This volume offers different perspectives on judicial practice in the European and American contexts, both arguably characterized in the last decades by the emergence of novel normative and even policy arguments by judges. The central question deserving the attention of the contributors concerns the degree in which judicial exercises in practical reasoning may amount to forms of judicial usurpation of the legislative function by courts. Since different views as to the nature and scope of legal reasoning lead to different degrees of tolerance regarding what should be admissible to courts, that same nature and scope is thoroughly debated.The main disciplinary approach is that of general jurisprudence, but the contributions take stock of other disciplines in which judicial activism has been addressed, namely positive theories of judicial behavior. Accordingly, the book also explores the development of interdisciplinary dialogue about the theme.

This book is a long-overdue contribution to the history of Black feminist activism in the UK. It provides unique insights into both historical and contemporary issues that impact Black women, their families and their communities, including immigration, education, policing, domestic violence and poverty. It fills a void in sociological and feminist literature by centring the voices, lived experiences and perspectives of women of the African and Caribbean Diaspora in the UK. Through the use of research, archival materials, narrative interviews, photographs, poems and reflective conversations, the authors explore the social issues which inspired these women's action for change. In drawing on personal and professional testimonies grounded in over two decades of community activism and scholarly analysis, the authors weave together the story of the Abasindi Cooperative, a woman's organisation famed for its progressive and far-reaching social justice programmes. In so doing the authors reveal narratives of political struggle that have their resonance in present-day society. This book is an acknowledgment and celebration of the sociopolitical activism and achievements of Black women in the UK and represents the hope, solidarity and triumph possible when women organise collectively to tackle social and racial injustice.

This book demonstrates why and how social activism targeting companies can produce unintended consequences. While it is challenging for social movement organizations (SMOs) to successfully change corporate behavior, it is even more difficult or impossible for SMOs to control the spillover effects of success. Successful social activism affects companies and consumers with diverse interests and intentions beyond the initial target of SMOs, which creates various business opportunities. Entrepreneurs are mobilized by the new opportunities that they identify to initiate their own businesses, and the chain of their actions may produce new market categories unintended by the SMO, including ones that are inconsistent with its superordinate goal. This book explores the process by which an SMO succeeds in changing corporate behavior and how this success leads to unintended market emergence by longitudinally examining the shoe industry in postwar Japan. The Japan Institute of Footwear, a private organization, began advocating shoe functionality over fashion in the 1960s and succeeded in changing corporate behavior in the 1980s through learning by doing; its success led to the unintended emergence of new market categories. The book's findings offer novel theoretical insights into the relationship between social activism and market change. The analysis also helps us understand the historical context of a movement that emerged in 2019, #KuToo—the word being an amalgam of kutsu (shoes), kutsū (pain), and #MeToo—and to consider its future.

This book frames a series of protests occurred in Brazil from 2013 to 2016 as exemplary cases of global trends in contentious politics to analyze the tension between two forms of collective action: the militant (militante) and the prefigurative activist (ativista). Building on sociology, political science, and psychology, it explores the relationship between protestors'activities and conceptions of political participation with their subjectivity and agency. The protest cycle triggered by the June 2013 events in Brazil gave strength and popularity to repertoires and strategies of collective action uncommon and innovative. Those praxes defied political parties'conventions, highlighted the limitations of militant unionist tradition, and brought prefigurative activism to the Brazilian left-wing agenda. In this book, Andre Luis Leite de Figueirêdo Sales combines theoretical tools and traditions from South and North America to build an interdisciplinary approach to Political Psychology and answer the question: what psycho-political differences lie behind the disparate forms of political action adopted by militantes (militants) and ativistas (prefigurative activists) in Brazil? Inspired by books of short stories, the chapters discuss different aspects of the distinction between militancy and prefigurative activism. On them, the author deals with problems such as: how are the ongoing changes in Brazilian protest culture connected with the rising popularity of autonomist movements across the globe? This book examines the reasons for which children join terrorist movements and how they eventually become peace activists fighting the very crimes that they once committed. The transformation of child terrorists into peace activists has received scant attention from academics and practitioners alike. Particular focus is placed on child jihadism, child terrorism in Africa and Latin America, child separatist terrorism, and White child supremacism. These five groups of child terrorists represent about 80% of the problem across the world. The text serves as a primer for anti-terrorism and peace activism for global social change. It includes original, applied research and features personal accounts from former child terrorists who became peace activists themselves. One of the nine chapters provides an in-depth thematic analysis of the lives of 24 subjects (from all five aforementioned groups). The analysis produced four main themes that encapsulate the time and effort that it takes to become a peace activist today: metamorphosis, terrorist behavior, disillusionment, and anti-terrorist behavior. This book is about Madeleine Slade (1892-1982) and Catherine Mary Heilemann (1901-1982), two English associates of Mohandas K. (Mahatma) Gandhi (1869-1948), known in India as Mira Behn and Sarala Behn. The odysseys of these women present a counternarrative to the forces of imperialism, colonialism, capitalism, and globalized development. The book examines their extraordinary journey to India to work with Gandhi and their roles in India's independence movement, their spiritual strivings, their independent work in the Himalayas, and most importantly, their contribution to the evolution of Gandhian philosophy of socio-economic reconstruction and environmental conservation in the present Indian state of Uttarakhand. The author shows that these women developed ideas and practices that drew from an extensive intellectual terrain that cannot be limited to Gandhi's work. She delineates directions in which Gandhian thought and experiments in rural development work and visions of a new society evolved through the lives, activism, and written contributions of these two women. Their thought and practice generated a new cultural consciousness on sustainability that had a key influence in environmental debates in India and beyond and were responsible for two of the most important environmental movements of India and the world: the Chipko Movement or the movement against commercial green felling of trees by hugging them, and the protest against the Tehri high dam on the Bhagirathi River. To this day, their teachings and philosophies constitute a useful and significant contribution to the search for and implementation of global ideas of ecological conservation and human development.

This book argues for renewed understandings of academic activism, understandings that conceive of the ideas, arguments and scholarship of the academe as embedded within the practices of what the academy does. It examines why and how a renewed notion of academic activism informs a philosophy of higher education specifically in relation to teaching and learning. The book focuses on the theories and practices of teaching and learning, in particular how such pedagogical actions are guided by social, political and cultural influences outside of the university as a higher education institution. The authors advocate for a living philosophy of higher education that is commensurate with real actions and imaginary fictions of what constitutes higher education and what remains in becoming for the discourse. This open access book documents and analyses the various interventions – legal, political, and even artistic – that followed the Ali Enterprises factory fire in Karachi, Pakistan, in 2012. It illuminates the different substantive and procedural aspects of the legal proceedings and negotiations between the various local and transnational actors implicated in the Ali Enterprises fire, as well as the legal and policy reforms sparked by the incident. This endeavour serves to embed these legal cases and reform efforts in the larger context of human and labour rights protection and global value chain governance. It also offers a concrete case study relevant for ongoing debates around the role of transnational approaches in making human rights litigation, advocacy, and law reform more effective. In this regard, the book interrogates and critically reflects on such legal campaigns and local and transnational reform work with a view to future transformative legal and social activism.

This book analyzes the effect of gender on policy-making in the Jamaican Parliament, specifically regarding women-friendly policies. So-called'women-friendly policies'are categorized as those laws which seek to promote and protect women's rights and equality and have some element addressing childcare, domestic violence, sex offences, reproductive rights, sex discrimination, property rights and family issues. It frames critical analysis of bill sponsorship and the participation levels and verbal contributions of legislators during floor debates on legislation affecting women. Using a mixed method approach, the author gives insight into how feminism is integrated into real-time public policy discourse. The book begins with a brief overview of feminist advocacy and activism and State feminism in Jamaica and an introduction to the country's Parliamentary system. It then moves to a theoretical discussion of feminist advocacy within public policy debates. The next two chapters present a time series analysis of bill introduction and floor debates on women's interests and issues legislation from 1962 through 2017. The concluding chapter ties up the research and provides recommendations for moving forward. Combining feminist theory with a detailed view of Jamaican Parliamentary procedure and debate, this book will be useful to students and researchers interested in feminist advocacy and activism, minority representation, democratic governance, and women in politics.

In this book the author argues that judicial activism in respect of the protection of human rights and dignity and the right to due process is an essential element of the democratic rule of law in a constitutional democracy as opposed to being ‘judicial overreach'. This book critically examines the many complex entanglements between AIDS activism and HIV science. It takes readers on a medical anthropological expedition across time and space that highlights the stakes from the perspective of those most affected by the epidemic. Author Robert Lorway reveals how early in the HIV epidemic, amid inadequate government leadership, communities of people living with and directly affected by HIV and AIDS rose to become a vital force at the forefront of prevention responses. Yet now, more than three decades later, HIV prevention and treatment is increasingly being placed under the jurisdiction of clinical, epidemiological, and management scientific expertise. In this kind of context, where does activism figure into the possibility of more democratized collaborations between affected communities, scientists, and policy makers? Coverage draws upon the findings from an array of community research projects conducted in Canada, India, and Kenya over a 22-year period. It weaves together rich, original data sources that range from in-depth qualitative interviews, field notes, and primary and secondary archival document retrievals in these three regions. Offering a rich diversity in perspectives, this book tackles the broader themes related to global health policy, science, and transnational activism at the same time as it highlights the experiences and local arenas where debates about activism and science play out. In the end, Lorway questions the growing expectation for affected communities themselves to produce sound evidence to legitimize their advocacy projects. He calls for the planners and implementers of biomedically oriented HIV research and interventions to more meaningfully engage with communities in ways that de-monopolize decision making as a matter of ethics and improved scientific practice.

This book explores how personalized content and the inherent networked nature of the mobile media could and do lead to positive externalities in social progress in Asian societies. 'To earn a degree, every doctoral candidate should go out to Harvard Square, find an audience, and explain his [or her] dissertation'. Everett Mendelsohn's worldly advice to successive generations of students, whether apocryphal or real, has for over forty years spoken both to the essence of his scholarship, and to the role of the scholar. Possibly no one has done more to establish the history of the life sciences as a recognized university discipline in the United States, and to inspire a critical concern for the ways in which science and technology operate as central features of Western society. This book is both an act of homage and of commemoration to Professor Mendelsohn on his 70th birthday. As befits its subject, the work it presents is original, comparative, wide-ranging, and new. Since 1960, Everett Mendelsohn has been identified with Harvard Univer­ sity, and with its Department of the History of Science. Those that know him as a teacher, will also know him as a scholar. In 1968, he began- and after 30 years, has just bequeathed to others - the editorship of the Journal of the History of Biology, among the earliest and one of the most important publications in its field. At the same time, he has been a pioneer in the social history and sociology of science. He has formed particularly close working relationships with colleagues in Sweden and Germany - as witnessed by his editorial presence in the Sociology of Science Yearbook.

In June 2013, after lengthy and complex negotiations the EU adopted the recast “asylum package” which represents a significant step forward in the future development of CEAS. In this timely study Velluti provides fresh insights into recent legislative and judicial developments in asylum and through the “lens” of sovereignty she looks at some of the contemporary challenges faced by the EU protection regime, with a particular focus on asylum-seekers'rights. The volume assesses whether the EU provides an adequate framework for protecting those seeking international protection from the opposing perspectives of effectiveness and fairness. It shows that, despite the newly adopted “second-generation” legislative acts which include changes aimed at ensuring a stronger level of protection for asylum-seekers, the reform process at European level does not adequately ensure an equal standard of protection across all Member States. Through a comparative analysis of selected ECtHR and ECJ asylum cases the book also examines the constitutional relationship between the two European Courts and how it impacts on the human rights of asylum-seekers and on the future of EU asylum law. Ultimately, the book shows that real progress in the development of the human rights dimension of CEAS will be achieved largely through the European and domestic courts.

This open-access book presents cutting-edge research on securitization and democratic development in the OSCE Region. Gathering contributions by practitioners and researchers from various disciplines, it presents case studies and highlights recent activities of proactive engagement in democratic institution-building and responding to security threats from the Balkans to Central Asia. This anthology constitutes an important contribution to the interdisciplinary debate on poverty measurement and alleviation. Absolute and relative poverty—both within and across state boundaries—are standardly measured and evaluated in monetary terms. However, poverty researchers have highlighted the shortfalls of one-dimensional monetary metrics. A new consensus is emerging that effectively addressing poverty requires a nuanced understanding of poverty as a relational phenomenon involving deprivations in multiple dimensions, including health, standard of living, education and political participation. This volume advances the debate on poverty by providing a forum for philosophers and empirical researchers. It combines philosophically sound analysis and genuinely global research on poverty's social embeddedness. Next to an introduction to this interdisciplinary field—which links Practical Philosophy, Development Economics, Political Science, and Sociology—it contains articles by leading international experts and early career scholars. The contributors analyse the concept of poverty, detail its multiple dimensions, reveal epistemic injustices in poverty research, and reflect on the challenges of poverty-related social activism. This book examines the role and nature of the judiciary in Papua New Guinea (PNG), the first comprehensive study since the country's independence in 1975. It challenges the traditional view of the judiciary as solely a legal entity, arguing for its broader social and political functions. Critiquing assumptions inherited from British and Australian colonial thinking, it discusses how decolonisation has redefined judicial power, enabling courts to have a more transformative role. Introducing transformative constitutionalism into Australian-Pacific legal thinking, the book argues that PNG has a transformative constitution defined by its intent for reform, extensive Charter of Rights, and a liberal judiciary—features not found in other Pacific constitutions. Given the region's challenges such as corruption, political instability, and climate change, the book advocates for a more proactive role for the judiciary. It proposes a re-evaluation of the classical tripartite doctrine of separation of powers, advocating for a quadripartite model in PNG where the judiciary has a broader reformative function and the independent constitutional institutions constitute a fourth arm of government. This work makes important contributions to understandings of judicial power and constitutional law as well as other fields including comparative constitutional studies, legal history and decolonial scholarship.

In the Community-building process, citizens are the most invoked and feared, but at the same time the least known subject. This lack of knowledge nourishes the citizens'detachment from the European Union and itself emerged in well known cases such as the French and Dutch referenda on the Constitutional Treaty or the public concern towards the EU policy on immigration. This gap is true especially for active citizenship organizations operating in the European policy making, not only in Brussels, but also and above all at national and local levels, and this book is aimed at filling this knowledge gap. The book is divided into two parts. The first part of the book focuses on the way in which the literature on EU governance and citizenship and on participatory democracy deals with citizen activism in public policy making. The second part discusses a number of empirical research projects on civic activism in Europe. This book aims, on the one hand, to bridge the academic debate to more policy oriented debates in which active citizenship organizations and policy makers are involved; and, on the other hand, to bridge theoretical discussion of the nature of the EU with the empirical literature based on the study of civic activism in Europe and at the national level. The distinctiveness of the book is that it tries to overcome both the “methodological nationalism” that affects the research and public debate on the EU, the normative attitude of most part of European studies in favor of an approach aimed at describing phenomena, and the habit of dealing with civic associations in Europe by referring only to the “Brussels Civil Society,'making it of interest to both policy makers as well as students and scholars in European Studies, Political Science, Sociology and International Relations. ​

Juliano Z. Benvindo investigates the current movement of constitutional courts towards political activism, especially by focusing on the increasing use of the balancing method as a “rational” justification for this process. From the critical perception of the serious risks of this movement to democracy, the book takes as examples two constitutional realities, Germany and Brazil, in order to discuss the rationality, correctness, and legitimacy of constitutional decisions within this context. Through a dialogue between Jacques Derrida's deconstruction and Jürgen Habermas's proceduralism, the author confronts Robert Alexy's defense of the balancing method as well as those two constitutional realities. This confrontation leads to the introduction of the concept of limited rationality applied to constitutional democracy and constitutional adjudication, which affirms the double bind of history and justice as a condition for a practice of decision-making committed to the principle of separation of powers.

​​The Art of Transitional Justice examines the relationship between transitional justice and the practices of art associated with it. Art, which includes theater, literature, photography, and film, has been integral to the understanding of the issues faced in situations of transitional justice as well as other issues arising out of conflict and mass atrocity. The chapters in this volume take up this understanding and its demands of transitional justice in situations in several countries: Afghanistan, Serbia, Srebenica, Rwanda, Northern Ireland, Cambodia, as well as the experiences of resulting diasporic communities. In doing so, it brings to bear the insights from scholars, civil society groups, and art practitioners, as well as interdisciplinary collaborations.

Practitioners of this considerably integrative and widely ranging field aim to address and, in certain cases, confront today's urgent ecological and cultural challenges, namely climate change, urban sustainability, biodiversity conservation, species decline, energy policy, the exigencies of the Anthropocene, environmental activism, and Indigenous peoples'justice. Although the environmental humanities have been relatively slow to gain traction in South Asia, an increasing momentum towards transdisciplinary approaches to ecology and sustainability is palpable in India. Comprising fourteen chapters, this contributed volume is the first major publication to call attention to current work in the environmental humanities in India.
