Abstract

The document reports the Washington component of Project IEP (individualized education program), a project designed to identify and clarify perceptions related to roles in the IEP process as mandated by P.L. 94-142, the Education for All Handicapped Children Act. It is explained that under Project IEP approximately 200 persons (including state and local education administrators, regular and special teachers, parents of handicapped children and the children themselves, support personnel, and advocacy groups) were given open-ended interviews. Findings and suggestions are reported for the following areas: parental roles (reasons for, barriers to, and consequences of parental involvement); role of teachers and support personnel (increased demands, effects on morale, accountability, and effects on programs for children); and federal/state/local relationships (monitoring, standards, and fiscal needs for implementation). Listed among IEP Panel recommendations are that there is a need for educators to recognize that their specialized vocabulary may not be functional in communicating with noneducators; that additional resources necessary to meet the mandate of the law will be required; and that to assure optimum development of a child's program that includes future needs, a protective clause should be provided to prevent litigation against the local educational agency if services are not provided as projected. 2. Project to Develop BEH Waiver Requirements, Procedures, and Criteria. Report of Case Study: Massachusetts' Waiver Review Process.

Abstract

The case study examines the review used by the then Bureau of Education for the Handicapped (BEH) to evaluate the compliance of special education programs in Massachusetts with P.L. 94-142, the Education for All Handicapped Children Act. Procedures to develop and implement the waiver review over the period October 1977 to June 1978 are reported. The waiver involves restrictions on supplanting state and local funds with federal funds. Four procedural components are identified and discussed in detail: initiation, design and specification, site selection, and on-site review. Interplay between BEH and the state education agency is described. It is explained that the review covered such aspects as child find, due process procedures and results, personnel, adequacy and comprehensiveness of state monitoring system, and the waiting list of children for services. Quantitative reports are specified for the state to prepare, and a timetable is proposed. Procedures used to select those local education agencies and state operated programs for program review are detailed, and the resulting 12 local educational agency sites are considered. On-site review procedures, including administrator review and public hearings, are described. (CL)

Abstract

The document analyzes monitoring procedures in use by other federal programs in an attempt to help the Bureau of Education for the Handicapped (BEH) develop its own procedures for waiver reviews. Waivers are explained as a request for exemption from P.L. 94-142's (the Education for All Handicapped Children Act) fiscal non-supplant requirements. The analysis is based on monitoring methods used in 11 other federal agencies for such programs as Occupational Health Programming (Department of Labor), Advertising Practices (Federal Trade Commission), Office for Civil Rights (Department of Health, Education and Welfare), Regulations Analysis (Environmental Protection Agency), and the Food Stamp Program (Department of Agriculture). The conclusion relates the BEH waiver review monitoring process to three dimensions: the subjects of monitoring, the orientation of the monitoring function, and the locus of responsibility for monitoring. Three monitoring practices considered most applicable to BEH are discussed: consumer participation, thoroughness and intensity of monitoring, and personnel utilization. (CL)

Abstract

Each component is considered in separate sections, with information on state and federal roles and responsibilities.
