The fifth volume of Birkhäuser Advances in Infectious Diseases is focused on pediatric infectious diseases. In modern medicine, the discipline pediatric infectious diseases is an important medical specialty. The successful prevention of childhood dise- es like diphtheria, tetanus and pertussis has made a major contribution to the improvement of public health. Understanding the biology of causative agents and the pathogenesis is an essential step in achieving control and elimination of disease. Today pediatric infectious diseases research is closely interconnected with other disciplines. This volume addresses vaccination, historical, epidemiological and soc- cultural issues as well as clinical and molecular biological aspects of pe- atric infectious diseases. New insights into the pathogenesis of infection are presented and an update on diagnostics, prevention and treatment of pe- atric bacterial, viral, fungal and parasitic diseases is provided. The role of emerging new pathogens is also pointed out. Finally, the future perspectives of pediatric infectious diseases are highlighted. Stefan Wirth untersucht, in welchem Umfang ein strafrechtlicher Schutz der Privatversicherer erforderlich ist. Dazu wird eine Annäherung an die faktischen Dimensionen der nachteiligen Verhaltensweisen versucht und das Vermögen der Versicherer als zu schützendes Rechtsgut ermittelt. Ausgehend von der zivilrechtlichen Ausgestaltung des Versicherungsverhältnisses, bestimmt der Autor die Verhaltensweisen, die als Anknüpfungspunkt für einen strafrechtlichen Schutz in Betracht kommen. Er analysiert den strafrechtlichen Schutz der Versicherer durch § 263 StGB, sonstige allgemeine Straftatbestände und Sondernormen, insbesondere durch §§ 265 a.F./n.F., 263 Abs. 3 S. 2 Nr. 5 StGB und gibt einen umfassenden Überblick über den geltenden Strafrechtsschutz der Versicherer und seine historische Entwicklung. Unter Berücksichtigung der über einhundertjährigen Reformdiskussion zu § 265 a.F. StGB wird geprüft, ob es eines speziellen Schutzes der Versicherer durch Sondernormen bedarf, was wegen des umfassenden und ausreichenden Schutzes durch allgemeine Straftatbestände verneint wird, weshalb die §§ 265, 263 Abs. 3 S. 2 Nr. 5 StGB ersatzlos gestrichen werden können.
