The article explores and, to a lesser extent, makes an evaluation of the different methodologies that the Criminal Law scholars in Spain try to develop to solve problems related with the free speech adjudication in cases of hate or extreme speech. The first of these purposes starts with an analytical separation that divides the different proposals in two paradigmatic models that contain the essential features to all the alternatives methodologies. Using this general exploration, the article ends in a more normative way, taking a position in the debate and trying to set an ideal order of priorities for the free speech adjudication in complex scenarios.
