This book engages in a constructive, practical debate on the nature and effects of uncertainty in global politics. International contributors explore the processes associated with different forms of uncertainty in the context of environmental issues, diplomacy and international negotiations, and conflict and security. From the collapse of the Soviet Union to the 1997 and 2008 financial crises to the Arab Uprisings and the European migrant crisis and the COVID-19 pandemic, assessments of many events with lasting consequences on the global order have begun with: “why didn’t we see this coming?” There is much to learn from how phenomena that affect the global order generate uncertainty and what effects such uncertainty has on actors and issues. Presenting perspectives from all corners of the discipline and emerging and established scholars the book provides an up-to-date overview of the state of the literature; a concise yet conceptually rich theoretical framework; a mix of regional and global contemporary issues; process-oriented empirical evidence and methodological tools to assess different forms of uncertainty and propose practical solutions to addressing uncertainty in diverse contexts. International law concerning maritime boundary dispute resolution reflects normative aspirations for peacefully managing some of the most intractable challenges in foreign affairs. Focusing on key international law issues relating to maritime boundary disputes, this book explores how international law and legal institutions facilitate these goals theoretically and practically. This process includes a balance of equities among states grounded in the Charter of the United Nations and the protection of sovereignty, territorial integrity, and political independence of Member States, while avoiding threats to the peace, breaches of the peace, and acts of aggression. The UN Charter is complemented by the rules in customary law and UNCLOS for evaluating maritime claims and addressing disputes, including conciliation, litigation, and arbitration. Despite the comprehensive nature of these procedures, numerous maritime disputes persist, including those in the East China Sea and South China Sea. As the disputes continue, however, general international law and the UNCLOS framework captures additional norms and rules that may act to reduce tension and manage disputes. As States shift closer to or farther from compliance on maritime claims and delimitation, the rules of behavior that pertain to flag States and coastal States may help to maintain the peace. This volume offers a distributed study in the factors affecting maritime disputes, international law frameworks and diplomatic models for addressing them, and legal, security, and historical dynamics in East Asia. The book goes beyond the existing debate to offer suitable methods for managing contemporary disputes and makes a meaningful impact on thinking about regional maritime security and international maritime law.

Climate change is modifying, in varying measure, the coastal geography of States. The phenomenon is not temporary but is expected to carry on during the 21st century and beyond.A distinctive feature of modern international law is the concept of maritime zones. Each maritime area is subject to an intricate scheme of States'rights and obligations. Coastal geography is a fundamental component of a long-standing method, developed and agreed upon between States, to establish the outward limits of these areas. A feature of this method is the baseline. In international law it is the only reference line from where the outward limits of maritime zones are measured. There are clear rules on how this is established along a coast. There is a concern amongst a number of States that rising sea water levels as a result of climate change may compel them to shift their baselines inward thus affecting the outward limits of their maritime zones. It is clear that the stability of maritime boundaries is put into question and this may bring about serious political, legal and economic repercussions. This concern may also affect the outcome of dispute settlement procedures before a competent international court or tribunal the purpose of which is to resolve overlapping maritime claims. Key questions emerge. What is the role played by coastal geography in the legal regime determining the outward limits of maritime zones? What are the consequences of changes to coastal geography? To what extent are dispute settlement procedures before a Court or Tribunal immune from this concern? Is international law able to address this? If so, in what way and what are its limits? What can be done to resolve this?

This volume assesses the nexus of gender and transboundary water governance, containing empirical case studies, discourse analyses, practitioners'accounts, and theoretical reflections.Transboundary water governance exists at the intersection of two highly masculinised fields: diplomacy and water resources management. In both fields, positions are mainly held by men, and core ideas, norms, and guiding principles that are presented as neutral, are both shaped by men and based on male experiences. This book sheds light on the often hidden gender dynamics of water conflict and cooperation at the transboundary level and on the implicit assumptions that guide research and policies. The individual chapters of the book, based on case studies from around the world, reveal the gendered nature of water diplomacy, take stock of the number of women involved in organisations that govern shared waters, and analyse programmes that have been set up to promote women in water diplomacy and the obstacles that they face. The United Nations Convention on the Law of Sea (‘UNCLOS') is hailed as one of the most significant multilateral legal agreements executed in the past few decades. However, its shortcomings are neither trivial nor inconsequential, especially regarding maritime boundary disputes involving hydrocarbon resources. This monograph examines the relationship between UNCLOS and maritime boundaries in five non-polar regions, encompassing almost 90% of global unresolved disputes involving offshore hydrocarbon development. The regions, which include the eastern Mediterranean, the Caspian Sea, the Persian Gulf, northeast Asia, and the South China Sea, were chosen for their oil and gas resources potential and recent military skirmishes that have the potential to lead to wider regional confrontations. The book addresses each region's maritime boundary status in the context of specific articles within UNCLOS that have been exploited by disputing states to justify their overlapping claims. The history and future applicability of multilateral Joint Development Area agreements for each region are evaluated for their potential to provide a cooperative solution to resolve ongoing tensions. Coastal States exercise sovereignty and sovereign rights in maritime zones, measured from their coasts. The limits to these maritime zones are bound to recede as sea levels rise and coastlines are eroded. Furthermore, ocean acidification and ocean warming are increasingly threatening coastal ecosystems, which States are obligated to protect and manage sustainably. These changes, accelerating as the planet heats, prompt an urgent need to clarify and update the international law of maritime zones. The Continental Shelf Delimitation Beyond 200 Nautical Miles provides an up-to-date and informed analysis of the now fast developing, yet confusing, field of the law of maritime delimitation. It examines the procedural matters in relation to the competence of international courts and tribunals in the light of the institutional framework of the United Nations Convention on the Law of the Sea and discusses the methodological questions arising out of the delimitation process. Many disputed maritime areas exist around the world. Often, the States concerned have not been able to reach agreement on how to, for example, regulate commercial activities within such areas. Conflict regularly arises between claimant coastal States if one of them acts unilaterally, such as in the South China Sea. This book examines the rights and obligations States have under international law concerning disputed maritime areas, in the first comprehensive treatment of this highly topical and pressing issue. It analyses conventional law, general international law, judicial decisions, State practice, and academic opinions that shine a light on the international legal framework that is applicable in disputed maritime areas. Proposing practical solutions on how to interpret the relevant international law, the book discusses the extent to which it currently provides clear guidance to States, and how international courts and tribunals have dealt with cases related to activities in disputed maritime areas.

Most of the world's maritime boundary disputes involve privately held rights - relating to such matters as fishing, petroleum exploration and scientific research - that states have unilaterally granted to non-state actors in areas of overlapping national claims. An international lawyer would typically investigate the legality of a state's decision to create such rights without notifying or consulting its neighbour, and the legal consequences this action would have for the interests of the states concerned. Departing from this approach, Dr Marianthi Pappa examines such situations from the perspective of the non-state actors: what will happen to private rights in a disputed maritime area if it changes hands from state A to state B due to a subsequent delimitation treaty or judgment? Does the legal framework of maritime delimitation protect those rights effectively against a potential reallocation? To address these questions, the book considers the place that private rights have in land boundary-making.

Some years ago, while a Senior Lecturer-in-Law at BPP University, one of my Master of Laws'students asked if he could write a dissertation in Maritime Law. He wanted to do a survey of the rules of both Admiralty Law and the Law of the Sea. The department contained no specialist in either of these fields, and I taught neither. As he could not be dissuaded from this plan, I had to undertake a rapid, informal, self-directed learning programme in the subjects in order to gain sufficient professional skill to be able to supervise, and, later, assess the dissertation. His project was surprisingly good–and I had my first contact with rules concerning territorial seas, contiguous zones, exclusive economic zones, continental shelves and high seas. My interest in these topics grew and, eventually, flourished in the project of this monograph. The book covers the laws in the United Nations Convention on the Law of the Sea 1982 that concern baselines and boundary delimitation, together with cases which relate to these topics. There is also a major input to the monograph from procedural matters pertaining to the International Court of Justice, the International Tribunal for the Law of the Sea and arbitration under Annex VII to the Convention, with an example case provided for each of these mechanisms. As States Parties to the Convention may make a Declaration under its Article 287 for the settlement of their disputes by one or more of these methods–together with special arbitration under Annex VIII to the Convention for four issues specified therein–this Article, together with the methods and the remainder of Part XV of the Convention, are core material for a systematic review of the Law of the Sea. In instances in which it is possible, comparisons are made between: (i) the United Nations Convention on the Law of the Sea and its predecessors, i.e., the Geneva Conventions from 1958, and (ii) the rules of the International Court of Justice and those of the International Tribunal for the Law of the Sea. In essence, the Convention builds upon its precursory instruments, which tend to be simpler than the former, and the procedural rules for the International Tribunal for the Law of the Sea are similar or identical to those of the International Court of Justice, other than a few provisions that are new or materially modified from the terms of the Cour, but with the necessary changes from the latter being made. The cases at this level are fewer than in black-letter subjects of the law, but tend to be complex and, for the legal scholar, very interesting. This is especially true of the South China Sea Arbitration, which was a judgment of pioneering brilliance from an Annex VII arbitral tribunal composed of one academic and four experienced judges, to which a substantial literature has–in the short period since this case's resolution–been devoted. This book examines the implications of geographical change for maritime jurisdiction under the law of the sea. In a multistranded intervention, it challenges existing accounts of the consequences of climate-related change for entitlement to maritime space, maritime limits, and international maritime boundaries. It also casts new light on the question of whether a loss of habitable land and large-scale population displacement will precipitate a loss of territorial sovereignty and the legal'extinction'of affected States. This study of the legal significance of geographical change is grounded in an in-depth study of the role of geography in the law of the sea. As well as offering a new perspective on the pressing question of how climate change will affect maritime jurisdiction, territorial sovereignty, and statehood, the book contributes to the scholarship on maritime delimitation and international boundaries generally (on land and at sea). Maritime Cooperation in Semi-Enclosed Seas, edited by Keyuan Zou, brings together distinguished scholars to discuss how and to what extent Article 123 of the LOSC has been implemented in state practice in East Asia and Europe, and what kind of existing experiences can be observed and lessons drawn so as to promote maritime cooperation in semi-enclosed seas. In 1986, Lewis M. Alexander, a world-renowned marine geographer, prepared for the U.S. Department of Defense a report, Navigational Restrictions within the New LOS Context: Geographical Implications for the United States. Edited by J. Ashley Roach, the reformatted report is presented in five sections and includes 20 maps, illustrating the world's international straits and major ocean navigation routes. Forty-three tables present the most comprehensive descriptions of the world's straits used for international navigation, as well as identify various categories of maritime claims. What made the Report extraordinarily valuable in 1986, and which makes it equally valuable today, is the compilation of geographic data - not available elsewhere - describing the world's straits used for international navigation and illustrations of the chokepoints and major international shipping trade routes. Roach has faithfully reproduced Alexander's seminal work by retaining the original structure and references. A table of defined terms and an index have been added.

For the Makahs, a tribal nation at the most northwestern point of the contiguous United States, a deep relationship with the sea is the locus of personal and group identity. Unlike most other indigenous tribes whose lives are tied to lands, the Makah people have long placed marine space at the center of their culture, finding in their own waters the physical and spiritual resources to support themselves. Equity emerged as a powerful symbol of aspired redistribution in international relations. Operationally, it has had limited impact in the Westphalian system of nation states - except for maritime boundary delimitations. El manual incluye información de orden jurídico, técnico y práctico que se considera esencial para negociar la delimitación de fronteras marítimas entre los Estados ribereños. También contiene información relativa a la solución pacífica de controversias en caso de que las negociaciones no tengan éxito y los Estados interesados deseen valerse del mecanismo de solución de controversias establecido en la Convención de 1982.
