The aim of the dissertation is to gain insights into the nature and feasibility of an accelerated share repur-chase in Germany. For this purpose, the acquisition method is considered in a multi-dimensional way: The focus is on the question of the extent to which the acquisition procedure is compatible with applicable corporate and capital market law; in this context, the extent to which an accelerated share repurchase is compatible with the nature of the German capital market from an economic point of view and the extent to which the procedure fits into the corporate governance of German companies is taken into account from a legal factual perspective; the answer to these questions is inseparably linked to a comparative examination of U.S. law and legal facts.

Raising the question of Ad hoc disclosure according to Art. 17 MAR and Related Party Transactions according to the German Act Implementing the SRD 2017 (ARUG II), the thesis combines two regulatory regimes that minimize unjustified (information) advantages to the detriment of third parties. The Ad hoc disclosure obligation alone imposes practical challenges to issuers. This thesis identifies new challenges in the practical implementation of both regulatory regimes by shedding light on the interplay between them. In particular, the thesis includes the question of the applicability of Art. 17 (4) and (5) MAR to the RPT publication obligation under sec. 111c (1) German Stock Corporation Act (AktG).

Advances in Accounting Education: Teaching and Curriculum Innovations publishes both non-empirical and empirical articles dealing with accounting education. Alexandrov spaces are defined via axioms similar to those of the Euclid axioms but where certain equalities are replaced with inequalities. Depending on the signs of the inequalities, we obtain Alexandrov spaces with curvature bounded above (CBA) and curvature bounded below (CBB). Anthropological Realism is a new theory of ethics that transforms static moral principles into global normative ideals. Two prominent weaknesses in the field provide the rationale for this book. First, as a discipline, ethics lacks a strong theoretical basis. A second concern is moral parochialism. Technologies are global, but international perspectives rarely reflect an ethics anchored in humanity as a whole.Progress in developing a moral globalism as the basis for ethics has been prevented by unproductive dualisms that lead to stalemates. Ethics is typically divided into opposites such as individual and society, consequentialism and deontology, and local and global.To deal constructively with this history of unproductive disputes, the book focuses on a fundamental rivalry in philosophical ethics—the opposition between realism and anti-realism. To move the field forward, the authors create a next-generation moral theory of hybrid moral realism that promotes a sustainable global ethics of humaneness and human flourishing.

There is a tension at the heart of family law and policy between the increasing influence of individual autonomy and the demands of caring for children. Individual autonomy envisages decisions made in one's own best interests, whereas decisions around care are often made for the good of the family, and may conflict with the caregiver's individual interests. Whereas individual autonomy valorises economic self-sufficiency, caregiving responsibilities constrain choice and conflict with paid work. This book explores this tension to consider how, given changing social trends, family law and policy should take account of caregiving responsibilities on parental separation. Crucially, it suggests that we need to rethink family law by placing care at its centre. This book draws on original empirical data to explore the experiences of parents in England and Wales, where the division of paid work and care is considered a choice, and Sweden, where parents are encouraged to work full-time, supported by wellfunded state childcare. This comparative perspective sheds light on whether the clash between the ideas of autonomy and care could be reconciled in a more gender equal society. The book argues that caregiving is hidden from, and undervalued by, law and policy in both jurisdictions, underscoring the need for the proposed new approach. The law needs to think more deeply about what it means to care, and how the care provided by parents differs. Anna Heenan outlines how family law might look different if the proposed framework, based on placing care at the heart of family law, is adopted.

Human and technical factors play a major role in the safety of aviation. From the competency of the airline pilot to the design and manufacture of aircraft, as well as how the aircraft is operated, there are compelling factors that a State must consider in implementing its safety management system. These elements are well regulated, in Annex 1 (Personnel Licensing); Annex 2 (Rules of the Air); Annex 6 (Operations of Aircraft) and Annex 8 (Airworthiness of Aircraft) to the Convention on International Civil Aviation (Chicago Convention) respectively. The overall philosophy of these Annexes is embodied in the broader principles contained in Annex 19 (Safety Management Systems). This book contains commentaries on the relevant Standards of these Annexes that require legal and policy analysis. It begins with a treaty interpretation of the Chicago Convention and the Annexes as well as their amendment processes and goes on to critically analyze the role of the International Civil Aviation Organization in that context. This work is a dissertation in the field of quantitative research in nursing science in Germany. It discusses the basics of subjective and objective probability theory and of gaining knowledge with quantitative research methods in nursing science. Despite the predominantly theoretical orientation of the work, reference is made again and again to very practical questions in nursing. The focus is always on the application of Bayesian statistics and what benefits this has for nursing science in general and German nursing science in particular. The author has been working in applied nursing research for 10 years.

In addition to a preparation and systematisation of the obstacle marking of wind turbines under aviation law, this book offers a well-founded legal analysis of the demand-based night lighting of wind turbines, with focus on the obligation of § 9 para. 8 EEG. In the sense of a practice-oriented commentary, the content of the provision and issues discussed in this regard are presented and interpreted. The compatibility with higher-ranking law and selected implementation issues are examined. In addition, approaches to the postulation for demand-based night-lighting founded on environmental protection regulations are presented.

Like no other discipline, environmental ethics can be a guiding star for environmental law and a discussion partner for the best possible environmental law. For the first time, the present study makes use of this critical potential of environmental ethics and takes a look at the Federal Mining Act (BBergG), the legal subject of raw material extraction. The main question is whether the individual regulations of mining law meet the requirements of resource ethics (as a relevant branch of environmental ethics). Specifically, resource ethics demands that the BBergG should be distributive and procedurally just and sustainable. The paper analyzes the extent to which the Min-ing Act meets these requirements and, based on this, formulates its own proposals for interpretation and reform.

The author addresses the conflict between the public interest in information and the protection of minors and human dignity on the basis of the so-called'reporting privileges'in the Interstate Treaty on the Protection of Minors in the Media (JMStV). In practice, the question of what content is still legally allowed to be presented arises not only, but especially in cases of reports about war and other humanitarian crises. In this respect, the work analyzes the legal provisions regarding the protection of minors relevant to broadcasting and telemedia services with the aim of providing orientation and guidelines for the often complex legal consideration processes, especially for media professionals and media supervision authorities.

Exposure to media figures, be they idols from television and the social web or virtual figures, shapes the personality development of children and young people. At the same time, this process is flanked by the protection mandate of youth media protection law. This interdisciplinary work bridges the gap between law and the social sciences by taking an in-depth look at the current state of knowledge in media socialization research on the benefits and risks of media relationships and making it suitable for the legal classification of offerings.

Scripture reveals that God has various attributes. One of the attributes that Scripture frequently refers to is God's righteousness. The attribute of God's righteousness enjoys a lot of scholarly attention in systematic theologies. Fewer studies, however, are devoted to investigating God's righteousness from a Biblical Theological perspective. This is exactly what this publication does: it provides a number of Biblical Theological investigations into the attribute of God's righteousness by investigating specific verses, chapters, and corpora from Scripture, and indicates how these portray God's righteousness as part of the developing, unfolding, and progressive storyline of the text. This includes research on topics that have not been adequately explored in the past. The chapters contained in this volume are written by Old and New Testament scholars, and the target audience is fellow Old and New Testament scholars and scholars interested in God's attributes.

This book, which is mostly a collection of the author's research, deals with clinical encounters through an interpreter. The book analyses the clinical communication and interpretation process from a new point of view. Clinical consultation through an interpreter can be divided into bilingual and trilingual communication. Bilingual communication means that the interpreter and the patient have the same mother tongue; thus, two languages are involved in communication: the patient's and the health provider's languages. In trilingual clinical encounters, the patient and interpreter have different mother tongues but both know a common language. In that case, three languages will be involved in the communication: patient's, interpreter's, and caregivers'languages. The interpretation process is doubled; first the patient must encode her/his language inside the brain (internal encoding), then the interpreter must interpret the message into the caregiver's language (external encoding). The risk of misunderstandings in trilingual communication is significantly higher than in bilingual communication. The book explores the difficulties involved in multilingual communication in a medical context, and will be of use to medical professionals and those in the field of language studies.

Nutraceutical, during recent decades, has emerged as a new term in the scientific literature. Synonymously used to the term nutraceuticals in literature are dietary supplements, bioactive nutrients, functional foods, etc. This book considers how nutraceutical substances are regulated in different countries; the physiological role of dietary fibers in relation to their claimed health benefits within the scope of functional foods, dietary supplements, and nutraceuticals; prebiotics, probiotics, and synbiotics as nutraceuticals; and the nature of a large number of phytochemicals as nutraceuticals. Examines how contemporary German and Polish novels reimagine borderlands as cosmopolitan spaces by engaging in border poetics, a narrative practice that relates political borders to figurative boundaries.Globalization notwithstanding, we live in an age of borders, as the ongoing conflict at Europe's eastern edge reminds us. Borders are meant to protect, but they more often divide and exclude. This book, however, focuses on literature that pushes back against the divisiveness of borders, advocating for transborder connections and criticizing exclusionary boundaries. It examines novels that reimagine past and present German-Polish borderlands as cosmopolitan spaces. Novels by Nobel Prize winners Olga Tokarczuk and Günter Grass are discussed alongside works by authors less well known internationally: the Polish Inga Iwasiów, the German Tanja Dückers, and the German-Polish Sabrina Janesch.The book utilizes and elaborates the concept of border poetics, a narrative and cultural practice that places political borders in relation to less concrete borders such as those of gender, ethnicity, or class, as well as in relation to epistemological and ontological boundaries: of language, knowledge, even reality. Because border poetics rests on the same productive tension between the particular and the universal that drives contemporary notions of cosmopolitanism, the book argues for the practice as an expression of what sociologist Gerard Delanty has termed'cosmopolitan imagination.'The richly contextualized analysis is framed within transnational German Studies and draws on border studies, cosmopolitanism, European literature, and world literature.

It is commonplace in certain quarters to posit that the British working class has virtually disappeared because of the collapse of manufacturing in the last decades of the 20th century. However, it is hardly plausible that there should be nothing left today of a social group that was conspicuous in the past owing both to its deep involvement in the economy and its palpable presence in the urban environment. As a matter of fact, not only has the working class been of interest to film-makers, singers, cartoonists, etc., over the last half century or so, but a majority of 21st-century Britons still consider themselves to be “working-class” while many eke out a living by performing tiring, repetitive, low-skilled and poorly-paid tasks, i.e. tasks typical of those carried out by workers in the past. This issue of Cycnos, therefore, aims at showing that the aforementioned verdict probably fails to take into consideration a number of critical questions that range from the notion of representation to that of permanence (whether physical or otherwise).

Catholics across Borders examines the evolution of a French-speaking population in Plattsburgh over a century. Contrasting with New England's francophone textile mill centers, Plattsburgh featured interethnic cooperation instead of conflict. The book explores how international events affected French Catholic identity at the local level, drawing from French-language newspapers and Catholic archives. Transnational Catholic migrants from Canada and France played a significant role in shaping local, regional, national, and international history in Plattsburgh and beyond, contributing to the larger narrative of the U.S. immigrant experience. This study provides a historic perspective for understanding the present.

Stelzer has gathered contemporary local newspaper reports of Churchill's lecture tours in many American cities, as well as interactions with leaders of local American communities—what he said in public, what he said at private meetings, how he comported himself. Readers observe Churchill as he is escorted by an armed Scotland Yard detective, aided by local police when Indian nationalists threaten to assassinate him, while he travels in deluxe private rail cars provided by wealthy members of his network; and as he recovers from a near-death automobile crash—with the help of liquor prescribed by a friendly doctor with no use for Prohibition. The links in Churchill's network include some of fascinating American figures: the millionaire financier Bernard Baruch; the railroad magnate, Averell Harriman, who became an FDR-Churchill go-between; media moguls William Randolph Hearst (and wife and mistress); Robert R. McCormick—who attacked Churchill's policies but enjoyed his company—and Charles Luce, who made him TIME's Man of the Year and later Man of the Century; and bit players such as Mark Twain, Charlie Chaplin, and David Niven. It is no accident that Churchill was able to put these links together into an important network that served to his, and Britain's, advantage. He worked at it relentlessly, remaining in close contact with his American friends by letter, signed copies of his many books, and by attending to their needs when they were in Britain. Many of these colleagues were invited to dinners at Chartwell and, later, Downing Street. Perhaps most importantly, Churchill's network of American allies had Franklin Roosevelt's ear while the president was deciding how to overcome opposition in congress to helping Britain take on the threat from Germany.
