Producción Científica, Curiously, we have no previous studies that deal monographically with the question of the sacralisation of spaces in Visigoth Iberia. It is intended in the following pages to fill this historiographical gap by focusing on the particular case of the churches. By means of the compilation and exhaustive analysis of all the available documentary sources, particularly the available conciliar canons, it is aimed to identify the different prescriptions and strategies that were used to sacralise new places of worship in Iberia during the Visigothic period. Particular emphasis will be placed on ritual procedures, which are mandatory for the consecration of any church, but also on material and sensorial factors as complementary determinants in the definition of sacred space. The article examines the relationships between the legal doctrine on the bonds of consanguinity and affinity, and the debates on the validity of marriage among indigenous peoples, from the perspective of their different visual representations. Thus, it explores both the graphics designed in the legal literature, as well as those tree-like representations that can be found in files and chronicles of local native populations. It also pays special attention to the impact of printing techniques on the emergence of graphic representations and their huge implications in legal-theological thought. Finally, the article reflects on the organic metaphor and the use of visual tools in canon law, in order to understanding the transformations that kinship trees underwent when they were used, translated and reproduced in new contexts and their materialities., El artículo examina las relaciones entre la doctrina jurídica sobre los vínculos de consanguinidad y afinidad y los debates sobre la validez de los matrimonios indígenas desde la perspectiva de sus diferentes representaciones visuales. Para ello, explora tanto los gráficos que se diseñaron en la literatura jurídica como aquellas representaciones arbóreas que se encuentran en expedientes y crónicas indígenas. Se presta especial atención también al impacto de las técnicas de impresión en el surgimiento de representaciones gráficas y sus implicaciones en el pensamiento jurídico-teológico. Finalmente, el artículo reflexiona sobre la metáfora vegetal y el uso de herramientas visuales en el derecho canónico, con vistas a entender las transformaciones que experimentaron los árboles de parentesco al ser traducidos, usados y reproducidos en nuevos contextos y materialidades.

El propósito de este número monográfico es analizar el uso de iconografías religiosas en manuscritos y libros impresos jurídicos para establecer un foro de discusión e intercambio sobre los diversos aspectos artísticos, históricos y sociales de estas iconografías.

The article focuses on codex XXV held at the Biblioteca Capitolare di Vercelli, a partially illuminated copy of the early manuscript tradition of the Decretum Gratiani, originally titled as Concordia discordantium canonum, which became shortly after its composition in Bologna before the mid-twelfth century one among the main reference textbooks for studying and teaching canon law in theWestern MiddleAges.The codex inVercelli has been at the core of a complicate literature and well exemplifies the issues offered by the early illuminated manuscripts of the Decretum, especially those produced in Italy, particularly with regards to the creation place and the origin of the artists responsible for the illumination.

The manuscript presented in this contribution, a Liber Sextus preserved in the Library of Congress in Washington DC (Ms. 28), has so far been overlooked by art historians.The stylistic analysis of the illustrative and decorative apparatus of the manuscript, conducted in this study, makes it possible to attribute it to the anonymous illuminator called Master of the Avignon Decretum (from the most relevant manuscript illuminated by him, Avignon, Bibliothèque Municipale, Ms. 659), as revealed by the physiognomies of the faces of the characters depicted in the manuscript.This illuminator, trained most probably in Toulouse and active between 1320 and 1350, likely had links with the Dominicans of the city.

This paper’s approach is eminently canonic: this means, we expose and analyze the current canonic legislation on masonry or, more specifically, on Catholics followers that do not belong to any masonic groups. From there, and as expressed before, we shall discover the theological reasons stated by the Church to justify the penal and disciplinary norm and if the simultaneous belonging to both institutions is theologically compatible. We hope this contributes to a better clarification of the terms in which this dialogue is currently being held., El tratamiento que abordaremos en nuestro trabajo es eminentemente canónico: esto es, exponemos y analizamos la legislación canónica vigente sobre la masonería o, en concreto, sobre los seguidores católicos que no pertenecen a ningún grupo masónico. De ahí, y como antes se expresó, descubriremos las razones teológicas esgrimidas por la Iglesia para justificar la norma penal y disciplinaria y si la pertenencia simultánea a ambas instituciones será definitivamente teológicamente compatible. Esperamos que esto contribuya a una clarificación de los términos en los que actualmente se plantea este diálogo.

The contribution aims to investigate the reflection of the jurist Pietro d'Ancarano between the years 1405-1409 and the passage from the idea of the via cessionis, expressed in the treaty of 1405 as the only solution to the schism, to the complete adherence to the program of the councilium generale utriusque partis of the cardinals separated from their respective popes. The case study offers the possibility of highlighting the relationship between legal production and the failure of the negotiations between the contenders to the papacy and to explore the role of Ancarano in planning phase of the council., Il contributo intende analizzare la riflessione del giurista Pietro d’Ancarano tra gli anni 1405-1409 ed il passaggio dall’idea della via cessionis, presentata nel trattato del 1405 come unica possibile soluzione dello scisma, all’adesione completa al programma del concilium generale utriusque partis dei cardinali separatisi dai rispettivi papi. Il caso di studio offre la possibilità di evidenziare il rapporto tra produzione giuridica e fallimento delle trattative tra i contendenti al papato e di approfondire il ruolo di Ancarano nella fase di programmazione del concilio.

The impediment of abduction regulated in the Code of the Latin Church and in the Code of Canons of the Eastern Churches contemplates two of the most radical coercive mechanisms to obtain matrimonial consent, abduction and the retention intuitu matrimonii. The present study analyses canon 1089 of the 1983 CIC with the aim of assessing the convenience and opportunity of maintaining this canonical figure. In order to do so, it is necessary to take into account the phenomenology of forced marriage, in terms of its causes, expressive forms of coercion and consequences, as currently described by international norms. Several questions arise in this reflection. Firstly, whether the configuration of the impediment, only in relation to the abducted woman, constitutes discrimination and whether it responds to normative schemes typical of a restorative legal technique; secondly, how the active subject of the ruling norm should be interpreted, taking into account the social and cultural contexts of forced marriage; and, finally, whether from the victims’ experience there is a «safe and free place» that guarantees a minimum threshold of autonomy for the ordinary cessation of the impediment or whether, on the contrary, the set of coercive forces that operate in the unwanted marriage reinforce the presumption of the defect of consent and suggest attending to the process of formation of the nuptial will, integrating the situations of abduction and retention with a view to marriage in the chapter of vis vel metus., El impedimento de rapto regulado en el Código de la Iglesia latina y en el Código de Cánones de las Iglesias Orientales contempla dos de los mecanismos coactivos más radicales para obtener el consentimiento matrimonial, el rapto y la retención intuitu matrimonii. El presente estudio analiza el c. 1089 del CIC de 1983 con la finalidad de valorar la conveniencia y oportunidad de mantener esta figura canónica. Y para ello es necesario tener en cuenta la fenomenología del matrimonio forzado, en cuanto a sus causas, formas expresivas de la coacción y consecuencias, descrita en la actualidad por la normativa internacional. Son varias las cuestiones que se plantean en esta reflexión. En primer lugar, si la configuración del impedimento, únicamente en relación con la mujer raptada, constituye una discriminación y si responde a esquemas normativos propios de una técnica jurídica reparadora; en segundo término, cómo ha de interpretarse el sujeto activo de la norma dirimente, atendiendo a los contextos sociales y culturales del matrimonio forzado; y, finalmente, si desde la experiencia de las víctimas existe un «lugar seguro y libre» que garantice un umbral mínimo de autonomía para el cese ordinario del impedimento o si, por el contrario, el conjunto de fuerzas coactivas que opera en el matrimonio no deseado refuerza la presunción del defecto de consentimiento y sugiere atender al proceso de formación de la voluntad nupcial, integrando las situaciones de rapto y de retención con miras al matrimonio en el capítulo de vis vel metus.

This study explores the reception of learned law in Late Medieval Frisia, particularly in the 14th and 15th centuries. While scholars in the 17th century noted the comprehensive application of Roman law in Frisia, this study shows that elements of learned law were present for centuries prior. It investigates the changes in the Frisian legal system, methods, and norms, as well as the reasons for adopting or adapting foreign law. During the Medieval period, Frisia enjoyed a unique position of self-governance, with no feudal structures or serfdom. Consequently, changes to the legal system were made by the Frisians themselves and their customs and practices, rather than by a central authority. Three legal cultures form the basis of this research: traditional and indigenous Frisian law, Canon law with its consequential establishment of ecclesiastical structures, and the spread of Roman law in the late Medieval period. The analysis focuses on the interaction between these three legal cultures in the law and legal practice of late Medieval Frisia. This study examines five separate topics, covering five fields of law: niarkap and contract law; proof and procedural law; theft and the law of delict; testaments; and widowhood and guardianship. Based on the findings, it can be suggested that Late Medieval Frisia's reception of learned law consisted of receiving systems, methods, and norms to varying degrees, but it was never complete. Frisians had various reasons to adopt elements of learned law, such as filling gaps in their own legal system, but they also had several reasons to resist receiving such elements and maintain their traditional legal concepts and elements, like niarkap, oaths, and the house search. The conclusion identifies a progression in the reception of learned law from the 14th to the 15th century, starting primarily with comparisons between Frisian and learned law, which eventually led to the adoption of norms, methods, and systems. The present article shows the history of participation of scholars from Poland at the international congresses of medieval canon law along with the report from the 16th Congress in Saint Louis (13–23 July 2022) and the insights concerning the future of the science of history of common canon law in Poland. The congresses have been held since 1958 every four or five years on both sides of the Atlantic and they are an academic celebration for the scholars united by the same research objectives, namely medieval canon law and subjects related to it. Only sixteen scholars from Poland participated in the sixteen congresses and there were only nine papers authored by Polish academics in the renowned conference proceedings. These modest numbers show that the participation of Polish scholars in the international science of medieval canon law has been very limited over the past half century. Nevertheless, the last congress in Saint Louis witnessed a couple of harbingers of a positive trend of the growing inclusion of Polish scholars into this international academic community. The 16th congress itself was a organizational and scientific milestone for this community, which is currently looking forward to the next congress in Canterbury., Artykuł przedstawia historię udziału uczonych z Polski w międzynarodowych kongresach średniowiecznego prawa kanonicznego wraz ze sprawozdaniem z XVI Kongresu w Saint Louis (13-23.07.2022 r.) oraz spostrzeżenia dotyczące przyszłości nauki historii powszechnego prawa kanonicznego w Polsce. Kongresy odbywają się od 1958 r. co cztery lub pięć lat po obu stronach Oceanu Atlantyckiego i stanowią naukowe święto dla uczonych zjednoczonych przez te same cele badawcze, tj. średniowieczne prawo kanoniczne oraz powiązane z nim przedmioty. Zaledwie szesnastu uczonych z Polski brało udział w przeszłych szesnastu kongresach i raptem dziewięć artykułów autorstwa polskich naukowców zostało zaprezentowanych na łamach ich słynnych materiałów pokonferencyjnych. Te skromne liczby pokazują, że udział polskich uczonych w międzynarodowej nauce średniowiecznego prawa kanonicznego był mocno ograniczony. Niemniej ostatni kongres w Saint Louis był świadkiem kilku pozytywnych zwiastunów nowego trendu włączania polskich uczonych w szeregi tej międzynarodowej społeczności akademickiej. Sam XVI kongres stanowił organizacyjny i naukowy kamień milowy dla tej społeczności, która obecnie z niecierpliwością wyczekuje kolejnego kongresu, który odbędzie się w Canterbury.

El rol desempeñado por la Inquisición en Chile no se limitó a iniciar los sumarios en contra de los sospechosos de herejía, además, y al igual que las demás instituciones de la Monarquía Hispánica, dio cuenta de los hechos políticos, sociales y culturales que acontecieron al interior de sus espacios jurisdiccionales. Esta última labor ha sido poco analizada hasta ahora, pues la historiografía ha dado preponderancia al rol específico de la misma, salvaguardar la fe, analizando detalladamente quiénes fueron sometidos a procesos, bajo qué cargos y cómo se castigaron. No obstante, a base de una perspectiva jurídica y social, daremos cuenta del rol vigilante y de coadyuvante al “buen gobierno” del comisario de la Inquisición de Santiago de Chile. A partir del análisis de una serie de registros históricos, se analizará la inundación y el posterior incendio –ambos hechos dolosos– que afectaron a los agustinos de Santiago de Chile en 1595. Por lo anterior, el presente artículo da cuenta de la inundación e incendio que sufrió esta orden, vinculada a la circulación de las informaciones, a los conflictos entre órdenes religiosas, de qué manera se reguló este tipo de delitos por el derecho canónico y cómo fue el accionar del comisario de la Inquisición de Santiago de Chile ante los hechos desastrosos., The role played by the Inquisition in Chile was not limited to initiating the indictments against the suspicious of heresy, in addition, and like the other overseas institutions of the Hispanic Monarchy, it reflected the political, social and cultural events that occurred within their jurisdictional spaces. This last work has been poorly analyzed until now because historiography has given preponderancie to its specific role, to safeguard the faith, analizing in detail who was subjected to processes, under which charges and how they were punished. However, based on a legal and social perspective, we will give an account of the vigilant and contributing role to the "good government" of the commissioner of the Inquisition of Santiago de Chile. Based on the analysis of a series of historical records, the flood and subsequent fire –both malicious acts– that affected the Augustinians of Santiago de Chile in 1595 will be analyzed. Fort he above, this article analyzes the flood and fire that this Order suffered, linked to the circulation of information, conflicts among religious orders, how this kind of crime was regulated by canon law and how was the acting of the commissioner of the Inquisition of Santiago of Chile before the disastrous events.

In order to better evaluate Weber's most popular views on the economic ethics of religion, by comparison and due to the interaction of the opposites and sets of views expressed in them, in this work, the discipline of human rights will also be analysed, which will closely identify Weber's asceticism about the spirit of normative Protestantism and the ethics of capitalism and law school and education. The purpose of the research is to establish and identify the ideas expressed by Weber regarding the value scope of social classes, layers and typology of religion, by analysing them – conventionally, but specifically – through the doctrine of lex nature and education impact in school of sociology. Additionally, the purpose of the present work is to answer what is the general structure of Weber's philosophical thoughts and views on school of law, to find and identify in it the asceticism of the sociology of religion, interspersed with the theory of conflict and domination. But the relevance of the research is rooted in the fact that the methods of Weber's scientific approach are used to analyse the state's institutional and orderly system-theoretical dependence from the bureaucratized forms of public authority and this impact in knowledge.

Written in the twelfth century by the monk Gratian, the work Concordia Discordantium Canonum, known as Decretum Gratiani, was until the beginning of the twentieth century the reference for canon law and for the understanding of medieval and modern legal-philosophical thought derived from it. Emerged after the Gregorian reform, it will present the law divided between law/natural law and custom, human law. Exposing Graciano's theory of natural law, this work also points out how the Bolognese jurist will relate natural law to the golden rule, or regula dilectionis proximi. By linking the natural law to the golden maxim, Graciano inserts himself as a continuator of a tradition originated from the Greco-Roman philosophy, embraced by the patristic and developed by the scholastics., Escrita no século XII pelo monge Graciano, a obra Concordia Discordantium Canonum, conhecida como Decretum Gratiani, foi até o início do séc. XX a referência para o direito canônico e para a compreensão do pensamento jurídico-filosófico medieval e moderno daí derivado. Surgida após a reforma gregoriana, apresentará a lei dividida entre lei/direito natural e costume, lei humana. Expondo a teoria de Graciano acerca da lei natural, este trabalho também aponta como o jurista bolonhês relacionará a lei natural à regra de ouro, ou regula dilectionis proximi. Atrelando a lei natural à máxima áurea, Graciano insere-se como continuador de uma tradição oriunda da filosofia greco-romana abraçada pela patrística e desenvolvida pelos escolásticos.

This article contains various proposals of Canonical Patrimonial Law. They are suggestions for serving the mission of the Church to develop the full potential of Book V of the CIC., Este artículo contiene varias propuestas de derecho patrimonial canónico. In 1999, with the end of the twentieth century, the journal Estudios Eclesiasticos, in its annual monograph on canon law, published a chronicle of the presence of canonists from 1922, the year of the journal’s birth, until that year. The purpose of the present study is to take up that chronicle and present in detail, up to 2021, the canonical publications in the annual monographs that the journal dedicates to canon law (last issue of each year). The balance of the presence of canon law in Estudios Eclesiasticos is clearly positive. The chronicle of the presence of canon law in Estudios Eclesiasticos is an excellent testimony of the work of Spanish canonists throughout these 100 years, with special attention to the years 1999-2021, and a good research resource available to the cultivators of canon law and ecclesiastical law., En el año 1999, con el final del siglo XX, la revista Estudios Eclesiásticos, en el monográfico anual de derecho canónico, publicó una crónica de lo que había sido la presencia de los canonistas desde 1922, año de nacimiento de la revista, hasta ese año. El objeto del presente estudio es retomar aquella crónica y presentar de forma pormenorizada, hasta 2021, las publicaciones canónicas en los monográficos anuales que la revista dedica al derecho canónico (último número de cada año). El balance de la presencia del derecho canónico en Estudios Eclesiásticos es netamente positivo. La crónica de la presencia del derecho canónico en Estudios Eclesiásticos es un excelente testimonio de la labor de los canonistas españoles a lo largo de estos 100 años, con especial atención a los años 1999-2021, y un buen recurso de investigación puesto a disposición de los cultivadores del derecho canónico y eclesiástico del Estado.

Gli enti ecclesiastici e il diritto del Terzo settore

Per le loro caratteristiche istituzionali, gli enti ecclesiastici svolgono tradizionalmente numerose attività di interesse generale regolate dalla riforma del Terzo settore. Nel contempo, gli accordi intervenuti tra lo Stato e le singole confessioni religiose vincolano l’applicazione della disciplina italiana al rispetto della struttura e della finalità di tali enti. La riforma ha, pertanto, previsto alcune norme particolari, che consentono agli enti ecclesiastici di beneficiare del regime promozionale previsto per gli enti del Terzo settore nel ricorrere di determinate condizioni. Il presente lavoro illustra la disciplina di legge e discute, in particolare, due di tali condizioni: il regolamento, che gli enti ecclesiastici sono tenuti ad adottare per consentire, mediante un atto di autonomia privata, l’equiparazione funzionale con gli enti di Terzo settore; e il patrimonio destinato, che gli enti ecclesiastici debbono costituire per lo svolgimento delle attività regolate dalla riforma.

With the aim of standardizing the classification schemes of the main archives of the Church in Spain and following the archivists recommendations and archival regulations on functional classification, we have proposed to analyze the general functions of the Catholic Church, common to all producing ecclesiastical institutions, from the normative sources from canon law in order to integrate them in the archival models of functional classification in Spain., Con el objetivo de normalizar los cuadros de clasificación de los principales archivos de la Iglesia en España y siguiendo las recomendaciones y normativas archivísticas sobre clasificación funcional, nos hemos propuesto analizar las funciones generales de la Iglesia católica, comunes a todas las instituciones eclesiásticas productoras, a partir de las fuentes normativas procedentes del Derecho Canónico, para su integración en los modelos archivísticos de clasificación funcional en España.

Esta investigación analiza el secreto de los ministros de culto como protección del sigilo de confesión en el derecho español. Para abordar este estudio, se exponen las dos facetas de la misma cuestión, es decir, el aspecto religioso (el sigilo de confesión) y el aspecto estatal (el secreto de los ministros de culto). Para estudiar el primer aspecto se sintetizan aquí la historia y regulaciones del derecho canónico. Para investigar sobre el segundo aspecto, se exponen los valores jurídicos subyacentes a la protección del secreto de los ministros de culto. Finalmente se estudia críticamente la regulación del secreto de los ministros de culto en el derecho español., This research analyzes the religious communications privilege as a legal rule that protects the seal of confession in Spanish law. Two facets of the same issue are studied in preparation for this, namely the religious side (seal of confession)and the secular legal side (the religious communications privilege). Canon Law sources from the 12th and 13th centuries indicate that the control and payment of tithes performed a series of religious, political, and social functions. Among these functions, we can highlight the political, spatial, and jurisdictional organization of parishes, dioceses, and of the papacy itself. In a slow process in which the concept of jurisdiction was also under construction, tithes played an essential role in the definition and delimitation of ecclesiastical jurisdictions, particularly regarding episcopal and papal jurisdictions. Analyzing Hostiensis’s the Summa Aurea (1253) through an intertextual comparison against work as the Liber Extra and Gratian’s Decretum, this paper’s goal is to demonstrate the relationship between the discourse on tithes and the definition both of the concept and of the practical action of ecclesiastical jurisdiction between the 12th and 13th centuries., As fontes de direito canônico, produzidas entre os séculos XII e XIII, indicam que o controle e a cobrança do dízimo desempenhavam uma série de funções religiosas, políticas e sociais. Entre essas funções, destacava-se a organização política, espacial e jurisdicional das paróquias, dioceses e do próprio papado. Em um lento processo no qual o próprio conceito de jurisdição estava em formação, os dízimos tiveram papel fundamental na definição e delimitação das jurisdições eclesiásticas, principalmente em relação à jurisdição episcopal e papal. A partir de uma leitura de intertextualidade comparativa da Summa Aurea (1253) de Hostiensis com o Liber Extra (1234) e o Decretum de Graciano (c. 1140), o objetivo desse artigo é demonstrar a relação entre o discurso sobre os dízimos e a definição tanto do conceito quanto da atuação prática da jurisdição eclesiástica entre os séculos XII e XIII.

Le décès prématuré du dauphin Jean de Touraine en 1417 a privé sa jeune épouse Jacqueline de Bavière d’un destin de reine de France. Il place aussi celle-ci, en tant que comtesse héritière du Hainaut, de la Hollande et de la Zélande, dans une position politique inconfortable. Le remariage de Jacqueline, désormais régnante et en but à une rébellion, avec son cousin et voisin Jean IV, duc de Brabant, aurait dû permettre de stabiliser et consolider son héritage. Il n’en fut rien. D’échec militaire en concessions désastreuses, son mari met en péril les principautés de Jacqueline. Elle quitte la cour et se retire en Hainaut. Alliée dans un premier temps aux sujets brabançons qui mettent leur duc sous tutelle, elle fait un pas de plus contre celui-ci en déclarant tenir son mariage pour canoniquement nul, ce qui délie ses propres sujets de toute obéissance envers le duc de Brabant. Elle se réfugie dès lors à la cour d’Angleterre où elle épouse le duc de Gloucester. Avec celui-ci, elle vient reprendre possession du Hainaut, les armes à la main, dans un conflit l’opposant aux Brabançons. Délaissée par son nouveau mari anglais, elle consent à la reddition et se retrouve captive d’un autre cousin, Philippe le Bon, comte de Flandre et duc de Bourgogne, qui se présente en arbitre. Elle s’évade et reprend, seule, la lutte. Une sentence du pape confirmera la validité de son mariage brabançon, près de neuf mois après le décès de Jean IV. Cette sentence invalide évidemment son mariage anglais. Jacqueline consent dès lors à un traité cédant le gouvernement de ses comtés à Philippe le Bon (1428). Un quatrième mariage, contrevenant au traité, n’aura pas permis de reprendre le dessus politiquement et forcera la comtesse à l’abdication (1433). La communication examinera quels mécanismes ont mené de l’union des corps et des principautés des époux à leur séparation, puis à une guerre ouverte en 1424-1425. Starting from the proper value of the house for a religious institute, and above all from its importance of pursuing the purposes of consecrated life in general and of the institute in particular, it analyzes what is intended in canon law as a common life and what the needs are resulting from it for individual members and communities. Since religious Institutes are experiencing processes of reorganization and restructuring in every part of the world, processes that require care, attention and discernment, it will emphasize how fidelity to the foundational charism and the consequent spiritual patrimony of each Institute is the first criterion for evaluating decisions and interventions that are carried out in the Institutes, at any level, and also with reference to the specific good of the religious house. Finally, it will further demonstrate how the religious house has considerable importance also as an ecclesiastical good to be protected and valued, always respecting its nature and its purpose, by briefly examining some magisterial documents governing the topic, and in particular those issued by the Congregation for the Institutes of Consecrated Life and Societies of Apostolic Life.

This article offers a systematic characterization of abuse of conscience in order to its typification as a canonical crime. We begin exploring the study of conscience manipulation in moral theology after Vatican II as an important background for the understanding of abuse of conscience in more recent studies. The core statement of this study is the definition of abuse of conscience and its gravity. This kind of abuse is set within care relationships, where the abuser steps over the limits of his ecclesial mediation: he appropriates himself of God’s own authority. This study builds on this literature to understand abuse of conscience as a specific type of spiritual abuse in catholic settings. We understand this is absolutely necessary for justice and reparation towards victims., Resumen Este estudio tiene como objetivo perfilar el concepto de abuso de conciencia en vistas a su tipificación en el derecho canónico. Se comienza describiendo la reflexión postconciliar sobre la manipulación de conciencia desde una perspectiva teológico-moral, que anticipa el concepto actual de abuso de conciencia. El centro del artículo es el esclarecimiento del concepto de abuso de conciencia y de su gravedad. Este abuso se da en el contexto de relaciones de cuidado, donde se traspasan los límites de la mediación eclesial que corresponde a dicha relación: el abuso de conciencia implica apropiarse indebidamente de la autoridad de Dios. El presente estudio continúa la línea de investigaciones precedentes para perfilar con mayor nitidez el abuso de conciencia propiamente tal en el contexto católico. Es un paso indis pensable para la necesaria justicia y reparación para las víctimas de este grave delito.

An event of the magnitude of the Covid-19 pandemic also generates consequences at the legal level, as happens at the headquarters of contract compliance. Traditionally, the observance of the agreement (pacta sunt servanda) has been a dogma in the law of obligations and contracts. Even being a rule sculpted in the heat of the moral dyes of the influential medieval canon law, we verify its deep roots in Roman Law, as well as some of its exceptions that will, with the passage of time, in the clause rebus sic stantibus germinate. The encoding will embrace an almost absolute principle, but the pressing reality compels its updating. The paper presents the column entitled "Utrumque Ius intersezioni", which intends to encourage the scientific dialogue between canon law and contemporary legal culture. There is no doubt that the science of general law during the twentieth century valued the comparative approach to legal problems. On the canonical side, then, the challenge is on the one hand to test the reasons of law in a strictly internal context and on the other to verify the same belonging of canon law to the lógos or general juridical discourse. It is a suggestive challenge because at stake is the same identity of law and legal science as such, its foundations and what makes it what it is. "Utrumque ius. Intersections" ultimately wishes to contribute to that "healthy openness which is never in contrast with identity" and which, by integrating "elements of different origins", can cause "the birth of a new synthesis which in the end benefits everyone "

This article offers a reading of the acceptance of Roman law in the European legal systems since the High Middle Ages. Gregory VII's reforms, the role of the Bologna school, the search for systematization of canon law and the rediscovery of the enormous sources of Roman law were the starting point for a process of rationalization of law that retains the symbolic character that canon law possessed. This allowed the expansion of legal elements throughout Europe that formed a common denominator for the time: the Ius Utrumque., Este artigo oferece uma leitura do processo de recepção do direito romano nos sistemas jurídicos europeus desde a Alta Idade Média. As reformas de Gregório VII, o papel da escola de Bolonha, a busca da sistematização do direito canônico e o redescobrimento das enormes fontes do direito romano foram o ponto de partida para um processo de racionalização do direito que conserva o caráter simbólico que o direito canônico apresentava. The idea that a simple unilateral promise, until it is accepted, is not binding according to natural law is defended by Grotius in his major work with an argumentation drawn directly from Lessius, an important source of inspiration for the Dutch jurist, who in turn solves the dispute rooted in the tradition of ius commune. This article aims to reconstruct, in its essential stages, an itinerary through the main positions of medieval and early modern civil and canon lawyers about this controversial issue. These sources constitute the background of early modern scholastics and Grotius as well. The paper analyses some of the principal texts of both bodies of law, highlighting arguments and adding new findings. Notably it is shown that Lessius's and Grotius's statements represent a turning point, as far as they react against the resumption of the theory of the binding force of simple unilateral promises in the sixteenth century. With Lessius and Grotius, on the other hand, acceptance became a necessary requirement for every transfer of rights and duties to be enforceable.

The aim of this article is to reflect on the method of argumentation undertaken by the authors of moral theology textbooks at the turn of the 19th and 20th century in the field of human relations with animals and defining the limits of their use. The analysis of a dozen or so studies representing various trends has led to the conclusion that most statements are a repetition of civil and canon law or commentary on them. Including only these data did not allow the moralists to formulate a coherent concept that would answer the more and more frequently emerging questions and doubts about the scope of man's domination over the created world., Celem niniejszego artykułu jest podjęcie refleksji nad sposobem argumentacji podejmowanym przez autorów podręczników teologii moralnej przełomu XIX i XX wieku w zakresie relacji człowieka do zwierząt i określenia granic ich wykorzystania. Analiza kilkunastu opracowań reprezentujących różne nurty doprowadziła do stwierdzenia, że większość stwierdzeń stanowi powtórzenie przepisów prawa cywilnego i kanonicznego albo komentarz do nich. Uwzględnienie tylko tych danych nie pozwoliło moralistom na sformułowanie spójnej koncepcji, która stanowiłaby wyczerpującą odpowiedź na pojawiające się w tym czasie coraz częściej pytania i wątpliwości o zakres panowania człowieka nad światem stworzonym.

We analyze the birth of the metaphor of spiritual marriage between bishop and Church in the fourth century, and its subsequent development during the formation of the Corpus Iuris Canonici (XI-XV), mainly in the West of Christianity. For this we proceed to the reading of diverse interdisciplinary sources, which reveal the irregular evolution and implementation of the metaphor in various areas of the emerging canonical science and theology. We conclude by establishing the iter followed by the metaphor in the theology of the episcopal ministry, and according to the evolution of Ecclesiology: from bishop prevalently husband of his church, to the representative bishop of Christ —the only Spouse—, united by a double bond with the Universal church and with the particular church., Analizamos el nacimiento de la metáfora del matrimonio espiritual entre obispo e Iglesia en el siglo IV, y su posterior desarrollo durante la formación del Corpus Iuris Canonici (XI-XV), principalmente en el Occidente de la cristiandad. Para ello procedemos a la lectura de diversas fuentes interdisciplinares, que revelan la irregular evolución e implementación de la metáfora en diversos ámbitos de la emergente ciencia canónica y de la teología. Concluimos estableciendo el íter seguido por la metáfora en la teología del ministerio episcopal, y acorde a la evolución de la Eclesiología: de obispo prevalentemente esposo de su iglesia, a obispo representante de Cristo —único Esposo—, unido por un doble vínculo con la Iglesia universal y con la iglesia particular.

Between the means available to administrative justice, it´s found the so-called Hierarchical resource. The knowledge of the requirements and effects that the presentation supposes it is essencial for its correct processing. These requirements are foreseen in cc. 1734-1738 of the Code of Canon Law., Entre los medios de la justicia administrativa se encuentra el denominado recurso jerárquico. El conocimiento de los requisitos y efectos que la interposición de un recurso administrativo conlleva, resulta esencial para su correcta tramitación y resolución. Estos requisitos y efectos se encuentran previstos esencialmente en los cánones 1734-1738 del Código de Derecho Canónico.

Nowadays it is generally held, that the owner who brought an actio legis Aquiliae usually claimed no more than his loss, perhaps already in Ulpian's time, for certain in Justinian's. For the sum of condemnation based upon the estimation-clauses of the lex Aquilia would only then exceed his damages, if either the injured object's value had decreased in the last year or 30 days (Inst. 4,3,9) or the wrongdoer had denied having caused the damage (C. 3,35,4). There is, however, a third reason, which the Roman texts fail to mention: A possible residual value of killed lifestock, wounded slaves, and damaged objects, which benefitted the owner. Only a few later jurists took this into account: In medieval times Jacques de Révigny and Pierre Jacobi, Johann Oldendorp in the Early Modern era. The notion prevailed that the lex Aquilia obliged to pay at least the object's full value.

In the article the author proposes the analysis of theoretical and practical aspects of a spiral theory of the time. In the fi rst part she explains the meaning of the terms: time and eternity, afterwards she elaborates the structure of the spiral conception of the time. Consecutive parts of the article refer to temporal aspects in law, the time in the light of the Catholic Church’s knowledge and theology (the perspective of eternity) and applications of the spiral conception of time in provisions of the ecclesiastical law. This conception of time connects circular and linear theories of time. The canon law legislator uses the spiral conception of time and lays down legislative acts which should contribute to the regaining the meaning of life – eternity. It is important to help people take good care of how they live and spend their time in order to transform chronos into kairos. The contemporary problem of a continuous lack of time is becoming more pressing. Living in a great hurry and fear of death are connected with loss of the perspective of eternity. In view of the above, the author draws the conclusion that kairos is a time that gives hope, a time that gives a chance to overcome crisis and to start over, making use of the previous experiences, getting back on to some occurrences, but experiencing them in a spiral growth, being on a new, superior stage of advancement. The author also pays attention to Catholic mission’s domination and canon law’s subordination. The pursuit of eternity requires ceaseless progress and growing in Christian perfection., Autorka w artykule proponuje analizę teoretycznych i praktycznych aspektów spiralnej koncepcji czasu. W pierwszej części wyjaśnia znaczenie pojęć: czas i wieczność, a następnie omawia konstrukcję spiralnej koncepcji czasu. Kolejne części pracy odnoszą się kolejno do aspektów czasowych w prawie, spojrzenia na czas w świetle nauki Kościoła katolickiego i teologii (perspektywa wieczności) oraz do zastosowania spiralnej koncepcji czasu w normach prawa kanonicznego. Przedmiotowa koncepcja stanowi syntezę dwóch innych teorii czasu, tj. cyklicznej i linearnej. Kościelny prawodawca korzysta ze spiralnej koncepcji czasu i konstruuje normy prawne mające na celu pomoc ludziom w odnalezieniu sensu ich życia – wieczności. Istotne jest, aby ukierunkować ich na troskę o jakość przeżywanego czasu – przemianę chronos w kairos. Współcześnie powszechnym doświadczeniem staje się problem nieustannego braku czasu, pośpiechu i lęku przed śmiercią, związany w pewien sposób z utratą perspektywy wieczności. W tym kontekście kairos to czas niosący nadzieję, dający szansę na wyjście z kryzysu i rozpoczynanie od nowa – korzystając z dotychczasowych doświadczeń, powracając do pewnych zdarzeń, lecz przeżywając je niejako w ruchu spiralnym, na nowym, wyższym etapie rozwoju. Autorka zwraca również uwagę, że prawo kanoniczne jest podporządkowane misji Kościoła, która polega na prowadzeniu wiernych do wieczności. Oznacza to konieczność ciągłego rozwoju i dążenia do chrześcijańskiej doskonałości.

The evangelisation of the Philippines took place after the Council of Trent; hence, from the beginning matrimony was governed by its canons and decrees. Until the provincial councils held in the 1770s, the Philippine Church followed the directives of the Third Mexican Provincial Council. Manuals for the administration of sacraments and for parish priests by authors based in the Philippines and published were primary references for the canonical form of marriage. Serving as a window into how Church authorities dealt with local situations and customs towards enforcement of Tridentine doctrine and law are the edicts, pastoral letters, and on occasion of diocesan visits, ordinances issued by bishops. On the micro-level, the dispensations granted for a variety of impediments and the matrimonial cases processed in the ecclesiastical court of Manila show the nuances of law and justice, taking into account pastoral considerations, personal circumstances, and local customs. They also demonstrate the understanding of litigants of the attributes of canonical marriage as well as the level of assimilation of the same. Missionary literature from the first century of evangelisation mentions common difficulties encountered in introducing Christian marriage vis-à-vis indigenous institution: the doctrine of the unity and indissolubility of marriage, the primordial requirement of consent, and the matter of impediments. The cases discussed by moral theologians indicate the prevalence of those issues well into the eighteenth century, especially in missionary districts and rural areas.

In the document “The Church and scandal of sexual abuse” published in 2019, the emeritus pope Benedict XVI uses the category of “legal good” when referring to faith and its corresponding process. This article presents, first, an understanding of legal goods as intrinsic rights in the relationships of justice, and applies them to the Church and its specific legal goods; particularly, to the word of God and the Sacraments. Second, the article offers an interpretation of the legal good of faith as a common good of the Church’s horizontal dimension of communion. Specifically, it shows how sexual abuse crimes against minors committed by the clerk affect the communion within the People of God in terms of faith and hope. The article concludes with some suggestions for a renewed penal canon law, which should expanded to protect the ecclesiastical legal goods as a whole, and value thoroughly the legal process., El papa emérito Benedicto XVI en el documento que publicó en 2019 sobre “La Iglesia y el escándalo del abuso sexual” emplea la categoría del “bien jurídico” con respecto a la fe y al debido proceso. El artículo presenta en primer lugar una comprensión de los bienes jurídicos como bienes intrínsecos en las relaciones de justicia, aplicándolo a la Iglesia y sus bienes jurídicos específicos, ante todo la palabra de Dios y los sacramentos. Enseguida se ofrece una interpretación del bien jurídico de la fe como bien común de la Iglesia en su dimensión de comunión horizontal, mostrando cómo los delitos de abusos sexuales cometidos por clérigos contra menores repercuten en la comunión del Pueblo de Dios en la fe y en la esperanza. Se concluye con algunas sugerencias para un renovado derecho penal canónico que se extienda al conjunto de los bienes jurídicos eclesiales y valore plenamente el proceso judicial.

In cc. 1733-1735 of the Code of Canon Law, the legislator includes two new legal provisions. The first one is intended to avoid the need for a hierarchical resource (c. 1733). The second one, and in case that the former does not dispense effect, aims to properly prepare its appeal (cc. 1734-1735). Both provisions are part of the administrative justice in the bosom of the Church., En los cánones 1733-1735 del Código de Derecho Canónico, el legislador introduce dos nuevas previsiones. La primera está destinada a evitar la necesidad de un recurso jerárquico (c. 1733). The Church has, at various times in its history, been described as a communitas perfecta, a perfect and supreme society that has as its goal the promotion of salvation of humanity. Like any organization, the Church is governed by rules that enable it to achieve its end, and this is the most basic function of canon law. When John Paul II promulgated the revised Codex iuris canonici in 1983 by means of the Apostolic Constitution Sacrae disciplinae legis, recognizing that in the aftermath of the Second Vatican Council the place of law in the Church was again being questioned by many, he offers four clear definitions for the role and function of canon law. First, canon law makes the hierarchical and organic structure of the Church visible. Second, canon law ensures the proper exercise of the sanctifying function of the Church. Third, canon law provides rights, obligations, and methods of resolving conflicts in the Church. Fourth, canon law attempts to provide the structures that sustain and direct the Church’s common initiatives.

Dissimulation is a technical canon law concept which means something like turning a blind eye to an illegal state of affairs because it would do more harm than good to take positive action against it.
