This paper examines the standpoints and the approach of the stakeholders working towards combatting sex trafficking in Assam and Meghalaya, India, with the aim of understanding whether the selected stakeholders uphold a gender-sensitive conceptualization, understanding and approach towards sex trafficking. Such an approach is significant since it ensures that victims of sex trafficking are protected from further marginalization and exploitation. In contemplating the voices of the stakeholders, the paper shows that the implementation and execution of the anti-trafficking provisions are genderladen. It claims that, while putting the anti-trafficking provisions of prevention, rescue, rehabilitation and repatriation into action, the stakeholders do not differentiate between voluntary and forced sex work. The absence of this distinction results in the “forced rescue” of voluntary sex workers. This article therefore shows how stakeholders impose the idea of “normal womanhood” and constantly seek to control and regulate women’s sexuality.

The region we denominate North America, consisting of Central America, Mexico and the United States, is one where sex trafficking has been deeply rooted. This article, based on a qualitative methodology which included in-depth interviews with 155 women from Central America, offers a comparative analysis of the characteristics of the sex trafficking suffered by migrant women in the different countries of the region. It concludes that in the case of those who travel to the United States, the victims are mainly young women who are lured by sex trafficking networks with false promises of glamorous or well-paid jobs; in Mexico many victims are kidnapped by criminal groups, and in Central America, the victims are mostly minors prostituted by people who are close to them or who are deceived by pimps.

According to the World Report on Violence and Health (World Health Organization, 2002), sexual violence (SV) is defined as any sexual act, attempt to obtain a sexual act, comments, unwanted sexual advances, or acts directed at the sex trafficking. In most aggressions, vaginal, oral and anal penetration occurs without the use of condoms, making SV a gateway to numerous sexually transmitted infections (STIs), in addition to the various physical and psychological damage to the victim. Nowadays there is still a relationship between sexual aggression and an increase in STI cases, among which we can highlight syphilis. Given this relevance, the present study aimed to ascertain this relationship and the proportion of these data for public health, as well as for victims. This is a research of an application nature, with a descriptive approach. The sample consisted of a search in the BVS, Medline, Scielo and PubMed databases, about articles with the descriptors "sexual assault in Brazil", "syphilis acquired in Brazil" and "STIs in Brazil". It was possible to identify in the literature the worrying character of the increase in the rates of sexual aggression against women in Brazil. Many of these victims bring psychological damage, unwanted pregnancies, in addition to contracting STIs. During the years 2015 to 2020 there was a growing curve in cases of sexual assault and an increase in syphilis cases in Brazil among the female population, despite observing a drop in syphilis rates in 2020. In addition, it was seen that the vaginal penetration is described as the most frequent act in sexual crimes against young women and women in reproductive age, usually practiced through psychological intimidation. Finally, it was found that only 8% of hospitals provide the correct assistance to the victim of sexual violence present in the technical regulations. In recent decades, the issue of violence has been widely debated, having gained visibility in several multidisciplinary fields and by international organizations. Despite the various national measures made available to this population, many victims of sexual violence abstain from health services or discontinue their treatment. The present article sought to relate in a didactic way the reported values of acquired syphilis and the rates of sexual violence in the female population in our country. The intimate relationship of SV and syphilis acquired in women was highlighted, not only correlating to the act itself, but the lack of correct, continuous and adequate care for the situation within an ideal environment, which should bring respect and security to the victim. Nas últimas décadas, o combate ao tráfico de pessoas tem-se consolidado gradualmente também em Portugal, através da ação conjunta de organizações governamentais e forças policiais com organizações não governamentais e internacionais. Apesar da falta de evidências, as preocupações envolveram, em primeiro lugar, as mulheres migrantes exploradas no mercado do sexo. No entanto, estas cedo deixaram de estar entre as primeiras preocupações de resgate e o tráfico sexual tornou-se um assunto tabu. O artigo questiona o desaparecimento da exploração sexual da ideia de tráfico, em Portugal. Para tal, analisa a construção do campo do combate ao tráfico no país, utilizando as fer-ramentas analíticas de campo e de encerramento ideológico. O artigo argumenta que, num contexto atravessado por conflitos violentos em torno da venda de sexo, bem como por um alto nível de isomorfismo institucional, o objetivo superior de construir o campo do combate ao tráfico restringiu a ideia de tráfico, da qual o tráfico sexual permanece substancialmente excluído., In recent decades, the fight against human trafficking has gradually been consolidated in Portugal through an alliance of government organizations and police forces with non-governmental and in-ternational organizations. Despite the lack of evidence, the concerns involved, first and foremost, migrant women exploited in the sex market. However, they are no longer among the first rescue concerns and sex trafficking became a taboo subject. The article questions the disappearance of se-xual exploitation from the idea of trafficking in Portugal. For this purpose, it analyzes the construc-tion of the field of counter-trafficking in the country, using the analytical tools of field and ideologi-cal closure. The article argues that in a context of violent conflicts on the sale of sex, as well as a high level of institutional isomorphism, the overarching goal of building the field of counter-trafficking has restricted the idea of trafficking from which sex trafficking remains substantially excluded.

Com base na teoria critica da seguranca sobre a construcao do outro como sujeito diferente e perigoso, esse artigo desenvolve um estudo critico dos discursos dominantes sobre os fenomenos de trafico sexual e migracao pelo trabalho sexual na Europa. Busca-se realizar uma analise do processo de securitizacao atraves do qual a migrante prostituta e identificada como uma “vitima criminosa”, que coloca em risco a ordem publica, o modelo da familia tradicional, a sexualidade feminina e a soberania dos Estados europeus. ABSTRACT This article develops a critical study of the dominant discourse on sex trafficking and transnational sex work in Europe, by relying on the critical security theory about the construction of the “other” as a different and dangerous subject. It seeks to analyze the process of securitization of migrant prostitutes, through which they are identified as "criminal victims" who challenge the public order, the traditional family structure and female sexuality, and ultimately the sovereignty of European states. The degree of dangerousness of irregular migrants involved in prostitution is defined through a construction of their risk profile, which serves as a justification to implement policies of body and movement control, by restricting immigration entrance, criminalizing or deporting them to their countries of origin. Este artigo reflete sobre as facilidades e dificuldades no enfrentamento ao tráfico sexual de mulheres. Trata-se de um estudo exploratório de natureza qualitativa; entrevistaram-se representantes de instituições governamentais e não governamentais do Brasil e de Portugal. O material coletado foi submetido à análise temática. Verificou-se a existência de vários obstáculos: desde uma legislação dúbia, estigmatização das mulheres, morosidade investigativa, naturalização de práticas violadoras até falta de recursos. Em contrapartida, percebem-se avanços, como: a gradativa visibilidade e sensibilidade social ao tema; ações de parceria entre as instituições, assim como a busca de diálogo e aprendizado com os grupos representativos dessas pessoas. Recomenda-se: a integração das ações, serviços, políticas e setores que lidam com o tráfico; a formação dos profissionais com a participação de pessoas que já sofreram tal experiência, e a inserção deste assunto nas políticas de violência contra a mulher. This paper proposes a reflection on the facilitators and obstacles in addressing sex trafficking. This is an exploratory qualitative study, that interviews representatives of governmental and nongovernmental institutions in Brazil and Portugal. A thematic analysis was performed on the collected material. Several obstacles were found, ranging from dubious legislation, stigmatization of women, delays in investigation, usual and accepted transgressive practices and lack of resources. On the other hand, we see advances such as the gradual visibility and social sensitivity to the subject; partnership actions between institutions and the search for dialogue and learning with representative groups of the victims. It is recommended the integration of actions, services, policies and sectors that deal with trafficking; the training of professionals with the participation of people who have suffered such an experience, and the inclusion of this issue in policies addressing violence against women. Este articulo reflexiona sobre las facilidades y dificultades en el enfrentamiento al trafico sexual de mujeres. em este estudio, exploratorio y de naturaleza cualitativa, se entrevistaron representantes de instituciones gubernamentales y no gubernamentales de Brasil y Portugal. El material recuperado fue sometido a un análisis temático. Se identificaron varios obstáculos, entre ellos una legislación con dificultades en su formulación, estigmatización, demoras, naturalización de prácticas de violación y falta de recursos. En contraposición, se encontraron avances relacionados con la sensibilidad social hacia el tema, asi como acciones compartidas entre las instituciones, así como la búsqueda de un diálogo y aprendizaje con los grupos que representan estas personas. Se recomienda la integración de acciones, servicios, politicas y sectores relacionados con el tráfico, la formación de profesionales con personas que sufrieron tal experiencia y la inserción de este asunto en las politicas de enfrentamento a la violencia contra la mujer.

Resumo No Canadá atual, as questões envolvendo o tráfico humano estão em alta na agenda pública. Uma variedade de atividades é incluída dentro dessa rubrica, incluindo a prostituição doméstica, na qual cruzar fronteiras nacionais ou internas não é um pré-requisito para como o Estado define o tráfico. O Canadá não está sozinho em sua definição expansiva de tráfico humano. Globalmente, trabalho sexual/prostituição, “tráfico sexual”, trabalho infantil, trabalho migrante infantil, e “escravidão moderna” são parte integral dos discursos hegemônicos sobre “os horrores” do tráfico humano. Neste artigo analiso três campanhas proeminentes que sustentam esse discurso e discuto algumas das ações que essas campanhas promoveram. Argumento que um exame mais detalhado deixa visível uma versão do século XXI do “fardo do homem branco” apoiado por interesses ocidentais, corporativos e neoliberais contemporâneos, através dos quais, a exploração e o abuso sem restrições da vida e da força dos/as trabalhadores/as continuam ocorrendo. Argumento que, ao invés de ir “ao fundo da questão”, os discursos dominantes sobre tráfico humano tendem a ofuscar problemas estruturais e a revitalizar o imperialismo de novas maneiras. Abstract In Canada today the issue of human trafficking is high on the public agenda. A variety of activities are included under the rubric, including “homegrown” or domestic prostitution, where crossing either national or internal borders is not a requisite for state definitions of trafficking. Canada does not stand alone in this attention for an expansive definition of human trafficking. Globally, sex work/prostitution, “sex trafficking,” child labour, undocumented migrant labour, and “modern slavery” are integral to hegemonic discourses on “the horrors” of human trafficking. In this paper I look more closely at three prominent campaigns that sustain this discourse and discuss some of the work that these campaigns do. I argue that a closer examination makes visible a twenty first century version of the “white man’s burden” supported by contemporary western, corporate, neoliberal interests, through which the unfettered exploitation and abuse of working people’s lives and labour continues. So, rather than getting to “the bottom of things,” I argue here that dominant discourses on human trafficking tend to obfuscate structural problems and revitalize imperialism in new ways.

Abstract The trajectories of migration and prostitution are embedded in representations of body, gender, sex and sexuality. This article seeks to understand the articulation between migration and sex work through the lens of gender. To this end, this article relies on a typological approach that aims to clear some ground in the ongoing debate on the issues of prostitution, sex trafficking and migration of sex workers. It explores the theoretical cross-contribution as well as the conceptual limitations of radical, liberal, post-colonial, critical and postmodern feminist perspectives on the issues of prostitution, sex workers’ mobility and sex trafficking. It gives special focus to the contributions of the postmodern feminist reading, especially by highlighting how it has challenged conventional feminist theories, hitherto grounded in dualistic structures. In fact, the postmodern feminist approach makes a stand against the simplistic dichotomies such as First/Third World, passivity/agency, vulnerability/empowerment, innocence/conscience, sexual trafficking/voluntary prostitution or ‘trafficked victim’/‘autonomous sex worker.’ As such, postmodern feminism disrupts all fixed demarcations and homogeneous forms of categorisation on which the dominant feminist theories were based, allowing thus for the emergence of new practices of subjectivity as well as new forms of flexible identities.

15. Queering the Debate: Analysing Prostitution Through Dissident Sexualities in Brazil

Abstract The aim of this article is to contrast prominent discourses on prostitution and human trafficking to the context of prostitution in Brazil and local feminist discourses on this matter, understanding their contradictions and limitations. I look at Brazilian transgender prostitutes’ experiences to address an agency-related question that underlies feminist theorizations of prostitution: can prostitution be freely chosen? Is it necessarily exploitative? My argument is that discourses on sex work, departing from sex trafficking debates, are heavily engaged in a heteronormative logic that might be unable to approach the complexity and ambiguity of experiences of transgender prostitutes and, therefore, cannot theorize their possibilities of agency. To do so, I will conduct a critique of the naturalization of gender norms that hinders an understanding of experiences that exceed the binary ‘prostitute versus victim.’ I argue how both an abolitionist as well as a legalising solution to the issues involved in the sex market, when relying on the state as the guarantor of rights to sex workers, cannot account for the complexities of a context such as the Brazilian one, in which specific conceptions of citizenship permit violence against sexually and racially marked groups to occur on such a large scale.
