The attribution of criminal liability to the tax advisor has been seen as a phenomenon of growing interest and relevance in Spain. This paper aims to address the issue using the dogmatic scientific method, taking into account Spanish positive law and jurisprudence, in combination with criminal policy considerations. In this way, it starts from general concepts such as the determination of the protected legal asset, the analysis of article 305 of the Criminal Code and the different activities associated with tax advice. Subsequently, it is intended to include the problems inherent in the attribution of criminal liability to the tax advisor for the commission of the crime of tax fraud, which is conceived as a special crime that restricts the circle of authors and, therefore, the different ways in which the tax advisor can be held liable through the required qualification. Finally, reference is made to the scarce existing jurisprudence on the subject, which highlights the technical difficulties of attributing authorship to the advisor, with the predominant concept of him as a necessary cooperator. La imputación de responsabilidad penal al asesor fiscal se viene apreciando como un fenómeno de creciente interés y relevancia en España. En el presente trabajo se pretende abordar la cuestión utilizando el método científico dogmático atendiéndose al Derecho positivo y jurisprudencia españoles, en combinación con consideraciones de política criminal. De tal forma, se parte de conceptos generales como la determinación del bien jurídico protegido, el análisis del artículo 305 del Código penal y las diferentes actividades asociadas a la asesoría fiscal. Posteriormente se pretende recoger la problemática inherente a la atribución de responsabilidad penal al asesor fiscal por la comisión del delito de defraudación tributaria, concibiéndose el mismo como delito especial propio. Ello restringe el círculo de autores y, por tanto, se analizan los diferentes cauces para la trasmisión de la cualificación exigida por el tipo para la determinación de la autoría y participación. Por último, se alude a la escasa jurisprudencia existente al respecto y que pone de manifiesto las dificultades técnicas de atribuir la autoría al asesor, predominando su conceptuación como cooperador necesario.
