Scotland was unique in Western Europe in continuing to accord legal validity to irregular marriage until 1939 with one form of irregular marriage remaining legal until 2006. This article examines official attitudes to irregular marriage in Scotland in the period 1855–1939 as well as its incidence and popularity amongst the populace. The article argues that irregular marriage was narrowly defined by the authorities as meaning those irregular marriages that had been registered. Other forms of irregular marriage were often deemed to be cohabitation or concubinage which was regarded as morally reprehensible. However, authorities, including Poor Law officers, could also be flexible and sympathetic in their treatment of couples who lived together where the law was perceived to be rigid. Although it is impossible to quantify the numbers of couples who lived in non-registered informal unions, the evidence suggests that there were significant numbers but that in the majority of cases couples cohabited because they were unable to marry for legal, religious, or financial reasons. The 1640 General Assembly of the Kirk, dominated by Covenanters, was keen to discover something amiss in the doctrine of the Episcopalian John Forbes of Corse. Ultimately they were forced to admit his orthodoxy, even while deposing him for his refusal to subscribe the National Covenant. Modern scholars have succeeded where Forbes's contemporary antagonists failed, representing Forbes as the champion of a party that was, to one degree or another, out of step with the Calvinist orthodoxy of the day. This article examines Forbes's theology at points where his disagreement with contemporary reformed thought has been claimed, and draws implications from its findings for our knowledge and understanding of seventeenth-century Scottish theology more broadly. The collapse of the ambitious and experimental Ayr Bank (Douglas, Heron & Co.) was the central episode of the 1772–3 British credit crisis and served as a direct influence on Adam Smith's monetary analysis in the Wealth of Nations. This article identifies the issuance of redeemable annuities in response to the bank's stop of payments in June 1772 and the distressed nature of its asset liquidations afterwards as the main reasons behind the size of its losses. It furthermore uses primary manuscript evidence to reconstruct and extend the existing narrative of this famous episode, from the planning stages in 1773 while the bank was still fighting for its survival, to the retirement of its banknotes by the Edinburgh public banks in 1773–4, the legal and political manoeuvring behind the redemption of the annuities by Act of Parliament in 1774, and the over 40 years of asset unwinding that followed. Despite the prominence of religious issues in the historiography of Restoration Scotland, understanding of the position of the Kirk in the Highlands remains sparse. This article seeks to address this lacuna through analysis of two related themes. Firstly, it looks at provision, discussing the Kirk's financial, material and manpower resources, as well as the challenge posed by Gaelic. Secondly, it traces the extent of Nonconformity, both Presbyterian and Roman Catholic, with a view to judging the degree of adherence to the established Episcopalian structure. Savings banks were created as a means to encourage the newly created working class to save for the uncertainties of urban industrial life. This article explores the success of the Savings Bank of Glasgow, and pays particular attention to the response of savers to the financial and commercial crises of 1847 and 1857. The crisis of 1847 was shallower but longer lasting in Glasgow, while that of 1857 was greatly exacerbated by local conditions in the short term, but of little long-term importance to savers. It suggests that, in both crises, some elements of contagion may have been present but that those who panicked in 1857 were systematically different from those who did not. [ABSTRACT FROM PUBLISHER]

In 1787 an anonymous student of the Perth Academy spent countless hours transforming his rough classroom notes into a beautifully inscribed notebook. Though this was an everyday practice for many Enlightenment students, extant notebooks of this nature are extremely rare and we know very little about how middle class children learned to inscribe and visualize knowledge on paper. This essay addresses this lacuna by using recently located student notebooks, drawings, and marginalia alongside textbooks and instructional literature to identify the graphic tools and skills that were taught to Scottish children in early modern classrooms. I show that, in addition to learning the facts of the curriculum, students participated in educational routines that enabled them to learn how to visually package knowledge into accessible figures and patterns of information, thereby making acts of inscription and visualization meaningful tools that benefitted both the self and society. Eighteenth-century architect-builders were a small group, but important for understanding the market strategies of knowledge-based experts in an age of rapid growth in technical information before the creation of modern professions. This article confronts a teleological historiography of emerging professionalization. It is focused on Robert Mylne and several of his contemporaries in Edinburgh and London, including a number of successful London-based Scots who were active as architects, builders, engineers, and surveyors, and self-styled in all these areas when it suited them. It supplies an account of what it took for building experts to establish themselves and flourish in big cities and the ways in which such experts navigated, controlled, and accommodated an environment of unregulated expertise that largely suited contemporary practitioners. Smith was influenced by Newton’s method. Nonetheless, he introduced elements that led him far from the Newtonian perspective. The present essay analyzes how historical dimensions, contingencies, institutions, and conflicting human inclinations modify a Newtonian horizon. Finally, the paper focuses on how, in Smith’s view, institutions determine “unintended outcomes,” which are sometimes opposed to those of the market. In this sense, the “invisible hand” is not only the result of the behavior of myopic individuals trying to improve their conditions; it is also the outcome of the work of institutions that operate as structures autonomous with respect to individuals. Divisions in the Scottish political community that were evident by the end of the reign of James VI have been posited as roots of the Scottish revolution of 1638 and the wars of the three kingdoms. This article argues that the disengagement of central government from the political nation at large was a key factor in this development. By demonstrating the frequency of conventions of the estates, it highlights the intensity of consultation in James's Scottish government before 1603. A sudden decline in their frequency thereafter was symptomatic of a wider failure of government to adapt to the absence of the king in the context of a composite monarchy. While correspondence between the king and the privy council was copious, communication between the council and the political elites of Scotland withered. Without conventions of the estates as a vital point of contact in which new policies could be tested and negotiated, parliaments became more disagreeable. The crown's reliance on unprecedented levels of management and increased central direction alienated a significant proportion of the political elite, driving them into the oppositional stance which endured through the reign of Charles I. Palisaded enclosures were huge enclosed spaces with timber boundaries found across Britain, Ireland, and Scan- dinavia in the Neolithic. Five such sites have been identified in Scotland dating to the later Neolithic, four of which have been excavated to varying degrees. These sites form the main focus of this paper, which draws in particular on interim results from the authors' excavations at Forteviot, Perth and Kinross, during 2007-2009. The palisaded enclosures of Scotland are part of a wider British and Irish tradition and there are a number of European parallels, the closest of which lie in southern Scandinavia. The palisaded enclosures in Scotland are tightly clustered geographically and chronologically, constructed in the centuries after 2800 cal BC. This paper explores the function, role, and meaning of palisaded enclosures in Scotland and more generally, drawing not just on the architecture of the monuments, but also the individual posts that were used to create the enclosures. The role of these monuments in reconstituting nature is also considered. This review assesses scholarly attempts to synthesize various forms of Scottish philosophy in the context of eighteenth-century America. It suggests potential new directions for the study of Scottish Enlightenment ethical theories on the western side of the Atlantic, and then examines scholarship on a separate and neglected Scottish influence in American thought: an evangelical notion of religious authority that was not opposed to wider incorporation in multi-denominational political unions. The ideological basis for American independence owed much to a tense counterpoise between Scottish moral sense reasoning and Presbyterian evangelicalism, rather than to their singular and starkly binary contributions to colonial American ideology. When James VI and I arrived in London in 1603, he created a new bedchamber, which he filled with Scottish courtiers. This he positioned, antagonistically as it turned out, between himself and the more English privy chamber. These Scottish courtiers thus had the most intimate access to James, and were able to exercise great influence over the distribution of James's favour. Whilst their importance has been debated within an English context, their significance within James's government in Scotland has not yet been addressed. These Scotsmen became the focus for patronage networks stretching from Whitehall, through the privy council in Edinburgh, to the Scottish regional elites, and helped James retain the co-operation of those elites. Against the background of attempts to gain fuller union, James sought to demonstrate the benefits of regnal union by prosecuting a pacification of crime within the Scottish and English Borders, now rechristened the Middle Shires. Patronage networks from Whitehall to Roxburghshire secured the co-operation of the Scottish Borders elite, whilst acting as conduits for information and advice back to Whitehall. This article will suggest that these relationships were integral to Scottish governmental processes in James's absence, providing a much-needed cohesive force within his fragile new multiple monarchy. Two groups of patients admitted to psychiatric hospital in Dumfries were studied, drawn from the periods 1880-1889 and 1970-1979. Feighner criteria were applied to make three diagnostic categories - depression, mania and schizophrenia - and the occurrence and content of delusions were noted for each. A significant decline in the prevalence of delusional depressive illness was found between the two periods, and a similar trend was noted for delusional manic illness. In contrast, the prevalence of delusional schizophrenic illness was stable. The article traces history of treatment of the insane in private dwellings. The method started years ago at Gheel, Belgium, when the control and administration of the colony at Gheel passed from the Commune into the hands of the state. A few years later, after the Scottish Lunacy Act of 1857, numbers of the mentally ill were treated in private dwellings in Scotland. The system was soon adopted in other countries, but its most remarkable development is to be found in Germany, for, whereas in that country there were in 1882 but two small family-colonies for the insane with scarcely more than fifty patients, ten years later there were thirty-two colonies with 1200 patients, and at the end of 1906 there were fifty-one separate colonies with 2400 patients so treated.
