In Intellectual Property Scholarship [...], Analogies are ubiquitous in legal reasoning, and, in copyright jurisprudence, courts frequently turn to patent law for guidance. From introducing doctrines meant to regulate online intermediaries to evaluating the constitutionality of resurrecting copyrights to works from the public domain, judges turn to patent law analogies to lend ballast to their decisions. At other times, however, patent analogies with copyright law are quickly discarded and differences between the two regimes highlighted. Why? In examining the transplantation of doctrinal frameworks from one intellectual property field to another, this Article assesses the circumstances in which courts engage in doctrinal borrowing, discerns their rationale for doing so, identifies whether certain patterns of borrowing exist, and scrutinizes the value, propriety, and impact of such borrowing. By tracing the different strains that animate the courts' analogical jurisprudence in patent and copyright law, the Article builds on broader insights from the scholarship on legal borrowing and offers guidance on how to approach analogies between related legal regimes in a more disciplined fashion. In the end, the Article seeks to provide a better understanding of what juridical techniques courts may deploy to strengthen the efficacy of borrowing--so that importation of legal doctrine can do more good than harm--in intellectual property law and more generally.

Pompe disease is caused by acid alpha-glucosidase (GAA) deficiency, resulting in lysosomal glycogen accumulation. This disease is characterized by progressive skeletal muscle weakness, respiratory distress, and in the infantile-onset form, cardiomyopathy. The only approved treatment is enzyme replacement therapy (ERT) with human recombinant GAA. While ERT therapy extends life span, residual symptoms remain, with poor muscle uptake and immunogenicity limiting efficacy. We examined a novel Centyrin protein—short interfering ribonucleic acid (siRNA) conjugate targeting CD71 (transferrin receptor type 1, TfR1) and GYS1, a key enzyme involved in glycogen synthesis. Unlike existing ERTs designed to degrade aberrant glycogen deposits observed in Pompe patients, the CD71 Centyrin:Gys1 siRNA is designed to restore glycogen balance by inhibiting glycogen synthesis. To this end, we administered the CD71 Centyrin:Gys1 siRNA conjugate to the 6neo/6neoPompe mouse model. Once bound to TfR1, siRNA-conjugated Centyrin is internalized into cells to facilitate gene knockdown. We found that treatment with this conjugate significantly reduced GYS1 protein expression, glycogen synthase enzymatic activity, and glycogen levels in muscle. In addition, impaired treadmill exercise performance of male Pompe mice was improved. These data suggest that Centyrin-mediated delivery of Gys1 siRNA may be an effective next generation therapy for late-onset Pompe disease or, in combination with ERT, for infantile-onset Pompe disease.

The current study tested a mediational model accounting for the hypothesized sequence of relationships between the perceived peer-created learning climate, academic motivation, and indices of student functioning across two cohorts in a Higher Education setting. Utilizing a total of 373 undergraduate psychology students from two independent samples (cohort 1: n= 172; cohort 2: n= 201), our findings revealed that a perceived peer-autonomy supportive climate significantly and positively related to both types of academic motivation, albeit more strongly for autonomous relative to controlled regulation, and was inversely associated with amotivation. In turn, higher levels of autonomous motivation were strongly related with higher levels of engagement, and lower levels of burnout symptoms among the participants, whereas the inverse was observed for controlled and amotivation. Indirect effects were also found concerning the mediational role of academic motivation, and our findings were replicated across samples ruling out the possibility of a potential cohort effect. Overall, our findings point towards the theoretical and practical significance of peer influence for fostering academic motivation and healthy functioning among students in Higher Education. However, they also highlight the potential of peers to create climates which may, on the face of it, appear autonomy-supportive, but promote more introjected and external reasons for student motivation which, in turn, undermines their psychological functioning. Future research unpacking the complex influence of peer climates on student motivation in Higher Education is needed.

Anomalous X-ray diffraction (AXD) and neutron diffraction can be used to crystallographically distinguish between metals of similar electron density. Despite the use of AXD for structural characterization in mixed metal clusters, there are no benchmark studies evaluating the accuracy of AXD toward assessing elemental occupancy in molecules with comparisons with what is determined via neutron diffraction. We collected resonant diffraction data on several homo and heterometallic clusters and refined their anomalous scattering components to determine metal site occupancies. Theoretical resonant scattering terms for Fe0, Co0, and Zn0were compared against experimental values, revealing theoretical values are ill-suited to serve as references for occupancy determination. The cluster featuring distinct cation and anion metal compositions [CoCp2*][(tbsL)Fe3(μ3–NAr)] was used to assess the accuracy of different f′ references for occupancy determination (f′theoretical± 15–17%; f′experimental± 10%). This methodology was applied toward calculating the occupancy of three different clusters: (tbsL)Fe2Zn(py) (6), (tbsL)Fe2Zn(μ3–NAr)(py) (7), and [CoCp*2][(tbsL)Fe2Zn(μ3–NAr)] (8). The first two clusters maintain 100% Fe/Zn site isolation, whereas 8showed metal mixing within the sites. The large crystal size of 8enabled collection of neutron diffraction data which was compared against the results found with AXD. The ability of AXD to replicate the metal occupancies as determined by neutron diffraction supports the AXD occupancy methodology developed herein. Furthermore, the advantages innate to AXD (e.g., smaller crystal sizes, shorter collection times, and greater availability of synchrotron resources) versus neutron diffraction further support the need for its development as a standard technique.

In this paper, an intervention analysis approach was applied to daily cases of COVID-19 in Nigeria in order to evaluate the utilization and effect of the COVID-19 vaccine administered in the country. Data on the daily report of COVID-19 cases in Nigeria were collected and subjected to two models: the naïve solution and the interrupted time series (the intervention model). Based on the Alkaike Information Criterion (AIC), sigma2, and log likelihood values, the interrupted time series model outperformed the Naïve solution model. ARIMA (4, 1, 4) with exogenous variables was identified as the best model. It was observed that the intervention (vaccination) was not significant at the 5% level of significance in reducing the number of daily COVID-19 cases in Nigeria since the start of the vaccination on March 5, 2021, until March 28, 2022. Also, the ARIMA (4, 1, 4) forecasts indicated that there will be surge in the number of daily COVID-19 cases in Nigeria between January and April 2023. As a result, we recommend strict adherence to COVID-19 protocols as well as further vaccination and sensitization programs to educate people on the importance of vaccine uptake and avoid Corona virus spread in the year 2023 and beyond.

Background: Understanding and mitigating the societal economic impact of vision impairment (VI) is important for achieving the Sustainable Development Goals. Aim: To estimate the prevalent societal economic impact of presenting VI in Trinidad and Tobago using bottom-up cost and utilisation data from the 2014 National Eye Survey of Trinidad and Tobago. Methods: We took a societal perspective to combine comprehensive, individual-level cost and utilisation data, with population-based prevalence estimates for VI, and additional data from a contemporaneous national eyecare system survey. We included direct (medical and non-medical) and indirect (productivity loss) costs, and intangible losses in total cost estimates, presented in 2014 Trinidad & Tobago (TT) dollars and UK sterling equivalent. We considered but excluded transfer payments and dead weight losses. Sensitivity analyses explored impact on total cost of parameter uncertainty and assumptions. Results: Individual utilisation and cost data were available for 65.5% (n= 2792/4263) and 59.0% (n= 2516/4263) eligible participants aged ≥40 years, respectively. Participant mean age was 58.4(SD 11.8, range 40–103) years, 56.3% were female. We estimated total societal cost of VI in 2014 at UK£365,650,241 (TT$3,842,324,655), equivalent to £675 per capita (population ≥40 years). Loss of wellbeing accounted for 73.3%. Excluding this, the economic cost was UK£97,547,222 (TT$1,025,045,399), of which indirect costs accounted for 70.5%, followed by direct medical costs (17.9%), and direct non-medical costs (11.6%). Conclusion: This study provides a comprehensive estimate of the economic impact of vision loss in a Caribbean country, and highlights the extent to which affected individuals and their families bear the societal economic cost of vision impairment.

AbstractCoastal restoration projects are significantly important in coastal ecosystems as wetland losses accelerate. This study investigates tidal hydrodynamics and the potential impacts of a waterway opening on an existing roadway to restore and revitalise salt marshes in a small estuarine system in Virginia, USA. A depth-integrated, discontinuous Galerkin shallow-water equations model (DG-SWEM) is applied for astronomic tide simulation. The model employs a high-resolution unstructured mesh with a minimum element size of less than one meter and resolves complex tidal flows in the entire barrier island system, including the existing culvert gate and canal system. Compared to the existing system, the water exchange increased dramatically (flushing time also dramatically decreased) under the opened scenarios regardless of the opening width (22.9-, 30.5-, and 38.1-m width). By increasing the opening width, peak velocity through the proposed opening decreased 30–40%, and the maximum shear stress was reduced by more than half. The high-resolution model represented complex tidal flows, including eddies, and assisted in striking a balance of water-exchange capability, opening stability, and minimising their potential erosions for the opening design. Besides, erosion and sediment transport potentials for suspended sediments were estimated using bed shear stress and a Lagrangian particle tracking module. Such proxy modelling approach allows for the impact assessment of civil engineering and ecological waterworks in complex and highly damped tidal flow areas and is readily transferrable to other like systems (e.g. causeway construction, causeway cutting, biota passageways, and inlet modification).

AbstractIn this study, we attempted to curate a list of tools whose primary intent is to enable and teach children to code. From this list, we developed a framework for the classification of coding tools and reviewed current research to determine how tools are used to teach coding in elementary education. The catalog grew to over 300 specific tools intended to teach coding to children. We subsequently searched Google Scholar for studies of computational thinking in elementary or primary education. This resulted in an analysis of 161 research studies in which there was an intervention intended to teach computational thinking to young children. Through this analysis, we identified patterns in which tools have been used to teach elementary coding, to which audiences, and in what ways.
