Neste artigo apresentamos a abordagem alternativa feita por Bondi para a teoria da relatividade especial. Durante o desenvolvimento, analisamos os diagramas de Bondi, recursos visuais dos quais podemos retirar algumas informações sobre os sistemas analisados, e discutimos o fator K da teoria de Bondi, que está no cerne deste trabalho. Posteriormente, discutimos alguns dos principais resultados obtidos pela relatividade especial de Einstein tais como a dilatação temporal, a contração espacial e a simultaneidade de eventos separados espacialmente, além das transformações de Lorentz. Mostramos também dois outros resultados importantes na física a partir do cálculo K: o momento linear relativístico e a energia total relativística. In this paper we present an alternative approach due to Bondi for the special theory of relativity. During the development, we analyse the Bondi diagrams, visual resources from which we can take some information about the analysed systems, and we discuss the K factor of Bondi's theory, which is in the core of this work. We then discuss some of the main results obtained from Einstein's special theory of relativity such as the time dilation, spatial contraction and simultaneity of spatially separated events, besides the Lorentz transformations. We also show other two important results in physics coming from K calculus: the relativistic linear momentum and the total relativistic energy.

The general goal of this article is to open a new line of discussion in teaching of modern relativity of motion, offering a four-dimensional Euclidean geometric approach which adopts proper time as the fourth Cartesian axis. This initiative is because many observe severe barriers to attempt to do transpositions of the relativistic phenomena to basic education when necessary, mainly because Special Theory of Relativity (STR) is very abstract, and Minkowskian Spacetime Theory (STT) and General Theory of Relativity (GTR) requires a non-Euclidean geometry. In this context, this new geometry is mainly focused on the training of teachers, who are the creators of these transpositions, and has the specific goal of exploring its functionality in describing exclusively the relativistic kinematics, without defining a quantity to describe the change of movement, discussing the problems of time dilation, composition of movements, length contraction and the “paradoxes” of twins, contraction of space, and rigidly rotating disk. This specific goal is important because these six problems are not only historically relevant, but also serve as a laboratory to test the validity of this new geometry, which, although equivalent to STR and STT, has its internal cohesion. O objetivo geral deste artigo é abrir uma nova linha de discussão no ensino da relatividade do movimento moderna, oferecendo uma abordagem geométrica euclidiana em quatro dimensões, que adota o tempo próprio como quarto eixo cartesiano. Essa iniciativa se deve ao fato de que são identificadas severas barreiras às tentativas, quando necessárias, de transposição dos fenômenos relativistas para a educação básica, principalmente porque a Teoria da Relatividade Especial (TRE) é muito abstrata e as Teorias do Espaço-tempo (TET) minkowskiana e da Relatividade Geral (TRG) exigem uma geometria não-euclidiana. Nesse contexto, essa nova geometria é focada, sobremaneira, na formação de professores, que são os artífices dessas transposições, e possui o objetivo específico de explorar sua funcionalidade em descrever exclusivamente a cinemática relativista, sem definir uma grandeza para descrever a mudança do movimento, discutindo os problemas da dilatação do tempo, da composição de movimentos, da contração do comprimento e dos “paradoxos” dos gêmeos, da contração do espaço e do disco rígido girante. Esse objetivo específico é importante porque estes seis problemas não só são historicamente relevantes, como também servem como laboratório para testar a validade da nova geometria, que, apesar de equivalente à TRE e à TET, possui sua coesão interna.

Esta pesquisa se propôs a investigar os processos criativos na realidade cotidiana da ação do piloto policial durante uma ocorrência de segurança pública caracterizada pelo confronto armado. Adotamos uma concepção de criatividade distribuída, relacional, histórica e cultural, repelindo os modelos teóricos que reduzem o processo criativo a variáveis intrapsicológicas e reforçam o paradigma do gênio criador. Para tal, encontramos aporte teórico nas propostas da psicologia cultural da criatividade de Glaveanu, nos trabalhos de Vygotsky e seu entendimento da criatividade como atividade humana que resulta em novidade, do criador como produto de sua época e da centralidade da linguagem neste processo, e também no dialogismo do filósofo Mikhail Bakhtin e suas alegorias filosóficas importantes como a exotopia e o excedente de visão. Tivemos por objetivo compreender como se singularizam os processos criativos na ação do piloto policial através da dinâmica semiótica-cultural da experiência desse sujeito e para tal, nos propomos a mapear na experiência desse piloto policial as alteridades que atuam na ação criativa e suas formas de integração, refutação e coordenação face ao inesperado da situação, bem como buscamos inferir como os processos criativos se singularizam em sua dimensão afetiva e cognitiva no contexto da prática da pilotagem policial de helicópteros. Adotamos a abordagem idiográfica qualitativa estruturada em quatro etapas: a escolha do registro em vídeo da ocorrência aeropolicial da unidade aérea e sua tripulação, a seleção dos trechos de vídeos e imagens utilizados nas entrevistas, a entrevista com o piloto policial de helicóptero com exibição dos vídeos e imagens selecionados e a entrevista coletiva com a tripulação com a exibição dos vídeos selecionados. A análise dos dados e as discussões se basearam em quatro eixos interpretativos: Perspectiva, ambiguidade e ambivalência, temporalidade e uso de instrumentos. Nossos dados mostraram que nos momentos de maior risco e aumento da tensão, a incerteza se faz acompanhada de uma ampliação da sensação de dilatação do tempo de duração da experiência e de uma suspensão de sentidos prévios que, ante à indeterminação do futuro, surge de um lado a perícia e do outro o conjunto de valores que balizam as decisões e as ações na emergência do novo. Nossa principal contribuição é uma proposta de estudo dos processos criativos em uma abordagem sócio-histórico-cultural de uma atividade laboral marcadamente prescrita e procedural diversa do campo das artes, em um contexto de risco e emergência. This research aimed to investigate the creative processes in the daily reality of the police pilot during a public security incident characterized by armed confrontation. We adopted a conception of distributed, relational, historical and cultural creativity, repelling the theoretical models that reduce the creative process to intrapsychological variables and reinforce the paradigm of the creative genius. To do so, we found theoretical contribution in Glaveanu’s proposals of cultural psychology creativity, in the works of Vygotsky and his understanding of creativity as a human activity that results in novelty, of the creator as a product of his time, and of the language centrality in this process, as well as in the dialogism of the philosopher Mikhail Bakhtin and his important philosophical allegories such as exotopy and visual surplus. We aimed to understand how creative processes are singled out in the police pilot action through the cultural-semiotic dynamics of the experience of this person. For such, we proposed to map, in the experience of the police pilot, the alterities that act in the creative action and its forms of integration, refutation, and coordination in the face of the unexpected of a situation. We also sought to infer how creative processes become significant in their affective and cognitive dimension in the context of police helicopters pilotage practice. We adopted the the qualitative idiographic approach structured in four stages: the choice of the video record of the aeropolicial incident of the air unit and its crew, the selection of video clips and images used in the interviews, the interview with the police helicopter pilot with the exhibition of selected videos and images, and the crew collective interview with the exhibition of the selected videos. Data analysis and discussions were based on four interpretative axes: perspective, ambiguity and ambivalence, temporality and use of instruments. In the moments of higher risk and increase of tension, our data showed that uncertainty is accompanied by amplification of time dilation sensation and a suspension of previous senses. Faced with the uncertainty of the future, expertise on the one hand and the values that mark decisions and actions in the emergence of the new on the other hand arise. Our main contribution is a study proposal of creative processes in a social, historical and cultural approach of a markedly prescribed and procedural labor activity diverse from the field of art, in a context of risk and emergency.

The overall goal of this research is to discuss the necessary structures for knowing Albert Einstein's Special Theory of Relativity according to the Model of the System of Schemes of Actions and Operations on Symbols and Signs (MoSEAOSS), a model based on Jean Piaget's Genetic Epistemology. The specific objectives of this research are: to discuss the phenomena of Time Dilation and Length Contraction that follow the postulates of Special Theory of Relativity, as well as the Twin Paradox, and, based on them, to analyze the notion of space-time that results from them; to introduce the MoSEAOSS, as well as the key concepts involved in it, especially, the concepts of transfiguration and transignation; to apply the MoSEAOSS to Special Theory of Relativity and to show that the notion of space-time can be explained by means of operations that the subject performs on symbols and signs. Bibliografia: f. 109-111 Resumo: RESUMO Este trabalho aborda um texto de um renomado físico norte-americano, cujo tema é a conexão intrínseca entre a Teoria da Relatividade Especial (TRE) e o Eletromagnetismo Clássico, isto é, alguns elementos introdutórios de Eletrodinâmica Relativística. O físico mostra que os efeitos relativísticos de dilatação temporal e contração de Lorentz estão naturalmente contidos no contexto da Teoria Eletromagnética, mesmo se a velocidade entre referenciais inerciais for muito baixa. Assim, sob a ótica da TRE, campos e forças elétricas e magnéticas tornam-se grandezas e conceitos completamente relativos; porém, as equações de Maxwell se preservam (não necessitando de correção relativística) em qualquer destes referenciais. A invariância da carga elétrica elementar, junto ao princípio de conservação da carga (além dos efeitos citados acima), leva o cientista a concluir pela compatibilidade entre TRE e Eletromagnetismo. Isto é destacado a partir de abordagem teórica, clássica, das forças atuantes numa carga de prova, em distintos referenciais inerciais o que, para curtos intervalos de tempo, está de acordo com os postulados de Einstein. Nosso propósito consistiu em elaborar um material pedagógico para estudo dirigido, baseado no texto do cientista, a fim de ser aplicado em curso superior de Física ou afim. Os pressupostos teórico-pedagógicos adotados provêm de uma obra de importantes estudiosos da Pedagogia (relacionada ao ensino superior) e também de ideias e pensamentos atribuídos à Teoria histórico-social e a um de seus principais pensadores. Estes fundamentos pedagógicos permitiram, por exemplo, justificar a importância de pré-requisitos para o estudo/leitura do texto do físico, assim como de uma potencial discussão a respeito de noções significativas deste. O texto, no idioma português, foi aplicado para a leitura em uma oficina com alunos universitários. Nesta, também se passou um material experimental, contendo questões sugeridas e uma errata daquele. Infelizmente, não houve tempo suficiente para a tentativa de resolução destas questões o que se propôs como atividade extraclasse. Mas os participantes do encontro fizeram a leitura de texto; e se iniciou o diálogo sobre alguns aspectos relevantes do tema contido. Antes da leitura, foram preenchidos pré-saberes faltantes relacionados à TRE. Como não se recebeu nenhum conjunto de respostas esperadas às questões (devido a problemas encontrados), julgou-se útil a produção de questionário a fim de avaliar o material e a aplicação; este foi respondido apenas por dois participantes. Outras duas pessoas, que não estiveram na oficina, também auxiliaram neste trabalho, ao fazer a leitura do texto, resolver parcialmente as questões e responder o questionário. Foram feitas algumas modificações no material aplicado. Elaborou-se, ainda, um documento suplementar com respostas às questões sugeridas e considerações sobre importantes aspectos do texto ou correlatos , documento que pode ser valioso para o autoestudo do leitor, para correção das questões e esboço de discussão com estudantes. Este suplemento foi passado a todos os participantes da oficina; e também aos (dois) não participantes que contribuíram com este trabalho. Os resultados (dados) coletados no questionário indicam que o aqui proposto tem potencial em ser eficiente numa futura aplicação, auxiliando o estudo/compreensão do texto em questão. Além disso, foram levantadas humildes sugestões para o aprimoramento da oficina e algumas recomendações para a aplicação do material e discussão de texto. Palavras-chave: Ensino de Física. Abstract: This work addresses a text of a renowned American physicist, whose theme is the connection between the Special Theory of Relativity (STR) and the Classical Electromagnetism, that is, some introductory elements of Relativistic Electrodynamics. The physicist shows that the relativistic effects of time dilation and Lorentz contraction are naturally inserted on the scope of Electromagnetic Theory, even if the velocity between inertial frames is very low. Thus, from the perspective of STR, magnetic and electric fields and forces become completely relative concepts; however, Maxwell´s equations remain with the same mathematical form (do not require relativistic correction) in any of these frames. The invariance on the elementary electric charge and the principle of charge conservation (in addition to the effects mentioned above), allow the scientist to conclude that STR and Electromagnetism are compatible. This is highlighted from a classical theoretical approach of the forces acting on a test charge (in different inertial frames) which, for short time intervals, is in accordance with Einstein´s postulates. Our purpose has been to develop a pedagogical material for the study to be guided by a Professor, material based on the scientists text, for use in undergraduate Physics course (or similar). The pedagogical assumptions are from a work of important scholars of the Pedagogy (related to higher education) and also from thoughts and ideas of the Sociocultural theory and one of its leading thinkers. These pedagogical foundations allowed, for example, justify the importance of prerequisites for study/reading of the text, as well as a potential dialogue about relevant textual notions. The text, in Portuguese, has been applied for reading during a workshop with university students. The material prepared has also been delivered, containing errata and proposed questions. Unfortunately, there was not enough time to the attempt to solve these questions which has been proposed as homework. However, the text reading has been made by the meeting participants; and a dialogue on some relevant notions of the text has started. The prior knowledge, concerning STR, has been exposed before the reading. We have received no answers to the questions (due to the problems faced); therefore, we have thought it would be valuable to make a questionnaire in order to evaluate the material and the meeting which was answered only by two participants. Two other individuals, who were not in the workshop, have also helped our work: they have read the text, partially resolving the questions and answering our questionnaire. Some modifications have been done on the applied material. In addition, it is produced a document with answers to the suggested questions and considerations about important notions on the text or correlated , which may be valuable to the self-study, to correct questions and help on discussion with students. This supplement has been delivered to the workshop participants and to the (two) non-participants who contributed to this research. The information collected from the evaluation questionnaire indicates that our proposal has potential to be efficient in a future application, assisting the study/comprehension of the text. Moreover, humble suggestions for the workshop improvement and some recommendations regarding the material application (and discussion of the text) have been raised. Keywords: Physics Education. Coordenação de Aperfeiçoamento de Pessoal de Nível Superior (CAPES) This present work aims to build a Teaching and Learning Sequence (TLS) proposed by Marco. A. Moreira , based on David Ausubel's Meaningful Learning Theory. The TLS aims to lead to a meaningful conceptual learning of Einstein's Special Relativity theory by suppressing the excessive calculus involving it. One of its greatest achievements is the use of the educational game - a slower speed of light and animations. The topics of the unit content are time dilation, length contraction, invariance of the speed of light, the relativity of simultaneity, spotlight effect and Terrell effect. The TLS was able to promote differentiated classes, providing evidences of conceptual evolution - stimulating and making it possible the teaching of modern and contemporary physics at this level. The TLS developed for this study was applied in two classes in a State high school in Itapira - SP and the results were analyzed so that the teaching unit efficiency could be evaluated. At the end of this work an instructional product, which is the TLS itself, is presented. O presente trabalho tem como objetivo construir e aplicar uma Unidade de Ensino Potencialmente Significativa (UEPS), baseada na teoria da Aprendizagem Significativa de David Ausubel e proposta por Marco A. Moreira. A UEPS visa facilitar a aprendizagem significativa da teoria da Relatividade Restrita e suprimir o excesso de matematização que envolve a tal teoria. Um dos diferenciais desta UEPS é o uso do game educativo A slower speed of light e animações. Os temas abordados na unidade de ensino são a dilatação temporal, a contração do comprimento, a invariância da velocidade da luz, a simultaneidade de eventos relativísticos, o efeito holofote e o efeito Terrell. A UEPS construída foi capaz de permitir aulas diferenciadas, fornecendo evidências de uma evolução conceitual por parte dos alunos, viabilizando e incentivando o ensino da física moderna e contemporânea neste nível de ensino. A UEPS desenvolvida neste trabalho foi aplicada em duas salas de uma escola pública de Itapira – SP, sendo que os resultados foram analisados para que se pudesse avaliar a eficácia da unidade de ensino. Ao final do trabalho é apresentado o produto educacional que consiste na UEPS para o ensino da teoria da Relatividade Restrita.

Introduzimos nossas considerações pela transformação de Lorentz nas coordenadas da frente de luz, com o objetivo de vislumbrar a possibilidade de sugerir aquelas transformações nessas novas coordenadas. As transformações de Lorentz usuais, isto é, aquelas consideradas padrão no espaço-tempo de Minkowski (x0,−→x) com referenciais inerciais S e S′ movendo-se com velocidade relativa ao longo dos eixos z//z′ são tais que a coordenada tempo t′ em S′ é expressa em termos das coordenadas tempo t e espaço z em S; e similarmente, a coordenada espaço z′ em S′ é expressa em termos das coordenadas tempo t e coordenada espaço z em S. Como as coordenadas da frente de luz são construídas pela combinação linear entre as coordenadas tempo (t) e coordenada espaço (z), espera-se que as transformações de Lorentz na frente de luz se manifestem conectando apenas coordenadas similares, isto é, tempo em S com tempo em S′ e coordenada espacial em S com coordenada espacial em S′.Essa suspeita se confirma em nossa pesquisa e esse resultado é responsável pela introdução de profundas modificações nas estruturas algébricas das transformações. Demonstramos assim, novas maneiras, maneiras sui generis de expressar os resultados bem conhecidos da dilatação temporal e contração espacial. O estudo do espalhamento de partículas sempre se constituiu numa ferramenta muito poderosa não somente para descrever as interações, mas também para compreender os processos físicos envolvidos em tais espalhamentos. Assim, usando o formalismo de coordenadas da frente de luz, calculamos a correção perturbativa de dois corpos a ordem O(g2) e a ordem O(g4), respectivamente... In this work we discuss several aspects of relativistic particle dynamics in the front form as proposed by Dirac more than half a century ago. We introduce our considerations with Lorentz transformations in the light front coordinates, with the objective of seeing the possibility of expressing those transformations in the new coordinates. Usual Lorentz transformations, that is, those considered standard in the Minkowski space-time (x0,−→x) with inertial reference frames S and S′ moving with relative velocity v along the z//z′ direction are such that the time coordinate t′ in S′ is expressed in terms of both time coordinate t and space coordinate z in S; and similarly, the longitudinal space coordinate z′ in S′ is also expressed in terms of both time coordinate t and space coordinate z in S. Since light front coordinates are defined as linear combinations of time coordinate (t) and space coordinate (z), we expect that the Lorentz transformations in the light front will manifest themselves connecting only similar coordinates, that is, time in S with time in S′ and space coordinate in S with space coordinate in S′. This suspicion is confirmed in our research and this result is responsible for the profound modifications in the algebraic structures of the transformations. We thus show news uigeneris ways of expressing the well-known results of time dilation and space contraction. The study of particle scattering has always been a very powerful tool not only to describe the interactions but also to realize the physical processes involved in such scattering. So, using the light front formalism, we calculate the perturbative corrections for two body interactions to the order O(g2)and orde rO(g4) respectively. We present some diagrams which can be useful to help the teacher when it is necessary to explain some of the most important aspects of Special Relativity for High School students, or first year undergraduate students. These diagrams can be used to construct some simple instruments to demonstrate effects like time dilation and size contraction. We propose also a construction, with an equivalent pendulum in order to demonstrate the difference in time advance between two reference systems: the first in rest relatively to the observer and the second in movement relatively to the same observer. Apresentamos neste trabalho alguns diagramas que podem ser úteis como recursos auxiliares para o professor quando for explicar alguns dos aspectos mais importantes da Teoria da Relatividade Restrita para alunos de ensino médio ou mesmo de primeiro ano de cursos de graduação. Tais diagramas podem ser usados para construir instrumentos simples para demonstrar efeitos como a dilatação do tempo ou a contração espacial. Propomos uma construção com um pêndulo equivalente para demonstrar a diferença no avanço do tempo entre dois sistemas de referência: o primeiro em repouso em relação ao observador e o segundo em movimento em relação ao mesmo observador.

The Lorentz transformations and special relativity are unable to provide a realistic physical explanation of the behavior of matter and light. We will show that all these phenomena can be explained using Newton's physics and mass-energy conservation, without space contraction or time dilation. We have seen previously that the principle of mass-energy conservation requires that clocks run at a slower rate in a moving frame, and physical bodies become longer because of the increase of the Bohr radius. These results allow us to answer the question: With respect to what does light travel? For example, when we move away at velocity v from a source emitting light at velocity c, the relative motion of the radiation is observed from the Doppler shift. How can we explain logically that these photons appear to reach us at velocity c and not (c-v)? The conventional explanation relies on special relativity, but it implies an esoteric space-time distortion, which is not compatible with logic. This paper gives a physical explanation how the velocity of light is really (c-v) with respect to the observer, even if the observer's tools always measure a velocity represented by the number c. We explain how this problem is crucial in the Global Positioning System (GPS) and in clock synchronization. The Lorentz' transformations become quite useless. This apparent constant velocity of light with respect to a moving frame is the most fascinating illusion in science. As transformações de Lorentz e a relatividade especial são incapazes de fornecer uma explicação física realística do comportamento da matéria e da luz. Mostraremos aqui que todos esses fenômenos podem ser explicados usando-se a física de Newton e a conservação da massa-energia, sem apelar para a contração espacial ou a dilatação do tempo. Sabemos que o princípio de conservação da massa-energia requer que os relógios funcionem mais devagar em um referencial móvel, e que os corpos físicos tornam-se maiores devido ao acréscimo do raio de Bohr. Estes resultados nos permitem levantar a seguinte questão: A luz viaja com respeito a quê? Por exemplo, quando nos distanciamos a uma velocidade v de uma fonte emissora de luz, que, por sua vez, se desloca com velocidade c, o movimento relativo da radiação é dado por um deslocamento Doppler. Como podemos explicar logicamente que estes fótons parecem chegar até nós a uma velocidade c e não a uma velocidade (c – v)? A explicação convencional remete à relatividade especial, mas isto implica em uma esotérica distorção espaço-temporal, que não é compatível com a lógica. Este artigo fornece uma explicação física de como a velocidade da luz é realmente (c – v) com respeito ao observador, mesmo se as ferramentas do observador sempre meçam a velocidade representada pelo número c. Explicamos como este problema é crucial no Global Positioning System (GPS – Sistema de Posicionamento Global) e na sincronização dos relógios. As transformações de Lorentz tornam-se desnecessárias. Esta aparente constância da velocidade da luz com respeito a um referencial móvel é a mais fascinante ilusão na ciência.

This study is constructed through a dialectic hermeneutical process, aiming Procedural Law which has constitutional foundation. The problematic is centered historically and is developed during the 45th Constitutional Amendment scenario, within the procedimentalist and substantialist paradigmatic conflict, who define the part that should be played by the magistrate in the Constitutional State of Law. The hypothesis is of which the insertion of the Fundamental Right to the Reasonable Duration of the Lawsuit in the hard core of constitutional text gives it, through a material and formal points of view, legal characteristics of fundamental right, with immediate and complete efficacy, even thought it does not have aptitude to interfere in the procedural march, reducing their time span. It also demonstrates that many assumptions under which the jurisdictional response delay problem are untrue, because they are not scientific approaches of the problem or have shown themselves unable to solve the problem. Recognizing the relativity of its concept and theoretical abstractions of the Fundamental Right, firm an concept of the terms Right to the Reasonable Duration of the Lawsuit are made, taking into consideration the many view points of the actors in its relation. With its iusfundamentality, the Right to the Reasonable Duration of the Lawsuit puts itself through an interdisciplinary approach with other themes of the legal science, questioning the doubts of its judiciality, bringing back to focus the problem of the criteria of legitimation of the jurisdictional power in Brazilian law, the role of the magistrate in the realization of rights, and the realization of the material effects of the judicial decisions. Also as an objective, making the Fundamental Right to the Reasonable Duration of the Lawsuit shine its theme of the civil responsibility of the state and magistrate due to the unlawful time dilation of the judicial lawsuits, due to negligence or disdain in the conduction of the lawsuit, having in mind the text that resulted from the parallel amendment after the promulgation of the 45th amendment to the Constitution of Brazil. The active and passive entitlement of the Fundamental Right to the Reasonable Duration of the Lawsuit will also be studied, as will be the consequences of its vertical efficiency against the state, and horizontally, as a reflection of the fundamental rights between particulars- which operates, in the case of the right studied, between the poles of the procedural relationship whose time gap has grown beyond what is reasonably expected. A proposta desta dissertação é a análise teórica do artigo 5°, inciso LXXVIII, da Constituição Federal de 1988, conhecido como Direito Fundamental à Duração Razoável do Processo, ou Direito ao Processo sem Dilações Indevidas. O estudo é construído sob método hermenêutico-dialético, com enfoque no Direito Processual que tem assento constitucional. A problemática é centrada historicamente e desenvolvida no cenário da Reforma do Poder Judiciário implementada pela Emenda Constitucional n°45/04, bem como, dentro do contexto de confronto entre os paradigmas procedimentalista e substancialista que definem, segundo os discursos de aplicação e justificação, o papel da magistratura no Estado constitucional e democrático de direito. A hipótese é a de que a inserção do direito à Duração Razoável do Processo no núcleo fundamental do texto constitucional dá a ele, tanto do ponto de vista formal quanto material, natureza jurídica de Direito Fundamental, com eficácia plena e imediata, embora não tenha a aptidão para interferir na marcha dos processos, abreviando-lhe o tempo de duração. Este trabalho demonstra, ainda, que algumas das premissas sobre as quais o tema da morosidade da prestação jurisdicional se desenvolve na atualidade são falsas, porquanto não se prestem a uma abordagem científica e, principalmente, por se mostrarem inócuas a solucionar o problema. Reconhecendo a relatividade e abstração conceitual dos direitos fundamentais em geral, esta dissertação estabelece uma definição operacional dos termos Duração Razoável do Processo, levando em consideração e discutindo as diversas óticas dos atores da relação processual. Com sua jusfundamentalidade, a Duração Razoável do Processo vem, em uma abordagem interdisciplinar, colocar-se em cotejo com outros temas da Ciência Jurídica, questionando acerca de sua judiciabilidade, reacendendo a problemática dos critérios de legitimação para o exercício do Poder jurisdicional no direito brasileiro, do papel do magistrado na concretização dos direitos materiais e, por conseguinte, a conscientização acerca dos efeitos concretos das decisões judiciais. Visa, também, fazer o Direito Fundamental à Duração Razoável do Processo iluminar o tema da Teoria geral da responsabilidade civil do Estado e do magistrado em decorrência da dilação indevida do tempo de duração dos processos judiciais, analisando as hipóteses em que tal fato se dá por negligência ou desídia na condução do processo, tendo em vista o texto que resultou na Proposta de Emenda Constitucional paralela após a promulgação da Emenda Constitucional n°45/04. Também serão estudadas as titularidades ativa e passiva do Direito Fundamental à Duração Razoável do Processo, como conseqüência de sua eficácia vertical, contra o Estado e, horizontal, referente à eficácia dos direitos fundamentais entre particulares - que se operam, no caso do direito em estudo, entre as partes da relação processual - quando litigam em processo que se desenvolveu em lapso de tempo além do que razoavelmente se esperava.
