Purpose: This paper aims to present a mixed methods study of child criminal exploitation (CCE), particularly in the form of "county lines", in three local authorities in southeast England. The data is analysed using a framework constructed from two relevant contextual and relational theories to understand experiences of CCE and the safeguarding responses undertaken to protect young people from harm. Design/methodology/approach: Data were drawn from a survey (n = 118); interviews (n = 5) and focus groups (n = 15) with professionals; interviews with parents (n = 4); and from secondary analysis of eight interviews with young people affected by criminal exploitation. The analytic framework was applied to the data to answer two research questions: what is the role and significance of young people's interactions with peers, parents and professionals in their CCE trajectories; and how do professionals understand and address risks within contexts in which young people are exposed to CCE? The mixed methods data collected by the authors were coded and analysed using this framework. Findings: Although professionals were aware of contexts and relational power dynamics, the situated and temporal nature of CCE remained overlooked within safeguarding systems. Professionals required more space, time and support to fully and flexibly engage with young people and their families to increase safety. Originality/value: There is limited research available that critically examines safeguarding responses to CCE in diverse geographic and cultural contexts. This paper contributes a critical account of how professionals might create connections and opportunities for change with young people, identifying structural constraints within practice systems alongside emerging examples of effective practice. Understanding the factors that influence domestic violence and abuse (DVA) victims to withdraw from the Criminal Justice System globally continues to be a key focus for professionals and academics working within this area. There is a dearth of extant literature examining the motivations behind victim withdrawal, particularly retraction occurring post provision of an initial statement. This paper examines the phenomenon of retraction, by thematically analysing N = 60 police retraction statements (PRS) collected by police officers in a large suburban police force in the North West of England. In examining these statements, insight can also be garnered from those victims still in an active relationship with their abusers. Findings highlight female victims' motivations for retraction and are framed around victim problem solving including: a) accepting the relationship which resulted in a discordance in proceeding with the prosecution of the abuser b) rejecting the relationship thereby rendering the prosecution as redundant c) engaging in procedural problem solving where alternative measures such as civil actions were sought to substitute a CJS prosecution and d) the effect of children where motivations were split between retracting to return to the complete family unit including the victim as the mother and retracting due to recognising the importance of the father's role without involvement from the mother. Notwithstanding limitations, this paper demonstrates that there is significant value in conducting an analysis of PRSs in furthering the understanding of why victims choose to retract at this point in their prosecution journey. The extracts from this dataset add insight and understanding into DVA female victim motivations to retract post-initial statement provision and highlight the differences within victim populations who retract their original statement. In many countries today, specific frameworks have been established to recognize physical injuries and provide compensation for bodily harm. These frameworks, in line with criminal policy objectives, aim to deter future harm and ensure compensation. This paper employs an analytical and descriptive approach to examine this issue within the criminal justice systems of Iran and England, exploring the conceptual differences in the recognition of bodily injury and the provision of compensation in both legal systems. The present research reveals that in the Iranian legal system, the compensation for bodily injuries is based on the concepts of "diyyah", "arsh", and "government", while the English legal system evaluates and calculates compensation based on tariff systems, consideration of the function of body parts, the lost enjoyment of life, and the valuation of human life and the quality of life years. Drawing on the notion of generative mechanisms as constitutive rules, this paper advocates a shift away from the notion of routines as sources of ongoing change and towards a rule‐based understanding of routines as institutional facts. While the recent practice turn to routines studies has highlighted sources of endogenous change, this paper adopts a Critical Realist stance to investigate exogenous forces that account for the emergence of a new routine. To this end, the paper endeavours to analyse the passing of new legislation in the criminal justice system of England and Wales. By examining what makes the rules of the game change between the Police and the Crown Prosecution Service, the paper explains an instance of institutionalisation in the making. Theoretical and practical implications are discussed. Our contribution stresses that constitutive rules play a pivotal role for recognising, identifying and labelling organisational routines, thus generating order, stability and patterning. Technological developments continue to have a transformative impact on various aspects of our lives. While legal systems have often been regarded as resistant to these types of change, they have, in recent years, become much more open to taking advantage of digitalisation as a means of making criminal proceedings more convenient and efficient. It is crucial to ensure that criminal justice systems are fit for purpose, and that they continue to develop, to mirror social trends and developments. However, where these changes are adopted rapidly, and with little regard for human rights, technological developments risk worsening existing endemic challenges in criminal justice systems, including discrimination and over-incarceration. This paper considers: the factors that have contributed to the increasing use of technology in criminal proceedings in England and Wales; how technology is now shaping not just the appearance, but also the very nature of criminal proceedings; and how these developments might impact on fair trial rights. Responding to domestic violence and abuse (DVA) poses significant challenges for the criminal justice system, with recent studies highlighting a number of significant gaps and failings in the nature of the police response in particular. This paper reports on findings from a component of the multi-stage ESRC funded project 'Justice, Inequality and Gender-Based Violence' (ESRC grant ES/M010090/1) that relates to 400 reported incidents of DVA involving intimate partners recorded by two police force areas in England in 2014. Drawing on this large data set concerning a wide range of incidents, this paper employs quantitative methods to analyse the trajectories of reports made to the police, and the factors that may influence their progress through, or attrition from the criminal justice system. In doing so, this paper finds that certain 'inequality' factors such as victim gender, vulnerability (including mental health) and incident type are found to impact the progression of cases through the criminal justice system. This work seeks to build on our understanding of what happens to incidents of DVA that are brought to the attention of the police by victims and survivors, and reflects upon how the outcomes of such incidents impact the broader debate concerning the pursuit of a formal, or criminal 'justice' in cases of DVA. In recent years, there has been considerable policy and academic interest in the existence of ethnic inequalities in the Criminal Justice System. A large body of sentencing research has been dedicated to exploring whether ethnic minority defendants are treated more harshly than similarly situated white defendants. This paper extends this research utilizing Ministry of Justice linked criminal justice datasets and multilevel models to assess the effect of ethnicity and other defendant case and contextual factors on sentencing outcomes in the Crown Court. The analysis shows that legal characteristics such as plea, pre-trial detention, offence type and severity are important factors determining sentencing outcomes although they do not fully explain disparities in these outcomes between ethnic groups. Ethnic disparities in imprisonment persist and, in some cases, become more pronounced after controlling for defendant case and court factors. In contrast, ethnic disparities in sentence length are largely explained by legal factors, and after adjusting for other predictors of sentencing outcomes, observed differences between most (but not all) ethnic minority groups and the white British disappear. The concept of participation is now widely accepted in healthcare and social services, but is less apparent in the delivery of services for vulnerable people who encounter the Criminal Justice System and its associated agencies (Buck et al, 2020). This article considers the extent to which children and 'vulnerable' adults who have been detained in police custody are currently able to actively participate in the design and delivery of Appropriate Adult Schemes. This paper draws together responses from 43 services in England and Wales concerning levels of service user engagement to ascertain the current level of participation, and to make recommendations for the future. The paper applies Forbat, et al.'s (2009) models of service user involvement to conceptualise ideological drivers which underpin the Appropriate Adult Scheme's commitment to involvement. The data reveal that while there is a genuine desire to improve service user participation, that institutional, financial, and attitudinal barriers mean that participation either does not occur or is at a very cursory level. The project on which this paper is grounded is the first in-depth empirical study of the impacts of COVID-19 on each stage of the English and Welsh Youth Justice System. We take the notion of a child's right to a fair trial as the lens by which we detail the findings from our research. The paper documents the experiences of professionals working in the courts and children who had contact with the courts during the pandemic. While we concentrate on processes in England and Wales as an exemplar of the impact of COVID-19, recognising that globally, courts were experiencing similar challenges, initiates a discourse about how to re-envision their role in wider criminal justice systems in a COVID-19 world. Our research demonstrates an urgent need for renewed consideration of what support children need to effectively participate in court, and where and how children's cases should be heard. The pandemic demonstrated that creativity is possible and creates a timely opportunity to review the evidence and think more radically about a welfare-based, trauma-informed court process for children. 3D printing has rapidly developed and been applied in forensic science due to its use in creating demonstrations for courts of law. Much of the literature on this specific topic has focused on the use of 3D printed models in academia, the potential influence on a jury, and its use as a long-term documentation process, but with few actual forensic case examples. This paper offers an insight into the development of 3D printing in forensic practice and how 3D printing is currently being used in the criminal justice system in England and Wales. A series of case reports were gathered from multiple police forces and forensic practitioners in the UK to identify how 3D printing was being used. These discussions established who was requesting 3D printed exhibits, what type of technologies were being utilised, what type of exhibits were being printed, and resulting feedback for the use of 3D printed material within a criminal case. As a result, this research demonstrates the current use of 3D printing in England and Wales, discussing the associated cases that have been known to incorporate 3D prints. Likewise, this work explores the limitations that have been encountered by forensic practitioners and identifies a series of research questions that should be considered in future investigations. London: UCL Press., 1996. "Frame-Critical Policy Analysis and Frame-Reflective Policy Practice." Knowledge and Policy: the International Journal of Knowledge Transfer and Utilization 9 (1): 85–104), we explore the ways in which 'young people', 'vulnerability', 'risk', 'prevention' and 'prevention practice' were defined and framed by practitioners engaged in the design, delivery and commissioning of drug prevention interventions for young people in contact with the criminal justice system. We argue that practitioners describe their work in terms of both a preventative frame – based on a 'deficit' model – and a transformative praxis frame, more in line with an increasing shift towards 'positive youth justice' where practitioners aspire to actively involve the young person in a process of change. The implications of those, often competing, frames are discussed in relation to the development of prevention approaches and the challenges in designing drugs prevention for this group of young people. The paper is based on interviews and focus groups with thirty-one practitioners in England and is part of the EU funded EPPIC project (Exchanging Prevention Practices on Polydrug Use among Youth in Criminal Justice Systems 2017–2020). Background: Growing evidence of mental disorders among people going through the criminal justice system suggests the potential benefit of courts adding a Mental Health Treatment Requirement (MHTR) when sentencing an offender to a Community Order (sentence) in England and Wales. Although available since 2003, MHTRs have not been widely used, and there is little evidence on outcomes. Aim: To conduct the first large‐scale evaluation of mental health outcomes of people with an MHTR as part of their community sentence across multiple sites in England and Wales. Methods: Data were collected from 14 sites in England and Wales about individuals who were given an MHTR as part of a community sentence. They were assessed before and after this. During the MHTR, they received a psychotherapeutic intervention by assistant psychologists in a primary care framework. Measures of psychological distress (Clinical Outcomes in Routine Evaluation—Outcome Measure), anxiety (Generalised Anxiety Disorder‐7) and depression (Patient Health Questionnaire) were completed before the MHTR was implemented and after completion. Results: Where paired sample t‐tests and Wilcoxon signed ranked tests were used, with samples ranging between 309 and 447 individuals, clinically significant changes were obtained for all measures. Most individuals (63%) were identified as experiencing a reliable change in at least two out of the three scales. Finally, a negative linear relationship, between measures at the start of the intervention and reliable change, was identified with higher pre‐measures, indicating that more initial distress, anxiety and/or depression were associated with more sizeable changes. Conclusions: This paper provides the first substantial evidence in support of the MHTR within a primary mental healthcare framework as an effective pathway to reduce mental health problems among individuals under probation supervision as part of a sentence after conviction for a criminal offence. This supports the expansion of the provision across England and Wales. This paper will interpret and critically analyse the new offence for organised crime in England and Wales (Section 45 of the Serious Crime Act 2015) from a criminological perspective in light of evidence found in research in the country. It will argue that changes in the law relate to changes in political narratives rather than to variations in the criminal panorama of organised crime. It will discuss these changes within three perspectives, which address various levels of concern: a narrative perspective, which reflects on the overlapping of meanings in the use of the words 'organised crime'; an evolution perspective, which reflects on the origins of the new participation offences with reference to both national and international pressures; a management perspective, which reflects on some of the immediate effects of the new offences of organised crime on the criminal justice system. This paper will conclude that political narratives have indeed influenced criminal policy, while there is no significant change in the phenomenon of organised crime to justify such narratives. This study examined 91 Active Risk Management System (ARMS) assessments from four police areas across England and Wales. ARMS is a tool that guides criminal justice practitioners to assess and develop formal risk management plans based on the risks and strengths of individual clients convicted of sexual offending. This present study is particularly concerned with the application of this new tool and the quality of subsequent risk assessment as a result of police practitioner assessment. Findings indicate the quality of ARMS assessments were not to the expected standard. The study found while there were acceptable levels of detail and evidence documented by practitioners across individual areas; overall, assessor risk ratings and risk management plans were poor. Purpose: This study aims to investigate the views of commissioners, providers and criminal justice staff on how effective current health-care provision is at meeting the health needs of people on probation. Understanding perceptions of what constitutes effective provision, where barriers are encountered and where improvements could be made is an important step towards improving access to care for this hard-to-reach group.Design/methodology/approach: The research was part of a wider study. This paper focusses on findings from case studies conducted via semi-structured telephone interviews with 24 stakeholders in a purposive sample from six geographical areas of England. Interviews were conducted by researchers from a variety of backgrounds and an individual with lived experience of the criminal justice system. Data were analysed using thematic analysis.Findings: Participants provided examples of effective health-care provision, which largely involved multi-agency partnership working. It was apparent that there are many barriers to providing appropriate health-care provision to people on probation, which are underpinned by the complexity of this population's health-care needs, the complexity of the health-care landscape and problematic commissioning processes.Practical Implications: Improvements are needed to provide appropriate and accessible health care that meets the needs of people on probation, thereby reducing health inequalities. These include shared targets, improved funding, clearer pathways into care and giving probation a voice in commissioning.Originality/value: To the best of authors' knowledge, this is the first study of commissioner, provider and criminal justice staffs' views on the effectiveness of current health-care provision at meeting the health needs of people on probation. Background: Drugs and crime are linked and diversion from the criminal justice system into drug treatment is a well-established policy response. The point of arrest is a pivotal moment to initiate a drug-specific intervention. This paper assesses the impact of the introduction of drug testing on arrest (DToA) into a low crime area in England. Our mixed methods study analysed performance data collected by the National Drug Treatment Monitoring/Drug Test Recorder datasets and feedback from a series of semi-structured interviews with both clients and professionals. Results: In total, 2210 people were tested 2861 times of which 42.0% (n = 928) tested positive. Of those, 3% subsequently engaged with effective treatment. However, throughout the criminal justice system, treatment engagements increased year on year from 20% (n = 77) to 26% (n = 131). Clients (n = 19) and professionals (n = 14) reported that DToA was an acceptable/tolerable addition to the treatment pathway. Interviews suggested that the point of arrest may help primary desistance from further offending. Conclusions: The staggered introduction of the DToA made direct measure of impact difficult and there appears to have been a 'displacement' effect in response to the extra investment. However, DToA appears to have contributed towards an overall uplift in criminal justice drug treatment system performance activities (identification, assessment, referral etc.) and may have served to help strengthen care pathways. Barriers were noted about engagement with DToA by entrenched opiate users, suggesting that the effectiveness of DToA was limited within that group. Background and aims: During the past three decades an expansive literature has emerged that is dedicated to analysing the processes of policy transfer. One neglected pathway involves subnational agents emulating crime control innovations that have emerged in subnational jurisdictions of other nations. This paper presents the case of the London Mayor's Office for Policing and Crime's (MOPAC) Alcohol Abstinence Monitoring Requirement (AAMR) Pilot to examine the multi‐level factors that facilitate and/or constrain international–subnational crime and justice policy transfer. Methods: A qualitative case study design reconstructed the (in)formal events that led to components of the South Dakota 24/7 Sobriety Project (USA) being either abandoned or integrated into MOPAC's AAMR Pilot. Evidence is drawn from elite interviews and documentary materials. Results: A series of inter/transnational‐, macro‐domestic‐, meso‐ and micro‐level factors enabled and/or obstructed processes of complete international–subnational policy transfer. Exclusion of domestic violence perpetrators from the London Pilot was fuelled by interest‐group hostility and mobilization. Use of alcohol tags rather than breathalysers to monitor compliance was a result of political–economic constraints, concern surrounding intrusion, technological innovation and policy‐orientated learning. The decision to omit an 'offender pays' funding mechanism was a consequence of legal incompatibility and civil service reluctance, while 'flash incarceration' for breach was not implemented due to European policy harmonization. Conclusions: The London Alcohol Abstinence Monitoring Requirement Pilot was a policy 'synthesis' that combined ideas, goals, vocabulary, principles, technology and practices from the South Dakota model with the existing English and Welsh criminal justice framework. There is growing interest in the health correlates of people detained in police custody, and a number of innovations have been introduced to try to meet the complex needs of detainees. The implementation of Criminal Justice Liaison and Diversion (CJL&D) Services commissioned by the Department of Health in England is a substantial part of this investment. In this paper, we describe data from 858 detainees who were referred to the CJL&D service of a busy metropolitan police station in the North East of England. The detainees referred to the service had complex mental health needs, substance misuse and a range of vulnerabilities requiring specific intervention. The effective operation of these teams and how they interface with health and criminal justice systems also depend upon a number of systematic issues that emanate both from within the teams, and from external policy drivers. Integrated offender management (IOM) evolved from a series of related practice experiments in England and Wales which brought together key partners -police, prison, probation, community safety partnerships and the voluntary sector -to find a more focused way to tackle persistent and prolific adult offenders. IOM survived a change of government and has continued to prosper, though the jury is still out about how effective the model is at reducing reoffending. This paper, adapted from the Seventh Martin Tansey Memorial Lecture delivered in April 2014, looks briefly at the history of this initiative, drawing out and interrogating key elements in the operational and strategic structures and the extent of community involvement, considering issues in the setting of a researchable agenda, and setting this in the context of the co-production of services for both adult criminal justice service users and young people in transition to adulthood. Background: In England and Wales, 'approved premises' offer 24-hour staffed accommodation for high-risk offenders, most of whom are returning to the community from prison. With a move towards a standardised operating model, it is essential to be able to measure outcomes.Aims: Our aim is to collate and evaluate 'benchmarks' for approved premises.Methods: A cross-sectional, descriptive design was used to establish the impact of existing practice in all four approved premises in Wales. Data on well-being, life satisfaction, attitudes to violence and problem-solving abilities were recorded with 114 male residents (of 486), and attitudes to personality disorder and personal well-being/burnout with 30 staff (of 86), in both narrative style and according to a number of scales used within criminal justice and healthcare systems. Perceptions of environmental climate were assessed with both groups. Scores were compared with those from reference groups, including prisoners and secure hospital patients. Criminological outcomes (e.g. prison recall) were obtained for all 486 men.Results: Scores on the scales used were broadly comparable with those in relevant reference groups, but some showed floor or ceiling effects. Recall rates, whether directly from the premises or after further onward movement, were about 42% overall, comparable with those reported for similar offenders elsewhere.Conclusions: This paper provides a short battery of measurements for use as benchmarks of experience and outcomes in staffed community accommodation for high-risk men. Restorative Justice (RJ) has become an increasingly popular alternative to more traditional punishment methods in the last two decades within the Criminal Justice system in England and Wales; often in respect of youth justice and minor crimes which have a clearly defined victim. However, this article will explore the use of restorative justice in cases of financial fraud. Such cases can be particularly complex when identifying culpability within an organisation, and also victims, who may not be aware that they are victims. Corporate and public apologies are not unheard of, particularly with the increasing use of social media platforms, but they have not been widely discussed in relation to RJ. As there is a recognition that RJ entails more than a simple apology, innovative ways of administering RJ will be considered. Alongside discussion of the complexities of using RJ for large-scale financial fraud, the paper will draw on various cases of fraud and the resultant public apology from the early 18th century onward. Several forms of what we now term RJ will be illustrated from before the modernday resurgence of this type of justice. In most (though not all) of the several examples discussed, there is a clear separation of RJ practices from the formal criminal justice system operating at the time, and this may prove to be a useful guide to the future use of RJ as an adjunct to more legalistic criminal justice processes. The National Police Chiefs Council (NPCC) position on paedophile hunting groups is that their motivation should be questioned since there is no positive advantage to policing. Such activism increases risk to potential victims, the suspect, and to the efficiency and effectiveness of criminal justice processes (NPCC, 2018). Whilst public naming and shaming of those convicted of sexual offences against children is not a new phenomenon, the rise in popularity of the internet and the surge in content available online is. Increased accessibility to information made available by paedophile hunters has implications on all aspects of the criminal justice system including policing, courts and probation. Through an examination of the existing literature, this paper outlines how paedophile hunting activity has become a concept in the management of sexual offending in England and Wales. Analyses of crime based upon aggregate counts of different crime types have restricted value, because they count all crime types equally irrespective of the harm caused. In response to this problem, a series of weighted measures of crime harm have been proposed. In this short contribution, we contend that the use of some crime harm metrics to inform police deployment practices has the potential to reinforce ethnic disparities in the criminal justice system through the creation of unintended negative feedback loops. We focus our analysis on the Cambridge Crime Harm Index and the Office for National Statistics (ONS) Crime Severity Score, the preeminent crime harm indexes in England and Wales. We conclude that the ONS Crime Severity Score, which is based on mean sentencing outcomes, does give cause for concern in some contexts. There is currently no evidence that the Cambridge Crime Harm Index, based on sentencing guidelines, presents the same problems. [ABSTRACT FROM AUTHOR]

When does a punishment for crime cross from being a legitimate goal of the state to a dignity taking? From the Norman Conquest until the middle of the eighteenth-century, the Common Law provided that in addition to execution, the property of convicted felons or traitors was forfeited to the crown and their blood corrupted so that their heirs could not inherit. I argue this is a clear instance of dignity takings. The colonists who traveled to Massachusetts Bay wanted a fresh start and so sought to create a model society based on Biblical law. Using around 6,000 criminal cases from 1630 to 1683 this paper argues that a different form of dignity takings ensued. The use of "scarlet letters," pillorying, whipping, and other public punishment were all designed to single out unworthy members of the com munity. Contemporary criminal justice policy in England and Wales has witnessed various resurgences of political interest in resettlement and the short sentence population. This intermittent attentiveness has been mirrored in the circular re-iterations of policy initiatives ostensibly designed to bring greater continuity to the services that administer 'through the gate' work. These efforts include the 'seamless sentence' of the 1991 Criminal Justice Act; 'end-to-end offender management', the creation of The National Offender Management Service (NOMS) and the introduction of custody plus under New Labour; and the current Transforming Rehabilitation (TR) 'through the gate' reforms. It is important to analyse these attempts in order to understand why resettlement policy consistently fails to deliver an improved continuity between prisons and probation. This paper argues that resettlement policy has a common thread of issues that inhibit effective resettlement practice. This article will firstly consider the 'essence' (Senior and Ward, 2016) of resettlement practice, outlining several key principles that should be central elements for resettlement policy and practice, before providing an overview of these various policy initiatives; examining a common thread of failures in their realisation. This article will then look ahead at the next possible iteration of resettlement policy, 'offender management in custody' (OMiC), concluding that despite key changes, this latest policy continues to repeat the errors of past resettlement policy failures. Background: Within England, children and young people (CYP) who come into police custody are referred to Liaison and Diversion (L&D) teams. L&D teams have responsibility for liaising with healthcare and other support services while working to divert CYP away from the criminal justice system but have traditionally not provided targeted psychological interventions to CYP. Considering evidence that Solution Focused Brief Therapy (SFBT) leads to a reduction in internalising and externalising behaviour problems in CYP, the aim of this randomised controlled trial (RCT) was to determine whether there is a difference between services as usual (SAU) plus SFBT offered by trained therapists working within a L&D team, and SAU alone, in reducing offending behaviours in 10–17-year-olds presenting at police custody. Methods: Design: two-arm individually RCT with internal pilot and process evaluation. Participants: N = approximately 448 CYP aged 10–17 years presenting at one of three police custody suites in the area served by Lancashire and South Cumbria NHS Foundation Trust (LSCFT) who are referred to the L&D team. Participants will be recruited and allocated to intervention:control on a 1:1 basis. Interviews will be performed with 30–40 CYP in the intervention arm, 15 CYP in the control arm, up to 20 parents/guardians across both arms, up to 15 practitioners, and up to 10 site staff responsible for screening CYP for the trial. Intervention and control: Those allocated to the intervention will be offered SAU plus SFBT, and control participants will receive SAU only. Primary outcome: CYP frequency of offending behaviours assessed through the Self-Report Delinquency Measure (SRDM) at 12 months post-randomisation. Secondary outcomes: criminal offence data (national police database); emotional and behavioural difficulties (self-report and parent/guardian reported); gang affiliation (self-report). Process evaluation: evaluation of acceptability and experiences of the CYP, parents/guardians, site staff and practitioners; fidelity of SFBT delivery. Discussion: This two-arm individually RCT will evaluate the effectiveness of SFBT in reducing offending behaviours in CYP presenting at police custody suites within the area served by LSCFT. Our process evaluation will assess the fidelity of delivery of SFBT, the factors affecting implementation, the acceptability of SFBT in CYP aged 10–17 years and recruitment and reach. Background: Alcohol Use Disorders (AUD) in England have a prevalence rate of about 27% in the general population. There is good evidence to suggest that Alcohol Identification and Brief Advice (IBA) delivered in health-care settings reduces both consumption and related harms. Criminal Justice Settings offer opportunities for the identification of AUDs and afford a "teachable moment" where a link is made between alcohol use and consequence at which to deliver appropriate interventions. Objective: To identify areas in the English Criminal Justice System where the deployment of alcohol screening and brief interventions could reduce alcohol consumption and related harms. Methods: A rapid literature review for the prevalence of alcohol use disorders and the effectiveness of screening and brief interventions in criminal justice settings as well as conducting telephone interviews of key informant interviews. Conclusion: With young offenders, there is a lack of trials and none from the U.K. With AssestPlus screening it would appear more feasible to conduct a trial here than in other criminal justice settings which may offer an advantage than other settings. Simple Summary: Forensic entomology concerns the use of insects as evidence in legal investigations. Many sorts of investigation can benefit from an interpretation of insects associated with the crime scene, but insect evidence is most frequently used in investigations of death. The interpretation of insect evidence in casework is guided by the data supplied through research. Such data are essential to improve the casework interpretation of insect evidence, thereby improving the robustness of the legal systems in which it operates. This paper explores the mutually beneficial relationship between research and casework in forensic entomology, contrasting the different challenges that each presents and giving examples of how each can support the other in delivering results of real societal benefit. It is written from the perspective of the Criminal Justice System of England and Wales, but many of the points raised are relevant to legal systems worldwide. Research is a vital component of all forensic sciences and is often stimulated by casework, which identifies gaps in our knowledge. In such a niche area of forensic science as entomology there should be a close and mutually beneficial relationship between research and casework: to some extent there is a continuum between the two and many forensic entomologists are involved in both to a greater or lesser degree. However, research and casework involve quite differing challenges, from the replicated, highly controlled, sometimes esoteric aspects of research to the very individual, sometimes chaotic and disruptive, but highly applied aspects of casework. Ideally casework will include the full involvement of a forensic entomologist, who will collect the insect and climate evidence at the scene and produce a robust expert witness statement based on a full analysis of this data. Unfortunately, it can also include situations where samples, if collected at all, are poorly preserved, not representative of the full cadaver fauna available and presented to the entomologist months or years after the event, without local temperature data. While research is recognised through publications and their citation indices, casework and its associated expert witness statements often receive no credit in an academic workplace, although they do have a positive societal impact and many other benefits of teaching and public engagement value. This manuscript examines the relationship between research and casework from a UK perspective, to raise awareness of the need to create an environment that values the contribution of both, for future generations to flourish in both areas. While the relationship between offending and mental health is complex, research findings indicate that those in conflict with the law have higher levels of mental illness and need than the general population. This article considers the findings of a joint thematic inspection of the criminal justice journey for individuals with mental health needs, with a particular focus on the probation stage. Inspectors from across justice and health reviewed cases to establish the extent to which needs were identified and met. Interviews were also undertaken with 67 individuals who had lived experience of mental illness while in the criminal justice system. Findings are considered in relation to the identification of mental health needs; the role of trauma; probation practitioners' skills, knowledge and support; case management; and access to required services. There are long‐standing concerns that people experiencing homelessness may not recover well if left unsupported after a hospital stay. This study reports on a study investigating the cost‐effectiveness of three different 'in patient care coordination and discharge planning' configurations for adults experiencing homelessness who are discharged from hospitals in England. The first configuration provided a clinical and housing in‐reach service during acute care and discharge coordination but with no 'step‐down' care. The second configuration provided clinical and housing in‐reach, discharge coordination and 'step‐down' intermediate care. The third configuration consisted of housing support workers providing in‐reach and discharge coordination as well as step‐down care. These three configurations were each compared with 'standard care' (control, defined as one visit by the homelessness health nurse before discharge during which patients received an information leaflet on local services). Multiple sources of data and multi‐outcome measures were adopted to assess the cost utility of hospital discharge service delivery for the NHS and broader public perspective. Details of 354 participants were collated on service delivery costs (salary, on‐costs, capital, overheads and 'hotel' costs, advertising and other indirect costs), the economic consequences for different public services (e.g. NHS, social care, criminal justice, housing, etc.) and health utilities (quality‐adjusted‐life‐years, QALYs). Findings were complex across the configurations, but, on the whole, there was promising evidence suggesting that, with delivery costs similar to those reported for bed‐based intermediate care, step‐down care secured better health outcomes and improved cost‐effectiveness (compared with usual care) within NICE cost‐effectiveness recommendations. This survey provides one of the first comprehensive reviews of Wales's role in the England and Wales criminal justice system. The article explains that executive devolution has been responsible for a major transformation to Wales's position within the England and Wales jurisdiction. Attention is given to the institutions responsible for criminal justice since devolution to Wales as well as an overview of some of the key trends and latest data, including recent research which shows that Wales, when disaggregated from England, has the highest rate of imprisonment in Western Europe. In light of the developments that have taken place over the past two decades, this survey asserts that Wales must now be taken seriously as a distinct and worthwhile unit of criminological analysis. It is argued that future research on Wales can help to develop a more constitutionally literate criminological debate across the UK as well as European regions affected by devolution. Whilst criminologists, sociologists and policy-makers fuel a perennial debate over the existential value of the ‘gang’,1 the Criminal Justice System (CJS) in England and Wales creeps further into the lives of marginalised and excluded young Black men who have been identified as ‘gang-involved’, a ‘gang-concern’ or ‘associated’ with a gang. Drawing on research commissioned by two North West (English) Local Authority Crime Reduction Partnerships, this article offers a unique insight into the problematic way that the term ‘gang’ is being appropriated and used by criminal justice agencies. The findings suggest that the ‘gang’ label legitimises the over-policing of Black people and communities and acts as an inhibitor to the reconciliation of other, more acute, socio-economic problems endured within Black and Minority Ethnic (BAME) communities. Inspired by the paper ‘White sociology, black struggle’,2 this article is concerned with the problematising effects and the enduring features of the gang construct as a ‘signifier’ for Black men. More contentiously, it highlights the contribution of criminology to the Othering of young Black men, to show that the contemporary position of young Black men as significantly overrepresented and differentially treated within the CJS reflects a continuity with the idea of the ‘Black folk devil’ inherent within a burgeoning body of ‘uncritical’ criminology. In response to policy developments aiming to increase the involvement of penal voluntary organizations in criminal justice, a recent flurry of commentary has provided a marketized understanding of the penal voluntary sector and attempts to privatize it. Although this commentary has contributed significantly to the limited literature on the sector, the centrality of neoliberal policy in analysis is problematic. This article provides a critique of relevant commentary and offers a new exploration of the penal voluntary sector that extends beyond neoliberalism and marketization. A preliminary exploration of an alternative model is made, using political economy to provide a nuanced and politically enabling understanding of the role of voluntary organizations in criminal justice. This article draws upon quantitative and content analysis of 585 reports of rape recorded within two police force areas in England in 2010 and in 2014 tracking individual incidents to eventual outcome to examine the impact, if any, of intersecting inequalities on trajectories of rape cases reported to police. The data were collected as part of the wider Economic and Social Research Council funded Justice, Inequality and Gender-Based Violence research project which examined victim-survivor experiences and perspectives on justice. Building on existing distinctions between types of rape case based on the relationship between victim-survivor and accused, the results suggest age and gender are significant factors in how sexual violence, and the criminal justice system, is experienced. While younger women and girls were disproportionately affected by certain types of sexual violence case and more likely to come into contact with the criminal justice system compared to men and older women, they were not necessarily more likely to achieve a conviction. The findings also confirm that some of the most vulnerable victims-survivors of sexual violence, especially those with poor mental health, are still not achieving criminal justice. Victims-survivors from Black and minority ethnic group or lesbian, gay, bisexual, transgender, transsexual, queer groups are underrepresented within the criminal justice system, implying these groups are not seeking a criminal justice response in the same way as 'white' heterosexual victims-survivors. This article examines women's experiences of participating in 'Healing Trauma'; a gender‐responsive, trauma‐informed intervention delivered in women's prisons in England. Victimisation and trauma are prevalent among women in the justice system but are not perceived to be amenable to criminal justice intervention, and there are compelling arguments that correctional environments are inappropriate settings for trauma‐informed programmes. This article analyses focus group discussions with women who completed Healing Trauma to examine the legitimacy of developing trauma‐informed practice in prisons. The women's testimonies indicate that Healing Trauma offers a meaningful opportunity to begin to explore past victimisation that has contributed to their criminalisation. [ABSTRACT FROM AUTHOR]

This article explores the consequences of unenthusiastic criminal justice reform through the case study of special measures provision in England and Wales. These measures provide assistance to vulnerable people giving evidence in criminal trials. For witnesses other than the accused, the law's development followed a standard process: public concern; governmental inquiries; legislation; and a period of inception to prepare for its implementation. The development of special measures for the accused did not follow this same pattern. Instead, it was gradual, ad hoc and somewhat reluctant. This article argues that the way and the context in which special measures developed for the accused has had a negative impact on the extent to which they are embedded within the criminal justice system. This, in turn, has negatively affected their uptake in practice. It is concluded that the way in which the law is reformed is important to its success in practice. [ABSTRACT FROM AUTHOR]

Purpose: In January 2013, new court procedure rules were introduced in England and Wales, which resulted in significant changes to the instruction of expert witness psychologists (EWPsychs). This study aims to build on the results of previous survey studies of psychologists working as expert witnesses in identifying the current challenges faced by EWPsychs. Design/methodology/approach: Using a mixed-methods design, a sample 58 practicing psychologist expert witnesses were surveyed, and qualitative data was analysed using a thematic analysis approach. Findings: Six overarching themes emerged from the online survey data: training and knowledge, changes to procedure rules and Legal Aid Authority fees, quality of reports, pressures to change opinion, conflict with EWPsychs and expert witness feedback. Over a third of psychologists working as expert witness have not received specific expert witness training, with a quarter of respondents indicating that the capped legal aid fees are a determining factor in whether they accept instruction as an expert witness, and almost two-third of respondents believing that the legal aid rates do not accurately reflect the work that they do. Practical implications: There is clear demand for high-quality EWPsychs and a need to develop expert witness training programmes and guidance documents to better support the next generation of EWPsychs. While soft law is an integral part of the efficient and effective functioning of public administration in England & Wales, the extent to which it was deployed in response to COVID-19 is striking, with over 400 pieces of "guidance and regulations" created. In this article, we consider the general place of soft law in administrative law in England & Wales and the broad regulatory framework, including soft law, that governs the COVID-19 pandemic. This allows us to take a deep dive into COVID-19 and the criminal justice system, showing how the senior judiciary relied predominately on soft law (judicial guidance and protocols) to manage the system (set against the backdrop of targeted legislation and a limited number of Practice Directions, which have the force of law). We argue that the senior judiciary's approach to the use of COVID-19 soft law has, in many ways, been more effective than that taken by the government. Online abuse, facilitated via social media and mobile technologies, has recently attracted considerable academic attention. The nonconsensual sharing of intimate images—revenge pornography—can have a devastating effect on victims, is a global problem, and constitutes interpersonal violence. The national helpline in the United Kingdom has now received over 7,000 calls. In the United Kingdom, new legislation making revenge pornography a crime was introduced in 2014, yet the police do not always respond appropriately to victims. This article presents the findings of a national online survey of police understanding of revenge pornography, undertaken in the United Kingdom in March 2017. The study set out to investigate police knowledge of revenge pornography legislation, their confidence in responding to cases of revenge pornography, and what level of training they had received. A total of 783 members of the police force responded to the survey and, to the authors' knowledge, this the first study to seek to quantify the understanding of revenge pornography by police officers and staff in England and Wales. The findings suggest that the police in the United Kingdom have a limited understanding of revenge pornography legislation and lack confidence both in investigating cases and in effectively responding to victims. The implications of the study demonstrate that there is an urgent need for training across police forces to ensure that cases of revenge pornography are appropriately responded to, victims are safeguarded, and offenders brought to justice. Following years of debate, the creation of the Court of Appeal (Criminal Division) in England and Wales signified official recognition that the criminal process may sometimes result in unsafe convictions. Central to the operation of the appellate system, is the ability of individuals who claim that their conviction is in error, to revisit and re-examine evidence gathered during the investigation, as well as that relied upon at their trial. High-profile miscarriages of justice have often only been remedied when there has been defence access to materials post-conviction (which had often not been disclosed pre-trial). While there has (rightly) been critical attention paid to pre-trial non-disclosure and the risks this poses to justice, such scrutiny has been lacking post-conviction. And yet, it is arguable that the rationale of preventing miscarriages of justice underpinning the duties of pre-conviction disclosure, subsists post-conviction. However, the Supreme Court judgment in R (Nunn) v Chief Constable of Suffolk Constabulary & Anor. [2014] UKSC 37 has made it more difficult to gain disclosure post-conviction. This paper details a worrying picture of inconsistency among police and prosecution authorities, with confusion over what should be retained (and how), and whether disclosure post-conviction should be permitted. Central to the operation of the appellate system, is the ability of individuals who claim that their conviction is in error, to revisit and re-examine evidence gathered during the investigation, as well as that relied upon at their trial. High-profile miscarriages of justice have often only been remedied when there has been defence access to materials post conviction. There is also an imperative for forces to retain evidence in investigations in which no perpetrator has been detected or convicted, to facilitate cold case reviews. In order to give effect then to an appellate system and enable cold case reviews, evidence needs to be retained and properly stored. If materials are not retained and stored correctly, then re-investigations are rendered impossible. Retention is especially critical in respect of physical materials that could be subject to forensic examination. With the progress of science and technology, and the interpretation of results, it is essential that such physical (and now, often digital) materials are retained for future (re)evaluation. From analysis of responses to a Freedom of Information request to all police forces in England and Wales, and qualitative interviews with criminal justice stakeholders, this article examines the retention and storage of materials, and considers the operation and future of the Forensic Archive Ltd. It details a worrying picture of inconsistency, with confusion over what should be retained, and how. It concludes that justice demands that we accept that the proper retention and storage of materials is fundamental to the fair and effective operation of our criminal justice system, and ensures that the Court of Appeal can fulfil its remit in addressing wrongful convictions and forces can pursue justice in cold cases. The Forensic Science Regulator has the role of setting quality standards for forensic science in the Criminal Justice System (CJS) in England andWales. The current requirement is for organisations carrying out digital forensics to gain accreditation to the international standard ISO/IEC 17025 and the Forensic Science Regulator's Codes of Practice and Conduct. The aim of this requirement is to embed a systematic approach to quality, including understanding methods, validating software and systems, understanding risks, ensuring that all involved in the crime scene to court process have the skills and competence they need and the appropriate equipment and environment for the work, and providing ongoing assurance of quality through audit and proficiency tests. However, the challenge of implementing the standards in digital forensics should not be underestimated, particularly in an environment where there is insufficient capacity to meet a growing demand for services in an area of increasing complexity and fragmented delivery. It is therefore timely to review available data to determine the extent to which accreditation to ISO/IEC 17025 is addressing quality issues in digital forensics and consider what changes and resources could be made available to assist with implementation of quality systems. SUMMARY: The legal decision on whether a defendant can fairly take part in a criminal trial in England and Wales is currently based on the leading case of R v Pritchard (1836), which despite subsequent case law updates does not embrace the concept of mental capacity or effectively identify defendants who are unable to meaningfully participate. Further to an extensive consultation process, the Law Commission published recommendations for reform in 2016, with a proposed new test of capacity to participate effectively in a trial and detailed suggestions for statutory reform of court procedures for managing defendants found unable to participate. Here we review the proposals and consider practical implications and suggestions regarding their implementation. Since the mid-90s there has been almost a 50% reduction in the volume of crime in England and Wales - a trend that has been mirrored in many Western countries (Greenberg Justice Quarterly, 31(1), 154–188, 2014). Despite previous assumptions, for example, declining birth cohorts, it is proposed here that the decline in crime for the 1995–2005 period can largely be attributed to a doubling of the probability of a crime being 'proven' (cf Lloyd et al. 1994; MOJ, 2012; Taylor 2016). However, in the last decade these reductions in crime rates have levelled off to a relatively stable degree. Analysis of published data relating to the performance of the criminal justice system in England and Wales suggests that reductions in crime levels since 2005 are largely accounted for by the fall in proportion of the youth population engaging in offending behaviour. It is argued that falls in rates of crime are largely independent of the offending frequency of young people or variations in the probability of offences being proven; rather, reductions in youth crime over this period could largely be attributed to policy changes, including multiagency interventions targeted at young people who were at risk of starting to offend (McAra and McVie 2015; Smith 2015). Further discussion suggests that the binary proven reoffending rate is not an accurate barometer of criminal justice system performance; rather it is argued that reductions in the youth offending population feed forward into later reductions in the number of adult offenders and further impact on overall crime rates in the longer term. This study examines the prosecution of victims of trafficking for illegal activities they were compelled to carry out due to slavery or exploitation. The legal principle of 'non-punishment' protects victims from criminalization and was adopted in European law in 2005 and United Kingdom (UK) law in 2015. Despite this, prosecutions continue in the UK to date, with trafficking victims sometimes spending lengthy periods in custody. This research asks why that is the case. It adopts a micro-level analysis of two pathways: the first follows the processes within the criminal justice system from arrest to trial, and the second the progression between the state's adoption of law and/or policy and its application by state agents. This study finds that at almost every stage the state fails to take sufficient proactive steps to elicit change, so that business as usual often prevails on the front line. The study also considers two alternative hypotheses: that prosecutions are the result of victims' lack of disclosure, or a result of the need for the courts to establish in each case whether protection is warranted. It concludes that although these factors have some limited effect, state failings are the primary cause of prosecutions which breach the non-punishment principle. This research falls within the wider question of the effectiveness of international human rights law and I hope that it may contribute to the understanding and enhancement of human rights implementation. Background: In almost all countries worldwide, the first point of contact with the criminal justice system is with the police. A large proportion of these individuals may have vulnerabilities, such as mental health difficulties. Given the complexities associated with vulnerable suspects, such interviews may be compromised, which could lead to a miscarriage of justice. In England and Wales, the Police and Criminal Evidence Act (PACE) 1984 and its accompanying Codes of Practice lay down requirements for interviewing vulnerable suspects and provide for attendance of "appropriate adults" to support communication between police and the vulnerable suspect. To date, however, their role has been underresearched.Aims/hypotheses: To explore the role of appropriate adults in police interviews and test the hypotheses, first, that appropriate adults more commonly remain passive during interview than expected from guidance and, second, that any interventions are more likely than not to follow examples in current guidance.Methods: Transcripts of police interviews conducted with suspects with possible mental disorder and an appropriate adult present (N = 27) were analysed using a specially developed coding framework.Results: Appropriate adults were significantly more likely to remain passive than to intervene, even when current guidance would suggest intervention. When they did intervene, however, such interventions were significantly more likely than not to follow from guidance than the vulnerable suspect's needs.
