Outside the pages of Ms., divorced men's rights activist Charles Metz opened his own manifesto on marriage reform with a triumphant recognition that'noise is swelling from hundreds of thousands of divorced male victims.'In the 1960s and 70s, a broad array of Americans identified marriage as a problem, and according to Alison Lefkovitz, the subsequent changes to marriage law at the state and federal levels constituted a social and legal revolution.The law had long imposed breadwinner and homemaker roles on husbands and wives respectively. These approaches are seen to interpenetrate and to compose a coherent body of legal theory—a unified framework for understanding such seemingly disparate phenomena as the economics of free speech, the intellectual history of economic analysis of law, the relation between income and liberty, the law of possession, the psychology of legal decisionmaking, the role of emotion in law, and the use of citation analysis to evaluate judges and law professors. The book carries on Posner's project of analyzing the law as an institution of social governance.

The American West has had the highest divorce rate in the world from the 1870's to the present. In examining why marriages dissolve so frequently in the West, this volume is the first to explore the topic in a systematic, scholarly manner. It looks at a wide range of courtship and marriage practices among Anglos, Native Americans, Hispanics, and African Americans. In studying men and women across cultural and ethnic lines, Riley argues that traditions often overlapped each other but never gave rise to widely accepted norms. Riley devotes separate chapters to each phase in the life cycle of relationships - courting, the fusing and rending factors influencing marriage, the difficulties of intermarrying, and the dissolving of unions through separation, desertion, and divorce. She finds that family conflict occurred across cultures throughout the West when traditions clashed and people were unwilling or unable to blend beliefs or practices.
