Objective: At the end of 2012, the Indonesian government enacted tobacco control regulation (PP 109/2012) that included stricter tobacco advertising, promotion and sponsorship (TAPS) controls. The PP did not ban all forms of TAPS and generated a great deal of media interest from both supporters and detractors. This study aims to analyse stakeholder arguments regarding the adoption and implementation of the regulation as presented through news media converge., Design: Content analysis of 213 news articles reporting on TAPS and the PP that were available from the Factiva database and the Google News search engine., Setting: Indonesia, 24 December 2012-29 February 2016., Methods: Arguments presented in the news article about the adoption and implementation of the PP were coded into 10 supportive and 9 opposed categories. The news actors presenting the arguments were also recorded. Kappa statistic were calculated for intercoder reliability., Results: Of the 213 relevant news articles, 202 included stakeholder arguments, with a total of 436 arguments coded across the articles. More than two-thirds, 69% (301) of arguments were in support of the regulation, and of those, 32.6% (98) agreed that the implementation should be enhanced. Of 135 opposed arguments, the three most common were the potential decrease in government revenue at 26.7% (36), disadvantage to the tobacco industry at 18.5% (25) and concern for tobacco farmers and workers welfare at 11.1% (15). The majority of the in support arguments were made by national government, tobacco control advocates and journalists, while the tobacco industry made most opposing arguments., Conclusions: Analysing the arguments and news actors provides a mapping of support and opposition to an essential tobacco control policy instrument. Background: Specialized drug shops (SDSs) are popular in Sub-Saharan Africa because they provide convenient access to medicines. There is increasing interest in how policymakers can work with them, but little knowledge on how their operation relates to regulatory frameworks. This study sought to describe characteristics and predictors of regulatory practices among SDSs in Kenya., Methods: The regulatory framework governing the Kenya pharmaceutical sector was mapped, and a list of regulations selected for inclusion in a survey questionnaire. An SDS census was conducted, and survey data collected from 213 SDSs from two districts in Western Kenya., Results: The majority of SDSs did not comply with regulations, with only 12% having a refrigerator and 22% having a separate dispensing area for instance. Additionally, less than half had at least one staff with pharmacy qualification (46%), with less than a third of all interviewed operators knowing the name of the law governing pharmacy.Regulatory infringement was more common among SDSs in rural locations; those that did not have staff with pharmacy qualifications; and those whose operator did not know the name of the pharmacy law. Compliance was not significantly associated with the frequency of inspections, with over 80% of both rural and urban SDSs reporting an inspection in the past year., Conclusion: While compliance was low overall, it was particularly poor among SDSs operating in rural locations, and those that did not have staff with pharmacy qualification. This suggested the need for policy to introduce levels of practice in recognition of the variations in resource availability. Under such a system, rural SDSs operating in low-resource setting, and selling a limited range of medicines, may be exempted from certain regulatory requirements, as long as their scope of practice is limited to certain essential services only. Future research should also explore why regulatory compliance is poor despite regular inspections.

Environmental regulatory edicts within the EU, such as the regulatory framework for chemicals REACH (Registration, Evaluation, Authorisation and Restriction of Chemicals), the Water Framework Directive (WFD), and the Marine Strategy Framework Directive (MSFD) focus mainly on toxicity assessment of individual chemicals although the effect of contaminant mixtures is a matter of increasing concern. This discussion paper provides an overview of the field of combined effects in aquatic ecotoxicology and addresses some of the major challenges related to assessment of combined effects in connection with environmental risk assessment (ERA) and regulation. Potentials and obstacles related to different experimental, modelling and predictive ERA approaches are described. There are many ways that occupations are regulated, with the degree of regulation usually depending on the amount of harm to the public that lack of regulation could bring. Strict regulations, such as mandatory licensure, are established through state law and maintained by a state board. Less strict regulations, such as voluntary credentialing, may be requirements by employers or third-party payers. This white paper reviews the possible approaches ASET could take toward regulation of the practice of electroneurodiagnostic technology: maintain position of neutrality, advocate for no statutory regulation of END, advocate for statutory regulation of END, or advocate for voluntary credentialing. The routes taken by other allied health fields are outlined, with exploration of the advantages and disadvantages of each option, as well as what would be required of ASET in terms of time and other resources to achieve each option. The appendix is a summary of entry requirements of several healthcare professions.

The official position of the Society for Clinical Trials is to support legislation in the United States and internationally that mandates registration of all controlled clinicals trials at or before enrollment of the first participant. The major trial sponsor would be responsible for ensuring contribution of trial information. The mechanism for registering trials would be through research ethics review boards, and registration would be required for ethics approval and before trial initiation. Standardized data and a unique identification number would be available for each registered trial.

Since dockless bicycle-sharing systems (DBSS) first arose in China in 2016, studies have examined their governance. However, there has been no comprehensive review of the literature on DBSS. This paper presents the first systematic review of the burgeoning literature on the governance of DBSS. It maps key research themes, identifies research trends and provides a deeper understanding of the governance literature on DBSS. We searched the Web of Science (WoS), Scopus and China National Knowledge Infrastructure (CNKI) databases to identify 95 papers written in English or Chinese between 2016 and 2019 that address the governance of DBSS. A thematic coding of these papers was supported by bibliometric analysis and knowledge mapping using the VOSviewer. More papers are written in Chinese rather than English, focusing on Chinese cities. Although the time range of our literature search was between 2016 and 2019, the first paper was published in 2017. Four key themes in the governance of DBSSs were identified within the papers, and over time the papers shifted their focus from problem-finding and problem-defining to problem-solving. Discussion of the inherent characteristics of the sharing economy and the externalities underpinning the governance of DBSS (Theme 1) and rebalancing problems for DBSS (Theme 2) first arose in early 2017, whilst discussions of the government regulation of DBSS (Themes 3) and the cross-boundary governance models underpinning DBSS (Themes 4) first arose in mid-2017. This paper concludes with a discussion of the identified themes and trends in the context of the broader literature on bicycle sharing and identifies opportunities for further research.

Over the last decade, dozens of states and the federal government have enacted 'second chance' reforms that increase the eligibility of individuals arrested, charged, or convicted of crimes to shorten their sentences, clear their criminal records, and/or regain the right to vote. While much fanfare has accompanied the increasing availability of 'second chances,' little attention has been paid to their delivery. This study introduces the concept of the 'second chance gap,' which it defines as the difference between eligibility and delivery of second chance relief; explores its causes; and approximates its size in connection with several second chance laws and initiatives. Using administrative and other data, it finds that among a host of petition-based second chance opportunities, to shorten sentences, restore one's vote, and clear one's criminal convictions, only a small fraction (less than 10 percent) of those eligible for relief actually received it. Extrapolating based on a novel analysis of around sixty thousand criminal histories of persons primarily seeking gig-economy work and of the expungement laws governing nonconvictions of all fifty states applying the nonconviction expungement laws of all fifty states to around sixty thousand criminal histories of persons primarily seeking gig-economy work, this study estimates that at least twenty to thirty million American adults, or 30-40 percent of those with criminal records, fall into the 'second chance expungement gap,' living burdened with criminal records that persist despite appearing to partially or fully clearable under existing law. These findings suggest that tens of millions of American are stuck in a paper prison, held back by deficiencies in the administration of second chances that have left them incarcerated, disenfranchised, or burdened by convictions beyond what the law requires. Some of the barriers to relief are structural and related to debt, overburdened bureaucracies, and the contested nature of second chance rules that unwind past judgments and policies. But others are harder to see and stem from administrative failures like unworkable standards, missing and incomplete criminal justice information ('dirty data'), a lack of awareness of second chance opportunities, and costly and complex processes. Fixing them--by moving administrative burdens from the defendant and onto the state and algorithms through automation, standardization, and ruthless iteration--can narrow the gap. Leveraging them, 'Clean Slate' initiatives to automatically clear eligible criminal records can have the potential to help the millions of Americans in the second chance expungement gap. However, the ability of such second chance initiatives to improve outcomes depends on how they are implemented. Debt-related barriers and dirty data can contribute to incomplete automation, leading to 'second second chance gaps.' In the realm of expungement, application of the expungement criteria to minor but not major offenses can also have the effect of exacerbating, not narrowing, existing racial disparities within the population of people with records, while improving them within the general population. Further research is needed to understand the impact of automated clearance under different scenarios, such as when the defendant is not notified of the relief received or there is a risk of statistical discrimination making things worse, not better. Their ambiguous legal and ethical status has become a barrier to adolescents' appropriate involvement in research from which they may benefit and which is needed to improve adolescent health care and to inform health policy. Involvement of adolescents in research should be based on a scientific and empathetic understanding of their developing capabilities and a careful assessment of risks and benefits. The important role of parents and communities as protectors of adolescents should be respected and enhanced as we acknowledge and respect developing adolescent autonomy. These guidelines provide a framework to interpret the federal regulations for protection of human subjects in light of the unique legal, ethical, developmental, contextual, and racial issues that affect adolescents. The guidelines are designed to protect individual adolescent research subjects and to facilitate important youth research that would promote the health of adolescents.

It is a pleasure and a challenge to comment on these two very different Articles, 'Saving Human Rights from Human Rights Law,' by John Tasioulas, and 'On Human Rights and Majority Politics: Felix Frankfurter's Democratic Theory,' by Samuel Moyn. (1) Both are rich, complex, and thought-provoking. To the degree they share any common dimension, it would be their skepticism toward human rights law, and in particular toward the judicialization of human rights law. But the skepticism comes from quite different directions and from their different disciplines. In the case of Tasioulas's paper, the skepticism derives from his belief that legal human rights have gone beyond the realm of moral human rights, and thus he critiques unjustified legalization and judicialization of human rights. Moyn focuses on US constitutional law to argue that courts should exercise more deference with regard to the laws and policies decided upon by democratic majorities. For the first time since 1913, and as part of the 2017 tax reform, Congress adopted a tax regime that exempts from U.S. taxation dividends from foreign subsidiaries. By doing so, Congress abandoned the general principle that U.S. residents should be subject to tax on all income 'from whatever source derived.' This shift marks a good opportunity for considering the reasons the United States taxed such dividends in the first place. In 1962, Congress enacted 'Subpart-F,' which subjected certain earnings of the foreign subsidiaries of American parent corporations to current-base taxation. This was a deviation from the general tax principle of tax deferral, under which earnings of foreign subsidiaries are taxed only upon repatriation of these earnings. An example of a taxable instance would be by a dividend. The new legislation was the result of political compromise. Although the Department of the Treasury (Treasury) supported a wide-scale elimination of tax deferral, Congress eventually adopted a much narrower law which eliminated tax deferral only in instances where it was abused, such as when deferrals are used to avoid paying otherwise owed U.S. taxes.Seven internal Treasury Department reports found in the archives of Harvard Law School's Law Library reveal the dramatic sequence of events that led to the enactment of Subpart-F, one of the most prominent international tax reforms the United States has ever known. The reports unequivocally support the notion that Subpart-F was initially formed mainly due to the deteriorating U.S. Balance of Payment position, and that its 'original intent,' as designed by its main architect, Assistant Secretary of the Treasury, Stanley S. Surrey, was to eliminate tax deferral and protect the U.S. tax base. This was based on the principles of equity, efficiency (Capital Export Neutrality), and elegance. Congress, on the other hand, rejected the proposal and adopted a much narrower piece of legislation, mainly due to the concern that eliminating tax deferral would result in a competitive disadvantage to American corporations operating abroad.Based on the reports, as well as the controlling legal and economic concepts of the time, I argue that Congress was mistaken in limiting the original proposal to eliminate tax deferral. This work reports a microfluidic paper-based photoelectrochemical (μ -PEC) sensing platform for thrombin (TB) detection with electron-transfer tunneling distance regulation (ETTDR) and aptamer target-triggering nicking enzyme signaling amplification (NESA) dual strategies. Specifically, paper-based TiO 2 nanosheets (PTNs) were prepared with an efficient hydrothermal process, serving as the direct pathway for the charge carriers transfer. When CeO 2 -labeled hairpin DNA 3 (HP3) was closely located at the PTNs, the CeO 2 -PTNs heterostructure was formed, which could great facilitate the photogenerated carries separation of CeO 2. In addition, with the aid of aptamer target-triggering NESA strategy, the input TB could be transducted to numerous output target of DNA (tDNA), achieving the goal of desirable signal amplification. In the presence of TB, the output tDNA could be further hybridized with HP3 and unfold its hairpin loop, which forced the CeO 2 away from the surface of PTNs and vanished the CeO 2 -PTNs heterostructure, resulting in the obviously reducing of photocurrent signal. The as-designed sensing platform exhibited a linear range from 0.02 pM to 100 pM with a detection limit of 6.7 fM. The regulation of health claims for foods by the Nutrition and Health Claims Regulation is intended, primarily, to protect consumers from unscrupulous claims by ensuring claims are accurate and substantiated with high quality scientific evidence. In this position paper, the Academy of Nutrition Sciences uniquely recognises the strengths of the transparent, rigorous scientific assessment by independent scientists of the evidence underpinning claims in Europe, an approach now independently adopted in UK. Further strengths are the separation of risk assessment from risk management, and the extensive guidance for those submitting claims. Nevertheless, four main challenges in assessing the scientific evidence and context remain: (i) defining a healthy population, (ii) undertaking efficacy trials for foods, (iii) developing clearly defined biomarkers for some trial outcomes and (iv) ensuring the composition of a food bearing a health claim is consistent with generally accepted nutrition principles. Although the Regulation aims to protect the consumer from harm, we identify some challenges from consumer research: (i) making the wording of some health claims more easily understood and (ii) understanding the implications of the misperceptions around products bearing nutrition or health claims. Recommendations are made to overcome these challenges. Further, the Academy recommends that a dialogue is developed with the relevant national bodies about Article 12(c) in the Regulation. This should further clarify the GB Guidance to avoid the current non-level playing field between health professionals and untrained 'influencers' who are not covered by this Article about the communication of authorised claims within commercial communications.
