With the monumental national shift towards electric vehicles (EVs), most notably in states like California, the quest for a previously little-known element called Lithium is in the spotlight. As a result, large oil producing states such as Arkansas and Texas now have an increasing need for legal expertise and legislative action regarding lithium ownership. This paper serves to provide the reader an overview of lithium, its importance, and the legal ramifications of its ownership. It will focus on lithium extraction and ownership rights in Arkansas and Texas and will address the ultimate issue as to whether mandates.for battery production, such as those in California, are.feasible. The genesis of this paper originated from the authors' discussions and topic selection. for a directed research project at Texas Tech University School of Law, Once the research began, the Authors quickly realized the importance and lack of legal scholarship surrounding lithium in Texas and the need for an article directed toward energy law practitioners in Texas and elsewhere in the United States.
