For many years, the topic of "madness" was covered with prejudices not only in Mexican society, but also in the Mexican legal system, which in its beginnings did not have greater considerations towards people suffering from such condition, therefore, the administration of justice was irregular and often subject to the discretion of the judge, so medical experts had to be resorted. The legality of police arrests is decided at initial hearings in Mexico City's criminal justice system. In the crime of simple drug possession, decisions of illegality are much more frequent than in any other crime. I hypothesize that the perception of the person arrested, the importance of the crime to the problems of insecurity, and concern about the functioning of the hearing system are factors that impact this outcome. I employ a mixed methodological strategy. Interviews with legal operators show that people arrested for simple drug possession are seen more as "victims" than "criminals," and their prosecution as a problem for the workload. Based on a sample of hearings, I compare the probability of illegality of detention in the crimes of simple drug possession and drug dealing, crimes with similar detention dynamics. The higher probability of illegality decisions for the first crime supports the qualitative findings. I discuss the results in the context of studies on initial hearings, and more generally, on the importance of extralegal factors in the functioning of the justice system. [ABSTRACT FROM AUTHOR]

This article addresses a highly relevant issue for the judicial system of the Milagro canton: the impact on legal certainty in judicial processes related to drug offenses following the repeal of the drug consumption table. This analytical research aims to examine how the absence of the consumption table has affected the development of judicial processes, investigating the implications for the legal certainty of the parties involved. This article offers a comprehensive analysis of mediation and conciliation in Ecuador, focusing on its legal framework, accessibility, effectiveness, and future challenges. The objective is to analyze the current state of mediation and conciliation in Ecuador, highlighting its legal framework, accessibility, effectiveness, and future challenges. The methodology consisted of a review of 12 recent studies selected using the PRISMA method, examining these mechanisms within the Ecuadorian justice system. The main findings show that mediation and conciliation are well-established within the Ecuadorian legal framework, supported by the 2008 Constitution, the COIP, and the COGEP. These mechanisms have proven effective in reducing the judicial burden, particularly in areas such as civil, labor, and family law. However, significant challenges remain, such as limited accessibility in rural areas and a lack of specialized training for mediators, which affects the quality and effectiveness of the process. In terms of restorative justice, mediation has shown great potential to improve social cohesion and reduce recidivism in community conflicts. Despite these advances, reforms are needed, such as greater investment in creating mediation centers and training programs. The review on digital evidence in judicial systems addresses its growing importance and the challenges facing its implementation. The central objective of the reviewed studies is to analyze the evolution and challenges of digital evidence in the General Organic Code of Processes (COGEP) of Ecuador, as well as to compare it with the regulations and judicial practice in other countries such as Venezuela and Colombia. The generalization of the use of new technologies such as artificial intelligence (IA) has impacted key areas of human activity, from health care, management, administration of justice, design of new goods and services, to education at all levels. Al the same time, it has raised conceptual and ethical challenges with a speed barely matched by attempts at regulation and the warnings of intellectuals, including the developers themselves. The incorporation of AI in education has had significant uses in the personalization of education and assessment, support for the production of educational material, and freeing teacher from repetitive tasks, among other advantages, but it has also posed challenges and risks for the institutions that train the educators themselves, in addition to the consequences for traditional forms of teaching and learning. In this article, a documentary review of research and academic material is conducted to construct a state of the art of the possibilities of AI in education. This study examines the impact of Article 644 of the Organic Comprehensive Penal Code (COIP) on the right to appeal in traffic offenses in Ecuador, particularly in cases where no custodial sentences are imposed. Forensic anthropology in Ecuador is essential for the identification of human remains in judicial processes. In the face of violence and disappearances, this area unites scientific and ethical rigor, providing both judicial and emotional responses to the families of the victims. The research examines the growth and challenges of forensic anthropology in Ecuador, including its evolution, its relationship with forensic medicine, techniques used, and limitations in infrastructure and training. The research on the decriminalization of abortion in comparative law analyzes and compares legislation from Latin America, Europe, and North America, highlighting the diversity of approaches and restrictions. In Latin America, many countries have restrictive laws, such as El Salvador and Nicaragua, where abortion is banned in all cases. However, Argentina and Colombia have advanced partial decriminalization, allowing abortion under certain circumstances. In contrast, in Europe and some areas of North America, laws are more progressive, considering women’s health and autonomy as central factors. Canada, for example, allows free access to abortion, while the United States has seen a fragmentation of rights since the decision in Dobbs v. This paper proposes a reflection on the compliance programs in Colombia. This is a modern tool adopted in order to associate companies with the effort to protect issues considered valuable to the legal system. The institution has been partially and recently integrated into the Colombian legal system as part of a new legal discipline: compliance. This is a global regulatory trend that has developed in response to serious scandals involving large international companies. In this article, transparency and business ethics programs are analyzed based on Colombian regulations, which expressly propose to integrate international standards on the matter. A descriptive and analytical methodology of the national regulations on the subject is followed, which is complemented with a comparative analysis that takes into account the international origin of the institution. The first part of the text analyzes the positive aspects of the institution. These are associated with the diffusion of a new conception of corporate responsibility that allows for the imposition of obligations related to the protection of the general interest. In the second part, the shadows are analyzed, there a critical vision is raised on the way in which the institution has been integrated into the Colombian legal system. It is concluded that the figure can have positive effects, but the timid and incomplete adoption prevents it from generating all the beneficial effects that can be derived from it. This article includes and analyzes the events that occurred during the period 2011-2021 in relation to the socioenvironmental problems associated with mining in the Complejo Cruz Verde-Sumapaz Páramo (cpcvs) with the objective of identifying those actors who have a role in the problems, decision, and institutional-normative advances that have an impact on the environmental legal system. This research was carried out with a descriptive qualitative approach based on the methodology for community management of environmental conflicts. It provides a biogeographical characterization of the main socio-environmental elements and a precision of the temporality of the most relevant facts. As a result, three scenarios of debate are defined: ambiguity in the dispositions, normative outdatedness and applicability exceptions, concluding that these factors allowed the exploitation in the páramo, generating a significant conflict in the environmental legal system. Objective/context: This paper examines the open legal primary rule in Chile for the selection of the presidential candidate, established in 2012 through Law 20640. This rule contains elements shared with similar legislation in the region as well as specific characteristics. Methodology: Through a case study, we will investigate the results and consequences of the application of primaries on the three occasions they were implemented (2013, 2017, and 2021). We will review the formal changes adopted and the political events that occurred in the interim, considering the main variables that typically intervene in electoral events of this nature, drawn from the existing debate and literature. Conclusions: The case of Chile shows that the combination of an open legal primary system with voluntary internal voting, incomplete simultaneity, and the absence of stable political groupings produces effects that do not align with either the general aspirations for the implementation of primaries or the theoretical purposes outlined by the ideologists of Chilean legislation. The general objective of the research was to analyze justice for environmental defenders in the Peruvian legal system. This research work was developed from a quantitative approach with a descriptive methodology with a non-experimental design, which was supported by documentary-bibliographic analysis. Documents were used for this type of study, and the researcher collected, selected, examined and showed the results. A research process was organized in which the study population was based primarily on written documents, scientific articles and agreements, in order to study them and draw conclusions. Inheritance is the main form of access to land for family farming (FF) in the southwest (SO) region in Buenos Aires province, with a clear preference towards men when inheriting. Although there are no regulatory hindrances for women to have access to land in the Argentine legal system, they face socio-cultural obstacles to inheriting land. For this reason, the present work aims at analysing, from a qualitative approach and with semi-structured interviews as the main data collection technique, the situation and limitations regarding access to land for women in the Buenos Aires SO region. The incorporation of the gender perspective in the analysis of the problem of access to land faced by producer families in the Buenos Aires SO region shows that women from family farmers face various structural and historical inequalities due to their condition of being women, where the land becomes crucial since it brings together both the productive unit and the family home. This article aims to examine the phenomenon of court fees in Chile, exploring their legal nature, historical development, and the economic implications of adopting either a broader or more restrictive concept toward court fees. A historical methodology and dogmatic analysis were used to investigate the rationales for their implementation, as well as the challenges they pose to ensuring access to justice. The article concludes that court fees are not an effective instrument for reducing strategic litigation by certain habitual claimants, as better alternative mechanisms exist to achieve this purpose. However, it recognizes that court fees could serve a revenue-generating goal, provided this is consistent with access-to-justice principles. This article aims to identify some negative externalities arising from the failure to comply with specific ethical standards in Artificial Intelligence (AI) models. This study highlights the importance of paying rigorous attention to the data used in building AI models, such as listing potential solutions to reduce the incidence of skewed algorithms and mitigate their harmful consequences. This article followed an exploratory descriptive methodology, addressing practical cases, and turned to bibliographic review as a technical procedure. The main finding is that skewed algorithms cause disastrous social consequences, violating fundamental rights and actings as catalyzers, increasing and perpetuating prejudice and segregation inherent to their society, thus contributing to the structural racism that permeates society and the criminal justice system.
