Applied Research [...], In the brewing tech war between the United States and China, the quest for tech supremacy is in full force. Through enacting a series of laws and policies, China aims to reach its goal of tech supremacy. If China succeeds, U.S. corporations will face a daunting task in competing against Chinese products and services in core industries and in sectors where artificial intelligence and technological breakthroughs reign. This Article is the first to identify and analyze China's 2022 Law on Science and Technology Progress, Personal Information Protection Law, Made in China 2025, National Intellectual Property Strategies, and digital currency e-CNY; explore their potential impact on U.S. business; and urge immediate attention to the tech war.

Xenotransplantation, a procedure that involves the transplantation of animal organs, may be the most feasible solution to this issue. However, many unique risks are involved with xenotransplantation, namely the transmission of infectious diseases, known as xenozoonosis. Unknown risks, including the potential transmissions of infectious diseases unique to the procedure, pose potential violations of the Fourth and Fourteenth Amendments of the U.S. Constitution. To proceed with xenotransplantation trials, patients would need to give a "higher level" of informed consent for long-term surveillance, sample retrieval, quarantine, prohibitions on donating bodily tissues and fluids, and autopsies, among other restrictions. This Comment will discuss the issues and tensions of obtaining informed consent in xenotransplantation operations, consider how these issues can be addressed, and propose potential guidelines to obtain constitutional consent. This Comment will assert that despite constitutional challenges, informed consent can be obtained to enable the progression of xenotransplantation as a potential solution to the organ shortage crisis.

The capacity of the United States to protect its scientific and technological (S&T) advantage is vital not only as a matter of maintaining U.S. economic competitiveness, but also as a [...], Although there is widespread agreement among U.S. experts that the United States must protect its technological advantage, there is disagreement about how best to do so. The related debate reveals tension between maintaining an unrestricted federally-funded research and development enterprise, on one hand, and countering foreign governments seeking to exploit it, on the other. Although lawyers have engaged with this debate in academic scholarship and in strategic ways like influencing national-level law and policy, legal practitioners have often been absent at the operational level. By way of facilitating such engagement, this Article provides a primer on National Security Decision Directive 189, an executive order issued in 1985 that established national policy favoring openness with respect to federally-funded fundamental research. The Article also considers the legal force the order continues to hold given recent legislative and executive action designed to strengthen the federally-funded research and development enterprise against foreign threats.
