With the development of computer technology, automatic test paper generation systems have gradually become an effective tool for detecting and maintaining national machine security and protecting the rights and interests of workers. This article achieved multi-level oral scores for different types of questions through online scoring using artificial neural networks in recent years. Based on its specific situation and evaluation index requirements, an analysis module that is reasonable, efficient, and in line with the hierarchical structure and module requirements of national conditions has been designed to complete the research on automatic test paper generation technology, in order to help better manage and allocate human resources and improve production efficiency. This article revisits arguments about the death of labour law, and re-examines claims by Richard Mitchell that such arguments are mistaken. In the first half of the article I argue that the law of the labour market is not labour law as the latter discipline developed in the 20th century. I also argue that there is a clear ethical core to labour law which sets it apart from the law of the labour market, and that this ethical core is the consequence of political struggle. Labour law gives effect to the principle of international law that labour is not a commodity, a principle which the law of the labour market subverts. The purpose of revisiting this debate is to examine whether labour law as so understood can be resurrected. For this purpose, I focus on the recent work of Harry Arthurs who in a series of lectures and elsewhere provides a withering assessment of the current state of play and a bleak outlook for the future. While I agree strongly with his assessment of the current condition of the discipline, I take issue with his pessimistic vision of the future, which in my view underestimates the importance of political struggle in effecting social, economic and legal change. This paper is the product of an ongoing research's preliminary results with app drivers and aims to discuss how the game of forces has occurred in the relationships established between companies, workers, regulatory bodies, and society. This exploratory qualitative study employed document analysis, a questionnaire, and semi-structured interviews with drivers linked to associations in Rio de Janeiro (RJ), Brazil. The analysis was conducted from a tripolar perspective based on the theoretical-methodological framework of Ergology and social life's micro and macroscopic spaces, encompassing the poles referring to human activity, the market, and politics. The results show a background of norms built on this work about the relationship with companies, passengers, and the drivers themselves, besides issues raised from the COVID-19 pandemic. We can conclude that it is necessary not to counteract technological evolution to achieve workers' rights and health. We should recall that no action aimed at ensuring the reconciliation of health, work, and rights will advance without relying on a fruitful and balanced trend between the three poles mentioned. This paper investigates necessary conditions for developing a participatory, rightsholder-driven approach to remedy for business-related human rights abuses by analyzing findings from a case study with the Fair Food Program. With the inclusion of human rights into discussions of business ethics and CSR, scholars and practitioners have made calls for participatory approaches to remedy to address cases of human rights abuses. However, a gap remains in our understanding of how to operationalize participatory approaches in a manner that empowers rightsholders, particularly within contexts of severe power imbalances. The paper puts forth a rightsholder-driven theoretical framework for remedy, grounded on critical dialogic accountability principles and integrated with empirical analysis from the Fair Food Program case study. This framework defines remedy as a system comprising reinforcing aspects rather than standalone mechanisms. The critical dialogic accounting and accountability framework provides a theoretical framing of engagement that enables the inclusion of multiple, divergent voices and aims toward meaningful engagement with marginalized groups. The analysis of findings from the case study identifies enforcement and education as necessary conditions for effective and empowering rightsholder-driven approaches to remedy. The paper deconstructs these conditions to develop an understanding of the program's unique approach to enforcement and education. This paper focuses on the increasing prominence of digital labour platforms in the labour markets of Southeast Europe, and compares the supply of online labour from nine selected countries: Serbia, Romania, Hungary, Croatia, Bosnia and Herzegovina, Montenegro, Albania, North Macedonia, and Bulgaria. Digital labour platforms, as an innovative business model, play an important role in today's labour markets by linking the demand and supply of digital work. Southeast Europe is no exception to this trend, and has become an important supplier of online labour. With the impact of the Covid-19 pandemic, this and other new forms of employment further increased both globally and in Southeast Europe. Despite this trend, online labour often remains invisible and under the radar of national policymakers and regulators, as well as national statistical agencies, due to the globalised nature of online platforms. This paper aims to shed light on the development of online labour in the countries studied, based on publicly available data collected through Gigmetar, a web scraping tool designed to monitor trends on the number, gender, incomes, and occupations of online workers.1 The paper compares online labour from nine countries active on the most significant general digital labour platforms (Upwork, Freelancer, and Guru) from February 2022 to October 2022. The criteria for the comparison include occupations, 2 gender and income. The analysis is based on the data of approximately 80% of the total number of active digital workers on the platforms under investigation. The paper points out the similarities and differences in online labour between the countries of Southeast Europe. For example, the number of online workers increased in all the countries, with creative services and multimedia and software development comprising the most dominant occupations in each country. Moreover, men are more commonly represented in these digital markets than women. However, these generalities hide remarkable differences between the countries in terms of the number of online workers per capita, the comparative advantages of each country based on the composition of the online labour force in terms of professions, variations in the gender gap in income distribution, and the average hourly labour price demanded by workers. The results of our analysis may provide useful information to national policy makers as they work to address the challenges in the labour market brought by technological advancements. This paper explores the emerging practice of workplace surveillance by using neurotechnologies, particularly wearable neurodevices, to monitor employees' cognitive abilities, concentration levels, and emotional responses. It aims to assess the legality of such practices within the framework of EU law, focusing on the General Data Protection Regulation (GDPR) and the EU Artificial Intelligence Act (AI Act) by providing a detailed analysis of recent EU legislation in the context of the implementation of neurosurveillance at the workplace. Furthermore, the paper discusses whether current regulations adequately address the use of neurotechnologies in the workplace or are overly restrictive. It raises the question of ensuring sufficient flexibility in the regulations to allow for legitimate implementations of neurotechnologies in the labour field for workers' safety while protecting workers' rights. Overall, the paper offers insights into the intersection of neurotechnology advancements and labour relations and stimulates critical discussion about the fair balance between innovation and workers' rights. Food delivery riders have gained widespread significance when countries went into lockdown to prevent the spread of COVID-19. Particularly in the Philippines, two major companies - Grab and Food Panda - employ thousands of delivery riders as "independent contractors," sans any insurance or protection. This paper argues that food delivery riders, in line with the nature of their work, should be aptly recognized as employees of their digital platforms and should be accorded the proper benefits, protection, and compensation. Notwithstanding the cautious phrasing in the agreements signed by the delivery riders classifying them as independent contractors, it is the submission of this research that the law remains the primary factor that determines the relationship between the parties. As such, an employer-employee relationship, as laid down in Philippine jurisprudence, covers food delivery riders. The paper likewise cites landmark rulings from Spain and France, which recognized delivery riders and drivers as employees of their digital platforms. The COVID-19 pandemic has exposed several chinks in the armour of public health infrastructure across the world. However, the impact of the pandemic has been assessed primarily from the perspective of the 'privileged' members of society. The experiences of the 'other' world inhabited by the marginalised communities, who have had their livelihoods crushed under the weight of the pandemic, have been scarcely documented. As thousands of migrant workers were more scared of death caused by hunger rather than the disease itself, the various steps taken by different countries to curb community transmission have unveiled the ugly side of these measures. For example, as several states such as the US, the UK, Singapore, Hong Kong, and India/Bharat imposed lockdowns, border closures, quarantines, inter alia, the most vulnerable section of the human population has been the migrant workers, especially those individuals who were employed in the unorganised sector. Thus, the global health crisis has unravelled deep-rooted deficiencies, racial biases, and an overall lack of concern and empathy for the lesser privileged, apart from the growing socio-economic divide between the rich and the poor. This research paper aims to explore the impact of the COVID-19 pandemic on migrant workers in the informal sector by exploring the measures imposed by the US, the UK, Singapore, Hong Kong, and India/Bharat and analyse how their fundamental rights, including the right to development, were compromised. Purpose: This paper explores the reasons why Indonesia must have legal regulations to provide protection and guarantees for health workers in carrying out the profession in overcoming corona virus disease (COVID-19). This paper also explains the legal regulations as the foundation for today's medical workers' protection. This paper also aims at providing an ideal legal construction that safeguards the rights and obligations of health workers in overcoming COVID-19. Design/methodology/approach: In this paper, the author used qualitative research methods with a socio-legal approach. The data were obtained through literature study and analysis of laws and regulations through the socio-legal method. Findings: Various challenges and professional risks taken by health workers in dealing with COVID-19 derive from several factors, such as shortage of personal protective equipment, ineffective implementation of informed consent from the patients and the negative stigma spreading in the community. Moreover, the current legal regulation has not particularly modulated the protection of health workers, relying only on available articles that are actually irrelevant to be applied in the COVID-19 pandemic. Research limitations/implications: This research is focused on problems faced by health workers in combating COVID-19 and law concessions to ensure their protection. Practical implications: The final results of this research will be useful for The House of Representatives (DPR), the Ministry of Health of the Republic of Indonesia (Kemenkes RI) and the Indonesian Medical Association (IDI) in establishing legal and regulatory construction for the protection of health workers in tackling COVID-19. Social implications: This research aims at strengthening legal protections for the health workers so that their rights and obligations are well guaranteed. The paper aims to provide theoretical insights and explore the comparative legal practice of approaching mental health and well-being at the workplace by applying legal normative and comparative methods in a digitalized world of work. In this regard, subordination vs autonomy needs to be considered as a starting theoretical point accompanied by an overview of comparative legal approaches that have recently introduced some novel legal mechanisms, such as the right to disconnect to deal better with the exercise of fundamental labor rights. Additionally, introducing a psychosocial risk management model in occupational health and safety could significantly improve workers’ mental health and well-being in the digital age. Therefore, the proactive, holistic, and integrated approach to workers’ rights and status in the digital environment must be analyzed by exploring the bounding point between organizational management views on the subject and labor law standpoints. The European Works Council (EWC) Directive provides the establishment of a social partnership forum within Multinational Companies (MNCs). The directive gives employees the right to information and consultation with the supra-national group management. The aim of this concept paper is to contribute to the debate on the Europeanization of Industrial Relations (IR) in the European Union. Specifically, it assesses the influence that EWCs, a novel institution within certain Euro-companies, have on the convergence of industrial relations among the member states. This critical topic can be evaluated from the standpoint of the current theory and its practical implications in order to draw the perspectives for a European system of IR both within MNCs and the rest of the companies. Our conclusions indicate that EWCs contribute to Europeanization in several aspects of employee relations, although this contribution has been limited to those issues that are wished for by the MNCs. Purpose: The tea plantation industry is characterized by the large-scale deployment of cheap women laborers and gender-blind practices that make the social positions of women workers vulnerable. This paper considers women temporary workers in tea gardens to study the exacerbated impact of Covid-19 on their lives. The impact of the pandemic on marginal tea garden women laborers has not received enough attention from researchers; hence, the authors have studied the gendered implications of the pandemic on Adivasi temporary women workers in tea gardens in India. "Adivasi" is an umbrella term to refer to all indigenous tribes in India. Design/methodology/approach: The authors conducted a qualitative study with 26 in-depth interviews with women temporary workers who identify themselves as Adivasis. For the discussion, the authors have mainly borrowed from intersectionality and subalternity literature. Findings: The analysis explored the intersectional experiences of the women temporary workers (1) as members of Tea Tribes who are compelled to continue working at tea gardens as wage laborers, (2) job insecurities at work due to their temporary worker status, (3) disadvantages faced by women workers for their gender identity and (4) the gendered impact of the pandemic on their lives. Originality/value: This study has explored the gendered impact of the Covid-19 pandemic on the lives of temporary women workers who belong to ethnic minority groups in the global south. Purpose This paper aim to examine the implication of section 172(1)(b) on employment rights, particularly on workers on precarious employment contracts. The aim of the paper is to analyse whether company directors have any liability for potential abuse of worker on precarious employment contracts. The paper examine the advantage of companies recruiting staff on precarious employment contracts and the effect of such contract on the worker.Design/methodology/approach The paper reviews case law, statutory provisions and academic opinions on precarious employment contracts and its advantages and disadvantages to the company and the worker. The paper critically reviews the impact of Section 172(1)(b) of the Companies Act 2006 on precarious employment contract workers.Findings The paper argues that companies benefit more from precarious employment contracts than workers do. The Companies Act 2006 is silent on whether directors should factor the interest of precarious employment worker when making company decision, thereby leaving these workers in a vulnerable position and at the mercy of the employers.Originality/value The paper offers a different argument about why the use of precarious employment contracts is on the rise in the UK. Using the lenses and language of therapeutic jurisprudence, this paper will argue that the rights of pregnant workers are vulnerable in a post-Brexit climate. Whilst the sunset clause from the Retained EU Law Bill, which would have caused all retained EU law to automatically expire at the end of 2023 unless expressly stated otherwise by Ministers, was lifted, the original drafts of the Bill made clear the government's lack of respect for and interest in protecting workers' rights (amongst others). Furthermore, despite the abandonment of the sunset, the now legislated Retained EU Law (Revocation and Reform) Act 2023, aiming to deal with all laws that were once of European origin, still gives Ministers wide powers with limited input from Parliament to change EU derived legislation and replace with UK provision. Using an example from employment law, specifically, pregnant workers, this paper will show that the Act is a therapeutic jurisprudence unfriendly bottle as it has the potential to violate positive physical, social, and psychological outcomes. Recognising that these laws are currently vulnerable, we urge the government to keep intact (and potentially enhance) the laws protecting pregnant workers. [ABSTRACT FROM AUTHOR]

This paper analyzes the dynamic asymmetric effects of digitization on domestic inflation for a sample of 54 advanced economies (AEs) and emerging markets (EMs) over the period 2004–2018. Using Katz and Calorda's Digital Ecosystem Development Index and employing the system Generalized Method of Moments (GMM) estimation methodology, the results of the paper reveal that the improvement in digitization has a statistically significant nonlinear deflationary effect with an exact threshold level of 43.22 points, that is, that the marginal effect of the digital penetration is larger when its level is lower than the threshold level. For EMs, with a level of digitization below the average of our full sample, policymakers must continue to invest in and expand on their digital ecosystem until the threshold level is achieved. Our results show that investment in human capital and improvement in governance can reinforce these deflationary effects. Hence, to obtain the maximum positive impact of increasing digitization on domestic inflation, EM governments should focus on maximizing school enrollment, controlling corruption, establishing rule of law, protecting the right to freedom of opinion and expression, and implementing accountability measures. While China engages in world commerce as a global player and is signatory to international labor and human rights standards, at the same time it uses treaty reservations and its own domestic laws to limit and undermine the full application of those standards. Concern from Western governments and global human rights groups regarding China's longstanding treatment of the Uyghur people has resulted in a freeze in negotiations for the EU-China Comprehensive Investment Agreement (CAI). This was also a result of China's failure to ratify or implement relevant United Nations (U.N.) covenants and International Labour Organization (ILO) conventions and placing reservations or domestic legal barriers on them, as well as foreign accusations of forced labor. Now that China has recently ratified ILO Convention Nos. 29 and 105 prohibiting forced labor, what will be the effect on the currently frozen negotiations of the EU-China CAI, now at an impasse due to issues relating to China's alleged discrimination and forced labor treatment of Uyghurs in Xinjiang, China? In unbundling the legalities of this stalled draft agreement, this paper progressively examines the global obligations of the U.N. covenants and ILO conventions, as well as relevant provisions in the draft CAI, in the context of the Chinese approach to international labor and human rights standards, including the EU's emerging due diligence laws and the 2021 Uyghur Forced Labor Prevention Act in the U.S. Following Part I, Part II of this paper outlines the key international labor and human rights obligations of which China is a signatory, such as the Declaration of Human Rights, U.N. treaties, ILO labor standards, free trade agreements, and national legislation. Part III addresses the legal consequences of alleged non-compliance as it may affect the Uyghurs; and Part IV provides analysis and presents the dichotomy between international standards and Chinese practices. This paper aims to explore the impact of maintaining an attendance system, CSR, entrepreneurial intention, and machine learning behavior on psychological improvement and employee productivity. The paper utilizes both primary and secondary research to explore the relationship between the variables under consideration. The findings show that CSR has a positive impact on the performance of an employee. The machine learning behavior allows employees to select the right career paths that result in high performance, satisfaction, and productivity. In addition, entrepreneurial intentions improve the productivity of employees within an organization as they desire to create new core values. This paper intervenes in ongoing discussions on emerging legislation and jurisprudence across jurisdictions offering employees the possibility to renounce established labour rights through individual labour rights waivers. Building on discussions about consent and coercion in the employment relationship, the paper argues that individual labour rights waivers in most cases undermine labour law's overall emancipatory potential, as they reverse the decommodifying effects of nonwaivable labour rights by re-appropriating the capitalist market logic that those very rights seek to offset. The paper's intervention is twofold. It first develops the argument about the emancipatory function of labour law, and uses it to examine the negative effects of individual waivers on labour law's capacity to emancipate working people and society at large. Second, the paper introduces a jurisdiction that until now has not been considered in the discussions on individual waivers, namely Germany. Although discussions on individual waivers in the scholarly discourse in Germany are marginal, the paper examines what current exceptions to nonwaivability might qualify as waivers, and argues that the reasons why individual labour rights waivers are less present lie in the strong collective dimension of the ideational framework that underpins German labour law. • This paper focuses on the relation between Marx's and Sraffa's treatments of prices of production. • Sraffa turns out to be right that empirical aggregates have essentially the same magnitudes in prices and labor values. • However, Sraffa's emphasis on the curviness of individual prices is not supported by the data. Rather, empirical prices are mostly near-linear and can be extremely well approximated by a simple quadratic form. This paper examines three propositions: Sraffa's comment that Marx was "of course" right in thinking that labor value and "Sraffa price" (prices expressed relative to Sraffa's standard commodity) aggregates are essentially the same: empirical deviations of various aggregate components of total output are around five percent. This should be reflected in small representative models. Second, Pasinetti is correct that actual Sraffa price paths are generally simpler than those in the theoretical literature – as confirmed by the 403 industry price curves of the US 2002 input-output matrix. Third, as has been often demonstrated, Marx's transformation procedure is an iterative procedure for deriving Sraffa prices. Bienenfeld derives powerful first and second iterates, each beginning and ending at the corresponding individual Sraffa price curves. The simple nonlinear form of the second iterate provides excellent fits for the 403 Sraffa price curves. It is therefore an empirically sufficient general form of such price curves. Authors’ moral rights throughout history have been protected in various degrees across the globe: French law honors authors’ rights to their particular individual creative expression as supreme and perpetual; German law considers an author’s moral rights and economic rights in equal measure; in Australia, moral rights, though only recently codified, are not transferrable as they can be in the UK if waived. While the overarching Berne Convention for the Protection of Literary and Artistic Works promises to protect the personality and reputation of authors, the literary landscape is now more diverse, with crossplatform entertainment streams expanding subsidiary rights opportunities in ways not anticipated even a decade ago. This paper explores how publishers and authors are currently navigating the publishing process post contract negotiations. Do authors defer to having their work manipulated to increase exposure or sales? Are publishers and editors successful negotiators and mediators of multiple uses of creative content and the authors who are inextricably tied to the work? Previous research has shown that trade unions have resorted to a number of rhetorical tools to make their arguments and ensure the voice of their members was heard. In a time in which union membership is declining and many have questioned trade unions' representation role, the recourse to figurative language – e.g. metaphors – might contribute to getting unions' messages through, restoring trust among affiliates. Against this backdrop, this paper examines the metaphorical devices employed in trade union discourse, with a view to appreciating the way they are utilised in employee relations and highlighting the values unions intend to promote through these figures of speech. To this end, discourse analysis is carried out on a data corpus consisting of documents issued by the Trades Union Congress (TUC) in a given timeframe, in which metaphorical language is employed. The analysis focuses on a specific topic, i.e. platform workers and the protection of their rights. The findings reveal that metaphors are used by trade unions to convey different meanings, which are intended to generate narratives aimed at safeguarding the rights of platform workers. The purpose of the research is to assess the state of protection of the rights of workers of industrial enterprises from the viewpoint of both international and national legislation in the conditions of a full-scale invasion of the Russian Federation on the territory of Ukraine. The research was conducted using qualitative analysis, formal-legal, logical-legal, system-functional methods, as well as the method of interpreting legal norms (method of legal hermeneutics). The paper states the insufficient effectiveness of the norms of modern international humanitarian law regarding the protection of the rights of workers of industrial enterprises in the conditions of martial law in Ukraine. The paper describes the general and special regime of regulation of the rights of workers of industrial enterprises in the conditions of martial law in Ukraine. For the first time, the authors proposed to understand the protection of the rights of individuals by international humanitarian law in both a broad and a narrow sense, and the meaning of such approaches was revealed. The publication developed recommendations for the protection of the rights of workers of industrial enterprises in the conditions of armed conflicts, recommendations which are important for the development of regulations, which indicates the practical significance of the paper.
