Les personnes atteintes de troubles mentaux sont surreprésentées dans la population carcérale. Les tribunaux en santé mentale font partie de la justice résolutive de problèmes et visent à prendre en charge de manière globale les délinquants souffrant de troubles psychiques. Ces tribunaux représentent une alternative à la détention et sont basés sur la collaboration des services judiciaires et de santé mentale. Le premier tribunal en santé mentale a été créé en Floride en 1997 et il en existe maintenant plus de 300 aux États-Unis. À Lyon, en France, par le biais d'un travail avec l'équipe canadienne du tribunal de santé mentale de Montréal, a été créé en 2017 un nouveau programme appelé Contrainte Pénale Justice Thérapeutique (CPJT). Ce dispositif est également basé sur la collaboration des services de justice et de soins psychiatriques et addictologiques préexistants afin de traiter les délinquants récidivistes atteints de troubles psychiques et/ou addictifs. Le but de cet entretien avec Constance Baheux et le Dr Sabine Mouchet–Mages est de présenter les résultats des tribunaux en santé mentale américains et de présenter le dispositif de Contrainte Pénale Justice Thérapeutique mis en œuvre à Lyon en 2017. People with mental disorders are over-represented in the criminal justice system. Mental Heath Courts are problem-solving oriented courts developed as a means of providing treatment to individuals with mental illness involved in the criminal justice system in order to avoid recidivism and to improve access to community mental health care services. MHCs are an alternative to the incarceration and the innovation behind his model is the collaboration between the judiciary and mental health services. The first MHC was created in 1997 in Florida; there are now more than 300 such courts in the United States. In Lyon, France, thought work with Canadian team at the Montreal Mental Health court, a new program called Contrainte Pénale Justice Thérapeutique was created in 2016. CPJT is also based on the collaboration of legal, social and pre-existing mental health services in order to treat recidivist offenders suffering from psychiatric and/or addictive disorder. The aim of this interview with Constance Baheux and Dr Sabine Mouchet–Mages is to present the results of American mental health court in terms of effectiveness and to introduce the French program Contrainte Pénale Justice Thérapeutique in Lyon according to French law. Drug treatment courts (DTCs) have been proposed as an alternative to custody that will better deal with drug-dependent offenders through application of therapeutic jurisprudence (TJ). While DTC proponents emphasize the positive aspects of the judicial involvement and intense treatment that most courts provide, critics observe that there are many punitive aspects to DTCs. Frequent court appearances, curfews, urinalysis, multiple bail conditions, and delayed sentencing can be viewed as extensions of coercive social control rather than as benevolent measures intended to help offenders. Further, critics of Canadian DTCs have challenged the efficacy of treatment. This paper seeks to add to a limited Canadian research literature by examining a DTC in the Prairie city of Winnipeg, Manitoba. Two samples are used: sample 1 examines sentencing outcomes and reoffence data for 199 DTC admissions from 2006 to 2014; sample 2 is employed for a quasi-experimental comparative recidivism study using a propensity score matching determined sample of 63 DTC cases with 167 adult probationers from 2010–12. Graduates showed lower rates of reoffence compared to unsuccessful cases. Sentencing outcomes showed that unsuccessful participants were most often incarcerated when re-sentenced on original charges. Probation cases reoffended at higher rates than the matched DTC group. Administrative violations were still higher than in the probation group, and may actually result in an inflated reoffence rate for Canadian DTCs. The over-representation of Indigenous peoples in criminal justice systems internationally remains a critical issue. Some have argued that replacing generic services with culturally relevant programming would be an effective strategy to address this problem. This meta-analysis examines the effectiveness of culturally relevant programs for Indigenous offenders compared to conventional programs. Results based on seven studies (N=1,731) indicate Indigenous offenders who participate in these programs have significantly lower odds of recidivism (odds ratio=0.72) compared to Indigenous offenders who participate in generic programs. Although considerable methodological limitations were observed in the studies reviewed, the results of this meta-analysis are consistent with the concept of specific responsivity and the notion that treatment effectiveness is maximized when the learning environment is engaging and relevant. Additional research of higher methodological quality is needed to further evaluate culturally relevant programs and determine with greater confidence how correctional interventions best work for this population. Intensive supervision probation (ISP) has proven generally ineffective for youth. In this article we argue that mentorship, an intervention with increasing empirical support in the literature, is a missing treatment component. We test this proposition with results from the Spotlight Serious Offender Services Unit, an urban-based Canadian ISP program that targets high-risk gang youth. Unique to Spotlight is their adoption of street mentors to work with youth in the community. Our study incorporated quantitative and qualitative approaches: client interviews and researcher observation of street mentors coupled with comparison of recidivism outcomes between a comparison group (N = 85) of high-risk young offenders and Spotlight (N = 57) clients, matched via a propensity score matching (PSM) procedure. Spotlight cases did significantly better than the comparison group on all recidivism outcomes examined. Qualitative interview and observation data supported mentorship efficacy. Given the lack of effectiveness of other ISPs observed in the literature, we argue that mentorship makes a difference. [ABSTRACT FROM AUTHOR]

A primary goal of forensic rehabilitation programming for incarcerated offenders is to eliminate or, at the very least, decrease rates of recidivism. However, repeat offending continues to occur, and studies suggest that reductions in recidivism brought about by programs are modest. Indeed, a series of studies suggests decreases in recidivism ranging between only 7% and 14%. While several factors have been identified as potential contributors to criminal behaviour, one notion that has garnered much attention is that an individual may be predisposed to criminality if s/he has deficits in executive cognitive functioning. At this time, the link between executive functioning and antisocial behaviour is largely unquestioned. However, it remains uncertain whether executive deficits may be even more profound in offenders who have served multiple terms of imprisonment. Using a cross sectional design, 93 Canadian federal inmates, categorized as either first timers (n=56) or return inmates (n=37) were tested on a battery of executive cognitive-functioning measures. In keeping with our hypotheses, return inmates showed more severe and pervasive patterns of executive dysfunction. These results suggest that improved focus on ameliorating ECF deficits of offenders may further assist in decreasing recidivism. [ABSTRACT FROM AUTHOR]
