This paper aims to present comprehensively, but not exhaustively, the role of Baptism in the life of the Christian and its implications both in the way of life of the human collective and in the life of each individual, i.e. in the moral dimension of this Mystery. The work of renewal associated with Christian baptism is essential in the life of the believer, inviting them to constantly review their beliefs, reaffirm their commitment to God and strengthen their connection to the Christian community. By continuing this process of spiritual renewal, the believer is guided to grow in holiness and wisdom, to strengthen his or her relationship with God and to manifest his or her faith in daily life. Thus, Christian baptism and its ministry of renewal are not just isolated events in the believer's life, but become fundamental pillars in his or her spiritual journey of transformation and salvation. The important points that this research will touch upon are: ancestral sin, the moral dimension of baptism, John's baptism and Christian baptism helping us to conclude that the application of baptismal knowledge in seen acts generates the idea of morality and bears the marks of the preaching of Christ in society. This paper is based on one of Paul Evdokimov's seminal works: The Art of the Icon: A Theology of Beauty. If secular art tries to capture and go beyond the human by reaching for the idea of the transcendent which it projects into the abstract, the art of the icon renders the spiritual, the spiritual world, the world that penetrates the immanent without denying it, even using its means to translate us into the light of the eighth day. Using limited means to render the Unbounded is indeed an art. The author shows us that not every religious artistic achievement can be called an icon in the true sense of the word, not even what we find in churches exposed for worship and bearing the title "icon" are icons. The present work is intended as a solution and as a criterion that can be used to distinguish between a canonical and a non-canonical icon from both a theological and an artistic point of view. Church music is one of the most dynamic and generous (rom a scholarly approach) parts of Church theology. Its location at the confluence of liturgy, art, dogma, history and tradition gives it a unique characteristic that provides a paradox: the difficulty of approach combined with the pleasure of study. In order to understand the importance of St. Roman Melodum for Byzantine music, it is necessary to take a brief look at the notion of "chondac", and then a historical look at the evolution and development of this liturgical form over time. This text will highlight how Roman the Melodist composed the condac and the sources of inspiration. He composed elaborately structured hymns that revolutionized Greek poetry. The study of potential aphrodisiacs has made it possible to divide them into several categories, and these may relate to their action on both libido and other aspects of sexual activity. While some aphrodisiacs may fall into distinct classification groups, others may fall into several categories at the same time. These substances, be they vitamins or aromatic substances, have been attributed with the ability to induce a modulation of passion that could stimulate erotic behaviour, turning sexuality into a true art. However, the effect of aphrodisiacs is dependent on the individual’s health, lifestyle and the harmony of the couple’s life. From this point of view, it could be said that the best aphrodisiac for a couple is a mix of love, trust, spontaneity and a balanced diet. A balanced diet, in such cases, can be defined as a diet which, on the one hand, maintains or helps to achieve good health and, on the other, boosts the parameters which define the quality of the individual’s sexual life. On the basis of the considerations which state the ineluctable nature of the power of the case law, that of being a creator of law, belonging to well-known doctrinaires, among whom we remember Hans Kelsen and Portalis, and taking into account the major changes that have taken place recently in the Romanian laws concerning the civil and civil procedure matters, the study seeks to show how the case law has imposed, in terms of legislation, many solutions or legal concepts. It is thus demonstrated how the legal concepts dedicated in terms of the case law (some of them being supported by the doctrine) have been taken up by the legislator and taken over - as such or with certain refinements - in the newly adopted regulatory documents (Civil Code and the Civil Procedure Code). The step taken by means of this study does not involve an analysis of the solutions / legal concepts newly inserted by the legislator in the abovementioned regulatory documents, but it only concerns the process through which they have been established in terms of legislation and how they have been taken over, making reference only to several such legal concepts: petition of heredity, proceedings in delivering a court judgement to replace an agreement, unforeseeability, and optional jurisdiction. The author points out some aspects of novelty brought in the civil procedure by the Civil Procedure Cod, which came into force on 15 February 2013, reveals some institutions or provisions designed to ensure the rationale of the act of justice and the continuation of a unitary jurisprudence and that produce its positive effect. However, the current Code of Civil Procedure has failed to eliminate all the shortcomings of the old regulation and some of its innovative provisions have not found the necessary infrastructure for application and development. The paper aims to make a general presentation of some of the interactions between Intellectual Property Law and Competition Law focusing on the case of patent rights and their effects on the qualification of their owner's position under the provisions of art. 6 of the Competition Law and art. 102 TFEU. In order to highlight these interactions we chose to individualize the case of standard essential patents, in what these are concerned the interactions being more evident, documented in both literature and practice and also of great current interest. Starting with the delineation of the constitutive elements of the abuse of dominance, the paper identifies how these apply to patents, how these are potentiated in what concerns standard essential patents and what are the effects of the application, in what these are concerned, of the rules regarding abuse of dominance. This research aims at identifying the moral and symbolic patrimony specific to the multiethnic community of Rasnov. I opted for a cultural sociological approach as it opens up not only the possibility to study tangible aspects of culture but because it gives particular importance to intangible, spiritual, moral and symbolic values structuring the collective mind and the social behavior of the community. The complex social reality of this multiethnic group sheds light on the axiological significance various cultural identities gained by imposing models and sharing behavioral norms and moral and symbolic values. The article aims to revisit a few points raised in our previous article on this matter published 10 years ago. Thus the divergence in denominations used and proposals explicitly made in this regard in the legal litterature are analyzed. Moreover we shortly point to the justification for the creation of these mechanisms within copyright law and to the importance of an ex ante analysis of the economic justifications for such, based on as much as possible objective criteria. Romanian private international law, similar to the private international law of other European Union member states, went through important transformations following the "europeanisation" of this field of law. An increasingly wide area of the Romanian private international law has its source directly in the European regulations. For instance, as regards the law applicable to contractual obligations, art. 2640 from the Romanian Civil Code makes direct reference to the EU regulations, and as regards the law applicable to divorce, the provisions from the Romanian Civil Code are largely inspired by Council Regulation (EU) No 1259/2010 of 20 December 2010 implementing enhanced cooperation in the area of the law applicable to divorce and legal separation (Rome III Regulation). In addition, the Romanian lawmaker chose to draw inspiration from EU private international law even when drafting purely national law provisions. For instance, some provisions in the Romanian Code of civil procedure regarding the jurisdiction of the courts draw inspiration from Brussels I Regulation. The current article aims at outlining several impact points between EU law and Romanian private international law, starting from the history of the step by step extension of the EU regulations in the field of conflict-of-laws and conflict-of-jurisdictions. The new Civil Code, recently enacted, contains a broad regulation of the nonpatrimonial rights, comprising a distinct title (Title V) dedicated to the protection of such rights. In this respect, art. 253 Civil Code ("Defense means") provides the categories of civil actions that can be submitted in front of the courts by way of the ordinary law procedure for the protection of any non-patrimonial rights, while art. 254 provides the actions concerning the defense of the right to a name. These actions can be submitted also for the protection of the intellectual property rights with non-patrimonial content, even if special regulations are also enacted for protection thereof. In order to ensure a rapid and efficient protection of the non-patrimonial rights, ever since the very start of their breaching or even before that moment, the legislator provides the possibility of taking some defense provisional measures, under an urgency regime, which should last until the court would settle the action on the merits on the basis of the ordinary law procedure. By the law for the enactment of the new Civil Procedure Code there was introduced in this Code as well the chapter titled "Provisional measures in the matter of intellectual property rights", in which there are regulated the same provisional measures provided by the Civil Code, but which shall apply not only to the non-patrimonial intellectual property rights, but also to those with patrimonial content. Palliative care is a domain in which there are placed numerous ethical issues, a lot of them similar to those occurring in other medical fields. The approach of ethical issues specific to the palliative care is based on accepting that the incurable and/or terminal patient is not an organic residue for whom there is nothing it can be done, a being that only needs and whose life doesn't have to be extended with no sense, but a person, a human being able to make his life an experience of feeling and achievement, with the condition of being bio-psychosocial and spiritual integrated. The numerous deaths occurring nowadays within the neonatology departments of the hospitals, bring to discussion the general aspects of this highly delicate and controversial field. The practitioner doctors need protocols to regulate the definitions, different clinical situations, and also the duties of the medical and care team under certain circumstances and particular procedures. The problem of life stopping in the neo-natal medicine is out of the context when we talk about other disciplines within pediatrics or adult medicine, as the new-born are beginning their lives and not ending them, and symbolically their entire life is out there waiting. That is why, the subject of this article is to initiate a debate among specialists, especially concerning the limitation and even stopping of life supporting, in delicate decisional situations. The even more medicinized caring strategies of the poli-handicapped children, impose limitation and constraint problems. From ethical point of view, choosing these treatments must take into consideration the notion of life quality. The more and more sophisticated caring modalities of the handicapped children, underlined the problematic of limitation and constraints of the medical treatments. The efforts of the caring personal to reach at any costs ‟a good state" of the patient, from medical point of view, often produce psycho-affective dissolutions hard to quantify, but that finally affect the quality of the medical deed. Last but not least, the applying of these treatments, called conservative, must be discussed, as they maintain or compensate a function and allow ameliorations of the relational life. Neo-natal traceability of the metabolically and endocrine diseases allows the precocious care of the severe pathologies as early as the asymptomatical stage. If the strategies used until now are proven ion the new born, born on due time, the prematurity still represents a source of contradictorily data. The purpose of this thesis is to evaluate the impact of the prematurity upon the efficacy of the program for tracing of several metabolically diseases, but also to respond to two questions put by the praxis. First of all, if there is a connection between the sensitivity of the rests and the degree of prematurity, and secondly if the tracing tests need to be performed on an ulterior age? The specificity of informing the sick child involves the care personnel, but also the parents or tutors who must exercise their responsibilities in taking decisions concerning the medical acts regarding the child. The material informing is beneficial for the sick child, because it answers the needs specific to all the children and especially to need of respecting the child as a human being and of considering him as a subject and not as an object of the medical cares. As concerns the minor, who does not have the capacity to give his/her consent, an intervention can be made only if his/her legal representative, or other authority or other person or instance designated by the law, gave his/her authorization. In Romania, the age for expressing the informed consent is 18 years when the minor, from a juridical point view, acquires the exercise capacity. The preschool child does not have the aptitudes to participate in taking decisions and consequently his/her legal representative must approve or refuse the medical intervention, representing the sick child's interest. The school age minor may participate in raking medical decisions, but he/she dose not have the full capacity of deciding, the consent being given by the legal representative, until the age of 14 years. The child having the age between 14-18 years, considered to have restricted exercise capacity, may give his/her consent only after having previously informed his/her parents. The teenager who is already 16 years old may express his consent in his/her parents' absence in case treatments regarding sexual or reproductive apparatus disease, at his/her express request, or in case of emergencies. The present study aims to punctually present some of the legal dispositions of the Civil Procedure Code of February 13th 2013, as well as the difficulties arising in their application and also, besides critiques and reasoned comments, advances some de lege ferenda suggestions, to be used in the future by the legislator. In this study the authors criticize the case law of some courts by which it is ordered „the restoration of the previous situation", in case a person acquires an asset (by committing an offence) and subsequently alienates it to a third party in good faith. The situation presented is justified, according to the authors, by the idea that, if the solution suggested is not accepted, an uncertainty and an instability will be created in the civil circuit, which are likely to lead to the infringement of the property right or of the mortgage right. Moreover, in the matter of real rights on buildings, uncertainty would be reached even in respect of the buildings recorded in the land book, thus infringing the provisions of Article 900 (1) of the new Civil Code, a text that establishes that „if a real right has been recorded in the land book for the benefit of a person, it will be presumed that the right exists for the benefit of such person”.
