Marketing products/services internationally entails a bold decision that has high-cost implications and significant performance consequences: Should the firm standardize or adapt its marketing strategy across borders? The dilemma is a seminal issue, and perhaps the most enduring in international marketing scholarship. However, despite the voluminous work on the topic, an ontological assumption induces inconclusive conceptualizations and impedes theoretical advancement. The author contends that a self-contained, atomistic representation of the standardization/adaptation decision is such an impediment. This work problematizes a portrayal of the decision as if it is taken following a detached, own judgment of broad environmental contingencies. In turn, the study builds on fit literature and promotes an alternative perspective that acknowledges relational imperatives for requisite theorizing. Hence, standardization/adaptation is framed as a coconstituted process toward relational fit, with international marketing strategies being contingent on the role of significant "others." The spotlight has recently been shone on the statutory duties of directors of companies in financial distress in Australia and New Zealand. In Australia, the 2023 Report on Corporate Insolvency noted concerns about the efficacy of the Australian insolvent trading regime and mooted the possibility of Australia adopting the United Kingdom ‘wrongful trading’ standard. In August 2023 the New Zealand Supreme Court delivered a much-anticipated judgment in Yan v Mainzeal Property and Construction Limited (in liq) focusing on the equivalent reckless trading duties, prompting the question of whether the New Zealand approach may offer useful insights for Australia and the United Kingdom. This paper provides a comparative analysis of the ‘insolvent trading’ provision in Australia, the ‘wrongful trading’ provision in the United Kingdom, and the ‘reckless trading’ provisions in New Zealand, considering these provisions against the backdrop of related statutory provisions and broader policy considerations and objectives. ABSTRACT Background Aims Methods Results Conclusions With the increasing demand for cosmetic procedures in recent years, the implementation of some of these procedures by unauthorized persons has led to undesirable results and subsequently to the creation of a large number of case files.In this study, it is aimed to retrospectively evaluate the decision texts of the Turkish Supreme Court regarding minimally invasive cosmetic dermatology procedures and to evaluate the reasons and results of the applications reaching the high court in these procedures.The Supreme Court's decisions in cases filed due to undesirable consequences caused by minimally invasive cosmetic interventions were scanned using the Supreme Court of Appeals' online database from 2013 to 2023.The majority of the procedures addressed by the lawsuits are carried out in beauty salons; laser epilation is the procedure that is conducted most frequently, and burns are the most prevalent complication (87.8%, 85.7%, and 77.6%, respectively). As an adverse event, 94.7% (n = 36) of burns occurred in beauty centers. Thirteen (26.5%) of the cases in our analysis were carried out by an unauthorized person. When laser epilation and other procedures are considered as two separate categories, in applications due to adverse events of laser epilation, 28 (66.7%) cases were concluded in favor of the defendant.Complications, especially burns, that occur after laser epilation performed by unauthorized persons in beauty salons constitute a serious caseload, and there seems to be a need for better control mechanisms to reduce this burden. Information on the psychological mechanisms behind people's perceptions of robot judges in the courtroom is limited. We aimed to determine whether perceptions of empathy increase people's trust in robot judges and whether this trust influences people's evaluation of judgments by a robot judge and their acceptance of such judges in the courtroom. We conducted a web-based randomized experiment on December 27, 2022 with 738 Japanese participants aged 18 years or older. Participants viewed one of four short clips and completed a questionnaire. Data from 531 individuals were included in the analysis. Results showed that perception of the judge's empathy increased trust in that judge and impacted the judgment evaluation. Overall, participants perceived the human judge as significantly more empathetic than the robot judge. A perception of empathy from the robot judge was associated with a higher rate of accepting a robot judge in the courtroom via trust in that judge. [ABSTRACT FROM AUTHOR]

In Chile, university administrators may appeal to a secondary agency to challenge the accreditation decisions of the primary national accreditation agency. The study analyzes the appeal judgments, using an empirical approach to identify arguments used by the secondary agency to justify its decisions. The analyses identify several factors, such as improvements since the last accreditation, faculty productivity, and financial standing, as the most relevant predictors of appeal success. The appellate agency, however, tends to emphasize the absence of deficiencies or weaknesses associated with these factors when it grants an appeal, sidestepping the primary agency’s criteria and standards for accreditation. Such an approach may be appropriate given the heterogeneous landscape of the Chilean higher education system, providing leeway to drive excellence in more selective institutions while maintaining some minimum standards in less selective ones. This article explores different interpretations of Kant's transcendental idealism, with a focus on Anja Jauernig's intentional object interpretation of Kantian appearances. Jauernig argues that intentional objects, which exist only as the contents of mental states, can explain the mind-dependence of appearances without making them purely subjective. The article also delves into the concept of representational content and its role in understanding Kant's account of appearances. The author agrees with Jauernig's distinction between empirically real objects and non-existent intentional objects, but questions how this can be the case if appearances are merely intentional objects. The article concludes by discussing the challenges of reconciling an intentional object view with contingently undiscovered truths and understanding perceptual states that are both intentional and a function of things as they are in themselves. There are examples of how unconscious bias can influence actions of people. In the judiciary, however, despite some examples there is no general theory on whether different demographic attributes such as gender, seniority or ethnicity affect case sentencing. We aim to gain insight into this issue by analyzing over 100k decisions of three different areas of law with the goal of understanding whether judge identity or judge attributes such as gender and seniority can be inferred from decision documents. We find that stylistic features of decisions are predictive of judge identities, their gender and their seniority, a finding that is aligned with results from analysis of written texts outside the judiciary. Surprisingly, we find that features based on legislation cited are also predictive of judge identities and attributes. While own content reuse by judges can explain our ability to predict judge identities, no specific reduced set of features can explain the differences we find in the legislation cited of decisions when we group judges by gender or seniority. Our findings open the door for further research on how these differences translate into how judges apply the law and, ultimately, to promote a more transparent and fair judiciary system. The U.S. Supreme Court has heard several cases regarding special education. These cases have resulted in decisions that have addressed issues involving special education programming and procedural issues. On March 21, 2023, the U.S. Supreme Court issued a unanimous ruling in Perez v. Sturgis Public Schools. This decision, which was the most recent special education case heard by the highest court in the United States, involved litigation in special education. In this brief article, we address the Supreme Court's decision in Perez by (a) examining the background of the case, (b) reviewing the decision by the lower courts and the U.S. Supreme Court, and (c) discussing the implications of the case for special educators. Can a constitution be treated as a recommendation rather than as binding and entrenched law? I argue that the answer to that question is Yes. With respect to the constitution in gross, that is, the total set of general provisions setting out both the structures of governance and the basic rights the constitution protects, the constitution as recommendation can serve as a focal point for ordinary political contestation which, because it unfolds in real time and is conducted by actors with limited time and energy for such contestation, occurs within (largely) settled institutional forms. With respect to the constitution in detail, that is, brought to ground in judicial judgments in contested cases, the answer is more complicated. Ordinarily treating judicial judgments as recommendations is a prescription for instability (and for that reason inconsistent with the idea of institutional settlement). If the target of such a judgment makes a considered judgment that instability is worth it, the target is raising questions about the continuing value of remaining in the particular polity within which the principle of institutional settlement holds sway. The article deals with a court ruling that concerns the duty of doctors to inform patients about treatment alternatives. According to the ruling, doctors must inform patients about significant differences between different treatment methods, especially about specific risks associated with a particular method. In the present case, a doctor was sued because he did not sufficiently inform the patient about an alternative surgical method that carried a lower risk of complications. The court ruled that the doctor had violated the duty to inform and that the patient was entitled to compensation. The plaintiff is demanding compensation for pain and suffering as well as damages from the defendants due to a faulty and inadequately informed vaccination against the coronavirus SARS-CoV-2. The defendants are doctors in a joint practice. The district court granted the plaintiff's declaratory action, but set the amount of compensation too high. The higher regional court considers a compensation amount of €22,000 to be appropriate. The assumption of liability by the state excludes direct claims against the vaccinating doctor. This article examines the legitimacy and rationale of the Joint Criminal Enterprise (JCE) principle in international criminal law, focusing on the implications of the UK Supreme Court's decision in R v Jogee, which fundamentally abolished JCE as a legal principle. JCE, characterized by its complexity and contentious nature, has been criticized for being driven more by policy considerations than legal precedents. The article first explicates the concept and evolution of JCE, including common purpose liability and parasitic accessorial liability, and highlights the irrationalities within these principles. Through an in-depth analysis of the R v Jogee decision, the author argues that the ruling successfully rectified residual errors in criminal law, deeming the abolition of JCE consistent with legal logic and tradition. The article concludes with recommendations for enhancing transparency and clarity in prosecution and sentencing processes to restore public confidence in the criminal justice system. It discusses the author's claims regarding constitutional interpretation in relation to the Supreme Court decision in the 1964 libel case "New York Times" v. Sullivan that favored the newspaper. This case review considers Theis J's judgment in Re Z (Surrogacy: Step-parent Adoption) [2024] EWFC 20, in which she refused a step-parent adoption order but made several other orders in relation to contact and the exercise of parental responsibility between the three adults involved. I posit that while the judgment probably represents the best possible outcome all round – especially the best interests of the child at its heart – it does not reflect the lived reality of most surrogacy agreements entered into in this country, or the experiences of those involved. It does, however, indicate that proposed reforms as recommended by the Law Commission of England and Wales and the Scottish Law Commission in 2023 would be welcome, especially as the intention behind them is precisely to protect against breakdowns in surrogacy arrangements such as sadly happened in this case. The identification of the scope of the limited property law (that is transmission easement), as well as the taking of appropriate actions, has become difficult. The far from sufficient implementation of rules has led to numerous disputes, the resolution of which has been sought in court. Very generalized legal bases, interpretation of regulations and the acceptance of the rulings of common courts have made the development of operating procedures possible and have determined the persons participating in performing work related to transmission easement. The specifics and the multidimensionality of the subject requires cooperation from several experts. The methodological bases are limited, and the regulations unclear. The goal of the research is the standardization of designations of component parts and activities associated with transmission easement. The entire process is made easier by a set procedure proposed in the form of an outline. This study draws attention to individual activities and the order in which they are performed. This allows individual specialists to carry out the next stages of work, which in turn leads to sanctioning the rights of the grantee, while determining fair and satisfactory compensation for the grantor. This article provides an overview of the most relevant cases decided by the Court of Justice of the European Union concerning contract law. This study aimed to systematically investigate the effects of event intensity and frequency on the judgment of procedural justice in fair and unfair situations. Data were collected using Qualtrics online survey questionnaires from 420 employees across different industries in the United States. Participants were randomly assigned to one of three frequency conditions (high, medium, and low), and within each frequency condition, two conditions of event intensity (high and low) were applied. Additionally, participants were randomly assigned to either fair or unfair situations. The findings indicated that frequent exposure to fair procedures had a positive impact on perceived procedural justice, underscoring the significance of maintaining fair practices for employee perceptions of justice. Conversely, the intensity of the event significantly influenced judgments of procedural justice. Unfair procedures in high-importance events could negatively affect employees' perceptions of procedural justice. The study also revealed that specific combinations of procedural justice rules seemed to be applied based on the interaction of fairness, frequency, and intensity. Based on these findings, managers and supervisors should not overlook seemingly insignificant daily practices, as their cumulative effect can significantly affect employee perceptions of procedural justice. As an alternative to traditional court litigation, arbitration has gained prominence in Jordan's legal landscape for its distinct attributes like speediness, confidentiality, autonomy, and efficiency. Central to the sanctity of this mechanism is the arbitrator's duty of disclosure, ensuring that the arbitration process remains impartial, transparent, and devoid of any potential bias. This paper explores the profound significance of the duty of disclosure in Jordan by analyzing the latest Jordanian Court of Cassation Decision No. 1479 of 2023, where nondisclosure by the Arbitral Tribunal led to the annulment of the arbitral award. Through juxtaposing international arbitration norms and thoroughly examining Jordanian legislation, this study underscores the consequences of nondisclosure and the paramount importance of transparency in arbitration. The insights drawn from this case reaffirm that the foundation of arbitration's credibility and trustworthiness rests on the rigorous adherence of arbitrators to disclosure, ensuring that justice is not only served but is transparently perceived. On 30 March 2023, the International Court of Justice rendered its judgment on the merits of the case concerning Certain Iranian Assets , in which the Iranian central bank was not characterized as a company within the meaning of the Treaty of Amity. In so concluding, the Court relied upon the test focusing on the central bank's sovereign functions and the purposes of the transaction at stake. Debate surrounds the origin and sources of inspiration of the sovereign function test, insofar as the majority's minimum reasoning leaves an impression that it arose from thin air. This article explores the origin and the sources of inspiration of the test, concluding that the Court's judgment affords the reading that the test was inspired, albeit clandestinely, by rules and practice specifically dedicated to the characterization of central bank activities, located in areas such as the laws of State immunity or responsibility, by judicial cross-referencing. As concerns for reproductive rights continue to be debated across the United States, the June 24th, 2022, U.S. Supreme Court ruling in the Mississippi case of Dobbs v. Jackson Women's Health Organization that overturned Roe v. Wade essentially upended the disciplinary foundations and ethical underpinnings of helping professions. The Council on Social Work Education (CSWE) does not mandate the integration of reproductive justice content in social work education. And yet, threats to bodily autonomy burgeon across the United States prior to and after the dismantling of Roe v. Wade, affecting the populations social workers serve. The time has come to talk about, not around, reproductive justice in social work education as well as how social workers are being subverted from using their professional training and ethical commitment to clients. Meta-session autoregulation, a person-adaptive exercise programming approach, is characterized by individuals' matching exercise demands specifically to their current readiness states. Some consumer wearables provide 'recovery' or 'readiness' scores, computed primarily based on heart rate variability. Despite the growing popularity of consumer wearables and interest in person-adaptive programming, limited research exists on how exercisers interact, interpret and use these scores. This study explores individuals' experiences with wearable devices and their associated readiness or recovery scores. Seventeen regular exercisers who owned and used a Whoop™ band or Oura™ ring for at least 3 months participated in a one-on-one virtual semi-structured interview. Interviews were analyzed using reflexive thematic analysis, with themes supported by 'in-vivo' quotes. This paper focuses on three key themes for a comprehensive demonstration. Theme 1, 'It's more about how I can make adjustments to optimize my programming,' (MPR) highlights users' intended use of wearables for guiding training decisions. Theme 2, 'So many things outside of training modifications have changed,' (Misty) reveals that users also modify non-exercise behaviors to manage and optimize their scores. Theme 3, 'You can't really capture the complexities of a human on a device' (Letty) underscores users' recognition of the limitations and errors associated with these devices emphasizing self-reliance to further direct behavioral adjustments. While wearable devices provide a numeric approach to measuring readiness and recovery, users prioritize self-awareness, flexibility, and personal judgment for exercise decisions. An economic model of news contends that the pressures of limited column space and market competition force media actors to be strategic concerning which notable events receive exhaustive coverage, if any at all. Applying this framework to the Supreme Court can explain why coverage of the Justices' decision-making has historically been sensationalized and reserved for decisions sure to have a pronounced effect on public discourse. However, the emergence of social media as a practical alternative for mass media dissemination raises notable questions, chief among them being whether the economic framework fully extends to this newer medium. In this study, I analyze media coverage of the Court's decisions using Twitter and observe important distinctions among environments for news dissemination. I argue that the apparent reduction in the economic costs associated with coverage dissemination and consumption on social media platforms like Twitter requires viewing Supreme Court news in these environments through an amended theoretical framework. In examining public evaluations of governing institutions, are job approval and legitimacy related? This question has dominated scholarship on Supreme Court legitimacy for decades. Conventional wisdom suggests that specific support (e.g., job approval) and diffuse support (e.g., legitimacy) are independent. Specific support captures short-term orientations based on policy alignment with the Court. Legitimacy is a long-term perspective reflecting more fundamental support for the Court as a governing institution. We challenge the paradigm that job approval and legitimacy are largely unrelated concepts. Specifically, we employ a variety of statistical techniques and panel data to show that changes in legitimacy are a direct effect of changes in public approval. Salient decisions and Court vacancies directly shape approval and indirectly shape legitimacy through their effects on approval. Longitudinal analysis confirms that changes in job approval precede and predict changes in legitimacy. These results suggest that the Court needs public approval, and its public approval is rooted in outcome-oriented perceptions of its decisions and membership. Further, sustained low levels of approval will eventually erode legitimacy and limit the Court's influence over policy. Thus, like the outwardly political executive and legislative branches, it is important for the Court to build political capital through job approval. [ABSTRACT FROM AUTHOR]

Recent research shows that many people support courts based on their ideological congruence with those courts and their decisions. But people likely hold varying degrees of intensity in their preferences for judges who will implement conservative or liberal policy. We suspect that court support is a function of that intensity. Our results agree. Court support turns on the intensity with which people prefer conservative, moderate, or liberal judges. In fact, accounting for the strength with which people prefer ideological judges explains more of their support for courts than some existing approaches. [ABSTRACT FROM AUTHOR]

Between 2017 and 2022, the U.S. Supreme Court examined three cases that involved states that tried to limit the use of public money to support religious-affiliated schools. The Supreme Court found a violation of the Free Exercise Clause in all three cases. Although not the focus of the Court's opinions, these cases may have created avenues for discriminatory practices in publicly funded state school voucher programs. In elevating free-exercise rights above Establishment Clause concerns, the Court's decisions may have serious implications for students' civil rights in schools. This article specifically examines whether the growth of school voucher programs in the context of these recent Supreme Court decisions creates a pathway for racial discrimination in participating voucher schools. We first explore the impact of the three Supreme Court decisions. Specifically, we argue that when the Court eliminated distinctions between policies denying funding because of religious status and policies denying funding for religious uses and when it elevated free-exercise arguments, it may have opened additional avenues for discrimination. Thus, we next address whether participating voucher schools can refuse admission to Black students. To set the context for this discussion, we provide a brief historical analysis of case law that has previously supported race-based discrimination on religious grounds. We show that although past court cases and federal tax policy have created a bulwark against such discrimination, the recent rulings favoring free exercise rights raise concerns. If free-exercise rights trump civil rights, some voucher statutes may create an alternative funding stream for modern-day "segregation academies." [ABSTRACT FROM AUTHOR]

The high-level Reykjavík Declaration (2023) recognises the importance of local authorities (the lowest tier of administration within a state) for the functioning of the European Convention on Human Rights (ECHR) system. This article seeks to provide a better understanding of the human rights role of local authorities and the potential of the European Court of Human Rights (ECtHR) as a promoter of this role. It examines how local authorities appear in the judgments of the ECtHR and assesses the extent to which they provide clear pictures of local authorities and their role in human rights issues. The analysis draws on a close reading of a sample of cases encompassing a diverse set of states and human rights issues. It shows how the ECtHR's reasoning indicates what is required of a local authority for a specific set of circumstances, but also the general attributes of local authorities that are conducive to the provision of human rights. For judgments of the ECtHR to promote local authorities as human rights actors, local authorities and their interlocutors need to be able to identify the judgments and the elements of reasoning therein that are of most relevance for their circumstances. Since the Supreme Court ruling in Miller banning mandatory juvenile life without parole (JLWOP) sentences, many states have gone one step further and completely eliminated JLWOP sentences. However, this trend has stagnated. One potential reason is society's "tough on crime" framework, which legislators are hesitant to deviate from. To understand public opinion on adolescent adolescent development and sentencing of youth, we surveyed residents in one state considering legislation that would ban JLWOP and similar sentences, Michigan. Most participants had sufficient understanding of adolescent development and viewed adolescents as having the capacity for change. Additionally, most participants supported alternative sentences to JLWOP, with support primarily given to sentences that were rehabilitative in nature. Our results can help policymakers better understand their constituents' beliefs regarding adolescent sentencing, which can inform policy decisions. [ABSTRACT FROM AUTHOR]

Recent case-law has been analyzed and interpreted, with a close focus on Italian Supreme Court ruling n. 38162, issued on 30th December 2022 and European Court of Human Rights (ECtHR) rulings issued over the past decade. Uncertainty and ill-defined norms and court rulings risk harming the rights of children, surrogate mothers and intended parents. So far, court decisions have somehow filled the legal vacuum, considering that cross-border surrogacy is not specifically regulated in many countries and the status of children born abroad is still controversial. The views and judgments of supranational courts on the issue need to be accounted for when drafting new specific legislation. It is of utmost importance to uphold the rights of children born through surrogacy abroad, whose best interests risk being damaged. Legislative harmonization at the international level is essential to prevent the cross-border surrogacy trend. This article scrutinizes the strategic legal and political actions taken by gender‐critical feminist (GCF) scholars and activists aimed at curtailing protections afforded under existing equality law and criminal justice policies that safeguard transgender individuals against discrimination and victimization. Two prominent legal judgments are critically reviewed to highlight the phenomenon of crowdfunded litigation and to exemplify the ways in which the law can be (mis)used to shape public perceptions of trans identities and, consequently, how this impacts trans individuals' full and equal participation in society. The subsequent analysis examines how the previous and current governments' support of the GCF movement has led to newly proposed, and recently enacted, legislation and policies restricting trans rights and legal protections. The article concludes by reflecting on how these coordinated legal interventions detrimentally affect the emotional, physical, and social well‐being of trans individuals, while simultaneously contributing to a broader political narrative aimed at dismantling protections against discrimination and victimization for all marginalized groups. The Article presented herein focuses on two different methods of constitutional interpretation: originalism and living constitutionalism. This Article seeks to explore the advantages and disadvantages of both methods of interpretation, while simultaneously focusing on how the gap between the two methods can be bridged. To do so, this Article evaluates the impact that an applied interpretation method can have (e.g., how cases are decided from the bench based on the way the justices interpret and understand the Constitution). To the extent that the methods of constitutional interpretation cannot be reconciled, this Article proposes solutions for how to bridge the gap between two seemingly juxtaposed methods of interpretation. After the surge in political protests during the summer of 2020, protest rights have been thrust into the forefront of the nation's consciousness. Specifically, questions have arisen with respect to the boundaries of the First Amendment rights of protesters, in addition to the duty of police officers to maintain public safety and order. In this article, the interpretation and application of relevant First Amendment precedents involving protest policing and the policing of protesters are examined using cases decided by the United States Circuit Courts of Appeals. Using inductive, qualitative doctrinal methods in the tradition of grounded theory, four overarching themes emerged among the caselaw: place of protest, protest permits, law enforcement misconduct, and ordinances that restrict protests. Findings from the court rulings emphasize the importance of supervision of law enforcement and adequate training of officers who police protests. While order maintenance and public safety remain critical, law enforcement must internalize the importance of their role in protecting the First Amendment right to protest. [ABSTRACT FROM AUTHOR]

The interpretability of AI is just as important as its performance. In the LegalAI field, there have been efforts to enhance the interpretability of models, but a trade-off between interpretability and prediction accuracy remains inevitable. In this paper, we introduce a novel framework called LK-IB for compulsory measure prediction (CMP), one of the critical tasks in LegalAI. LK-IB leverages Legal Knowledge and combines an Interpretable model and a Black-box model to balance interpretability and prediction performance. Specifically, LK-IB involves three steps: (1) inputting cases into the first module, where first-order logic (FOL) rules are used to make predictions and output them directly if possible; (2) sending cases to the second module if FOL rules are not applicable, where a case distributor categorizes them as either "simple" or "complex"; and (3) sending simple cases to an interpretable model with strong interpretability and complex cases to a black-box model with outstanding performance. Experimental results demonstrate that the LK-IB framework provides more interpretable and accurate predictions than other state-of-the-art models. Identifying, classifying, and analyzing arguments in legal discourse has been a prominent area of research since the inception of the argument mining field. However, there has been a major discrepancy between the way natural language processing (NLP) researchers model and annotate arguments in court decisions and the way legal experts understand and analyze legal argumentation. While computational approaches typically simplify arguments into generic premises and claims, arguments in legal research usually exhibit a rich typology that is important for gaining insights into the particular case and applications of law in general. We address this problem and make several substantial contributions to move the field forward. First, we design a new annotation scheme for legal arguments in proceedings of the European Court of Human Rights (ECHR) that is deeply rooted in the theory and practice of legal argumentation research. Second, we compile and annotate a large corpus of 373 court decisions (2.3M tokens and 15k annotated argument spans). Finally, we train an argument mining model that outperforms state-of-the-art models in the legal NLP domain and provide a thorough expert-based evaluation.
