The subject "defensive democracy" came back in Brazil during the government of former President Jair Bolsonaro, since the other two Branches identified the need to fight the democratic erosion provoked by him. With the recent change of government, the Executive Branch, reportedly inspired by the alluded theory, created an office for the defense of democracy, under the supervision of the Attorney General, whose main goal is to protect the integrity of the public action and the preservation of the three Branches and their members, ensuring the exercise of their constitutional functions. The Brazilian Office for Democracy Defense follows the example set by Germany in the second post-war period, when this European country created, for the same reasons, the Federal Office for the Protection of the Constitution (BfV). Based on this background, the main goal of this paper is to present the two government initiatives mentioned above, in addition to tracing the possible parallels between Germany and Brazil in the creation of a culture of "defensive democracy" and, what is more relevant, in the effective defense of democracy. The research method used was the "comparative" and the research technique was the "bibliographic review". The results obtained point to the fact that the creation of agencies for the defense of democracy, as occurred in Germany and Brazil, contributes to the strengthening of democratic values, not only institutionally, but also within society. The debate on democratic backsliding and its various manifestations is at the heart of contemporary political science. The purpose of this article is to present certain tools drawn from semiotics which, it is argued, can prove useful in achieving greater precision concerning the concepts used in this debate. To the extent that conceptual discussions within political science tend to be articulated on the basis of categories of meaning that mediate the interpretation of empirical evidence and social reality, this article analyzes the categories of “democracy,” “non-democracy,” and “authoritarianism,” among others, based on their positioning in a semiotic square that reveals the logical relationships between them.

In view of the new wave of authoritarianism expanding throughout the world, it is essential to better understand the phenomenon and to devise appropriate strategies to analyze it. To this end, this article proposes three contributions. First, it discusses the moral cost of democratic deterioration. It is argued that the value of democracy is not only defined by its performance, but because it ensures that citizens can choose and control public power. Second, it proposes the concept of democratic erosion as an analytical tool that denotes a process of deterioration of the attributes of the political regime that puts its democratic nature at risk. Finally, two paths of democratic erosion are currently proposed. It is on this basis that recent contributions and pending agendas are discussed.

This article aims to understand the state of the art of literature on recent phenomenon of democratic erosion in constitutionals democracies systems around the world, which has been studied by comparative researches on constitutional law and political science, in order to map which institutional strategies represent the incremental decline of quality of these regimes towards authoritarianism. First of all, the concept of liberal democracy in crises present in this literature will be analyzed. Second, the two ways of how democracies can end: the rapid, authoritarian collapse, and the slow, democratic erosion. Third, it will seek to identify the constitutional, legal and political measures that can be taken by an elected official and political parties to subvert the democratic institutions, to concentrate power on their behalf, to reduce the odds of opposing groups, and to undermine pluralism. Resumo Este artigo discute a viabilidade teórica do conceito de constitucionalismo iliberal. Indo além da pergunta sobre se ele seria um oxímoro, demonstra-se que, ao assumir uma abordagem duplamente normativa e empírica, não é só possível, mas necessário, classificar regimes políticos que se situam entre a democracia e o puro autoritarismo como regimes de constitucionalismo iliberal. Por meio de verificações bibliográfica, comparada e de políticas iliberais concretas, destaca-se que o ponto central do constitucionalismo iliberal é a subversão de instituições jurídicas liberais contra elas mesmas e em prol de fins políticos específicos. Abstract This article debates the theoretical feasibility of the concept of iliberal constitutionalism. Going beyond the question of if it is only an oxymoron, it is demonstrated that, when claiming an approach that is both normative and empirical, it is not only possible, but necessary, to classify political regimes that are situated between democracy and puro authoritarianism as regimes of iliberal constitutionalism. Through bibliographic, comparative and illiberal concrete politics investigations, the article emphasizes that the main feature of iliberal constitutionalism is the subversion of liberal legal institutions against themselves and on behalf of specific political aims.

As facing an international context of rising authoritarianism and fragilized democracies by illiberal tendencies, the understanding of this phenomenon is important to interpret which way the illiberal project has influenced the first year of the 2019-2022 term. Jair Bolsonaro elected allegedly being on the edge of the traditional status quo - in several opportunities - claimed to be an outsider from the legal pattern and its rules. Thus, identified this posture from the elected president, this article analyzes the first year of Bolsonaro-Mourão’s term concerning its legislative proposals and in which way there is a tendency to legal authoritarianism. The hypothesis centers on the high power of the Brazilian executive’s agenda, which can be an instrument of a legal transformation. The objective of this research was to analyze if this agenda can be used as an illiberal instrument with an authoritarian intent by the executive power in the legislative year of 2019, focusing on legislative proposals from executive power in the same year. The research centered on four types of legislative proposals: Proposals of Constitutional Amendments, Complementary Bills, Provisional Measure, and Regular Bills. The chosen proposals were concentrated for their power on the agenda and its bills in the Brazilian context. The conclusion is that, in the first year of his term, President Bolsonaro does not use explicit mechanisms of democratic erosion, using instead, subtle forms of discoordination of a democratic order. Frente a un contexto internacional de creciente autoritarismo y democracias frágiles por tendencias antiliberales, la comprensión de este fenómeno es importante para interpretar de qué manera el proyecto antiliberal ha influido en el primer año de la legislatura 2019-2022. Jair Bolsonaro electo supuestamente por estar tradicionalmente al borde del status quo - en varias oportunidades - desafiado a ser un extraño al patrón legal y sus reglas. El primer año del mandato de Bolsonaro-Mourão en cuanto a sus propuestas legislativas y de qué manera hay una tendencia al autoritarismo legal. La hipótesis se centra en el alto poder de la agenda del ejecutivo brasileño, que puede ser un instrumento de transformación jurídica. El objetivo de esta investigación fue analizar si esta agenda puede ser utilizada como un instrumento antiliberal con intención autoritaria por parte del Poder Ejecutivo en el año legislativo de 2019, enfocándose en las propuestas legislativas del Poder Ejecutivo en el mismo año. La investigación se centró en cuatro tipos de propuestas legislativas: Propuestas de Enmiendas Constitucionales, Proyectos de Ley Complementarios, Medida Provisional y Proyectos de Ley Ordinarios. Las propuestas elegidas se concentraron por su poder en la agenda y sus proyectos de ley en el contexto brasileño. La conclusión es que, en el primer año de su mandato, el presidente Bolsonaro no utiliza mecanismos explícitos de erosión democrática, sino que utiliza formas sutiles de descoordinación de un orden democrático. Di fronte a un contesto internazionale di crescente autoritarismo e fragili democrazie da tendenze illiberali, la comprensione di questo fenomeno è importante per interpretare in che modo il progetto illiberale ha influenzato il primo anno del mandato 2019-2022. Jair Bolsonaro eletto presunto essere tradizionalmente ai margini dello status quo - in diverse opportunità - sfidato a essere un estraneo al modello legale e alle sue regole. Il primo anno del mandato di Bolsonaro-Mourão riguardo alle sue proposte legislative e in che modo c'è una tendenza all'autoritarismo legale. L'ipotesi è incentrata sull'alto potere dell'agenda dell'esecutivo brasiliano, che può essere uno strumento di trasformazione giuridica. L'obiettivo di questa ricerca è stato quello di analizzare se questa agenda può essere utilizzata come strumento illiberale con un intento autoritario dal potere esecutivo nell'anno legislativo del 2019, concentrandosi sulle proposte legislative del potere esecutivo nello stesso anno. La ricerca si è incentrata su quattro tipi di proposte legislative: proposte di modifica costituzionale, disegni di legge complementari, provvedimenti provvisori e disegni di legge ordinari. Le proposte scelte sono state concentrate per il loro potere sull'ordine del giorno e sui suoi progetti di legge nel contesto brasiliano. La conclusione è che, nel primo anno del suo mandato, il presidente Bolsonaro non utilizza meccanismi espliciti di erosione democratica, ma ricorre a sottili forme di disordine di ordine democratico. Diante de um contexto internacional de autoritarismo crescente e de democracias fragilizadas por ondas iliberais, a compreensão do fenômeno dentro do contexto brasileiro é importante para entender em que medida o projeto iliberal influenciou a atuação do Poder Executivo brasileiro no primeiro ano da gestão 2019-2022. Jair Bolsonaro, em diversas oportunidades, identificou-se como um outsider no que diz respeito às regras do jogo. Dessa forma, observando essa postura do presidente eleito, este artigo tem como objetivo analisar o primeiro ano da gestão Bolsonaro-Mourão no que diz respeito às propostas legislativas oriundas do Poder Executivo e em que medida elas flertam com o legalismo autoritário. A hipótese gira em torno do alto poder legislativo do chefe do Poder Executivo brasileiro, o que pode ser instrumento de transformação marcante na ordem jurídica, inovando o ordenamento jurídico. O objetivo foi analisar se essa força foi utilizada com intenções antiliberais de cunho autoritário pelo Poder Executivo no ano legislativo de 2019. A pesquisa centrou-se em quatro tipos de propostas legislativas do Poder Executivo, a saber: as Propostas de Emenda à Constituição (PECs), os Projetos de Lei Complementar (PLPs), as Medidas Provisórias (MPs) e os Projetos de Lei (PL). A escolha desse corpus se deu pelo papel significativo que esses tipos de propostas legislativas possuem em alterar a normatividade do sistema jurídico. A conclusão alcançada é de que o primeiro ano da gestão do presidente Bolsonaro não se utiliza de mecanismos explícitos de erosão constitucional, empregando, por seu turno, formas sutis de desestruturação da ordem democrática.
