Dealing with counter-revolution is a tricky business. For while the word "counter-revolution" signifies opposition to revolution, it is first important to get to grips with the principles of revolution. And while principles are ideas, their application and implementation presuppose a terrain capable of receiving them - in other words, a society ready for revolution. It's in this sense that we need to think about a counter-revolution. It's one thing to know the contours and guiding ideas, but quite another to be able to apply and realize them in a society. This is where a good counter-revolution, like a revolution, must unite the philosopher and the politician, the man of ideas and the man of realizations.

The Revolt of Naples in 1647, led by the fisherman Tommaso Aniello (Masaniello), provoked intense reactions throughout the European continent. In addition, discussion on politics and the Reason of State acquired increasing relevance from the second half of the 17th century onwards. Literature followed and some intellectuals saw in these historical events the opportunity to expand their pedagogical models in the Protestant school dramas: the use of history as a method of teaching politics, rhetoric, and religion at the same time. One of these authors was Christian Weise (1642-1708) who, taking as his source some of the chronicles of the above-mentioned Revolt, wrote a play, Masaniello (1682), in which he sought to make his students, the audience and the reader reflect on political prudence and the Reason of State.

FR. Longtemps, les risques encourus par les journalistes sur les zones de conflits armés n’ont pas, ou peu, été reconnus et pris en charge par les industriels de l’information. Être blessé.e ou mourir en couvrant des conflits pouvait être considéré comme un prix à payer afin d’appartenir à la noblesse des reportèr.es ou des correspondant.es de guerre, afin d’être adoubé.e par le reste de la profession. Les traumatismes n’étaient pas davantage reconnus et pris en charge, et en faire l’aveu pouvait être assimilé à une forme d’incompétence. Un tournant a été amorcé dans les années 1990. Depuis, la sécurité a progressivement fait l’objet d’une attention singulière, d’un nouveau focus, notamment dans les pays anglo-saxons et en France. Équipements de protection, formations à la sécurité en zone hostile dispensées par des militaires, prévention et guérison des traumatismes, codes de bonne conduite pour journalistes et éditeurs, sont autant de dispositifs traduisant ce tournant prudentiel. Les nouvelles précautions, différemment selon les aires géographiques et inégalement selon les statuts des journalistes, ont contribué à transformer les pratiques et à diminuer le nombre global des journalistes morts en couvrant des guerres. À partir de la littérature académique anglo-saxonne et d’une enquête de terrain menée auprès de journalistes français.es, on se propose d’appréhender le tournant prudentiel du journalisme de guerre, les prescriptions de nouvelles normes et les mesures de sécurisation des pratiques, au regard des transformations de la production d’information depuis les années 1990. Dans la lignée des travaux de Richard Sambrook et de Chris Paterson, la recherche présentée dans cet article restitue les logiques qui ont présidé à cette évolution, en particulier en France où elle avait peu été étudiée jusqu’à présent. *** EN. For a long time, the risks encountered by journalists in armed conflict zones were not, or only rarely, recognized and addressed by the news industry. Being injured or dying while covering conflicts could be considered as the price to pay in order to be included in the nobility of reporters or war correspondents, and to be praised by the rest of the profession. Trauma was not further recognized and addressed, and admitting to it could be seen as a form of incompetence. A turning point came in the 1990s. Since then, safety has gradually become the object of a particular attention, of a new focus, particularly in the Anglo-Saxon countries and in France. Protective equipment, trainings provided by the military on safety in hostile zones, prevention and healing of trauma, codes of conduct for journalists and editors are measures that demonstrate this cautionary shift. The new precautions, which vary according to geographical areas and to the status of journalists, have contributed to transforming practices and to reducing the overall number of journalists who have died while covering wars. Based on Anglo-Saxon academic literature and a field survey undertaken with French journalists, we propose to understand the cautionary turn of war journalism, the prescription of new norms and measures to make practices more secure, in the light of the transformations in news production since the 1990s. In the tradition of the work of Richard Sambrook and Chris Paterson, the research presented in this article describes the rationale behind this evolution, particularly in France, where it has been little studied until now. *** PT. Durante muito tempo, os riscos enfrentados pelos jornalistas em zonas de conflito armado foram desconsiderados pela indústria jornalística. Ferir-se ou morrer cobrindo conflitos era o preço a pagar para pertencer à nobreza do/as repórteres ou correspondentes de guerra e ser reconhecido/a pelos pares. O mesmo ocorria com relação aos traumas, ignorados ou considerados como uma forma de incompetência. Nos anos 90, inicia-se uma virada a partir da qual a segurança vai se tornando objeto de atenção e de foco, especialmente nos países anglo-saxões e na França. Equipamentos de proteção, treinamento de segurança por militares em zonas de conflito, prevenção e tratamento de traumas, códigos de ética para jornalistas e editores são exemplos de medidas que refletem essa virada prudencial. As novas precauções, que variam de acordo com as áreas geográficas e, desigualmente, com o status dos jornalistas, ajudaram a transformar as práticas e reduzir o número de jornalistas morto/as em coberturas de guerras. Fundamentados na literatura acadêmica anglo-saxônica e com base em uma pesquisa de campo com jornalistas franceses, analisam-se a virada prudencial do jornalismo de guerra e as novas normas e medidas prescritas para tornar as práticas mais seguras, à luz das transformações da produção de notícias a partir dos anos 90. This article considers the nature of Marxism as a species of Enlightenment Utopian Socialism, the relation of both these to a denial of nature of common sense properly understood. It argues that underlying all species of Enlightenment Utopian Socialism are psychological principles that deny the reality of evidently known first principles of understanding that are measures of truth in all forms of psychologically healthy human knowing and reasoning. In addition, it maintains that, as a result of these essentially anarchic psychological first principles inherent in its nature, any attempt to apply any species of Utopian Socialism to develop healthy social organizations and cultural institutions—such as forms of human communication and educational and political instittions—is doomed to fail. Utopian Socialism will always destroy common sense in whatever it infects with its disordered habits of understanding and reasoning.

This article defends the teaching of Mortimer J. Adler that human education must aim at the betterment of human beings by forming good habits in us; and that, if intellectual and moral virtues, or good habits, are the same for all human beings because our natural capacities are the same and tend naturally to the same developments, then what logically follows is that the intellectual and moral virtues, or good habits, as the ends of education, are the absolute and universal principles on which education should always and everywhere be founded. This being the case, it concludes that, because of its essential foundation in the essentially flawed Enlightenment understanding of human nature, the New World Order can never be a cause of higher education, can, at best, cause a caricature of it.

Abstract As a result of the biotechnological advance, synthetic biology has been applied from the improvement of food to the creation of new organisms. This article investigates, from a bioethical perspective, the benefits, risks and threats to life, arising from the production, manipulation and, especially, the creation of synthesized DNAs that do not exist in nature. Bioethics reports from the White House and the Bioethics Committee of Portugal and Spain contributed to the discussion. The progress of technoscience, without the proper ethical capacity for evaluation, can produce results that compromise the social development, environmental preservation, human dignity, and biosphere life in the future. In this sense, the achievements of synthetic biology have been shown to be ambivalent, because hopes are mixed with threats, with unpredictable results to the diversity of life of the biosphere, which makes prudence the virtue par excellence.

Thomas Aquinas holds not only that prudence, the virtue of right practical reasoning, is necessary for living well, but emphatically asserts that it “is the virtue most necessary to human life.” This essay argues that the force of Thomas’ assertion should not be understood as simply contradicting the objection—that “it seems that prudence is not a virtue necessary to living a good life”—with vigor, but rather, as we intend to show, that although all the moral virtues are necessary for the good life, there is a superior importance to the need for prudence, as that whereby the parts of virtuous living are not merely stacked up like building blocks of moral righteousness, but coalesced into a complete whole. To make clear the reasons for this preeminent necessity, we shall first consider the parts and constitution of prudence itself, its relationship to the other virtues, and conclude with its principal act, praeceptum.

Purpose – This study researches whether the change in NBC TG, promoted in 2011, that excluded Prudence (Conservatism), had any effect on companies’ accounting information. Design/methodology/approach – Quantitative approach, using a linear regression based on the Basu (1997) method, Wilcoxon tests and t test, on a sample with 109 companies, listed on the BM&FBovespa, from 2008 to 2013. Findings – The results indicate that conservatism is present in accounting for the entire period, and changes do not occur in this feature of the accounting information as of 2011. Originality/value – This research reinforces the perception of the superiority of economic interest, in particular for possible tax gains, to the detriment of accounting information quality, be it of regulatory origin or another.

The article begins by recalling the most important understandings associated with the term prudence in the history of philosophy.Then it introduces the Aristotelian concept of prudence linked to practical truth—prudence seen in contrast to wisdom and knowledge of manufacturing. The article discusses various forms of rational knowledge associated with the right will, and proves the need of linking prudence to all the other ethical virtues based on moral principles. It emphasizes the problem of how to relate general principles to specific actions which involve particular goods. For resolving this problem, the article refers to Aristotle who sees the solution in political ethics which has a significant impact on individual behavior; consequently, good law and proper education are considered to be necessary conditions which allow to form the moral judgment skills for providing a morally good life. The article concludes with the claim that the proper field to capture the specificity of prudence includes the theory of human action and that of human morality.

The article is an attempt to formulate a Thomistic spiritual philosophy of recovery. The author faces two issues. One, what do recovering alcoholics mean when they say: “I am spiritual, but not religious?” He comes to the conclusion that it means recovering alcoholics are experiencing spiritual healing in their willingness to trust a loving God who has performed a miracle of recovery from alcoholism in their life. As a result of this experience, they are prepared to live a life of virtuous habit. Two, recovering alcoholics have discovered a spiritual second nature of moral character. The author explains why there are many in A.A. who discover that as God comes into their life and they turn to the path of virtue they rediscover religious worship and devotion is essential to the one day at a time journey.

Given his emphasis on deontological ethics, Kant is rarely regarded as a friend of prudence. For example, he is often interpreted as an opponent of so-called “historical faiths” (i.e., empirical religious traditions). What typically goes unnoticed is that in explaining the legitimate (indeed, indispensable) role of historical faiths in the moral development of the human race, Kant appeals explicitly to their prudential status. A careful examination of Kant’s main references to prudence demonstrates that the prudential status of historical faith is the key to understanding both its limitations (as merely the vehicle of true religion, not its essential core) and its real value (as a necessary means of moral empowerment). The wise person adopts some form of historical faith, because to abandon any and all prudential appeals to a faith-based vehicle for morality would render the goal of living a good life virtually impossible for embodied beings to achieve.

This study provides a decision framework to analyze optimal production iversification decisions under uncertainty for a farmer who is risk averse in the Arrow-Pratt sense and downside risk averse. The decision model accounts for the third central moment of the joint distribution of portfolio returns. This is relevant for asymmetrical return distributions. This general model contains the classical decision model as a special case. The benefit of the proposed generalization is that each competing behavioral hypothesis is discerned econometrically through the significance of the agent’s coefficient of absolute and/or relative downside risk aversion.

It asks to what extent can we continue to speak of "politics" in a context in which the objective of the action of professional politicians has ceased to be the community and the effective management of its conflicts to focus on the conquest and maintenance of power. To this end, Immanuel Kant’s notions of "public reason" and "private reason" are considered, as well as some of Max Weber’s acute observations about the political vocation and the scientific vocation. Despite its situated character -it is written with the current circumstances of Spain (economic crisis, 15-M) in mind- it aims to offer useful considerations for all those interested in contemporary political theory.

Virtue according to Aristotle’s thought is a medium term with regard to us regulated by right reason, as a prudent man. would act. It is that mode of being by which man becomes good and through which he performs his function very well. Virtue is directly related to how people act; these steps or actions should lead to a good, and that good must be a generator of happiness in man. It depends just on man himself that the actions he performs are done well and according to virtue. Thus, it is expected that the scientist who experiments with animals to act according to virtue, to have a permanent disposition to work according to right reason, and to discuss what is good, particularly what does good especially to other forms of life which share with us the mystery of life. The Aristotelian virtuous man must search that his actions are mediated by reason to choose what is good , not for himself but for the common good.

The rhizomatic perspective in Deleuze and Guattari's thought consists in a "rupture of scale" of analysis of reality, in which we no longer perceive it as pure unity, either in the subject or in the object. Hereupon, they make us notice that the classical thought, philosophical and scientific, never allowed the rhizomatic multiplicities they propose to be understood, where every form of unity is excluded. From the rhizomatic operation of subtraction the unit as a reference image for all multiplicity (n-1), we observe a way to approach realities that emerges from three sets of lines that compose ourselves, individuals or groups, and that are distributed in a plane of immanence in which they relate continuously. The analyses of the lines and their relationships bring us closer to the question of the novelty’s creation or production and the becoming in the work of Deleuze and Guattari. The task is to open up the practical problems in order to free the lines, whether those of a life, an individual or a society, but in this case it is necessary to convoke experimentations in which one must proceed with prudence. In this sense, this practical philosophy must necessarily be understood as an ethic, and what we intend here is precisely to think about how this dynamic and immanent way of evaluating the risks and factors of creation that constantly present themselves at the most diverse levels of reality is configured.

La recomendación de consistencia en el lenguaje normativo puede encontrarse en guías o manuales de redacción, y también en varios estudios. Sin embargo, una revisión desde el punto de vista de la práctica invita a formular propuestas para obtener una recomendación más funcional. En este trabajo se ofrecen algunas ideas al respecto. En él se estudia la acepción de consistencia que pudiera ser más óptima y sus tipos, y se plantea la pregunta de si la recomendación ha de aplicarse en todo caso. Tomando como base esta exposición se propone una nueva formulación de la recomendación.The recommendation that regulatory language should be consistent is common in guides or manuals for drafting as well as in several studies. Yet a review from the angle of practice demonstrates the desirability of a more functional recommendation. This study offers some ideas in this regard. It analyses which might be the optimal definition for consistency and its types, and it asks whether the recommendation should be applied in all cases. That discussion then serves as the basis for a new formulation of the recommendation.

21. The dark side of phrónesis: revisiting the political incompetence of philosophy

In his Ethics, Aristotle joins sophrosúne and phrónesis as synonyms. In approximately the same time frame, Xenophon provides a Wittgensteinian account of a go-and-look instance of what sophrosúne looked like in one ancient Greek context. We have a disturbing description of sophrosúne in action. It leaves a reader with quitea different picture of the meaning of these two key words from the staid, peaceful, deliberative contemporary interpretations, particularly in Continental philosophy, that attempt to make both phrónesis and sophrosúne the foundation for a praiseworthy ethics and politics. Continental philosophers like Martin Heidegger and Hans-Georg Gadamer attended closely to Aristotelian phrónesis (not the Xenophonic variety), but were unable to put that learning into practice in their own ethical and political lives, making one wonder why followers of Heidegger and Gadamer continue to insist on ethical programs based in the Heideggerian and Gadamerian phronetic tradition, where Aristotle has supplanted Odysseus as the model most associated with phrón?sis and sophrosúne.

The novel, Guzmán de Alfarache was conceived as a Silenus fable that the subtle reader has to open in order to unravel its significance. Thus in the same way that a knight had to turn the wooden panel of a painting around in the final chapter (II, 3, 9), the said reader can give an altogether different meaning to the reading intended for one less subtle. From such an angle, even if we accept that the Sevillian’s itinerary is literally a process of degradation, from an allegorical perspective it takes the form of an initiation to the art of “prudence”: that demanded by the “traps” that pave the path of “human life”, and that which is depicted as much in the first of the engravings as in the two parts that make up the pseudoautobiography. While explicitly defending the metaphorical urbanity of the watch-tower, Alemán dignifies implicitly wit, suspicion, awareness, dissimulation and simulation, uniting them in a complex pharmacopeia of Evil, but one that ultimately benefits Good.

Dans cet article, on examine les fondements de la méthode "prudentielle" d'analyse de la politique développée par Francesco Guicciardini, homme d'état et écrivain florentin du XVIe siècle. On montre que cette méthode part d'une distinction analytique entre "diversités substantielles" et "diversités accidentelles" des choses humaines, laquelle permet de tisser des arguments nécessaires ou probables, respectivement, à l'analyste prudent de la réalité, doté de discrezione et d'un "regard pénétrant" - fruit de l'association entre "prudence naturelle", expérience dans les affaires publiques, large connaissance des "histoires anciennes et modernes" et raison pratique. Un telle méthode constitue la base des réflexions de Guicciardini en ce qui concerne la prise de décisions politiques et les possibilités de transformation du reggimento (gouvernement) de la ville de Florence.

Este trabajo analiza los recursos teóricos que emplean Laudato si’ y Fratelli tutti para consolidar una ética cósmica comprometida con la totalidad de la creación y con las deudas generacionales, así como una fraternidad universal que descree de las dimensiones cercano-lejano, pues el sufrimiento hace de lo infinitamente lejano algo profundamente cercano. La aspiración, difícil, de ambas es procurar un llamado a la paz entre los hombres, buscando lo que hay de común entre ellos, superando los muros que los separan gracias a ideologías arraigadas en el conflicto, en el temor y la segregación del desconocido. Metodológicamente el artículo intentará mantenerse más acá de los límites confesionales, para así extraer la savia propiamente racional de los argumentos. No deseo llamar a esto “ateísmo metodológico”, pero sí “prudencia metódica”, para, respetando aún ambas dimensiones, mantenernos en ésa en que la racionalidad marca las normas del discurso. El método a seguir es analítico-sintético: los documentos revisados se examinan de manera hermenéutica, propia de la tradición humanística, se confutan posiciones teóricas y se establecen conclusiones provisionales cercanas a los documentos pontificios analizados., This work analyzes the resources used by the encyclicals Laudato si’ and Fratelli tutti to consolidate a cosmic ethic committed to the totality of creation and to generational debts, as well as a universal brotherhood that does not believe in the dimensions close-far away, because suffering makes the infinitely far something deeply close. The difficult aspiration of both is to seek a call for peace among men, seeking what is in common between them, overcoming the walls that separate them thanks to ideologies rooted in conflict, fear and the segregation of the unknown. Identificaba la política con la prudencia y, en sus páginas, el religioso presentaba cómo esta podía hacer del mundo un lugar mejor a través de la ética y la moral católicas. The works of Luis de la Puente are fundamentally framed in ascetic and moral theology. However, within his text about social status and the path of virtue that everyone can walk in their lives, the Jesuit set apart a space to meditate on the government in general. He identified politics with prudence and, in his pages, the religious presented how it could make the world a better place through Catholic ethics and morals.

Resumen ¿En qué consiste la aplicación más justa de la ley, en aplicarla al pie de la letra en todos los casos o permitir al juez cierto margen para interpretarla? A lo largo de este texto presentaremos cómo no han sido pocos los partidarios de un “literalismo” a la hora de aplicar la ley, y para ello explicaremos lo sucedido durante la Revolución Francesa. Basados en la opinión de Rousseau, los ilustrados franceses creían que el legislador, en tanto que creador de la ley, era el que mejor conocía el espíritu de la misma, luego la interpretación de la ley por parte del jurista era arbitraria. Dicho de otra manera: la labor del juez se entendía nada más como la inferencia de una conclusión a partir de ciertas premisas (la ley y el caso). Aristóteles, sin embargo, ya había previsto este problema. Dado lo anterior, el propósito de este escrito es (1) explicar qué ha llevado a querer aplicar la ley al pie de la letra, (2) cuáles son sus riesgos y (3) la solución que Aristóteles propone a este asunto, en donde hablaremos sobre la prudencia y el juez como «ley dotada de vida». Abstract What is the fairest application of the law, applying it to the letter in all cases or allowing the judge some scope to interpret it? Throughout this text we will present how there have been many supporters of a “literalism” when it comes to applying the law, and for this we will explain what happened during the French Revolution. Based on Rousseau's opinion, the enlightened French believed that the legislator, as the creator of the law, was the one who best knew the spirit of it, then the interpretation of the law by the jurist was arbitrary. In other words: the work of the judge was understood nothing more than the inference of a conclusion from certain premises (the law and the case). Aristotle, however, had already foreseen this problem. So, the purpose of this writing is (1) to explain what has led to wanting to apply the law to the letter, (2) what are its risks and (3) the solution that Aristotle proposes to this matter, where we will talk about prudence and the judge as "law endowed with life".

Background Theoretically, the exercise of good medicine requires physicians who possess and practice virtues. There are good reasons to believe that virtue ethics would be highly appreciated by patients. Aim To determine the importance that patients attribute to the possession virtues among physicians. Material and methods Patients hospitalized in a private and a public hospital were invited to answer a three-question survey. The questions were: first, what do you expect of a good physician? Second, please evaluate, in a scale from 1 to 5, the importance of physician virtues to consider him a good doctor (fidelity to trust given by the patient, benevolence, postponement of self-interests, compassion, intellectual honesty, justice and prudence). Third, among the seven former virtues, select the three more important, and then the most important of all. Results Most patients responded that they valued that a good physician should have good communication skills, a cordial relationship, commitment to the patient and knowledge. All virtues studied were considered important or very important by almost all patients. The virtues considered the most important were intellectual honesty and fidelity to trust given by the patient. Conclusions These results support the theoretical argument that, for patients, the practice of virtue ethics is essential for a good medical practice.

El presente artículo pasa revista a las dimensiones hermenéuticas presentes en la filosofía aristotélica, y se detiene en la filosofía moral. El concepto φρόνησις llamó la atención de Heidegger, que acabó aproximándolo al de conciencia (Gewissen), y de Gadamer, que encuentra en él un modelo de los problemas de la aplicación (Anwendung) en la tarea hermenéutica. El propio Gadamer acabará defendiendo el carácter dialogal y hermenéutico de la retórica, que no es más que una forma de la φρόνησις. This article reviews the hermeneutical dimensions present in Aristotelian philosophy, and focuses on moral philosophy. The concept of “prudence” caught the attention of Heidegger, who brought it close to that of “conscience” (Gewissen), and Gadamer, who finds in this concept a model of the problems of application (Anwendung) in the hermeneutical task. En concreto, la virtud de la prudencia (la ‘phronesis’) ha recibido escasa atención. La prudencia es una virtud muy importante en el pensamiento de MacIntyre, aunque el autor no la haya analizado de manera unitaria y sistemática. Sus principales propuestas sobre el ser humano y la investigación moral no pueden ser comprendidas sin la virtud de la prudencia. El objetivo de este artículo es ofrecer una exposición y un análisis de dicha virtud en el pensamiento de MacIntyre. Abstract: The concept of virtue by Alasdair MacIntyre has been treated by his critics in a unsystematic and shallow way. In particular, the virtue of prudence (the ‘phronesis’) has received little attention. Prudence is a very important virtue in MacIntyre’s thought, although the author has not analyzed it in a unitary and systematic way. His main proposals about human being and moral enquiry can not be understood without the virtue of prudence. The aim of this paper is to offer an exposition and an analysis of this virtue in MacIntyre’s thought.

Luego problematizamos con tres temas clásicos: la naturaleza humana, la perfección y la distinción entre virtudes públicas y privadas. Finalmente, pensamos las virtudes desde el proceso de globalización. The article is a reflection about the possibilities of the ethics thought from the analogical hermeneutics, with critical sense. For this, we review the assumptions of analogical hermeneutics proposed by Mauricio Beuchot. From there we study the components of one theory of virtues, such as prudence. Then we discuss three classic topics: human nature, perfection and the distinction between public and private virtues. Finally, we think the virtues from the process of globalization.

This article selected both, ethical and intellectual virtues, which must be introduced into the curricula of the programs of law for the ethical training of these professionals. The virtues that were selected are: (i) Justice, since it is willing to practice what is right; (ii) the prudence, by which the lawyer conciliator is able to deliberate properly about what is good and (iii) wisdom, intellect and science; intellect because it refers to the principles and science because it refers to things susceptible of demonstration from principles.

En tal ejercicio, se persigue el desarrollo de una palabra autorregulada en relación con las intenciones con que se dicen las cosas y al momento de discutir con el otro. De esta interpretación, por último, se expone la panorámica general de la argumentación y sus planteamientos sobre los géneros del discurso retórico, la lógica, la conmoción y la ética, sus fases de producción y comprensión y, como conclusión, la incidencia de su aplicación en una población de trabajo con dificultades a nivel de convivencia y a nivel argumentativo. Abstract This paper proposes an understanding of the discourse of prudence to achieve a good argument based on Aristotelian concepts. The aim of this exercise is to develop a self-regulated word with regards to the intent with which people say things and when they discuss with others. Finally, and based on this interpretation, we present an overview of argumentation and its approaches to the genres of rhetorical discourse, logic, commotion and ethics, its phases of production and understanding and, in conclusion, the incidence of applying it in a population with difficulties at the coexistence and argumentative level. Resumo Este artigo propõe uma compreensão do discurso da prudência para uma boa argumentação desde conceitos aristotélicos. Nesse exercício, procura-se o desenvolvimento de uma palavra auto-regulada em relação com as intenções com as que as coisas são ditas e no momento de discutir com o outro. Dessa interpretação, por últimos, expõe-se a panorâmica geral da argumentação e suas abordagens sobre os gêneros do discurso retórico, a lógica, a comoção e a ética, suas fases de produção e compreensão e, como conclusão, a incidência de sua aplicação em uma população de trabalho com dificuldades a nível de convivência e a nível argumentativo.

Beginning with the philosophical and literary sources, prudence is considered the main virtue that every ruler must possess. This relationship favoured the interaction between the figure of the ruler and prudence’s image. In this way, prudence sometimes acquires the attributes of the ruler, just as he acquires those of prudence, portraying himself even as this virtue. Partiendo de las fuentes filosóficas y literarias, la prudencia se considera la principal virtud que debe poseer todo gobernante. Esta relación propició la interacción visual entre la figura del gobernante y la imagen de la prudencia. De este modo, en ocasiones, esta cualidad adquiere atributos propios del gobernante, así como este adquiere los de la prudencia, retratándose incluso como esta misma virtud. This paper explores a very precise question: what does Machiavelli mean when he writes, in the chapter XXV of The Prince, that it is preferable to behave impetuously rather than cautiously? Through an in-depth analysis of this chapter, the author questions the validity of the prevailing interpretation, which holds that a virtuous individual can subjugate “fortuna” through an impetuous action. Machiavelli’s assertion should be construed as a bet on the creative potentialities of action in a context of corruption in which fatalism and the desire to be dominated tend to prevail. In this sense, the priority given to impetuosity is the cornerstone of a provisional morality required for adverse times.Este artículo explora una pregunta muy precisa: ¿qué significa la propuesta, expuesta por Maquiavelo en el penúltimo capítulo de El Príncipe, según la cual es preferible ser impetuoso que respetuoso? A partir de un análisis riguroso de este capítulo, el autor cuestiona la validez de la interpretación dominante según la cual mediante una acción impetuosa, un individuo virtuoso puede someter a la fortuna. An ethical and legal view of gender diversity in childhood and adolescence is presented from the perspective of the best interest of the child and the principle of protection against vulnerability. The identification of gender diversity in childhood and adolescence is a process that requires support, coordination and a multidisciplinary team that improves care and helps to obtain evidence that is lacking today. Secure, equitable and comprehensive access to care and health care should be guaranteed when required. It is necessary to promote a changing of social outlook, capable of overcoming the stereotypes that lead to discrimination and increase suffering. Respect for gender diversity in childhood and adolescence is a fundamental Human Right. The recognition of a positive value in diversity is an ethical imperative. All of this, without forgetting that we are talking about minors often in contexts of vulnerability, and currently very uncertain, so prudence is the main rule that should guide decision-making. Resumen: Se realiza una mirada ética y jurídica de la diversidad de género en la infancia y la adolescencia desde la perspectiva del interés superior del menor y del principio de protección frente a la vulnerabilidad. La identificación de la diversidad de género en la infancia y la adolescencia es un proceso que además de acompañamiento exige coordinación y trabajo multidisciplinar que mejore la atención y ayude a obtener mayores evidencias que, a día de hoy, faltan. Se ha de garantizar el acceso seguro, equitativo e integral a cuidados y atención sanitaria en caso de que lo precisen. Es necesario promover un cambio de mirada social, capaz de superar los estereotipos que suponen discriminación y aumentan el sufrimiento. El respeto a la diversidad de género en la infancia y la adolescencia es un derecho humano fundamental. El reconocimiento de un valor positivo en la diversidad constituye un imperativo ético. Todo ello sin olvidar que hablamos de menores en contextos en muchas ocasiones de vulnerabilidad y actualmente de mucha incertidumbre, por lo que la prudencia es la regla principal que ha de guiar la toma de decisiones.

The rapid advances in the field of artificial intelligence (AI), which increasingly count on greater economic investments, require an ethical consideration to highlight its various implications. This work aims to invite the approach of the need for an ethics applied to the field of AI. For the construction of an ethics applied to this contemporary field, it is fundamental to drink from the diverse sources that the history of ethics offers us. Different ethical traditions, such as the deliberative, the Aristotelian or the responsibility, can provide us with interesting theoretical-practical frameworks from which to guide action and research in AI. However, there must be a willingness on the part of the knowledge involved in this field, in order to initiate an ethical project as participatory and broad as possible, adding perspectives and achieving meetings. Los rápidos avances en el campo de la inteligencia artificial (IA), que cuentan cada vez más con mayores inversiones económicas, requieren de una consideración ética para poner de relieve sus diversas implicaciones. Este trabajo pretende invitar al planteamiento de la necesidad de una ética aplicada al campo de la IA. Para la construcción de una ética aplicada a este contemporáneo campo, es fundamental beber de las diversas fuentes que nos brinda la historia de la ética. Diferentes tradiciones éticas, como son, la deliberativa, la aristotélica o la de la responsabilidad, nos pueden aportar interesantes marcos teórico-prácticos desde los que orientar la acción e investigación en IA. No obstante, debe existir voluntad por parte de los saberes involucrados en este terreno, para así poder iniciar un proyecto ético lo más participativo y amplio posible, sumando perspectivas y logrando encuentros.

Al examinar solo este aspecto, se omiten ciertos problemas secundarios, como la legitimidad de interpretar de manera actitudinal una doctrina asentada en el atomismo. The paper offers a critical review of a recent interpretation of Epicurean hedonism, according to which the latter could be understood as an attitudinal hedonism. Such reading implies certain internal tensions and neglects the fundamental meaning ofEpicureanism as a theory of prudential well-being. By focusing exclusively on one aspect, that reading omits certain secondary issues, such as the legitimacy of an attitudinal interpretation of a doctrine grounded in atomism.

El propósito de esta tesis es comprender el papel de la justicia y la sabiduría práctica –en tanto virtudes públicas-, en las interpretaciones de los concejales de Medellín, y de algunos representantes de grupos de interés, sobre la decisión de crear una empresa mixta mediante la fusión entre la compañía estatal colombiana UNE-Telecomunicaciones, y la multinacional privada sueca Millicom, como insumo para esbozar un modelo de formación de dirigentes en Toma de Decisiones Éticas (TDE). Con ese fin, se realizó un estudio exploratorio basado en el método etnográfico reflexivo. Se aplicaron entrevistas semi-estructuradas a una muestra voluntaria de 18 de 21 concejales, y una muestra no representativa de cuatro miembros de grupos de interés. Se encontró que tanto en las interpretaciones de los promotores de la fusión, como en las de sus detractores, se expresan la justicia –en tanto virtud que propende por defender los derechos de los individuos-, y la sabiduría práctica –en tanto virtud que busca los medios adecuados para alcanzar la justicia-. En cada caso, los derechos defendidos, y las formas de defenderlos, fueron diferentes e incluso opuestos. Además, se expresó desconfianza entre las contrapartes, basada en la mutua atribución de intereses personales disfrazados de altruismo. Aún así, se concluye que la presencia de visiones opuestas dentro de un mismo marco institucional, enriquece y equilibra las decisiones públicas propias de las organizaciones estatales. Bajo esta perspectiva, se esboza un modelo integral de formación de dirigentes en TDE, basado en el reconocimiento y el respeto de las creencias éticas Abstract: The purpose of this thesis is to understand the joint role of justice and practical wisdom -as public virtues- in the interpretations of Medellin councilmen and a number stakeholder representatives, of the decision to create a mixed company through fusion of a Colombian state company, UNE-Telecommunications, and the Swedish private multinational, Millicom, as way to delineate a training model for directors in Ethical Decision Making (EDM). With this goal, an exploratory study was conducted, based on the reflexive ethnographic model. Semi-structured interviews were applied to a voluntary sample of 18 of 21 councilmen, and four stakeholder representatives. It was found that both in the understanding of promotors and detractors of the merger, justice was expressed, both as a virtue used to defend individual rights, and in terms of practical wisdom, as a virtue which seeks the appropriate mediums for the achievement of justice. In each case, the rights defended and the forms of defense were different or even contradictory. Additionally, distrust was expressed between counterparts, based on the mutual attribution of personal interests disguised as altruism. Even so, it is concluded that the presence of opposing visions within an institutional framework enriches and balances public decisions made in state organizations. La conclusión de este estudio es que, sin perjuicio de ciertas objeciones que se le deben hacer a Viola -a saber, la incoherencia de su pensamiento, por decirse iusnaturalista a la vez que defiende tesis cercanas al relativismo-, su comprensión del razonamiento práctico como prudencia y la necesidad del casuismo como método jurídico son auténticas contribuciones al debate sobre la ley natural. Abstract The author offers a systematic and critical explanation of Francesco Viola's vision of the law and its knowableness. Both points, given Viola's unusual perspective, are inseparable. For Viola, the focal significance of diritto is that of a social practice constituted by the participants' interpretation of the practice itself, in recognizing it as a value that should be pursued. The conclusion of this study is that, notwithstanding certain obvious objections to Viola; namely, the inconsistency in his thinking by calling himself a jusnaturalist while, at the same time, defending certain theses close to relativism, his understanding of practical reasoning as prudence and the need for casuistry as a legal method are genuine contributions to the debate on natural law. Resumo O autor explica sistemática e criticamente a visão de Francesco Viola sobre o direito e sua cognoscibilidade. Ambos os pontos são, dada a perspectiva não usual de Viola, inseparáveis, pois, para ele, o significado focal de diritto é uma prática social constituída pelos atos de interpretação que seus participantes fazem dela, reconhecendo-a como valor que deve ser seguido. Conclui-se que, sem prejuízo de certas objeções que devem ser feitas a Viola - a saber, a incoerência de seu pensamento, por se dizer jusnaturalista ao mesmo tempo que defende teses próximas do relativismo -,sua compreensão do raciocínio prático como prudência e a necessidade do casuísmo como método jurídico são autênticas contribuições para o debate sobre a lei natural.

O estudo tem como base a buscagem em referenciais teóricos e entende que a vivência na amizade permite a construção de visões positivas de mundo, de si e do outro como seres humanos singulares e diversos. A convivência na amizade como um com-sentir contempla cenários de respeito à alteridade, um respeito que passa pela descoberta de si e do outro como exercício dessa convivência.The article investigates possibilities to establish formative experiences involving the dimensions of friendship and experiences in friendship, as dynamic potentiating the recognition of the other. Considers the pedagogical relations, aiming to homogenization, as carriers of the risk of submitting and excluding the other and the different. Recognize the required prudence given the complexity and historical difficulties in understanding the other. The study is based on the search for theoretical references and believes that the experience of friendship allows the construction of positive visions of the world, of themselves and others as unique and diverse human beings. The coexistence in friendship as a consent (feel with) scenarios with respect to otherness, a respect that goes by the discovery of self and other as an exercise of this coexistence.

Entre el amplio espectro de cuestiones que han puesto en movimiento la pluma filosófica de Arthur Schopenhauer, la cuestión del carácter reclama, sin dudas un lugar significativo. Este artículo ofrece una reflexión sobre un concepto de vital importancia para su filosofía práctica: el de "carácter adquirido". En opinión de nuestro autor, adquirir carácter no importa tanto desde un punto de vista ético cuanto prudencial. Esta aseveración puede, con todo, ser desafiada si consigue mostrarse que al adquirir carácter, un sujeto desarrolla el mismo tipo de habilidad requerida para actuar en sentido moral. Semejante línea argumentativa será seguida en este trabajo, al tiempo que intentará volverse consistente la propia posición asumida por Schopenhauer. Creemos que una lectura así orientada tiende a promover una interpretación más unitaria de su filosofía práctica. Among the wide range of issues that have drawn Schopenhauer’s attention, the issue of character undoubtedly plays a decisive role. In this paper, I will focus on an essential concept for his practical philosophy: the concept of "acquired character." In Schopenhauer’s view, to acquire character is a matter of prudence rather than morality. Despite of this assertion, I will attempt to challenge Schopenhauer’s statement, by arguing that acquiring character actually involves moral meaning. This moral implication arises from a point of view that is internal to Schopenhauer’s practical philosophy taken as a whole. Consequently, I will try to make his account consistent by appealing to his own arguments.

El objeto de este artículo es llevar a cabo una reflexión acerca de cómo el proceso de recuperación o rehabilitación de la filosofía práctica de corte aristotélico-tomista que, desde hace ya bastantes décadas, se ha venido desarrollando, fundamentalmente en Alemania y EEUU, ha supuesto una nueva reorientación en ámbitos muy diversos: desde el modo de entender el concepto de derecho –rompiendo con la tradición positivista de fundamentar la validez de éste tan sólo en criterios formales–, hasta en el terreno relativo a la propia praxis de los operadores jurídicos. En concreto, cabe destacar, en este último campo, la recuperación del pensamiento aristotélico sobre la virtud, con aplicaciones prácticas en la reflexión sobre el modo de actuar, y también de ser, del jurista. The purpose of this article is to carry out a brief reflection about how the process of recovery, or rehabilitation, of the practical philosophy based on the Aristotle-Thomas approach, which for several decades has been developing, fundamentally in Germany and USA, has meant a new reorientation in very different areas: from the way of understanding the concept of law - breaking with the positivist tradition of basing the validity of it only on formal criteria-, even on the ground relative to the praxis of legal operators. In particular, in this latter field, we must especially emphasize the recovery of Aristotelian thinking about virtue, with special application in the way of acting, and also of being, of the jurists.

Según la definición aristotélica de EN VI (1140b20), la phrónēsis es una héxis práctica, verdadera, acompañada de razón y se refiere a los bienes humanos. El presente ensayo se propone responder una doble pregunta: qué es una disposición habitual (héxis) y por qué la phrónēsis es una especie de héxis. La respuesta se encuentra, en parte, en Metafísica Delta 20 y 23 y en parte en Categorías 8. Esta investigación es solo el punto de partida de una pregunta más amplia que se busca responder en un momento ulterior: ¿cuál es la relación entre prudencia y verdad? Y ¿por qué la phrónēsis es siempre verdadera, tal como siempre son verdaderos la ciencia, el arte, la sabiduría y la virtud?

El presente ensayo es una introducción a la justificación de una nueva consideración del derecho notarial. Durante el transcurso de los últimos años, el interés del derecho ha ido mutando de perspectiva; ya no es relevante el cumplimiento estricto de la ley, sino el cumplimiento de la misma cuando no se opone a los paradigmas de la justicia. Eso es lo que explica que ciertas profesiones, como la notarial, deben comenzar por demostrar que lo esencial de su quehacer no es la aplicación técnica de un sistema decimonónico de interpretación legal, sino la concreción de una argumentación del derecho que justifique lo que a cada uno corresponde en el seno del documento. El nuevo derecho notarial entonces presenta elementos esenciales que justifican su importancia, y que desplazan a los antiguos, que no desaparecen, pero que se mantienen de manera secundaria. De esta manera, los deberes éticos notariales aplicados determinan el aspecto esencial del ejercicio actual de la función fedante, ya que la concreción de los mismos determinan un auténtico documento justo, que presupone una preocupación por el valor justicia y una comprensión de la prudencia notarial en la aplicación del derecho. In this article a journey is made by the history of the words -and its meanings. that give place to the concept of prudence. From the myth of Prometeo and the prometheia, going by philosophers and Greek thinkers (the fronesis and their adaptation in the Romans as providentia), until the treaty of the prudence in Thomas of Aquino, where it is assumed asintersection of the moral and intellectual dynamisms, and fundamentally as practical intelligence, key of the ethics that directs the election and governs towards the perfection of the human ethos. In this way you arrive to the political prudence in Thomas of Aquino: their integral parts and their classifications. It is especially studied the governmental prudence, with their specifications (prudence of the régime, legislative, of justice and military) and the properly political prudence of the citizens, in which is distinguished that of the citizens and that of the restricted groups.Key words: Thomas of Aquino, prometheia, fronesis, providentia, jurisprudence, political prudence. En el artículo se hace un recorrido por la historia de los vocablos –y sus significados–que dan lugar al concepto de prudencia. Desde el mito de Prometeo y la prometheia,pasando por filósofos y pensadores griegos (la fronesis y su adaptación en los romanoscomo providentia), hasta el tratado de la prudencia en Tomás de Aquino, donde seasume como intersección de los dinamismos morales e intelectuales, y fundamentalmentecomo inteligencia práctica, clave de la ética en cuanto dirige la elección e impera laacción en orden a la perfección del ethos humano. De esta forma se llega a la prudenciapolítica en Tomás de Aquino: sus partes integrantes y sus clasificaciones. La obra recoge sus reflexiones sobre la naturaleza y las causas de la locura y se sitúa con claridad en las corrientes filantrópicas del fin de las luces; defiende en todo momento el trato humanitario a los orates, revisa los tratamientos tradicionales e introduce nuevas formas de terapia, entre las que destaca la prudencia hipocrática (e ilustrada) de la vis medicatrix naturae y la dieta, entendida como régimen de vida, como higiene del alma. En definitiva, un análisis pormenorizado de la obra de Daquin, omitida por sus contemporáneos parisinos, nos permitirá valorar y reivindicar su importancia en el origen del alienismo.

The information come from the judicial organs is public. In its prosecution and diffusion it is necessary to harmonize the access to information right with other rights and constitutional rights. The judicial organs must try the diffusion for suitable channels of all the resolutions, except the cases in which the above mentioned publicity harms juridical interests that should be protected. Its diffusion contributes the society to the knowledge and comprehension of the form in which the Judiciary applies the right and takes jurisdictional decisions, facilitating this way a suitable civil control. The Fiscal Attorney General must articulate its relations with the press in accordance with canons of transparence and clarity, assuming the function to report, with the last purpose of that the journalists should arrange of a trustworthy information source. There becomes necessary the establishment of criteria and general rules of organization at the moment of allowing the access of the mass media to the information during the stage of preparatory penal investigation, ruled by the secret of summary. Every District attorney's office of Instruction must be provided with a spokesman or spokesman, entrusted of spreading the information to the mass media, with a prudence criterion, safeguarding constitutional value of the justice. This function can be realized so much by the Secretary or the Prosecretario, in accordance with the beginning of division of tasks and in coordination with the top organ (District attorney).

I reconstruct several deeply rooted deceptions by taking Villoro’s reflections as a starting point: i.e., the alternative consensus/ dissent; the nationalist enthusiasm or the understanding of habits and costumes as «the last word»; a non-reasonable concept of reason. With respect to the latter I make use of some observations owed to Muguerza to further develop the discussion.Partiendo de algunas reflexiones de L. Villoro se reconstruyen varios engaños-fetiches muy arraigados: la alternativa consensos/disensos, el entusiasmo nacionalista o los usos y costumbres como la última palabra, un concepto no razonable de razón. Respecto de este último engaño se enriquece la discusión con algunas observaciones de J. Muguerza.
