En esta investigación se pone en énfasis de qué manera ha impactado en el bienestar de los jóvenes que han tenido una ruptura familiar y se les ha concedido este tipo de custodia, ya que no se ha encontrado a nivel español análisis cualitativos que muestren las implicaciones que tiene para los hijos e hijas a la hora de desarrollar sus vivencias cotidianas. Para poder evaluar hasta qué punto se garantiza el bienestar subjetivo, se ha realizado un análisis comparativo de entrevistas en profundidad.

Aquest article exposa la importància de l’educació sexual als joves de gènere masculí que conviuen als centres d’acollida, sorgeix de la necessitat de formar els futurs adults en la igualtat i la paritat de gènere, eliminar els privilegis i també prevenir possibles actituds i comportaments compresos dins la violència masclista. Per tal d’aconseguir una societat fora del sistema patriarcal, lliure d’estereotips i creences que fomenten la submissió de la dona vers l’home blanc heterosexual. L’article busca eliminar l’androcentrisme i promoure l’evolució cap a un futur on totes les identitats i expressions de gènere puguin viure en igualtat sense ser jutjades ni oprimides. La problemàtica s’investiga a partir d’una metodologia qualitativa que aprofundeix en els coneixements dels joves i l’existència dels programes d’educació sexual. Els resultats mostren l’evident desconeixement social sobre la sexualitat i evidencien la necessitat de crear i incidir amb profunditat a una educació sexual propera i de qualitat This article exposes the importance of sex education for young people under guardianship, starting from the need to train future adults in gender equality and parity, to eliminate privileges and also to prevent possible attitudes and behaviours included in gender violence. To achieve a society outside the patriarchal system, free of stereotypes and beliefs that promote the subjugation of women to white heterosexual men. The article seeks to eliminate androcentrism and promote the evolution towards a future where allgender identities and expressions can live in equality without being judged or oppressed. The problem is investigated from a qualitative methodology that takes advantage of the knowledge of young people and the existence of sex education programs. The results show the evident social ignorance about sexuality and evidence the need to create and influence in depth an adequate and quality sexual education

Domestic violence victims in Haredi Jewish communities face serious obstacles to leaving their abusers and escaping domestic violence. Leavingtheir abusers often entails divorce and erce custody disputes. For manyHaredi women who have experienced domestic violence, leaving their abusers also involves leaving their religious sect or even religious observance in general. This paper will explore the dynamics that contribute to these concerns for Haredi Jewish domestic violence survivors and address how courts deciding child custody can inadvertently perpetuate domestic violence. This paper will then recommend changing the courts’ analysis in child custody cases to a “friendly religious co-parent” model in order to better protect victims of domestic violence., Columbia Social Work Review, Vol 18 No 1 (2020)

In 2013, the United States Supreme Court handed down a decision in Adoptive Couple v. Baby Girl, a decision that will have long-term effects on the use of the Indian Child Welfare Act by non-custodial Native parents. Congress passed the Indian Child Welfare Act in 1978 in response to the high volume of Native children that had been removed from their families and their tribes through the child welfare system. In the decades since the law was enacted, several state courts have sought to limit the application of the law through a state court created doctrine known as the Existing Indian Family Exception. Since the 2000s, that doctrine has been losing support among state legislatures and courts. Although Adoptive Couple does not explicitly endorse the exception, the opinion closely tracks the reasoning states courts have used to apply the exception. This Note analyzes how the majority opinion of the Supreme Court overlooks the rights and interests of non-custodial Native parents, who should also be able to invoke the Indian Child Welfare Act in a case involving their child. This Note also analyzes the recent guidelines and rules issues by the Bureau of Indian Affairs, which have started to fill in the holes of the application of the Indian Child Welfare Act left by the Supreme Court. However, as this Note will show, additional action, either by Congress or at the state level, is needed to ensure that future Native parents can use the Indian Child Welfare Act to ensure that their child remains connected to his or her heritage., Columbia Journal of Race and Law, Vol. 7 No. 1 (2017)

The one of the crucial issues in the Islamic family law in Indonesia is the issue of gender equity including tug of love. It is caused by historical and empirical of Islamic family law which still put unequal status and unequal roles between men and women. That Islamic family law is law that has become the positive law or has become law and regulation in Indonesia. This article will discuss about the provision of tug of love dispute in Islamic family law in Indonesia, and the renewal of provision of tug of love dispute from a gender justice perspective. Based on the review and analysis can be concluded that the provision of tug of love dispute in Islamic family law in Indonesia (particularly Article 105 and 156 KHI) is not gender equitable and should be revised by adding the aspect of morality, aspect of health, the ability to educate and the ability to take care of children as the main parameter in determining the right parent who will possess the custody of the children.Abstrak: Salah satu persoalan krusial dalam hukum keluarga di Indonesia yang perlu mendapat pembaharuan dewasa ini adalah persoalan keadilan jender dalam hukum keluarga, termasuk hak asuh anak. Hal ini dikarenakan kenyataan historis-empiris hukum keluarga masih menempatkan status dan peran yang tidak setara antara laki-laki dan perempuan. Hukum keluarga yang dimaksud adalah hukum keluarga yang sudah menjadi hukum positif atau menjadi peraturan perundang-undangan di Indonesia. Artikel ini akan membahas tentang bagaimana ketentuan sengketa hak asuh anak dalam hukum keluarga Islam di Indonesia, serta bagaimana pembaruan ketentuan sengketa hak asuh anak dalam perspektif keadilan jender. Berdasarkan kajian artikel ini, dapat disimpulkan; Pertama, ketentuan hukum tentang sengketa hak asuh anak yang diatur dalam pasal 105 dan 156 KHI tidak responsif jender. Kedua, aspek moralitas, kesehatan dan kemampuan mendidik dan memelihara anak tidak bisa dimonopoli oleh jenis kelamin tertentu akan tetapi semua aspek tersebut sama-sama bisa dimiliki baik oleh kaum perempuan (ibu) maupun oleh kaum laki-laki (bapak).

This dissertation examines the ways intimate partner violence (IPV) survivors' experiences of poverty, mental illness, social isolation, and gender inequality shape their opportunities to protect themselves and their children before, during, and after separating from abusive partners. Ethnographic research was conducted in three communities in the United States over two years. In each site I observed and interviewed women about their experiences of abuse and their attempts to achieve long-term security. I also observed and interviewed practitioners across a range of disciplines about their work with IPV survivors. The results of this study demonstrate that when women ended abusive relationships they often sustained a variety of losses related to their economic stability, social support, and access to their children. After leaving their batterers, many survivors faced debt, trauma, and protracted custody disputes that continued to disrupt their lives. However, the IPV interventions studied were routinely designed as though the collateral damage to an IPV survivor's life ended when she left her abuser. Interventions rarely accommodated survivors' post-separation social, economic, and parenting needs, and indeed, often placed additional strain on women's lives. As a result, the most disadvantaged survivors often found institutional resources in the domestic violence service system inaccessible, irrelevant, and at times counterproductive. This dissertation demonstrates that IPV is more than a series of isolated acts by individual people: it is the cause of many women's diminished agency and heightened suffering long after their abuse has ended.

A Partial Victory the decision in Debra H. v.\n Id.87 North Carolina's appellate court also applied the same basic features in Mason v. Dwinnell. Although it did not articulate a specific test, the court accorded a functional parent standing to seek custody, looking to (1) the couple's agreement to share in "all major decisions regarding their child"; (2) the functional parent's deliberate assumption of "emotional and financial care and support, guidance and decision-making" to the point of "equal participation"; and (3) the functional parent's "psychological parenting relationship" with the child.89 Thus while some states call mothers like Debra H. a de facto or psychological parent, some find that she stands in loco parentis or that exceptional circumstances warrant standing, and some prefer not to rely on strict terms or tests.

D.Litt. et Phil. This study explores the experience of parents who were involved in child custody disputes. In order to shed light on the phenomenon under review, an investigation of existing research literature was undertaken. The review comprises an overview of theoretical approaches to child custody and the various factors which play a role in the experience. These include an examination of factors surrounding the custody, emotional factors and coping skills. A further focus of the review is on the process of meaning making. The review explores the legal issues of child custody in South Africa and the role of the psychologist working in a forensic setting. The focus of the study is on the world of the lived experience as it is interpreted by participants in order to produce an understanding of the participants’ experience. Hence the study is sited within a phenomenological framework. Six participants were interviewed with the intention to act as informants who are able to give rich and abundant descriptions of their experience. All participants have been involved in disputes regarding the custody of their children. The interviews were recorded and transcribed. An interwoven analysis was presented in order to identify the themes and experiences of such disputes which emerged from the transcripts. An attempt was made to understand how the various phenomena relating to experience of disputed child custody as well as the role of the psychologist were reflected by participants in the interviews. Finally the study presents a reflection on the experience of the researcher. An evaluation comprising the strengths and limitations of the study as well recommendations for future research is further presented. The unique contribution to the field of psychology is also addressed.

In Beyond the Best Interests of the Child, three distinguished social science professionals have crafted out of evident compassion for the child a brief yet subtle program for the law's resolution of these difficult cases. Anna Freud and Albert J. Solnit are pre-eminent figures in child psychoanalysis and psychiatry, respectively, who insist that law recognize both what is known about child development and, as importantly, what is not known and cannot be predicted with certainty. Joseph Goldstein, a distinguished professor of law who has also acquired professional psychoanalytic training, seems ideally placed for the arduous task of smelting sound legal policy from the social science ore. Their book, warmly hailed by an impressive array of judges, child welfare professionals and others concerned with children, insists that the child's perspective must be controlling in any judicial proceedings to decide custody issues. In sum, we view much of what the authors say as extraordinarily helpful. The exhortation that courts would ordinarily do best to leave well enough alone -- to distrust their capacities for bettering even apparently harmful family situations, and consequently to follow a policy of repose -- is forcefully grounded and long overdue. But lawyers who understand and accept the authors' imperative concerns, whose highest value now in custody matters is keeping their clients out of court, may come to question this book for its failures to consider both the values -- values to children as well as to their parents -- of planning and compromise, and the impact of changed law upon behavior that does not presently come to court or find reflection in trouble cases. The book takes only the first, creative step towards important legal growth. So understood, its insights may mark the spot from which further analysis will occur. But initial creativity, the bold shift of perspective, must be channeled and refined before effective legal regimes can be shaped from it. That job remains to be done.
