorities. To explain these particular evolutions that contradict predictions of a direct drift toward a purely warehousing prison with greater informality under neoliberalism in Latin America, I engage in a comparative field analysis, analyzing the structure and dynamics within what I call carceral fields to account for the introduction of new rationalities and for their differential institutionalization in prison bureaucracies. After presenting the concept of carceral field and reviewing alternative accounts of prison change in Latin America, I show that the emergence of these rationalities follow the entrance of new experts within the field in democratic times, and account for their differential incorporation in prison policies and regimes analyzing how the interests of prison officers and political agents and increasing overcrowding conditioned the experts’ strategies. This study, based on documentary evidence and interview data, demonstrates that these new legal and economic rationalities do not oppose drifts toward populist punitivism, but give it a progressive face, legitimating punitive policies while providing new power resources to elite prison administrators. Resumo Publicado em 2007, ainda sem tradução para o português e pouco conhecido no Brasil, a obra Golden Gulag é um importante referencial para a compreensão da expansão prisional ocorrida no estado norte-americano da Califórnia, entre os anos 1982 e 2000. Neste livro, Ruth W. Gilmore oferece uma interessante interpretação sobre as motivações e articulações que impulsionaram a construção das unidades prisionais no interior daquele estado, além de fornecer um referencial analítico que rediscute a economia política da pena. Gilmore também é considerada uma das principais autoras que contribuíram para uma abordagem sobre o revigoramento prisional intitulada Complexo industrial carcerário, bem como membro-fundador de um coletivo antiprisão chamado Critical resistence. Este artigo procura realizar uma leitura atenta de Golden Gulag, de modo a extrair as principais formulações teórico-empíricas do livro, para, em seguida, ensaiar possíveis contribuições deste material para se compreender aspectos recentes da expansão prisional no estado de São Paulo. Abstract The book was published in 2007 and remains without translation into Portuguese. The author remains little known, due to this gap. However, the book Golden Gulag is an important framework for understanding the prison expansion in the State of California, which occurred between 1982 and 2000. In this book, Gilmore offers an interesting interpretation about the motivations and articulations that have driven the construction of prisons within the state, and provides an analytical framework that discussed again the political economy of punishment. Gilmore is also known for being one of the main authors who formulated a contemporary interpretation of prison expansion prison, called Prison Industrial Complex (PIC). She is also a founding member of a prison abolition movement named Critical Resistence. This article conducts a careful reading of the Golden Gulag in order to extract the main theoretical and empirical formulations of the book. With this reading done, we intend to test possible contributions of this material for understanding the recent prison expansion in São Paulo.

Imprisonment is an expansive concept, as it is regulated by laws under criminal justice system of the state. The state sets principles of punishment to control offenders and also puts limits to excess punitive control. One significant way through which it exercises control is through rules governing healthcare of imprisoned population. Prisons signify specialized settings which accommodate both medical and legal concerns. The provision of care operates within the institutional paradigm of punishment. This requires the state to negotiate adequately between goals of punishment and fulfilment of basic human rights of offenders. The present study is based on a critical analysis of prison healthcare standards in India, which include government policies and guidelines. It also demonstrates how healthcare is delivered by drawing insights from a primary study conducted in a correctional home in the state of West Bengal, India, which houses both male and female inmates. Forty women were interviewed through semi-structured interviews, followed by focus group discussions. Doctors and administrative personnel were also interviewed. Findings show how institutional practices control women through subversion of the role of doctors to prison administration. Also, poor healthcare infrastructure, unavailability of specialized services, hierarchies between personnel and inmates make prisons unlikely sites for therapeutic intervention. 25. Impact of family-friendly prison policies on health, justice and child protection outcomes for incarcerated mothers and their dependent children: A cohort study protocol

Introduction Female imprisonment has numerous health and social sequelae for both women prisoners and their children. Examples of comprehensive family-friendly prison policies that seek to improve the health and social functioning of women prisoners and their children exist but have not been evaluated. This study will determine the impact of exposure to a family-friendly prison environment on health, child protection and justice outcomes for incarcerated mothers and their dependent children. Methods and analysis A longitudinal retrospective cohort design will be used to compare outcomes for mothers incarcerated at Boronia Pre-release Centre, a women’s prison with a dedicated family-friendly environment, and their dependent children, with outcomes for mothers incarcerated at other prisons in Western Australia (that do not offer this environment) and their dependent children. Routinely collected administrative data from 1985 to 2013 will be used to determine child and mother outcomes such as hospital admissions, emergency department presentations, custodial sentences, community service orders and placement in out-of home care. The sample consists of all children born in Western Australia between 1 January 1985 and 31 December 2011 who had a mother in a West Australian prison between 1990 and 2012 and their mothers. Children are included if they were alive and aged less than 18 years at the time of their mother’s incarceration. The sample comprises an exposed group of 665 women incarcerated at Boronia and their 1714 dependent children and a non-exposed comparison sample of 2976 women incarcerated at other West Australian prisons and their 7186 dependent children, creating a total study sample of 3641 women and 8900 children. Este artigo tem entre seus objetivos lançar uma análise reflexiva sobre a situação dos detentos indígenas no município de Dourados, estado de Mato Grosso do Sul. Destaca-se que o problema teórico se embasa no fato de que, apesar de existirem inúmeros textos legais, pactos, protocolos, declarações e afins, tanto de caráter nacional quanto internacional, para a proteção dos direitos dos povos indígenas, verificam-se constantes violações a esses direitos que fazem parte da universalidade dos direitos humanos. Portanto, surgem questionamentos: Qual será a lacuna que impede a devida implementação dos direitos dos povos indígenas entre a população carcerária indígena no estado do Mato Grosso do Sul? Para a construção deste texto recorremos aos aportes de várias disciplinas, tais como: direito constitucional, penal, internacional e direitos humanos, por estarem intimamente interconectados com a proteção dos direitos dos povos indígenas. O direito aqui abordado será por meio de uma perspectiva interdisciplinar diante das várias áreas do conhecimento, com o intuito de que se possa avançar na compreensão dessa temática, fazendo uma menção especial à antropologia jurídica. O método adotado foi o descritivo-analítico, aplicando-se a análise documental e bibliográfica ao caso concreto. Além do que nos valemos de estudos de casos, conforme nos propõe a etnografia e a prática jurídica local, quando se trata de estudar culturas diversas. This work has among its objectives to launch a reflective analysis on the situation of indigenous prisoners in Dourados, state of Mato Grosso do Sul, Brazil. It is noteworthy that the theoretical problem is based on the fact that, although there are numerous legal texts, pacts, protocols, and similar Statements, both national, and international, to protect the rights of indigenous peoples, there are constants violations of those rights that belong to the universality of human rights. Therefore, questions arise such as: What is the gap that prevents the proper implementation of the rights of indigenous peoples from the indigenous prison population in the state of Mato Grosso do Sul? For the construction of this text appealed to contributions from various disciplines such as constitutional law, criminal law, International law and human rights, because they are closely interconnected with the protection of the rights of indigenous peoples. The rights addressed here, is by means of an interdisciplinary perspective on the various areas of knowledge, aiming to make progress in understanding this issue, making a special reference to the legal anthropology. The method used, was the descriptive-analytical method, applying the documentary analysis and literature to the case. Apart from that we use case studies, as proposed in ethnography and local legal practice, when it comes to studying diverse cultures. Cet article retrace le processus controversé de privatisation d’une partie du système carcéral français au milieu des années 1980. Il revient sur l’origine du projet, puis sur la bataille parlementaire à laquelle il a donné lieu. L’ambition d’une privatisation intégrale a laissé place à une concession partielle, apparemment superficielle, corrélative d’une expansion programmée du parc pénitentiaire. Cet épisode est un jalon majeur de la diffusion du raisonnement économique dans le système pénal. Par-delà un recodage juridique, l’argument est que cette épreuve a amorcé l’actualisation d’une rationalité politique réglant l’État de droit sur le raisonnement gestionnaire. This article reviews the controversial process of privatizing one part of the French carceral system during the 1980s. It returns to the origins of the project, then to the resulting parliamentary battle. The ambition to produce a complete privatization is seen to relent to a partial concession, apparently superficial, correlated to a programmed expansion of the prison system’s capacity. This episode is a major milestone in the diffusion of economic thinking through the penal system. Beyond a legal redefinition, the argument is that this event primed the actualization of a political rationality that adapted the rule of law to managerial thought processes.

Prison labor, establishing itself as a point of convergence between several different purposes conferred, contemporaneously, the capital punishment, meets, among other meanings, those who drive for understanding as a "transformative" intervention protagonist instrument in the life of inmates. Despite the possible ambiguities that entails meaning of prison labor in their configurations, we perceive it in our study as a motivating factor for the reflections and their exploitation in combating the social vulnerability of prisoners and individuals targeted by criminal selectivity. In this sense, we seek from this thesis unveilings subsidies from individuals belonging to two opposite geographically regional realities able to provide a critical analysis of the impacts that the work in prison strikes with the perspectives of life of inmates in their paths of returning to social life. The locations of data collection - Institute of Penitentiary Administration of Amapá/AP and Canguçu State Prison/RS - were chosen with the purpose of establishing tensioners contrasts of influences that the social, economic and cultural characteristics of each region register in the operation of the prison job by their administrators, as well as their responsiveness on the part of inmates of the prison system. For the pursuit of these objectives, sociological contributions of Michel Foucault, David Garland and Gustavo Busso were fundamental on the transmutations regarding the mechanism of power relations between social control and criminal selectivity, and notions concerning social vulnerability, respectively A problemática prisional representa um dos maiores desafios a serem enfrentados pelas políticas sociais e penitenciárias. O trabalho prisional, por constituir-se como um ponto de convergência entre inúmeros propósitos distintos conferidos contemporaneamente à pena de prisão, reúne, dentre outros significados, aqueles que se direcionam para o seu entendimento como instrumento protagonista de intervenção transformadora na vida dos condenados. Não obstante as eventuais ambigüidades que a acepção do trabalho prisional enseja em suas configurações, procuramos percebê-lo em nosso estudo como um elemento motivador de reflexões voltadas à sua instrumentalização no enfrentamento da vulnerabilidade social de egressos e indivíduos abarcados pela seletividade criminal. Neste sentido, buscamos através desta Dissertação desvelamentos a partir de sujeitos pertencentes a duas realidades regionais geograficamente opostas subsídios capazes de nos fornecer uma análise crítica acerca dos impactos que o trabalho prisional logra junto às perspectivas de vida dos egressos em suas trajetórias de retorno ao convívio social. As localidades de coleta dos dados Instituto de Administração Penitenciária do Amapá/AP e Presídio Estadual de Canguçu/RS foram escolhidas no desígnio de se estabelecer contrastes tensionadores das influências que as características sociais, econômicas e culturais de cada região imprimem na operacionalização do trabalho prisional por parte de seus administradores, assim como em sua receptividade junto aos apenados e egressos do sistema carcerário. International audience; This article relates the controversy over the process of prison privatization in France during the mid-1980s. It recalls the origins of the project, then focuses on the parliamentary battle which it gave birth to. The initial ambition of a total privatization became narrower and gave way to a seemingly superficial transfer, related to an indefinite expansion of the prison system capacity. This process can be seen as a key event in the extension of an economic style of reasoning in the criminal justice system.
