Any person has the right to ask the assistance of a lawyer based on his own choice in order to represent his rights and to protect him during all stages of the criminal procedure. Essentially, it is the duty of the Governments to ensure guarantees for everyone to be informed by the competent authorities about his right to be assisted by a lawyer of his choice when he is arrested, detained or placed in prison or jail. For obstructing the legal activities of lawyers and other persons empowered to protect the rights, freedoms and legal interests of a person and citizen, as well as the provision of legal assistance to individuals and legal entities, criminal liability is provided. В статье рассматриваются проблемные аспекты правовых последствий приостановления производства по уголовному делу и влияние применения уголовно-процессуальных норм рассматриваемого института на обеспечение прав и законных интересов участников уголовного процесса. Проводится анализ нарушения следователем (дознавателем) процедуры приостановления производства по делу, а также практики применения отечественных уголовно-процессуальных норм данного института права в решениях Европейского суда по правам человека. Анализируется запрет проведения следственных действий после приостановления производства по уголовному делу. Исследуются особенности приостановления производства по уголовному делу при оказании правовой помощи по уголовному делу иностранным государством, а также производства уполномоченными правоохранительными органами другого государства осмотра, выемки, обыска, допроса и судебной экспертизы. Обосновывается невозможность приостановления производства по уголовному делу в случае направления в ходе предварительного расследования международного запроса об оказании правовой помощи в иностранное государство., The article deals with the problematic of legal consequences aspects of proceedings suspension in a criminal case and the impact of criminal procedural norms application of such institution under consideration on ensuring the rights and legitimate interests of participants in the criminal process. An analysis is made of violating the procedure for suspending the proceedings by the investigator (inquirer), as well as the practice of applying domestic criminal procedure norms of this law institution in European Court of Human Rights decisions. The prohibition of conducting investigative actions after the suspension of criminal proceedings is analyzed. The features of criminal proceedings suspension in the provision of legal assistance in a criminal case by a foreign state, as well as the performing inspection, seizure, search, interrogation and forensic examination by authorized law enforcement agencies of another state are investigated. The subject. Nowadays a variety of civil law studies actively discusses the issues of insuranceregulation. However, legal expenses insurance is unknown to Russian legal doctrine andpractice. The research focuses on legal expenses insurance.The purpose of the article is to reveal a potential that legal and economic instruments have incomparison to other guarantees of unobstructed enjoyment of the rights and legitimate interests.The methodology. It is a comparative law approach that allows to describe the peculiaritiesof legal expenses insurance in foreign countries, outline the criteria to match the existingmodels, determine their similarities and differences as well as benefits and drawbacks. Economicanalysis of law is helpful to evaluate the convenience of a new tool for citizens andits influence on the level of their legal expenses.The results, scope of it’s application. As a result, the article argues that legal expenses insuranceimproves the financial accessibility of qualified legal assistance and stimulates legalactivity, since it does not impose any formal restrictions on the clients, the content of thecontract or the sphere of its application. Meanwhile, the research formulates and characterizessome difficulties that may occur in the course of introduction of this institution toRussian law. Primarily, such obstacles include the low level of insurance culture, the needof significant amendments to legislation in force and the lack of professional expertise inthis field. Despite different political and legal obstacles, it is necessary to create an effectivemodel of legal expenses insurance in Russia in order to improve Russian legal system andform the culture of getting legal services in time.Conclusions. The insurance mechanisms provide citizens with an opportunity to minimizetheir legal and financial risks connected to unforeseeable situations, which require coveringcosts of professional legal assistance. The authors conclude that legal expenses insuranceis able to become an additional guarantee to the right to qualified legal assistance in caseof appropriate adaptation to current conditions of Russian legal life and legal mechanisms.

Introduction: the current modernization of legal education in Russia puts emphasis upon the development of its practical component. Enhancement of the quality of higher legal education directly depends on the inclusion of practice-oriented components. In this respect, it is necessary to develop training of future lawyers based on legal clinics as structural units of higher educational institutions. Clinical legal education should combine the special pre-theoretical training of students as well as the practical work that has to do with rendering free legal assistance to socially vulnerable categories of citizens. Materials and Methods: comparative analysis of the experience of various Russian legal clinics made it possible to identify the similarities and differences between them, comparing different versions of clinical training, recognizing common problems and proposing an effective model of legal clinics’ activity enabling the learners to obtain professional skills and to improve the quality of legal services rendered by students. Results: the authors demonstrate and analyze different activities of Russian legal clinics, established in institutions of higher education. The process of detecting differences among structural divisions of universities providing legal training, allowed us to determine the common problems encountered by a legal clinic during day-to-day activity. The authors propose a model for legal clinics’ effective activity pertaining to the implementation of a practice-based training of students. The article reveals the learning process of developing professional skills (interviewing and advising on legal issues, drafting legal documents, case analysis, etc.) gradually. Necessary conditions for ensuring quality of legal services provided by students under the guidance of teachers are highlighted. Discussion and Conclusions: recommendations for the future development of legal clinic education in Russian universities are given. The importance of expanding legal clinic-based education, its implementation in the educational process is underscored. The significance of legal clinics for bachelor’s and master’s degree programmes is pointed.

The article deals with issues related to the regulation of personal non-proprietary relations of parents and children, which are relevant at the present time as they provide the child with legal protection and the realization of opportunities. The main attention is paid to the issue of determining the child’s citizenship under the laws of the Russian Federation and foreign law if there is a foreign element, which is applied when establishing the legal status of the child, which connects it with the state, giving the said person political and legal status of a citizen who distinguishes him from foreign citizens and stateless persons, in each case with a set of rights and obligations and responsibilities. Often, this status remains insufficiently regulated in the legislation of foreign countries, as well as in domestic law. It covers an issue related to the law applied when a conflict arises when establishing and disputing the child’s origin from specific parents in the presence of a foreign element in foreign and Russian legislation, which often causes certain difficulties in establishing and disputing this fact, conferring on those persons mutual rights and obligations and depriving their rights and obligations. The provisions contained in foreign legislation must be used in the law–enforcement practice of the Russian Federation. The establishment of paternity (maternity) is considered in the article as a legal act and as a way to protect the rights of the child, since if the claim is satisfied, the violated rights of the said person are restored: the right to live and be brought up in a family, to know their parents. The Institute of the legalization of children born out of wedlock is considered, which has wide application in foreign legislation and is relevant for fixing in Russian law. &nbsp

В статье представлен обзор понятий, которые возможно объединить в единую категорию «правовая услуга», анализируются подходы к определению понятия качества правовых услуг, осуществляемых в интересах граждан, с точки зрения менеджмента и теории услуг. Выявлены недостатки в теоретической разработанности проблемы оценки качества правовых услуг как категории сложных услуг. Выделены стороны, заинтересованные в обеспечении качества правовых услуг: государство; профессиональные юридические ассоциации; адвокаты и юристы, в том числе юридические фирмы (производители услуг); граждане (получатели услуг). Представлена попытка выделить совокупность оценочных признаков качества правовых услуг, состоящую из трех групп: профессиональные признаки, процедурные признаки и потребительские признаки., The article provides an overview of concepts that can be combined into a single category of «legal service»; approaches to the definition of the concept of the quality of legal services carried out in the interests of citizens from the point of view of management and the theory of services are analyzed. The author revealed the shortcomings in the theoretical elaboration of the problem of assessing the quality of legal services as a category of complex services. The parties interested in ensuring the quality of legal services are identified: the state; professional legal associations; lawyers, including law firms (service providers); citizens (recipients of services). The development of alternative dispute resolution procedures raises a number of new problems and questions for jurisprudence and legal practice. Many of these are closely related to the implementation of mediation procedures. Significant attention has been paid in the legal literature to the need for mediators’ legal education. Nowadays a professional lawyer usually performs the functions of a mediator. Nevertheless, in some countries the competence of mediators can be limited. In fact, such persons may be prohibited from providing any legal assistance to the parties. A direct prohibition of this kind exists in Russian legislation. To what degree is this prohibition realistic and reasonable? Different countries enjoy different approaches to the possibility of providing disputing parties with a mediator’s legal assistance in addressing issues requiring legal advice or in the drafting of legal documents. Different approaches to this issue have appeared for various reasons. The absence of consensus is caused by a contradiction between the principle of mediator neutrality in the conflict resolution process and the goals of dispute settlement in which a legally competent intermediary is involved. To ensure the effectiveness of the mediation process, legislators should seek out more flexible ways of regulating procedure. Mandatory regulation itself contradicts the spirit of ‘semi-formal’ alternative (extrajudicial) methods for conflict resolution. As such, the presence of direct prohibitions or severe restrictions may not only become challenging in the performance of law but such peremptory norms can also make mediation unattractive and ineffective for some particular types of dispute, such as labor disputes. The principle of preserving a mediator’s neutrality is possible if exercised within the framework of a balanced approach to reasonable limits and discretionary rules for the provision of certain types of legal assistance to disputing parties.The present article aims to consider the possibilities and limitations on a mediator’s ability to provide particular types of legal assistance where the guarantee of non-discrimination between disputing parties’ interests is presupposed.
