In recent years, discussions around workplace harassment, and especially the ratification of ILO Convention 190, have gained momentum worldwide, drawing attention to the profound impact it can have on people, organizational culture and the general well - being of society. As workplaces strive to foster environments of equity and inclusion, addressing the issue of harassment has become a fundamental aspect of Mexican labor law. This case study delves into the specific context of Mexico and the case of Rosa, a laboratory employee with 20 years of seniority as a chemical industry assistant, the workplace harassment she suffered from her Supervisor for 20 years, reaching the limit of wanting to resign despite requiring the money; This case, which has a 2023 ruling within a new Mexican labor procedure, undoubtedly dictates a relevant and hopeful judicial precedent for the hundreds of victims of corporate harassment and how to achieve economic compensation for workplace harassment within the framework of Mexican labor law. Mexico, within the context of the USMCA, like our partner nations, has promoted important legal, corporate and social changes to confront, eradicate and economically compensate victims of workplace harassment. Recognition of people's rights to dignity, safety and respect in the workplace is critical to fostering a healthy and productive work environment. This case study seeks to explore the jurisdictional mechanisms and nuances to achieve financial compensation as a remedy for workplace harassment in Mexico, providing information on the legal landscape, evidence, hearings and witnesses that were required for this purpose, as well as the prevailing challenges and possible avenues for improvement or even reform. It is imperative to recognize the economic implications of workplace harassment, which are then at the employer's expense, extending beyond the people immediately involved, to severely damaging their mental health. The business economic repercussions, both for affected individuals and organizations, highlight the urgency of implementing effective legal frameworks and redress mechanisms. Through a careful analysis of labor law in Mexico and real-life case studies, this study aims to bring valuable perspectives to the ongoing dialogue on fostering harassment-free work environments, promoting justice, and ensuring fair compensation for those who have suffered such violations. - Abstract
Organizational climate refers to the environment that exists among all members of an organization. Therefore, it is closely related to the quality of employee motivation and specifically describes the motivating characteristics of the organizational environment. The present study was carried out with the objective of analyzing the impact of labor relations on the organizational climate within the administrative areas of the Marbelize company. For this purpose, a mixed approach was used with scope at a descriptive level with direct participant intervention in the field study carried out in the Marbelize company. Among the statistical methods and techniques applied, a questionnaire based on the six-dimensional theory of organizational climate proposed by Weisbord stands out and was adjusted to the context of the tuna company in Ecuador. The questionnaire consisted of 30 questions grouped into three phases. An analysis of demographic data was carried out and the reliability of each dimension that includes the organizational climate and the employment relationship was evaluated. The results indicate that, after the implementation of strategies to improve labor relations, such as the creation of spaces for dialogue, training in communication skills and the introduction of flexible benefits, it is possible to restore a work environment favorable to the interests of both the company as well as the workers. It is concluded that with the stable behavior of these variables the company will have an increase in job satisfaction, collaboration between teams and a general improvement in performance indicators, which demonstrates that attention to labor relations and the implementation of specific actions They have a significant impact on the organizational climate. Despite the relevance of the pharmaceutical industry in Mexico, physicians working in this market, such as the Adjacent Pharmacy Clinics (caf) and the authorized third parties, are usually employed under flexible and precarious characteristics that tend to deprofessionalize them. With the support of the qualitative approach, a case study was developed, interviews were applied to physicians who worked in a third party authorized clinic located in Guadalajara; through testimonies, the activities and working conditions of the company were evidenced. It was identified that the physicians who worked in the clinic accepted flexible and precarious working conditions in exchange for practicing their profession and acquiring work experience while they found a job with better working conditions or while they were preparing to continue with their specialty studies. COVID-19 changed routines and affected health, economic and educational systems. Unfortunately, insufficient attention has been paid to its effects on mental health, particularly on teachers. In this framework, this research aimed to describe the self-reported general health of Chilean teachers during the physical isolation and quarantine measures imposed after COVID-19 in Chile. Methodologically, through a non-probabilistic sampling, the Goldberg General Health Questionnaire in its 12-item version (GHQ-12) was applied to 4,109 educators, teachers and principals between July 9 and August 6, 2020. Using frequencies and chi-square, the results show that 68.8% of the respondents self-reported mental health problems, especially critical in women, young people and those who practiced in in the classroom in elementary and middle school, caregivers and those with -or in their family- symptoms or diagnosis of COVID-19. The conclusions highlight the vulnerability of the profession to mental health problems as an effect of the outbreak, distance education and the precariousness of their pre-pandemic working conditions. Background: The mental health of health personnel was affected by the SARS-CoV-2 pandemic and its associated consequences, including the change in working conditions. Aims: To analyze the relationship between mental health indicators and socio-occupational factors. Materials and methods: The PHQ-9, GAD-7, and ISI-3 were applied to 90 health workers. Results: Nursing staff reported greater depressive, anxiety, and insomnia symptomatology. In turn, they manifested greater indicators of depression in interaction with the change in workday (F (1,86) = 3.83, p= 0.05, partial η² = 0.04) and work shift (F (1,86) = 6.80, p= 0. 01, partial η² = 0.07); greater anxious symptomatology in interaction with change in workday (F (1,86) = 5.83, p= 0.02, partial η² = 0.06) and work shift (F (1,86) = 9.26, p= 0.003, partial η² = 0.10). Additionally, more indicators of insomnia in interaction with being on the front line (F (1,86) = 4.96, p = 0.04, partial η²= 0.05) and changes in working hours (F (1,86) = 3.88, p = 0.05, partial η²= 0.04). 20. Desempeño docente: las consecuencias del burnout y su relación con factores protectores.

The burnout syndrome is an occupational health indicator that intervenes in the teaching-learning process and may harm the quality of education offered by institutions. The relationship between individual characteristics and the work environment may have different effects over the teaching performance. The current investigation seeks to analyze the fit of a model to predict teaching performance based on the teacher burnout, while including individual characteristics and the work environment perception in university teachers. The sample is composed of 94 teachers who provided information related to the Conscientiousness trait, their burnout and engagement levels, their teaching performance, and their perception of the work environment. This quantitative and cross-sectional research makes use of structural equation models to test its hypothesis. The second tested model showed the best fit, considering teaching performance as different variables for each component. This model shows that the perception of the work environment is the main predictor of performance (β = .116 - .239). The implications of these findings are discussed, focusing specially on performance as a construct. [ABSTRACT FROM AUTHOR]

Ecuadorian shrimp companies must comply with quality management systems and have certifications that guarantee a product with national and international standards, which leads to improving their work environments. Therefore, the aim is to propose improvements applying the 5s methodology (organization, order, cleaning, standardization, and discipline, by its original name in Japanese) for the classification and packaging area of a shrimp company. The investigation had a quantitative approach based on the survey of information in situ with the evaluation of the proposed criteria. It was determined that the current level of compliance with the 5S is 29%, therefore actions for improvement are proposed; based on the commitment of the partners to ensure success. The voice is the most used instrument in the work environment of teachers, but its care has not been the best. The research was carried out with the objective of diagnosing the preparation of teachers of educational institutions for the prevention of dysphonia, for which methods such as analysis and synthesis, induction and deduction, interviews, observation, descriptive statistics and the percentage calculation that allowed the collection and study of the information, which made it possible to determine the existence of risk factors for the appearance of dysphonia that are unknown by the teachers and to evaluate the level of knowledge about the use and care of the voice. The results show that the level of knowledge about the use and care of the voice is low, which can affect the appearance of disorders such as dysphonia and nodular laryngitis. [ABSTRACT FROM AUTHOR]

This article describes and analyzes the strategies used to introduce Uber in Spain. The concept of sociotechnical framework is used, highlighting the interaction of multiple factors to achieve the stabilization of the model. Among them, the role played by technology is relevant, but this concept helps us to consider the importance of other issues or the different dimensions involved in its use. Specifically, we describe the adaptations with respect to the original design that the Uber model had to make in order to operate in Spain, paying attention to the market situation that was established and its influence on the working conditions of its workforce. A characteristic feature of the model is considered to be hyper-flexibility, a circumstance previously existing in the Spanish labor market, but which is exploited and expanded through the use of algorithms applied to labor management. This implies an even greater increase in the hyperflexibility described in the text. The data used for the analysis come from extensive fieldwork. This material is combined with information from secondary sources, mainly the economic press, court rulings and data provided by the Spanish Ministry of Transport, Mobility and Urban Agenda. The objective is to determine the relationship between labor well-being and teaching commitment in an educational institution in Peru. It was developed from a quantitative approach and correlational scope, with a non-experimental field design, the population was made up of 41 teachers. A coefficient of 0.437 is evidenced, cataloging a moderate positive correlation between the study variables. A relationship is generated between the variables, so the positive hypothesis is approved and the null is rejected. The correlation, being moderately positive, reveals the need to increase labor well-being, since the teaching commitment has been statistically more significant in the participants. This implies that teachers are highly committed to their work, despite the fact that this does not generate all the favorable conditions to develop it. [ABSTRACT FROM AUTHOR]

Objective: To determine the relationship between over commitment and somatic symptoms among nurses in a type II hospital in Peru. Methods: A cross-sectional study with a probabilistic sample of 106 participants was carried-out. The Siegrist and Meter questionnaire was applied to measure over commitment and imbalance effort-recompense and the Health Questionnaire (PHQ15) was applied to evaluate somatic symptoms. A logistic regression model was built considering sociodemographic and labor variables. Results: The 68.3% of nurses that presented with moderate to severe somatic symptoms had a high level of over commitment. The regression model showed that over commitment (OR = 6.25, p < 0.01), time in the working place (OR = 0.74, p < 0.01) and labor status (staff or hired temporarily OR = 49.20, p < 0.01) influenced the level of somatic symptoms. The model discriminated well the 79% (95% CI: 95%: 0.70 - 0.88) of somatic cases. A value of 0.43 was selected to discriminate between mild to moderate-severe with a sensitivity of 73% and 74% specificity. Conclusions: A significant correlation between over commitment and somatic symptoms was found. The regression model attained a high discriminative level to identify nurses at risk. Introduction: The platform economy has invaded social relations in every way. Products of the information revolution, artificial intelligence and big data, the platforms constitute a sign of the times that crosses and deepens the set of pre-existing mercantile relations while commodifying a series of activities that, until their arrival, were outside to data extractive logic. The consequences of this irruption for the world of work are multiple and profound. Objectives: Here we propose to analyze the control practices and working conditions at UBER, the company that constitutes a paradigm of the new work management logics through digital platforms. Methodology: The study is qualitative in nature, based on ten in-depth interviews with UBER drivers during the years 2019 and 2020, in which, among other dimensions, working conditions, control mechanisms and meanings of work were investigated. Likewise, periodic monitoring of two driver and passenger forums was carried out. Results: Throughout the writing, a multiplicity of daily practices developed by the Uber company to influence the behavior and control the activity of drivers is observed. The platform's capacity to algorithmically manage work in a massive and personalized way is verified, with significant effects on working conditions. Conclusions: The study concludes that, far from the situation of autonomy proposed from business narratives, uberized work supposes significant degrees of dependency, control and exploitation of the workforce. Likewise, it is observed that the irruption of the platforms supposes a new stage in the deepening and extension of the relative vulnerability of work. [ABSTRACT FROM AUTHOR]

Introduction: This study shows the perceptions that the so-called «Guachimanes» have about their informal working conditions on the issue of security in Costa Rica. Despite the important role that these people play and the wide perception of insecurity in the country, little is known in whose hands the safety of the neighborhood is, much less its working conditions. Objetive: Due to the above, this study explores the informal work conditions in private security from the perceptions of the Nicaraguan migrant, to describe from their own experiences, to demonstrate and reflect on the work environment and the dignity of their labor rights and as human beings. Method and technique: This is an exploratory study with qualitative nature, the data were compiled through a methodological instrument of semi-structured interviews in different neighborhoods of the Gran Área Metropolitana (GAM) chosen directly upper-middle-class neighborhoods, in which the cabins and boom gates were present. Results: Different perceptions were found about their work's conditions, which objectively in few cases are considered attached to the workers' rights. These conditions despite not being optimal for migrants due to their irregular status in the country, they accept them even if they are considered «bad or regular». Conclusions: Finally, the conclusion is reached that the Nicaraguan immigrant, due to his condition in the country, is forced to renounce his rights on many occasions for fear of nonsubsistence in it. In this papper, we analyze the working conditions of domestic workers in Mexico considering aspects associated with income, social security and tax formalization in order to assess the degree of succes of government actions aimed at improving the conditions of this group. For this, we designed an analysis model based on remuneration, job stability, social security and fiscal formalization. Likewise, its main socioeconomic characteristics are considered. For that, we used the microdata from the National Occupation and Employment Survey for the first quarter of the period between 2018 and 2021 to consider the stage prior to the implementation of the pilot test program for the incorporation of domestic workers into the Mandatory Social Security Regime, its implementation, and the two subsequent years. As the main result, it was identified that domestic workers are nowadays a vulnerable and invisible social group in the focus of government attention. They are characterized by a series of factors that aggravate their vulnerability: both due to their origin and their professional activity, which refer us to their historical precariousness. The adoption of the neoliberal model and the implementation of the new public management approach in Chile, have led to the implementation of social policies that prioritize quantifiable efficiency and adherence to administrative standards over effective solutions to social problems. This has had a negative impact on the experiences of professionals working in the field of psychosocial intervention, and on the quality of their interventions. However, the perspectives of these professionals play a crucial role in shaping how they implement their interventions and ultimately determine the perceived effectiveness of social policies. The article pursues two main objectives: firstly, to identify subjective aspects of professionals involved in various psychosocial intervention experiences, and secondly, to explore their connection to the neoliberal nature of Chilean social policies. To this end, a systematic review was conducted, focusing on the perspectives of professionals on Chilean social policies, their work as interveners, and the users they work with. The study followed the PRISMA (Preferred Reporting Items for Systematic Reviews and Meta-Analyses) guidelines, and a total of 4,799 articles were identified in five databases (Psycinfo, Scopus, Sociological Abstracts, and Web of Science), out of which 26 met the eligibility criteria. The information was analyzed using a thematic synthesis, and the results were organized into five analytical themes: counterproductive framework, internal obstacles, users at fault, threatening tensions, and coping responses. The study concludes that an intervening rationality aligned with negative working conditions and intervention problems underlies these themes. Responses to this rationality are politically ambivalent, as they can either reinforce neoliberal logics or represent transformative lines for radical disruption in psychosocial intervention practices. Resumen: El heterosexismo y el cisgenerismo pueden dar lugar a experiencias de exclusión social en el trabajo, que perturban el bienestar de las personas LGBTQ+. Para medir esta realidad, los autores elaboran un índice específico de calidad del empleo, basado en datos de una muestra de 1761 trabajadores de Quebec, seleccionados en el marco de la encuesta UNIE‐LGBTQ (2019‐2020). Este índice, creado a partir de puntuaciones factoriales, comprende 16 indicadores y 5 dimensiones. Tiene una coherencia interna aceptable y se asocia moderadamente con la satisfacción laboral de las personas LGBTQ+. The objective of this review article is to determine, through a database, the level of the work climate of health personnel from public institutions in Latin America, generated through scientific publications from 2019 to 2022. The research is of descriptive quantitative character. A total of 1,069,976 articles found were obtained, leaving 12 articles through systematic purification as the final result. The results of this article show that, at the Latin American level, in eight of them (three from Mexico, two from Peru, two from Ecuador and one from Brazil) health professionals perceive an inadequate work environment, unlike the four remaining investigations (one from Brazil, Colombia, Venezuela and Chile) that perceive an optimal work environment. And the factors that affect the work environment in health personnel as identified public servants are, in the first place, the remuneration factor, inadequate decision making, lack of leadership, lack of recognition and outstanding achievements. The development of technologies, organizational changes and the COVID-19 pandemic have caused a significant increase in the use of remote work modalities. The objective of this research was to evaluate the working conditions of remote work modalities in Cuba. The telework/remote work questionnaire was applied to a total of 28,026 s and managers. The working conditions were valued positively teleworker and remote worker, and managers, elements related to: the clarity of the objectives to be achieved, the deadlines for completing their tasks and adequate communication with co-workers and managers stand out. The main difficulties with working conditions are associated with limitations in the speed and stability of the Internet connection, and access to the necessary computer means provided by labor organizations.
