By re-examining the political thought of Max Weber, Carl Schmitt and Hans Kelsen, this book offers a reflection on the nature of modern democracy and the question of its legitimacy. Pedro T. Magalhães shows that present-day elitist, populist and pluralist accounts of democracy owe, in diverse and often complicated ways, an intellectual debt to the interwar era, German-speaking, scholarly and political controversies on the problem(s) of modern democracy.A discussion of Weber’s ambivalent diagnosis of modernity and his elitist views on democracy, as they were elaborated especially in the 1910s, sets the groundwork for the study. Against that backdrop, Schmitt’s interwar political thought is interpreted as a form of neo-authoritarian populism, whereas Kelsen evinces robust, though not entirely unproblematic, pluralist consequences. In the conclusion, the author draws on Claude Lefort’s concept of indeterminacy to sketch a potentially more fruitful way than can be gleaned from the interwar German discussions of conceiving the nexus between the elitist, populist and pluralist faces of modern democracy. The Legitimacy of Modern Democracy will be of interest to political theorists, political philosophers, intellectual historians, theoretically oriented political scientists, and legal scholars working in the subfields of constitutional law and legal theory.

This chapter approaches the issue of methodological nationalism in the social sciences from both a historical and a contemporary perspective, with particular emphasis on migration studies. First, it offers a historical overview of the problem and delves into its early intellectual history by examining Eric Voegelin’s reflections on ‘national minds’ in the interwar period This anticipates many questions and challenges that future critics of methodological nationalism would consider to be central. Second, we examine the persistence of nation-state-centred concepts and methods in the context of migration and refugee studies. Third, the chapter discusses different conceptual tools for overcoming the insufficiencies of methodological nationalism, weighing both their fruitfulness and their limits. Notwithstanding the ineradicability of nation-state-centred frameworks in social science as well as in the self-perceptions of migrant populations, we show that it is possible to conceive of both ‘community’ and ‘knowledge’ in non-national terms to investigate the possibilities of knowledge produced through experiences of displacement., We would like to thank the editors and contributors to this volume for their helpful suggestions and insightful comments on previous drafts of this chapter. 10. Promise and failure: nationalism in the interwar thought of Carl Schmitt and Eric Voegelin

This article analyses the role played by the concept of nation in the interwar writings of Carl Schmitt (1888–1985) and Eric Voegelin (1901–1985). It contends that, although these conservative thinkers were drawn in different ways to the anti-progressive potential of nationalist ideas, the centre of their political and theoretical horizons in that period is occupied by the problems of political unity and authority. Therefore, their nationalism is fundamentally determined by, and instrumental to, their adherence to a monistic and authoritarian conception of the state. This, in turn, leads them to embrace, though not without some reservations, the solutions put forward by the emergent far-right ‘strongmen’ to the interwar crisis of liberal democracy. Voting in Old and New Democracies examines voting behavior and its determinants based on 26 surveys from 18 countries on five continents between 1992 and 2008.a It systematically analyzes the impact on voting choice of factors rooted in the currently dominant approaches to the study of electoral behavior, but adds to this analysis factors introduced or reintroduced into this field by the Comparative National Elections Project (CNEP)-socio-political values, and political communication through media, personal discussion, and organizational intermediaries.a It demonstrates empirically that these long-neglected factors have significant political impact in many countries that previous studies have overlooked, while "e;economic voting"e; is insignificant in most elections once long-term partisan attitudes are taken into consideration.a Its examination of electoral turnout finds that the strongest predictor is participation by other family members, demonstrating the importance of intermediation. Another chapter surveys cross-national variations in patterns of intermediation, and examines the impact of general social processes (such as socioeconomic and technological modernization), country-specific factors, and individual-level attitudinal factors as determinants of those patterns. Complementing its cross-national comparative analysis is a detailed longitudinal case study of one country over 25 years. Finally, it examines the extent of support for democracy as well as significant cross-national differences in how democracy is understood by citizens.Written in a clear and accessible style, Voting in Old and New Democracies significantly advances our understanding of citizen attitudes and behavior in election settings.

Recent confrontations between constitutional courts and parliamentary majorities in several European countries have attracted international interest in the relationship between the judiciary and the legislature.Some political actors have argued that courts have assumed too much power and politics has been extremely judicialized. Yet the extent to which this aggregation of power may have constrained the dominant political actors'room for manoeuvre has never been examined accurately and systematically. This volume fills this gap in the literature. To explore the diversity and measure the strength of judicial decisions, the authors have elaborated a new methodology that is intended to give a more nuanced picture of the practice of constitutional adjudication in Europe. The work opens with an assessment of the existing literature on empirical analysis of judicial decisions with a special focus on Western Europe and a short summary of the methodology of the project. This is followed by 11 country studies and a concluding chapter providing a comprehensive comparative analysis of the results. This book analyses the multifaceted ways law operates in the context of human mobility, as well as the ways in which human mobility affects law.Migration law is conventionally understood as a tool to regulate human movement across borders, and to define the rights and limits related to this movement. But drawing upon the emergence and development of the discipline of mobility studies, this book pushes the idea of migration law towards a more general concept of mobility that encompass the various processes, effects, and consequences of movement in a globalized world. In this respect, the book pursues a shift in perspective on how law is understood. Drawing on the concepts of ‘kinology'and ‘kinopolitics'developed by Thomas Nail as well as ‘mobility justice'developed by Mimi Sheller, the book considers movement and motion as a constructive force behind political and social systems; and hence stability that needs to be explained and justified. Tracing the processes through which static forms, such as state, citizenship, or border, are constructed and how they partake in production of differential mobility, the book challenges the conventional understanding of migration law. The interaction between military and civilian courts, the political power that legal prerogatives can provide to the armed forces, and the difficult process civilian politicians face in reforming military justice remain glaringly under-examined, despite their implications for the quality and survival of democracy. This book breaks new ground by providing a theoretically rich, global examination of the operation and reform of military courts in democratic countries. Drawing on a newly created dataset of 120 countries over more than two centuries, it presents the first comprehensive picture of the evolution of military justice across states and over time. Combined with qualitative historical case studies of Colombia, Portugal, Indonesia, Fiji, Brazil, Pakistan, and the United States, the book presents a new framework for understanding how civilian actors are able to gain or lose legal control of the armed forces. The global financial, economic and sovereign debt crisis since 2008 has led to increases in political disaffection among citizens, a loss of legitimacy of political institutions, the discredit of mainstream parties and the rise of extremist or anti-system political alternatives. This comparative volume sheds greater light on this critical juncture in the recent history of the European Union (EU) by focusing on the evolution of attitudes of national political elites. It examines whether the crisis has affected the legitimacy of the EU integration project as perceived by national political elites and, consequently, if the elite consensus that constituted one of the most solid fundamentals supporting that project has been eroded. Analysing these changes across the different dimensions in which support for the EU is organized and its relationship with the evolution of support towards European integration among citizens in member states, the book addresses a basic question: How have these events affected the perceptions of the EU of national political elites? Ultimately, it sheds light on the evolution of the relationship between the perception of the EU and the national contexts, as well as the likely evolution of the project of European integration in the near future. This book will be of key interest to scholars and students of political elites, EU politics, European integration, political parties, and more broadly to comparative politics, European studies and sociology.

This book analyses social movements and radical political parties'strategies in Spain, Greece, Portugal and Italy from 2008 to today. Events in 2011 such as the Arab Spring and the indignados movement in Spain initiated a new cycle of social protest. This book explores how the economic crisis and policies of austerity have transformed and continue to transform social movements, trade unions and radical political parties in Southern Europe. The economic crisis has led to a rise in protest movements, which confront political institutions and conventional forms of democracy, and develop new spatial and organisational strategies. This book examines these cases, in addition to those groups who, contrastingly, have used institutional politics to achieve their aims, such as new political parties like Podemos in Spain or Movimento 5 Stelle in Italy. Analysing the extent to which there has been a change in approach when it comes to contesting neo-liberal capitalism, this book makes an important contribution to the study of social movements and radical politics. With a comparative perspective and an emphasis on studying the largely unexplored recent social and political dynamics in the European periphery, this book is essential reading for students, scholars and activists interested in social movements, radical politics and European politics more generally.

In the past few years, constitutional courts have been presented with new challenges. The world financial crisis, the new wave of terrorism, mass migration and other country-specific problems have had wide-ranging effects on the old and embedded constitutional standards and judicial constructions. This book examines how, if at all, these unprecedented social, economic and political problems have affected constitutional review in Europe. As the courts'response must conform with EU law and in some cases international law, analysis extends to the related jurisprudence of the European Court of Justice and the European Court of Human Rights. 'After decades of isolation and a turbulent transition to democracy, Portugal's integration into the European Union has given political, economic, social, and cultural stability to a country that had to overcome the trauma of losing an empire. This volume clearly is a major contribution to the study of how Portugal became part of the European Union as a political system and its development towards Europeanization and domestication.Magone first lays a theoretical framework for the study of Europeanization and discusses political parties, the political system, and Portuguese society in terms of Europeanization. He then examines public administration, how the European Union and the OECD impacted on the modernization agenda, and includes a discussion of the national EU policy coordination. Magone also considers the Portuguese Euro-elite and how they interacted with the Portuguese presidency and the processes of decision-making going on among the different levels of the governance system of the European Union. He highlights a case study of the Portuguese presidency of the European Union, which took place in the first half of 2003. In addition, Magone discusses the impact of the EU structural funds on Portugal, and scrutinizes Portuguese foreign and defense policies, in particular its reconstructed foreign policy, which was clearly instrumental in achieving the independence of East Timor. It has been argued that the emergence of a European collective identity would help overcome growing disparity caused by the increasing diversity of today's European Union, with 28 member states and more than 500 million people.Research on European integration is facing the pressing question of what holds ‘Europe'together in times of crisis, growing distributional conflict and instability in its neighbourhood. Fado, often described as'urban folk music', emerged from the streets of Lisbon in the mid-nineteenth century and went on to become Portugal's'national'music during the twentieth. It is known for its strong emphasis on loss, memory and nostalgia within its song texts, which often refer to absent people and places. One of the main lyrical themes of fado is the city itself. Fado music has played a significant role in the interlacing of mythology, history, memory and regionalism in Portugal in the second half of the twentieth century. Richard Elliott considers the ways in which fado songs bear witness to the city of Lisbon, in relation to the construction and maintenance of the local. Elliott explores the ways in which fado acts as a cultural product reaffirming local identity via recourse to social memory and an imagined community, while also providing a distinctive cultural export for the dissemination of a'remembered Portugal'on the global stage.

This book makes the case that several East Central European countries have emerged as fully consolidated democracies. As such, they may be integrated into the mainstream of political science research, and not consigned forever to a transitional category encompassing countries that are now fully democracies as well as some that are not democratic at all. The author outlines the steps of another transition - from post-communist studies to political science research. He demonstrates how institutionalist, or rational choice, theories can be applied to the analysis of political processes in the successfully democratized countries, and proposes a new research agenda for political scientists studying the region. The results of this work can enrich political science as well as our understanding of both democracy and the polities of contemporary Eastern Europe.

Democracies evolve. Their evolution is not only key to their survival; it is also a reflection of the changing environment in which they operate. This book contributes to the analysis and understanding of how democratic states have transformed over time by examining a number of challenges and opportunities that they face. Foreword by Adrian Forty.The Algarve is not only Portugal's foremost tourism region. Uniquely Mediterranean in an Atlantic country, its building customs have long been markers of historical and cultural specificity, attracting both picturesque driven conservatives and modernists seeking their lineage. Modernism, regionalism and the ‘vernacular'– three essential tropes of twentieth-century architecture culture – converged in the region's building identity construct and, often the subject of strictly metropolitan elaborations, they are examined here from a peripheral standpoint instead.Drawing on work that won the Royal Institute of British Architects President's Award for Outstanding PhD Thesis in 2013, Algarve Building challenges the conventional inclusion of Portuguese modern architecture in ‘Critical Regionalism'narratives. A fine-grain reconstruction of the debates and cultures at play locally exposes the extra-architectural and widely participated antecedents of the much-celebrated mid-century shift towards the regional. Voting in Old and New Democracies examines voting behavior and its determinants based on 26 surveys from 18 countries on five continents between 1992 and 2008. It systematically analyzes the impact on voting choice of factors rooted in the currently dominant approaches to the study of electoral behavior, but adds to this analysis factors introduced or reintroduced into this field by the Comparative National Elections Project (CNEP)—socio-political values, and political communication through media, personal discussion, and organizational intermediaries. It demonstrates empirically that these long-neglected factors have significant political impact in many countries that previous studies have overlooked, while'economic voting'is insignificant in most elections once long-term partisan attitudes are taken into consideration. Its examination of electoral turnout finds that the strongest predictor is participation by other family members, demonstrating the importance of intermediation. Another chapter surveys cross-national variations in patterns of intermediation, and examines the impact of general social processes (such as socioeconomic and technological modernization), country-specific factors, and individual-level attitudinal factors as determinants of those patterns. Complementing its cross-national comparative analysis is a detailed longitudinal case study of one country over 25 years. Finally, it examines the extent of support for democracy as well as significant cross-national differences in how democracy is understood by citizens.Written in a clear and accessible style, Voting in Old and New Democracies significantly advances our understanding of citizen attitudes and behavior in election settings.
