On 12 November 2019, the Special Jurisdiction for Peace (JEP), handed down a landmark decision in the case of ‘Katsa Su’ concerning the Awa indigenous group in Colombia. The Colombian conflict has particularly affected indigenous groups, such as the Awa people, and has also affected the territory in which they live. In this article, we explore the decision of the JEP, within a broader analysis of the Colombian peace agreement and consider how it might help us to think about the place of the environment in the Women, Peace and Security agenda and in international law. We call for a gendered and intersectional approach to environmental peacebuilding which is attentive to the importance of gender and different groups. Further, we highlight how the Colombian example shows how concepts such as relief, recovery and reparations are often confined in international law to women's recovery and redress with respect to sexual violence and yet, this conceptualization should be much broader. The Katsa Su case provides an example of the fact that reparations and redress must address other forms of violence, spiritual and ecological, which women also suffer in times of conflict.

Este libro nacio en una conversacion entre los editores unas semanas antes del 2 de octubre del 2016, dia en que el Acuerdo de Paz de La Habana fue sometido a plebiscito. Como muchos colombianos, nos enfrascamos en una discusion sobre diversos aspectos de lo pactado por el gobierno colombiano y las Fuerzas Armadas Revolucionarias de Colombia –farc–. Esta inquietud de dos personas se transformo en un dialogo de veintitres. Asi, esta obra es una contribucion de la Facultad de Jurisprudencia de la Universidad del Rosario al debate del fin del conflicto armado y la construccion de paz en Colombia. En el, participan profesores de esta y otras universidades colombianas con el fin de presentar una reflexion academica desde los estudios socio-juridicos de los alcances, limitaciones y oportunidades de aprendizaje del proceso de paz y acuerdo logrado en 2016 con las farc. En este contexto, este libro responde a la necesidad de promover una discusion informada sobre el papel del derecho y de los abogados en la estructuracion e implementacion de iniciativas de paz. Luego de tantos anos en que los academicos han estudiado en el pais la interaccion conflicto armado y derecho, es esencial dar paso a una reflexion profunda que concatene esta disciplina con los escenarios de paz. This article explores the origin of private property in the Colombian legal system. The authors use Supreme Court case law from the twentieth century to analyze in-depth how wastelands (baldíos) come to be owned. Supreme Court decisions are organized and examined with respect to issues pertaining to appropriate modes of acquisition of wastelands, either occupation and labor or state grant, and the rules of evidence to prove whether the owner of a specific plot is the state, the titleholder or the settler (colono). This article demonstrates the difficult task of establishing simple clear rules to determine the ownership over tracts of land categorized as wastelands through the examination of the ambiguities of legislation and of the contradictory Supreme Court's rule of law. It also identifies the areas of contention, contestation and contradiction in the regulation of this matter and highlights how litigants, settlers, titleholders and Supreme Court Justices are part of a constant struggle to define the particular meaning of ownership over wastelands. © 2015 by De Gruyter.
