This paper discusses the Italian trade union’s system and the finding about the distinct evolution of the Brazilian and Italian models. Despite both systems had a very similar model before the World War II, Italy has adopted a trade union’s system that respects the freedom in the collective labor relations. Even though the Italian adaptation was not easy they have been making changes for more than half a century searching to guarantee the freedom in the trade union’s system. Brazil will have to adopt a system that respects the freedom in collective labor relations and the Italian experience can be useful as inspiration for the necessary changes.

For lawyers, relating Law with Literature is important. The combination of these two elements makes it possible to erode juridical dogmas, to desacralize and restore the law to its own measure and to the measure of ethics. What literature actually teaches about the abstractly codified structure of law is the lack of general laws in lived experience. It follows that convictions, as well as acquittals, are inevitably imperfect: we are all in some way guilty, but also, from another perspective, we are all innocent. And if the decrees of absolute guilt prove to be inadequate in the works of Proust, Musil and Hofmannsthal, so does the universe of Kafka and Zola. To this first deconstruction of law is added a second, even more radical one, relative no longer to its limits, but to the very essence of law. The normative system cannot classify in its categories a human reality that escapes the pre-established order, but it also borders on criminal violence, although ambiguously it is located on the opposite pole. In this sense, the intersection between law and literature teaches that individual situations are always placed in that social, cultural, historical, economic kaleidoscope that conditions our acts no less than our will.

- Abstract
This book examines how the principle of ecological integrity in international law and governance can help address our current global crises. The principle of ecological integrity points to the basic foundations that must exist for life – all life – not only to exist but also to flourish. Ecological integrity, or well-being, cuts across legal and geopolitical spheres, insofar as it is the decisions within our systems of governance that determine the integrity of our various living systems. This book provides a comprehensive examination of how the principle of ecological integrity can help us respond to our current crises of global conflict and insecurity. Including chapters by both academics and practitioners and by both experienced and emerging authors, the book covers a range of contemporary issues – the climate crisis, war, the pandemic, food, and more – at the intersection of peace, public health, and global security. It will appeal to scholars across a range of fields, including law, sociology, political science, environmental studies, and public health.

- Abstract

The objective of this research was to verify the veracity of the information that the use of pesticides -brought about by the Green Revolution -is necessary to eliminate hunger on the planet and if the green revolution is in harmony with the Principle of Prohibition of Environmental Retraction. The methodology used was that of the deductive method: the means was used for the bibliographic research and for the purposes, the research was qualitative. The conclusion reached was that the use of agrochemicals in an indiscriminate manner has brought innumerable damages to the environment, causing environmental imbalance and the appearance ofinnumerable ills to the beings that inhabit the planet earth; so the green revolution, as conceived in Brazil, is at odds with the Principle of Prohibition of Environmental Retraction.

The present chapter focuses on the relation between climate change and the animal-based industries. Firstly, the contribution of food production is analysed. It is argued that the agriculture impacts on climate change in a very profound way, not only by causing the loss of biodiversity, but also by polluting the land and the air, with severe damages for the health and the environment. Secondly, will be analysed the contribution of livestock and the animal-based industries to the climate change. It is argued that the livestock and the meat’s industries have big economic interests in promoting meat consumption. This is why they credit the idea that eating meat is good for health. The aim of the present chapter is to stress the importance of a more responsive attitude towards meat’s consumption. The needed changes claim for a collaboration amongst different actors, breeders, manifacturers, retailers, in order to minimize the environmental damages.

Objective: To demonstrate that the effectiveness of the right to food is strictly dependent on the adoption of appropriate public policies, capable of guaranteeing conditions of transparency and information, and granting individuals and groups the possibility to participate in the taking of decisions. Next, the focus is on the role played by the courts to address the issue of legal consideration of this right. Methodology: The study methodology included the analysis of jurisprudence on the right to food, as well as the constitutional recognition of the right to food. Likewise, the position of the courts and the political aspect of the right to food were challenged. Results: It has often been discovered that people are not even aware of the possibility of using litigation as a tool to promote the realization of the right to food. As well as the lack of knowledge on the part of politicians to implement public policies to realize this essential right to food. Contributions: The main contribution lies in realizing that it is not at stake or in the recognition of this right by the courts. While it is true that the role of the courts is essential because it facilitates the creation of a cultural climate sensitive to human rights, it is also true that the implementation of rights through jurisprudence means that the problem of access to justice is resolved. KEYWORDS: Fundamental rights; right to food; food sovereignty; legal consideration (justiciability); comparative law.

The legal nature of the consent for medical treatment is analyzed in a comparative perspective between the Italian and Brazilian experiences from the evidence of their analogies and differences. The debate developed on the topic has raised the attention that, in both cases, the respective legal systems are directed to the autonomy of the patient. But in Italy, unlikely to what occurs in Brazil, normative definitions offer significant openings to the freedom of choice of the patient, who may also choose not to be treated. In contrast, the Brazilian system brings respect to life as a basilar principle, imposing on the physician to intervene, thus limiting the patient’s proclaimed autonomy. Keywords: Medical-surgical activity, patient autonomy, dignity, consent by medical act.
