The present work investigates the incidence of organization and distribution rules on competence regarding the compliance with health service market. The issue will be discussed with special reference to four EU countries: Germany, France, England and Spain. On the one hand, one may say that the first two countries adopt the occupational model systems. Nevertheless, while Germany embodies decentralization of competence, France centralizes the competences. On the other hand, England and Spain adopt a 'universalistic' model system. nevertheless, while England centralizes, Spain decentralizes the competences. Moreover, the paper takes the operators and financial backers market into account, and this occurs in order to figure out EU legal system effects on it. as to this point, The perspective of legal system competition is of particular significance.
