El presente libro aborda la importancia del acceso a la justicia como elemento fundamental de la organización política y recurso generativo para alcanzar un orden jurídico igualitario. Propone una concepción del Derecho como proceso que permite concebir en su complejidad el contenido y carácter multidimensional y dinámico del derecho de acceso a la justicia que, más allá de ser instrumento de actuación de la legalidad, adquiere un sentido ético como vía para la igualdad y la participación. La perspectiva de la desigualdad social estructural muestra en su complejidad las barreras que enfrentan los grupos sociales desfavorecidos, prestándose en esta obra especial atención al problema de la injusticia epistémica y las dificultades de representación de intereses colectivos como obstáculos sistémicos al acceso a la justicia. Se enfatiza el fundamento normativo del derecho al acceso a la justicia, basado en la idea de capacidades y otros conceptos relevantes de la teoría crítica de la justicia social como el reconocimiento, el derecho básico a la justificación, la no dominación o el empoderamiento jurídico. El libro contiene un análisis particularizado del que se puede considerar el supuesto más grave de falta de acceso a la justicia en nuestros días, el que sufren los migrantes forzosos en el marco de estructuras sociopolíticas globales que les hacen radicalmente vulnerables a la marginación ante el Derecho y restringen sus capacidades jurídicas.

This book examines in detail the state of the art on census taking to spark a more vivid debate on what some may see as a rather technical – and hence uncontroversial – field of inquiry.Against the backdrop of controversy between instrumental and performative theoretical stances towards census taking, it analyses the historical trajectories and political implications of seemingly technical decisions made during the quantification process by focusing on the 2020 round of censuses, which have been particularly revealing as activities have been affected by the ongoing COVID-19 pandemic and the ensuing containment policies. At the core of all societies and economies are human beings deploying their energies and talents in productive activities - that is, at work. The law governing human productive activity is a large part of what determines outcomes in terms of social justice, material wellbeing, and the sustainability of both. It is hardly surprising, therefore, that work is heavily regulated. This Handbook examines the'law of work', a term that includes legislation setting employment standards, collective labour law, workplace discrimination law, the law regulating the contract of employment, and international labour law. It covers the regulation of relations between employer and employee, as well as labour unions, but also discussions on the contested boundaries and efforts to expand the scope of some laws regulating work beyond the traditional boundaries. Written by a team of experts in the field of labour law, the Handbook offers a comprehensive review and analysis, both theoretical and critical. It includes 60 chapters, divided into four parts. In the light of intense international focus on ongoing forms of world poverty, this book examines the potential of the concept of recognition in contemporary political philosophy to respond morally to this dire condition.This book uses recognition theories to develop a two-tiered response to the problem of global poverty. First, it highlights non-degradation, non-humiliation and the avoidance of social suffering as essential components to the agency of the very poor. This runs counter to liberal arguments that focus only on the deficit of basic material interests. Second, even if universal conditions of agency are met, many of the world's extreme poor may still suffer domination. The book argues that empowering the world's poor to resist domination is an essential response to global poverty. By conceiving poverty in terms of agency and empowerment, this book highlights the transnational relevance of recognition theory to one of the most crucial problems affecting a rapidly globalising world.Global Justice and Recognition Theory will be of interest to scholars and advanced students working in social and political philosophy, political theory, and global justice.

This book draws on a detailed corpus analysis of fifth-century historiographical texts to explore the influence of the Iranian languages on the syntax of Armenian. While contact between the Iranian languages - particularly Parthian - and Armenian has been a fertile field of research for several decades, its effects on syntax have to date been somewhat neglected. Here, Robin Meyer argues that the Armenian periphrastic perfect construction with its unusual morphosyntactic alignment was created on the model of similar constructions in Parthian, along with a number of other syntagms. Unlike previous accounts, the language contact model presented in this book can explain all the idiosyncrasies of the construction, as well as its diachronic developments. The study also offers new insights into the historical social dynamics between Armenian and Parthian speakers, and suggests that the Parthians, who were the ruling class in the Armenian Kingdom for almost four centuries, eventually abandoned their native language.

The key to the phonetic development of a given word across time lies in its accentuation. As the Old Celtic remains do not indicate their accent, it has to be deduced from their sound-changes. This book investigates for the first time in depth 14 Celtic phenomena resulting from the weakening of unstressed syllables (vocalic assimilations and reductions up to syncope, degeminations, ‚w‘-loss, nasal effacement, metathesis of liquids) and the strengthening of stressed ones (vocalic epenthesis and diphthongizations, geminations of consonants). The stress-patterns emerging from them are corroborated by the originally Celtic toponymy in today's non-Celtic-speaking countries and allow us to reconstruct the Celtic subfamily of languages by drawing a much simpler accentual model which also finds typological support. With its diachronic discussion of more than 3,600 words the book represents, moreover, a big help in the understanding of Celtic lexicon and onomastics.

The gap between the rich and poor is widening across the globe. This book explores whether this major societal challenge of our time can be addressed by the means of competition law.The primary goal of today's competition law is to ensure that market power does not lead to an inefficient production of goods and services. Studying the Indo-European languages means having a privileged viewpoint on diachronic language change, because of their relative wealth of documentation, which spans over more than three millennia with almost no interruption, and their cultural position that they have enjoyed in human history. The chapters in this volume investigate case-studies in several ancient Indo-European languages (Ancient Greek, Latin, Hittite, Luwian, Sanskrit, Avestan, Old Persian, Armenian, Albanian) through the lenses of contact, variation, and reconstruction, in an interdisciplinary and intradisciplinary way. Kniha se věnuje charakteristice dvou jednotících prvků kaligrafie? motivu kruhu a spirály. Zkoumá především to, jak umění vyjadřuje ontologický význam tělesnosti a cirkularity těla prostřednictvím uvolnění malířského gesta, rozvíjení performativních projevů a fyzického propojení umělce s dílem. In the Iranic-Semitic-Turkic contact area, where many languages are described as verb-final, ‘Targets'(Goals, Recipients, etc.) tend to appear in the immediate postverbal position, a pattern violating the alleged ‘basic word order'. Investigating empirical material, the present volume examines the idea of its contact-induced origin by combining various languages from inside and outside this contact area: the Greek variety Romeyka; Indic Domari; Iranic Balochi, Kurdish, Middle Persian, Parthian, Bactrian and Sogdian; Nilotic Maa; Semitic Arabic and Aramaic; Siberian and Iran-Turkic. The contributors investigate word order variation of transitive, ditransitive, and copula structures as well as intransitives with Targets. Their analyses highlight the relevance of grammatical, discourse-pragmatic, and cognitive principles. The volume highlights the importance of Target structures for linguistic theory by offering new perspectives and will be of interest to typologists and linguists interested in word order variation and information structure.
