6. Teamsters of Local 705 Win Racial Discrimination Lawsuit Against DHL.
- Abstract
Teamsters of Local 705 have won an $8.7 million racial discrimination lawsuit against DHL Express. The lawsuit, filed in 2010 by the US Equal Employment Opportunity Commission (EEOC), revealed that DHL subjected Black Teamsters in Chicago to different and less desirable job assignments compared to white employees. DHL has violated Title VII of the 1964 Civil Rights Act by determining job assignments based on race. As part of the settlement, DHL has entered into a consent decree with the federal government, and a monitor has been appointed to oversee the implementation of the decree's terms. 8. UAW to Pursue Campaign in South, Despite Loss.
- Abstract
The article discusses three separate topics. Firstly, it mentions the United Auto Workers (UAW) continuing its campaign in the South, despite a recent election loss at the Mercedes-Benz plant in Alabama. The defeat was attributed to aggressive anti-union activity by Mercedes bosses, including captive-audience meetings and worker threats. Secondly, the article highlights doctors employed by Delaware's ChristianaCare petitioning to unionize, citing concerns about overwork and understaffing. This would be the first union in ChristianaCare's history. Lastly, the article reports on Teamsters Local 705 winning an $8.7 million racial discrimination lawsuit against DHL Express, with evidence of unequal treatment and job assignments based on race. The settlement includes a consent decree and the appointment of a monitor to oversee DHL's compliance. [Extracted from the article]

BACKGROUND: Personal care products (PCPs) are exposure sources to phthalates and parabens; however, their contribution to men's exposure is understudied. OBJECTIVES: We examined the association between PCP use and urinary concentrations of phthalate metabolites and parabens in men. METHODS: In a prospective cohort, at multiple study visits, men self-reported their use of 14 PCPs and provided a urine sample (2004-2015, Boston, MA). We measured urinary concentrations of 9 phthalate metabolites and methylparaben, propylparaben, and butylparaben. We estimated the covariate-adjusted percent change in urinary concentrations associated with PCP use using linear mixed and Tobit mixed regressions. We also estimated weights for each PCP in a weighted binary score regression and modeled the resulting composite weighted PCP use. RESULTS: Four hundred men contributed 1,037 urine samples (mean of 3/man). The largest percent increase in monoethyl phthalate (MEP) was associated with use of cologne/perfume (83%, p-value<0:01) and deodorant (74%, p-value<0:01). In contrast, the largest percent increase for parabens was associated with the use of suntan/sunblock lotion (66-156%) and hand/body lotion (79-147%). Increases in MEP and parabens were generally greater with PCP use within 6 h of urine collection. A subset of 10 PCPs that were used within 6 h of urine collection contributed to at least 70% of the weighted score and predicted a 254-1,333% increase in MEP and parabens concentrations. Associations between PCP use and concentrations of the other phthalate metabolites were not statistically significant. CONCLUSIONS: We identified 10 PCPs of relevance and demonstrated that their use within 6 h of urine collection strongly predicted MEP and paraben urinary concentrations [ABSTRACT FROM AUTHOR]

Delivery company DHL has agreed to pay $8.7 million to settle a racial discrimination lawsuit filed by 83 Black employees in Chicago. The lawsuit alleged that DHL gave Black workers more dangerous assignments and segregated them from their White colleagues. This is not the first time DHL has faced allegations of racial bias, as the company settled a similar lawsuit last year. As part of the settlement, DHL will be monitored by a court-appointed monitor for four years and must provide training on federal laws prohibiting racial discrimination. The Equal Employment Opportunity Commission (EEOC) emphasized that segregating employees and giving them unequal work assignments based on race is unlawful. [Extracted from the article]

- Abstract
With a foreword by Jennifer Richmond-Bryant In October 1948, a seemingly average fog descended on the tiny mill town of Donora, Pennsylvania. With a population of fewer than fifteen thousand, the town's main industry was steel and zinc mills—mills that continually emitted pollutants into the air. The six-day smog event left twenty-one people dead and thousands sick. Even after the fog lifted, hundreds more died or were left with lingering health problems. Donora Death Fog details how six fateful days in Donora led to the nation's first clean air act in 1955, and how such catastrophes can lead to successful policy change. Andy McPhee tells the very human story behind this ecological disaster: how wealthy industrialists built the mills to supply an ever-growing America; how the town's residents—millworkers and their families—willfully ignored the danger of the mills'emissions; and how the gradual closing of the mills over the years following the tragedy took its toll on the town.

- Abstract
Health is political. It entails fierce battles over the allocation of resources, arguments over the imposition of regulations, and the mediation of dueling public sentiments—all conflicts that are often narrated from a national, top-down view. In All Health Politics Is Local, Merlin Chowkwanyun shifts our focus, taking us to four very different places—New York City, Los Angeles, Cleveland, and Central Appalachia—to experience a national story through a regional lens. He shows how racial uprisings in the 1960s catalyzed the creation of new medical infrastructure for those long denied it, what local authorities did to curb air pollution so toxic that it made residents choke and cry, how community health activists and bureaucrats fought over who'd control facilities long run by insular elites, and what a national coal boom did to community ecology and health. All Health Politics Is Local shatters the notion of a single national health agenda. Health is and has always been political, shaped both by formal policy at the highest levels and by grassroots community battles far below.

- Abstract
These volumes make new contributions to the history of psychiatry and society in three ways: First, they propose a theory of values and ideology influencing the evolution of psychiatry and society in recurring cycles, and survey the history of psychiatry in recent centuries in light of this theory. Second, they review the waxing, prominence, and waning of Community Mental Health as an example of a segment of this cyclical history of psychiatry. Third, they provide the first biography of Erich Lindemann, one of the founders of social and community psychiatry, and explore the interaction of the prominent contributor with the historical environment and the influence this has on both. We return to the issue of values and ideologies as influences on psychiatry, whether or not it is accepted as professionally proper. This is intended to stimulate self-reflection and the acceptance of the values sources of ideology, their effect on professional practice, and the effect of values-based ideology on the community in which psychiatry practices. The books will be of interest to psychiatric teachers and practitioners, health planners, and socially responsible citizens.

- Abstract
In When the Air Became Important, medical historian Janet Greenlees examines the working environments of the heartlands of the British and American cotton textile industries from the nineteenth to the late twentieth centuries. Greenlees contends that the air quality within these pioneering workplaces was a key contributor to the health of the wider communities of which they were a part. Such enclosed environments, where large numbers of people labored in close quarters, were ideal settings for the rapid spread of diseases including tuberculosis, bronchitis and pneumonia. When workers left the factories for home, these diseases were transmitted throughout the local population, yet operatives also brought diseases into the factory. Other aerial hazards common to both the community and workplace included poor ventilation and noise. Emphasizing the importance of the peculiarities of place as well as employers'balance of workers'health against manufacturing needs, Greenlees's pioneering book sheds light on the roots of contemporary environmentalism and occupational health reform. Her work highlights the complicated relationships among local business, local and national politics of health, and community priorities.

- Abstract
The climate change reckoning looms. As scientists try to discern what the Earth's changing weather patterns mean for our future, Rachel Rothschild seeks to understand the current scientific and political debates surrounding the environment through the history of another global environmental threat: acid rain. The identification of acid rain in the 1960s changed scientific and popular understanding of fossil fuel pollution's potential to cause regional—and even global—environmental harms. It showed scientists that the problem of fossil fuel pollution was one that crossed borders—it could travel across vast stretches of the earth's atmosphere to impact ecosystems around the world. This unprecedented transnational reach prompted governments, for the first time, to confront the need to cooperate on pollution policies, transforming environmental science and diplomacy. Studies of acid rain and other pollutants brought about a reimagining of how to investigate the natural world as a complete entity, and the responses of policy makers, scientists, and the public set the stage for how societies have approached other prominent environmental dangers on a global scale, most notably climate change. Grounded in archival research spanning eight countries and five languages, as well as interviews with leading scientists from both government and industry, Poisonous Skies is the first book to examine the history of acid rain in an international context. By delving deep into our environmental past, Rothschild hopes to inform its future, showing us how much is at stake for the natural world as well as what we risk—and have already risked—by not acting.

- Abstract
'The Cotton Dust Papers'is the story of the 50-year struggle for recognition in the U.S. of this pernicious occupational disease. The authors contend that byssinosis could have and should have been recognized much sooner, as a great deal was known about the disease as early as the 1930s. Using mostly primary sources, the authors explore three instances from the 1930s to the 1960s in which evidence suggested the existence of brown lung in the mills, yet nothing was done. What the story of byssinosis makes clear is that the economic and political power of private owners and managers can hinder and shape the work of health investigators.

NEW YORK TIMES BESTSELLER | Winner of the 2018 PEN/ESPN Award for Literary Sports Writing | Winner of The Times Sports Biography of the Year | The definitive biography of an American icon, from a best-selling author with unique access to Ali's inner circle. “As Muhammad Ali's life was an epic of a life so Ali: A Life is an epic of a biography... for pages in succession its narrative reads like a novel––a suspenseful novel with a cast of vivid characters.” –– Joyce Carol Oates, New York Times Book ReviewMuhammad Ali was born Cassius Clay in racially segregated Louisville, Kentucky, the son of a sign painter and a housekeeper. He went on to become a heavyweight boxer with a dazzling mix of power and speed, a warrior for racial pride, a comedian, a preacher, a poet, a draft resister, an actor, and a lover. Millions hated him when he changed his religion, changed his name, and refused to fight in the Vietnam War. He fought his way back, winning hearts, but at great cost.Jonathan Eig, hailed by Ken Burns as one of America's master storytellers, sheds important new light on Ali's politics, religion, personal life, and neurological condition through unprecedented access to all the key people in Ali's life, more than 500 interviews and thousands of pages of previously unreleased FBI and Justice Department files and audiotaped interviews from the 1960s. Ali: A Life is a story about America, about race, about a brutal sport, and about a courageous man who shook up the world.

BRITISH SPORTS BOOK AWARDS SPORTS BOOK OF THE YEAR. SHORTLISTED FOR THE WILLIAM HILL SPORTS BOOK OF THE YEAR PRIZE 2017. SHORTLISTED FOR THE JAMES TAIT BLACK BIOGRAPHY OF THE YEAR. WINNER OF THE PEN/ESPN AWARD FOR LITERARY SPORTS WRITING. THE TIMES SPORTS BOOK AWARDS BIOGRAPHY OF THE YEAR. The most comprehensive and definitive biography of Muhammad Ali that has ever been published, based on more than 500 interviews with those who knew him best, with many dramatic new discoveries about his life and career. When the frail, trembling figure of Muhammad Ali lit the Olympic flame in Atlanta in 1996, a TV audience of up to 3 billion people was once again gripped by the story of the world's most famous sporting icon. The man who had once been reviled for his refusal to fight for his country and for his fast-talking denunciation of his opponents was now almost universally adored, the true cost of his astonishing boxing career clear to see. In Jonathan Eig's ground-breaking biography, backed up with much detailed new research specially commissioned for this book, we get a stunning portrait of one of the most significant personalities of the second half of the twentieth century. We are not only taken inside the ring for some of the most famous bouts in boxing history, we also learn about his personal life, his finances, his faith and the moments when the first signs of his physical decline began to show. Ali was a symbol of freedom and courage, a hero to many, but this is also a very personal story of a warrior who vanquished every opponent but was finally brought down by his own stubborn refusal to quit. An epic tale of a fighter who became the world's most famous pacifist, Ali: A Life does full justice to an extraordinary man.‘Ali: A Life is the business – 640 pages of patient scholarship and intelligent reassessment written in crackly prose'Giles Smith, The Times ‘[A] richly researched, sympathetic yet unsparing portrait... - Abstract
A tremendously insightful biography of the man who helmed the Velvet Underground and single-handedly created alternative rock This book covers not only the highlights of Reed's career, but explores lesser-known facets of his work, such as his first recordings with doo-wop group the Jades, his key literary influences, the impact of Judaism upon his work, and his engagement with the LGBT movement. Drawing from original interviews with many of his artistic collaborators, friends, and romantic partners, as well as from archival material, concert footage, and unreleased bootlegs of live performances, Dirty Blvd. exposes the man behind the myth, the notoriously uncompromising rock poet who wrote songs that transcended their genre and established himself as one of the most influential and enigmatic American artists of the past half century.

- Abstract
Hugh J. Silverman was an inspiring scholar and teacher, known for his work engaging and shaping phenomenology, hermeneutics, psychoanalysis, structuralism, poststructuralism, and deconstruction. As Professor of Philosophy and Comparative Literary and Cultural Studies at Stony Brook University, State University of New York, Silverman's work was marked by'the between,'a concept he developed to think the postmodern in the space between philosophy and non-philosophy. In this volume, leading scholars explore and extend Silverman's philosophical contributions, from reflections on the notions of care, time, and responsibility, to presentations of the practices and possibilities of deconstruction itself. They provide an assessment of Silverman's life and work at the intersection of philosophy, ethics, and politics.

TABLE OF CONTENTS I. INTRODUCTION 325 II. SAMPLE AND LIMITATIONS 328 III. CHOICE-OF-LAW CLAUSES IN INTERNATIONAL SUPPLY CONTRACTS 330 A. Background 330 B. Empirical Results: Provisions in Choice-of-Law Clauses 333 [...], International transactions present unique legal risks. When a contract touches several different nations, a party may not know where it will be called upon to defend a lawsuit or, alternatively, which nation's law will be applied to resolve that dispute. To mitigate these risks, parties will often write dispute resolution provisions into their contracts. Arbitration clauses and forum selection clauses help to reduce uncertainty relating to the forum. Choice-of-law clauses help to reduce uncertainty as to the governing law. Over the past few decades, such provisions have become commonplace in international contracting. And yet there exist vanishingly few empirical studies exploring the use of these provisions in international commercial agreements. This Article aspires to fill this gap. Drawing upon a hand-collected dataset of 157 international supply agreements, it describes the ways in which large corporations seek to mitigate their risk in international transactions via dispute resolution clauses. The Article first provides a thorough descriptive account of choice-of-law clauses in these agreements to illustrate the myriad ways these clauses do and do not mitigate legal risk. It then undertakes the same project with respect to arbitration clauses and forum selection clauses, paying careful attention to the ways in which actual practice deviates from the model forms promulgated by arbitration groups, to show how these clauses mitigate forum risk. While the primary objective of the Article is descriptive rather than normative--it seeks to describe the contents of agreements that have heretofore been largely ignored by legal scholars--it also discusses the normative implications of its descriptive account for three groups. First, legal scholars may draw upon this account to better understand how contract boilerplate evolves and changes over time. Second, judges called upon to interpret a contract may utilize this account to determine whether a phrase is typically included in clauses of a given type. Third, and finally, contract drafters may glean useful insights into how to craft dispute resolution provisions that maximize the reduction in uncertainty in international contracting.
