7. The Legal Metaverse and Comparative Taxonomy: A Reappraisal.

Abstract

The present Article revisits my "Three Patterns of Law: Taxonomy and Change in the World's Legal Systems"—published in this very Journal a quarter century ago—which acknowledged the ideological nature of the law versus politics distinction and posited taxonomy as a means for understanding law. The original article classified law into professional law, political law, and traditional law, and heralded the tentative and dynamic natures of such classification. The two purposes of the present Article are to (i) reflect on legal transformations that have since occurred as reactions to global geopolitical, technological, and economic changes, and (ii) interrogate whether epistemological assumptions that produced the Three Patterns of Law hypothesis still hold. The question the present Article poses is whether a fourth pattern of law is now necessary to capture the new technological state of affairs and the new geopolitical balances of power: in particular, should a rule of smart law be introduced? This Article surveys some of the relevant legal transformations capable of impacting the mapping of each legal pattern to a given geography. Because the Internet (like law, religion, tradition, or language) is an informative-normative system that has produced a new frontier of development, and because of its ubiquity, I have used it as a test for the current viability of the hypothesis. I conclude that it is too early to add a fourth pattern of law; but it is, perhaps, too late to avoid a pattern of no law taking over global hegemony by substituting algorithms for lawyers. Abstract

In different branches of the Dutch legal system, there are categories and rights that serve to protect specific commons through different methods. Sunlight and air (including wind for windmills) can be freely used by everyone. Waters in the sea and rivers are things under private law, but do not have any owner until water is extracted. The seabed of the territorial sea and the Wadden Sea are State-owned and cannot be alienated. State-owned markets, schools, and swimming pools are public things. The public may claim access to private roads. Certain privately owned forests are maintained, in return for tax benefits, in the public interest. Health care, food, education, housing, and environmental protection are protected commons. Nationalisation requires an expropriation unless the owner is willing to sell: property may be expropriated only if in the public interest and the owner is compensated. In private law, there are specific grounds on which a non-owner can claim access to somebody else’s land.

Abstract

This is a talk about the decline and fall of constitutional law, an overarching characteristic of the new millennium. I focus on the period from the end of the Cold War—once described as the end of history—to what I call the "Second Cold War" beginning in the second decade of this century and having escalated in the proxy war in Ukraine. The Second Cold War is also characterized by an aborted cooptation of China through the World Trade Organization (to tame China's seemingly unstoppable ascension to global supremacy) as well as a state of permanent emergency.
