Tendo em vista a postura crítica de Platão relativamenteà arte “mimética”, pode causar surpresa que quase todos osdiálogos dele se apresentem, não obstante a riqueza e a variedade do seu conteúdo doutrinal, também como criações literárias de caráter eminentemente artístico, ou seja, como produtos poeticamente bem organizados, e, enquanto tais, pertencentes exatamente àquela arte “mimética” que ele, Platão, considera tão nociva e perigosa que até recomenda proibir e bani-la da cidade. O que pode explicar essa aparente contradição é o fato de a crítica platônica visar nãosimplesmente qualquer forma de produção artística, mas, em primeiro lugar, o ofício duvidoso daquele tipo de artista que, por não ter acesso à esfera da verdade, trabalha como ilusionista e criador de meros fantasmas e, praticando esta “arte”, pretende fazer se passar por sábio e educador competente do povo. Para quem conseguiu, no entanto, diferentemente de tal “imitador de sombras”, deixar paratrás o mundo da ilusão e encontrar, ou, como o filósofo, construir o caminho para o verdadeiro saber, a arte mimética representa um recurso absolutamente legítimo, já que ela, neste caso, não se realiza mais em forma de uma “imitação” enganadora de determinados objetos, mas como reprodução dos mesmos de forma mais “correta” e mais fiel possível, constituindo, assim, um importante recurso para preparar e familiarizar o leitor com um modo particular de pensamentofilosófico, o que significa em Platão: demonstrar que, para ele, um dos motivos mais importantes consistiu em mostrar que Filosofia não se reduz ao mero conhecimento de certas doutrinas filosóficas, mas significa, em primeiro lugar, aprender filosofar., Considering Platos critical attitude in relation to “mimetic” arts, it may astonish that nearly all his dialogues, notwithstanding the richness and variety of their doctrinal contents, also represent literary creations of an eminently artistic character, so that they seem to belong, as poetically organized products, exactly to the kind of “mimetic” art that is taken by Plato to be so harmful and dangerous that he even recommends its prohibition and exclusion from the township. But this is merely an apparent contradiction, for Plato is critic not of every form of mimetic creation, but only with regard to the dubious business of a sort of artists that, in default of an access to the sphere of truth, create simple phantoms and illusions and pretend, by practicing this type of “art”, to be reputed to be wise and competent people-educators. But whoever, in contrast to such “imitator of shadows”, left behind the world of illusion and could find, like the philosopher, the way to real truth, is allowed and legitimated to make use of mimetic art, because in this case it is not more a question of “false imitation” of objects, but of reproducing them as “correct” and as “true” as possible, in order to prepare the readers in this way for a specific mode of philosophical thinking, what means in Plato: to demonstrate that one of his most important motives consisted in showing that philosophy means not only the knowledge of philosophical doctrines, but, in the first place, learning to philosophize.

Esta pesquisa tem como objetivo sustentar que o conceito de Sumo Bem engendra uma importante função dentro da totalidade sistemática da filosofia de Kant. Para tanto, nos pautamos, principalmente, em obras do próprio autor, e também em trabalhos de renomados estudiosos da filosofia kantiana. Ao longo deste estudo, foram expostos argumentos e contra- argumentos às posições apresentadas com o intuito de tornar a tese deste trabalho nítida, consistente e legítima. Para tanto, inicialmente são reconstruídos os principais argumentos de Kant a respeito de sua teoria crítico-transcendental, cujo propósito declarado fora empreender uma análise pormenorizada das capacidades cognitivas humanas e, consequentemente, demonstrar quais as condições possíveis para falarmos sobre o conhecimento humano de maneira legítima. Consequentemente são apresentados os argumentos e os elementos fundamentais de sua teoria moral, sobretudo o conceito de Sumo Bem, o qual é considerado pelo autor como o objeto incondicionado da razão pura, na medida em que reúne os conceitos cardeais da metafísica: Deus, imortalidade da alma e liberdade. O referido conceito é formado por dois elementos, a moralidade ou virtude, enquanto expectativa humana de ser moralmente feliz, e a efetivação da felicidade conforme seu mérito moral. Ademais, analisamos o princípio da conformidade a fins e a faculdade de julgar reflexionante através dos quais, de acordo com Kant, podemos pensar a natureza como se ela possuísse fins, ou seja, como se fosse organizada como um sistema orgânico vivo. Demonstrou-se que é também em virtude da faculdade de julgar reflexionante e de seu princípio a priori da conformidade a fins que pensamos o Sumo Bem como o fim terminal da natureza. Finalmente, apresenta-se a tese principal sustentada neste trabalho através de três argumentos: o primeiro afirma que o Sumo Bem é sistematicamente relevante para a totalidade do projeto filosófico de Kant, e não apenas para etapas específicas, como sua filosofia moral; o segundo que a importância sistemática desse conceito decorre do fato de que, através dele, o autor opera diferentes passagens e unidades em sua teoria filosófica; por fim, o terceiro argumento em favor da tese deste trabalho sustenta que a passagem mais importante operada pelo Sumo Bem diz respeito às diferentes etapas da exposição filosófica de Kant e que, assim, o autor lança nova luz à possibilidade da metafísica adquirir status filosófico-científico. The following research aims to support the idea that the concept of the Highest Good has an important role within the systematic totality of Kant‟s philosophy. For this purpose, we focus mainly on the works by the author himself as well as in studies of renowned scholars of the Kantian philosophy. Throughout this study, arguments and counter-arguments about the positions presented have been exposed with the intention of making the thesis of this work clear, consistent and valid. In order to do so, at first, Kant‟s main arguments about his critical- transcendental theory – which stated purpose was to undertake a detailed analysis of the human cognitive capacities, and thus to demonstrate the possible conditions for us to debate about the human knowledge in a legitimate way – were rebuilt. Therefore, the arguments and the key elements of his moral theory were presented, especially the concept of the Highest Good which is considered by the author as the unconditional object of pure reason as far as it brings together the cardinal concepts of metaphysics: God, immortality of the soul and freedom. The above-mentioned concept is formed by two elements, morality or virtue as the human expectation of being morally happy, and the establishing of happiness according to one‟s moral merit. In addition, we analyzed the principle of purposiveness and the power of reflective judgment through which, according to Kant, we can think of nature as having its own ends, in other words, as if it was organized as a living organic system. It has been shown that it is also due to the power of reflective judgment and its a priori principle of purposiveness that we think of the Highest Good as the final end of nature. Finally, the main thesis presented in this work is supported through three arguments: the first one affirms that the Highest Good is systematically relevant to the totality of Kant‟s philosophical project and not only to its specific stages, such as his moral philosophy; The second one is that the systematic importance of this concept arises from the fact that through it the author operates different passages and units in his philosophical theory; Lastly, the third argument in favor of the proposition of this research states that the most important passage operated by the Highest Good concerns the different stages of the philosophical exposition of Kant and that so the author sheds new light on the possibility of the metaphysics to acquire philosophical-scientific status.

This dissertation consists of an introductory presentation on "the problem of dysthanasia in the light of the current bioethical discussion", a specific theme of biomedical ethics. The analysis begins by exposing the context of medicine that, due to significant scientific advances, death is no longer a natural outcome and has become an enemy that must be overcome at any cost. The main objective of the research is to clarify what are the possible solutions in the case of moral dilemmas of dysthanasia. The most important discussion was the question about: to what extent can the doctor stay only on the basis of a deontological morality to define the best moral choice and what is the role of emotions for a truly moral action? The exhibition follows the following steps: As a point of reference, I analyze the perspective of the old deontological ethics in contrast to the new bioethical propedeutics, from a historical and conceptual contextualization of the central issues of bioethics, medical ethics and hypocratic ethics. I intend to show the different meanings or perspectives of a series of systematic questions that at first glance seems to suggest a discussion of practical questions of the application of certain rules, but it is not so easy to decide which reasons and criteria guarantee a certain form application, a concrete medical practice of a moral character. Second, I analyze philosophically the technoscientific, commercial-business and humanitarian paradigms as a way to better understand dysthanasia. Third, I present the fundamental perspective of current bioethics with an exposition of the new biomedical ethics and the relativization of hypocratic morals. Finally, even though there is still great difficulty in defining answers in this new perspective of bioethical investigation, I concluded by the need to respect the patient's right to autonomy, with emphasis on the substantial or evaluative aspects surrounding empathic engagement in the doctor-patient relationship. A presente dissertação consiste numa apresentação introdutória sobre "o problema da distanásia à luz da discussão bioética atual", temática específica da ética biomédica. A análise inicia expondo o contexto da medicina que, devido aos significativos avanços científicos, a morte deixou de ser um desfecho natural e transformou-se em inimiga que deve ser vencida a qualquer custo. O objetivo central da pesquisa é esclarecer quais as possíveis soluções no caso de dilemas morais da distanásia. Teve como discussão mais importante a questão sobre: até que ponto o médico pode ficar apenas na base de uma moral deontológica para definição sobre a melhor escolha moral e qual o papel das emoções para uma ação propriamente moral? A exposição segue as seguintes etapas: como ponto referencial, analisa-se a perspectiva da velha ética deontológica em contraponto com a nova propedêutica bioética, a partir de uma contextualização histórica e conceitual das questões centrais da bioética, ética médica e ética hipocrática. Pretende-se mostrar os diversos sentidos ou perspectivas de uma série de questões sistemáticas que, à primeira vista, parecem sugerir ser uma discussão de questões práticas da aplicação de certas regras, mas não é assim tão fácil decidir quais os motivos e critérios que garantam uma determinada forma de aplicação, uma concreta prática médica de caráter moral. Em segundo lugar, analisa-se filosoficamente os paradigmas tecnocientífico, comercialempresarial e humanitário como forma de melhor compreensão da distanásia. Em terceiro lugar, apresenta-se a perspectiva fundamental da bioética atual com exposição da nova ética biomédica e a relativização da moral hipocrática. Por fim, mesmo que ainda exista grande dificuldade em respostas definitivas nessa nova perspectiva da investigação bioética, conclui-se pela necessidade de respeito ao direito a autonomia do paciente, com ênfase nos aspectos substanciais ou valorativos em torno do engajamento empático na relação médico-paciente.

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPES The present thesis tries to offer an interpretation on the question of the improvement of the customs of the human race in the horizon of the Kantian practical philosophy. In this perspective, the idea is defended that there is a textual basis in Kant to base the belief in the improvement of the human race through the articulation of two fundamental points: education and enlightenment. At first, we try to defend the idea that the Enlightenment movement has a unity and that it will directly influence the flowering of Kantian enlightened thought. Thus, it is understood that the critical use of reason added to the defense of freedom and autonomy are the fundamental elements to size the illustrated movement and that will influence Kant in the construction of his positioning before the enlightenment. In the sequence, an interpretation will be presented on the meaning of Aufklärung in Mendelssohn and Kant. Thus, it seeks to support a line of argument that indicates the relationship between enlightenment and the proposal of education advocated by Kant, given that its educational proposal is an important element within the clarification since, through it, conditions for the individual to reach autonomy. In order to systematize the discussion, in the third moment, we will present the four purposes of education thought by Kant, because it is understood that, through an appropriate pedagogical method, it becomes possible to prepare the individual to exercise his moral autonomy. Lastly, the last chapter presents the relationship between education and enlightenment and how belief in the improvement of customs can be sustained. The thesis has, on the one hand, the objective of reconstructing the Kantian argument regarding enlightenment, and, on the other hand, to demonstrate the importance of education in the search for adulthood. In this way, the idea is maintained that it is from the articulation between education and enlightenment that it is possible to defend the idea of the improvement of manners of the human race. A presente tese procura oferecer uma interpretação acerca da questão do melhoramento dos costumes do gênero humano no horizonte da filosofia prática kantiana. Nessa perspectiva, advoga-se a ideia de que há uma base textual em Kant para fundamentar a crença no melhoramento do gênero humano mediante a articulação de dois pontos fundamentais: educação e esclarecimento. Em um primeiro momento, busca-se defender a ideia de que o movimento iluminista possui uma unidade e que essa influenciará diretamente o florescimento do pensamento ilustrado kantiano. Assim, entende-se que o uso crítico da razão somado à defesa da liberdade e da autonomia são os elementos fundamentais para dimensionar o movimento ilustrado e que vão influenciar Kant na edificação de seu posicionamento frente ao esclarecimento. Na sequência, apresentar-se-á uma interpretação sobre o significado de Aufklärung em Mendelssohn e Kant. Assim, busca-se sustentar uma linha de argumentação que indique a relação entre o esclarecimento e a proposta de educação defendida por Kant, dado que a sua proposta educacional figura como um elemento importante dentro do esclarecimento, uma vez que, através dela, criam-se condições para que o indivíduo chegue à autonomia. Para sistematizar a discussão, no terceiro momento, apresentar-se-ão as quatro finalidades da educação pensadas por Kant, pois se entende que, através de um método pedagógico apropriado, torna-se possível preparar o indivíduo para exercer a sua autonomia moral. Por fim, no último capítulo, apresenta-se a relação entre educação e esclarecimento e o modo como pode ser sustentada a crença no melhoramento dos costumes. A tese tem, por um lado, o objetivo de reconstruir a argumentação kantiana referente ao esclarecimento e, por outro, demonstrar a importância da educação no tocante à busca da maioridade. Desse modo, sustenta-se a ideia de que é a partir da articulação entre educação e esclarecimento que seja possível defender a ideia do melhoramento dos costumes do gênero humano.

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPES The present thesis aims to propose the rescue of the concepts of duty and of universalism in the perspective of a naturalistic ethics from the contemporary reading of the moral works of David Hume. It follows the hypothesis that there is textual basis in Hume for the defense of a moral theory with pretension to universality from the idea of a shared human nature and the role of reason, next to the sensibility, in our moral judgments. We have a common structure that allows us to communicate our feelings and moral judgments through a standard language, however, the naturalization of moral concepts through the sensitivity has as a burden of the recognition of a certain contingency usually associated with empiricism. However, we argue that this contingency should not be an impediment to normativity. In this sense, there are already elements in the Humean moral for the defense of a duty that arises from the mutual expectations that we have. These expectations are based on our feelings, but also depend on our ability to reflect. The general structure of the text will be as follows: we will present some considerations of modern morality by showing that Hume must be comprehended like a defender of a harmonious view of reason and sensibility. Next, we will present the natural and artificial virtues that are perceptions of the mind and it concerns the character traits of moral agents. In this sense, moral judgments refer not to actions, but to character. The third chapter presents an analysis of the debate about the is-ought problem that reappears with MacIntyre. The aim is to question the classical interpretation of this passage and to show that Humean morality is compatible with the idea of moral duties and that its criticism concerned modern intuitionist rationalism and religious morals. Without further impediments to the establishment of a notion of duty, we will seek in the next chapter textual basis for the universalistic aspects of Hume's morality, mainly considering the idea of a shared human nature and a language that reflects our sensitivity. In the final chapter, we will point out some contemporary moral theories that present an idea of normativity based on the notion of “common point of view”, whose idea of duty refers to the human point of view that is sensitive, reflective, and capable of improvement. A presente tese tem como objetivo propor o resgate dos conceitos de dever e de universalismo na perspectiva de uma ética naturalista, a partir da releitura contemporânea das obras morais de David Hume. Segue-se a hipótese de que há base textual em Hume para a defesa de uma teoria moral com pretensão à universalidade a partir da ideia de uma natureza humana compartilhada e do papel da razão, junto à sensibilidade, em nossos juízos morais. Possuímos uma estrutura comum que nos permite comunicar nossos sentimentos e juízos morais através de uma linguagem padrão, todavia, a naturalização de conceitos morais pela via da sensibilidade tem como ônus o reconhecimento de uma determinada contingência, geralmente associada ao empirismo. Contudo, defendemos que essa contingência não deve ser um impedimento à normatividade. Nesse sentido, encontram-se já na moral humeana elementos para a defesa de um dever que surge das mútuas expectativas que possuímos. Essas expectativas são calcadas em nossos sentimentos, mas dependem também de nossa capacidade reflexiva. A estrutura geral do texto será a seguinte: apresentaremos algumas considerações sobre a moral moderna, evidenciando que Hume deve ser visto como um defensor de uma visão harmônica entre a razão e a sensibilidade. A seguir, apresentaremos as virtudes naturais e artificiais que são percepções da mente e dizem respeito aos traços de caráter dos agentes morais. Nesse sentido, os juízos morais referem-se não às ações, mas ao caráter. O terceiro capítulo apresenta uma análise do debate sobre o is-ought problem, que ressurge com MacIntyre. O objetivo é questionar a interpretação clássica desta passagem e mostrar que a moral humeana é compatível com a ideia de deveres morais, e que sua crítica diz respeito ao racionalismo intuicionista moderno e às morais religiosas. Sem maiores impeditivos para o estabelecimento de uma noção de dever, buscaremos evidenciar, no capítulo quatro, a base textual para os aspectos universalistas da moral de Hume, considerando principalmente a ideia de uma natureza humana compartilhada e de uma linguagem que reflete nossa sensibilidade. No capítulo final, apontaremos teorias morais contemporâneas que apresentam suas propostas normativas a partir da noção de “ponto de vista comum [common point of view]”, segundo a qual, a ideia de dever reporta-se ao ponto de vista humano, que é sensível, reflexivo e passível de aprimoramento.

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPES The main objective of this dissertation is to understand the classification of juridical laws in the ambit of moral laws, proposed by Kant, in order to investigate what this classification represents to think the relation between moral and law. With the intention to reach this aim, the master work presents, first, a contextualization of morality and right, and their respective laws, with the purpose of demonstrating why this classification is intriguing. After, the concept of moral laws and juridical laws is presented, from the bibliographic review of the Kantian works, mainly of The Metaphysics of Morals with the perspective of understanding the definition of these laws and the role attributed to them. This stage is importante, as far as allows to comprehend how juridical laws can be a subclass of moral laws, and the relation of these laws with the freedom. Posteriorly, the dissertation focuses on analyzing the role and the emergence of juridical law in the scope of right, in order to understand how it can have a function related to legality and morality concomitantly. From this exposition it is possible to include the role of juridical law in relation to freedom. After this stage, the máster work presents the study of some principles that grounds the duties of law, approaching its relation with the juridical law, as well as, exposes the constituent elements of the rule of law, with the purpose of proving how the right and the juridical law are related to freedom and, as this tends to a moral perspective. From this process it is possible to conclude that the term moral laws is also called the laws of freedom, since it refers to the laws in which freedom is possible. Thus, it can be understood that juridical law has peculiar characteristics that aim to allow freedom, and this factor permit to contain it as a subclass of moral laws, even though it is also a law that requires legality, not morality. The research also allows to conclude that juridical law and law are related to a problem that is political, but also, moral, because, they treat of question of human will, and therefore, the classification of the juridical laws within the scope of the moral laws can be justified. Besides these results, it is also possible to understand that not only the juridical law, but also the right, have a role with respect to freedom. These premises allowed to conceive that the classification of the juridical laws in the scope of the moral laws, represents that this law and the right must allow the realization of the freedom. And the purpose of this claim is that the rule of law is a space in which the moral dispositions of individuals can be developed. O presente trabalho tem como objetivo principal compreender a classificação das leis jurídicas no âmbito das leis morais, proposta por Kant, a fim de investigar o que essa classificação representa para pensar a relação entre moral e direito. Com o propósito de atingir essa finalidade, o trabalho apresenta, primeiramente, uma contextualização da moral e do direito e de suas respectivas leis, com a intenção de demonstrar porque essa classificação é intrigante. Posteriormente, apresenta-se o conceito de leis morais e de lei jurídica, a partir da revisão bibliográfica das obras kantianas, principalmente da Metafísica dos Costumes (2013), na perspectiva de entender a definição dessas leis e o papel atribuído a elas. Essa etapa é importante na medida em que permite compreender como a lei jurídica pode ser subclasse das leis morais, e a relação dessas leis com a liberdade. Após, o trabalho enfoca na análise do papel e do surgimento da lei jurídica no âmbito do direito, a fim de compreender como ela pode ter uma função relacionada à legalidade e à moralidade concomitantemente. A partir desta exposição é possível compreender o papel da lei jurídica com relação à liberdade. Finda esta etapa, o texto apresenta o estudo de alguns princípios que fundamentam os deveres de direito, abordando a sua relação com a lei jurídica, bem como expõe os elementos constituintes do estado de direito, a fim de comprovar como o direito e a lei jurídica se relacionam com a liberdade e como isso tende a uma perspectiva moral. A partir desse processo é possível concluir que o termo “leis morais”, é chamado também de “leis da liberdade”, visto que faz referência às leis nas quais a liberdade é possível. Com isso, pode-se compreender que a lei jurídica possui características peculiares, que visam permitir a liberdade, e esse fator permite compreendê-la como subclasse das leis morais, mesmo que ela também seja uma lei que exige legalidade, e não moralidade. A pesquisa também permite concluir que a lei jurídica e o direito estão relacionados com um problema que é político, mas, também, moral, pois, tratam da questão do arbítrio humano, e em função disso, a classificação das leis jurídicas no âmbito das leis morais pode ser justificada. Além destes resultados, também é possível compreender que a lei jurídica e o direito possuem um papel com relação a liberdade. Tais premissas permitiram conceber que a classificação das leis jurídicas, no âmbito das leis morais, indica que esta lei e o direito devem permitir a realização da liberdade. E, a finalidade desta pretensão, é que o estado de direito seja um espaço em que as disposições morais dos indivíduos possam ser desenvolvidas.

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior The following thesis aims at offering a broad and systematic interpretation of the doctrine highest good. Based on that, we defend that the idea of highest good represents a necessary complement to Kant‟s moral theory. In order to defend that, it is needed to present the context in which the idea of highest good is introduced by Kant, observing that in this period there was no moral theory itself yet, which was based on the autonomy of the will. It is important to emphasize that both during development and among the different phases of critical philosophy the idea of highest good has been there. Thus, it is essential to analyze the relationship between the idea of highest good and the theory of morality, taking into consideration that sometimes the concept seems to be unstable regarding the foundations of the moral theory. It happens that, although the concept or idea of highest good has already its legitimacy ensured since the beginning of critical period, it is from a practical perspective of reflective judgment that it will become an essential part of the moral theory and of the architectonic of pure reason. On one hand, the following thesis has the objective of rebuilding Kant‟s argumentation regarding the idea of highest good during the critical period and, on the other hand, showing that the concept of highest good does not compromise the fundamental principle of morality. Besides that, considering that the idea of highest good is constantly retaken by Kant himself in his critical philosophy, we defend that the highest good not only has an assured place, but a privileged one in moral philosophy. Even though the highest good is an object of faith for practical pure reason moral it theologically complements moral theory representing pure reason ultimate goal for rational human beings. A presente tese procura oferecer uma interpretação abrangente e sistemática da doutrina do sumo bem. Nessa perspectiva, defende-se que a ideia do sumo bem representa uma complementação necessária à teoria moral kantiana. Para tal empreendimento faz-se necessário apresentar o contexto no qual a ideia do sumo bem é introduzida por Kant, observando que nesse período ainda não existia uma teoria moral propriamente dita, baseada na autonomia da vontade. Cabe ressaltar que tanto no desenvolvimento quanto nas diferentes etapas da filosofia crítica a ideia do sumo bem esteve presente. Com efeito, torna-se imprescindível analisar a relação entre a ideia do sumo bem com a teoria da moralidade, tendo em vista que em alguns momentos esse conceito parece instável no tocante à fundamentação da teoria moral. Ocorre que, embora o conceito ou ideia de sumo bem já tenha a sua legitimidade assegurada desde o início do período crítico, é a partir de uma perspectiva prática da faculdade de julgar reflexionante que ele passa a se constituir como uma parte indispensável da teoria moral e da arquitetônica da razão pura. A tese tem, por um lado, o objetivo de reconstruir a argumentação kantiana referente à ideia do sumo bem no período crítico e, por outro lado, demonstrar que essa ideia do sumo bem não compromete o princípio fundamental da moralidade. Além disso, visto que a ideia de sumo bem é constantemente retomada pelo próprio Kant em sua filosofia crítica, defende-se que a ideia do sumo bem não somente tem um lugar assegurado, mas um lugar privilegiado na filosofia moral. Mesmo que o sumo bem seja um objeto de fé da razão prática pura moral ele complementa teleologicamente a teoria moral representando o fim último da razão pura para os seres racionais humanos.

The strategy adopted by the author starts by defining what the Beauty is not (in this case, a judgment of knowledge). Among other things, the complacency in Beauty is distinguished from complacency in Good, being the former disinterested, whereas the latter has an interest in the existence of the judged object. This difference is already made in the opening paragraphs of the first book of the Analytic of the Beauty. Nevertheless, insofar as Kant advances in his analysis of the feeling of the Beauty (and later, the Sublime), the author suggests that the separation between an aesthetic judgment (of the Beauty) and a moral judgment (of the Good) is not necessarily abrupt and sometimes such judgments constitute an ambiguous relationship. The work to be done intend to investigate the sinuosity of the Kantian discourse developed along the third Critique about the problem of the Beauty and the Good, especially the apparent change in Kant s argument at the §§16 and 17, and affirmation of the "Beauty as a Symbol of Morality" [KU, B253] in § 59 of this book. Na Crítica da Faculdade do Juízo Kant preocupa-se com o problema da filosofia transcendental do Belo, buscando a possibilidade de um juízo estético universalmente válido, a priori e necessário. A estratégia adotada pelo autor inicia por definir o que o Belo não é (no caso, um juízo de conhecimento). Dentre outras coisas, distingue-se o comprazimento no Belo do comprazimento no Bom, sendo aquele desinteressado, ao passo que este contém um interesse na existência do objeto ajuizado. Esta diferença é feita já nos parágrafos iniciais do primeiro livro da Analítica do Belo. Não obstante, na medida em que Kant avança em sua análise sobre o sentimento do Belo (e posteriormente, do Sublime), o autor deixa transparecer que a separação entre um juízo estético (do Belo) e um juízo moral (do Bom) não é necessariamente abrupta e, por vezes, tais juízos constituem uma relação ambígua. Systems theory has widely circulated in the past half century, with contributions from biology, cybernetics and mathematics. Luhmann rejects the old tradition based on ontological concepts, the notion of system as a whole composed of parts, the search for the essence of the elements. In exchange initially proposes a systems theory that is guided by the distinction between system and environment. In its mature phase designs functionally differentiated social systems, autopoietic, self-reference and endowed with meaning. The first chapter will be devoted to the presentation of the evolution of systems theory, elements that are common to any social system and to question the place of the subject in theory luhmannian. The second chapter is devoted to communication, synthesis of information, the act of communicating and the act of understanding. Communication is the basic operation of social systems. We'll see how the contact with the psychic and living systems. The third chapter is devoted to the law. This subsystem has the social function of generating expectations of conduct. The self-reference, autopoiesis and select the legal operations of non-legal. The binary code legal / illegal conduct legal communication and indicates the pipes that are nonconforming or conforming to the law. O presente trabalho possui o objetivo de apresentar alguns elementos centrais da teoria dos sistemas de Niklas Luhmann. A teoria dos sistemas possui grande difusão na metade do século passado, com contribuições da biologia, da cibernética e da matemática. Luhmann rechaça a tradição vétereo-européia baseada nos conceitos ontológicos, na noção de sistema como todo composto de partes, na busca da essência dos elementos. Em troca propõe inicialmente uma teoria dos sistemas que se pauta pela diferenciação entre sistema e entorno. Na sua fase madura concebe os sistemas sociais funcionalmente diferenciados, autopoiéticos, autorreferenciais e dotados de sentido. O primeiro capítulo será dedicado à apresentação da evolução da teoria dos sistemas, dos elementos que são comuns a qualquer sistema social e à pergunta pelo lugar do sujeito na teoria luhmanniana. O segundo capítulo é dedicado à comunicação, síntese da informação, do ato de comunicar e do ato de entender. A comunicação é a operação elementar dos sistemas sociais. Veremos como ocorre o contato com os sistemas psíquicos e vivos. O terceiro capítulo é dedicado ao direito. Esse subsistema social possui a função de gerar expectativas de conduta. A autorreferência e a autopoiésis selecionam as operações jurídicas das não-jurídicas. O código binário legal/ilegal conduz a comunicação jurídica e indica as condutas que são conformes ou desconformes ao direito. A recursividade das operações e a memória do direito, através da positividade e das reiteradas decisões, reforçam esse subsistema normativo. A obra de Luhmann é vasta, possuindo diversas referências à tradição da filosofia e sociologia, da mesma forma que se apropria de elementos das ciências exatas e biológicas. É possível encontrar nesse autor duas fases de referência em suas obras. O marco de divisão ocorre com a introdução do conceito de autopoiésis, resgatado da teoria de Maturana, e a concepção de autorreferência e funcionalidade. Por tudo isso, a teoria desenvolvida por Luhmann se mostra extremamente interessante e complexa.

Conselho Nacional de Desenvolvimento Científico e Tecnológico This dissertation aims to explain and discuss the Kantian proposal regarding the grounds of moral action from the pure practical reason, and the relationship between these grounds and the "moral sense", i.e., the feeling of "respect". Thus, it is presented the reconstruction of the Kantian argumentation concerning the problem of objective validity of the moral law as a determinant of human will, as well as an analysis of the respective sections of the Groundwork of the Metaphysics of Morals and the Critique of Practical Reason, which present the Kant's arguments concerning the relation between the moral law and the feeling of respect, as a central figure to the practice of this law. In order to do so, the first chapter deals with a terminological analysis of the concept of feeling of Respect, distinguishing it from the conception of moral sense and the feeling of happiness. In the second chapter it is intended to show how the moral law can be realized in the hearts of a finite rational human being like a man, in view of the issue of moral motivation and the systematic link between the feeling of respect and the moral law. Finally, in the third chapter, the dissertation addresses the relationship between the feeling of respect and the fact of reason. A presente dissertação tem como objetivo principal explicitar e discutir a proposta kantiana quanto à fundamentação do agir moral a partir da razão prática pura, e a relação desta fundamentação com o chamado sentimento moral , i.e., o sentimento do respeito . É neste caminhar debaixo para cima, quer dizer desde a abstração do direito privado até atingir a super-estrutura necessária do Estado que procuraremos reavaliar um conceito subjacente ao âmbito da instituição essencialmente política, um conceito chave que foi herdade de Rousseau: é a noção de vontade geral. Para tanto uma revisão das premissas do Contrato Social devem fazer jus para uma devida confrontação com a visão de Hegel que assume outra perspectiva e adota uma leitura diversa da de seu antecessor francês. A formulação do problema, portanto, será nesta pesquisa revisada e refletida procurando apreender a diferença nos dois autores o que implicará a retomada de noções tais como liberdade, contrato, liberalismo e, essencialmente da figura do Estado nos conduzindo a uma conclusão que procura cavoucar o significado da expressão no contexto da Filosofia do Direito, aparentemente obscura e pouco aprofundada.

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior This master thesis aims at reconstructing the Kantian concept of the Highest Good (höchstes Gut) since its presentation in the Critique of pure reason`s Transcendental doctrine of method (1781), passing by Groundwork of the metaphysic of morals (1785) and the Critique of practical reason (1788), until the preface of The religion within the limits of reason alone (1793). We intend here to clarify the definition that Kant presents about the concept of the Highest Good, as well as its relation with morality. That way, we maintain that in the development of the critical philosophy Kant presented different perspectives about the Highest Good, taking into account the different meanings this concept has in Kant. The same applies to Kant s conception of the foundations of moral, considering that his arguments in different stages of the critical philosophy sometimes are unstable about the determination of the origin of the moral law. Thus, it is necessary to analyze the relation of morality to the Highest Good, because it is an extremely important element of this concept. After clarifying this relation, we approach the question, linked to Highest Good and morality, about how happiness can be an element of the concept of such object without compromising its characteristic of originating from pure rational will. Furthermore, we approached the problem of the importance of the Highest Good for Kant`s practical philosophy. We take the doctrine of the practical reason`s postulates as relevant to this question. Finally, we go into Kant`s philosophy of religion in which the concept of the Highest Good seems to adopt an anthropological character, representing the final end that rational human beings aim to attain. Este trabalho consiste em uma reconstrução do conceito kantiano de Sumo Bem (höchstes Gut) desde sua apresentação na Doutrina transcendental do método da Crítica da razão pura (1781), perpassando pela Fundamentação da metafísica dos costumes (1785) e a Crítica da razão prática (1788), até o prefácio de A religião nos limites da simples razão(1793). Busca-se aqui, esclarecer a definição que Kant apresenta do conceito de Sumo Bem, assim como, de sua relação com a moralidade. Nesse sentido, observa-se que no desenvolvimento da teoria crítica, Kant expõe diferentes perspectivas a respeito do Sumo Bem, merecendo, por isso, atenção aos distintos significados usados desse conceito. O mesmo ocorre com a compreensão que ele possui da fundamentação moral, tendo em vista que sua argumentação nas diferentes etapas da filosofia crítica, por vezes, se revela instável no tocante à determinação da origem da lei moral. Por isso, faz-se necessário analisar a relação da moralidade com o Sumo Bem, uma vez que ela consiste num elemento extremamente relevante para esse conceito. Tendo esclarecida essa relação, aborda-se a questão vinculada ao Sumo Bem e a moralidade acerca de como a felicidade pode compor o conceito de tal objeto sem comprometer sua característica de ter origem na vontade racional pura. Ademais, aborda-se o problema referente à importância do Sumo Bem à filosofia prática de Kant. Para tanto, toma-se a doutrina dos postulados práticos como relevantes para a tentativa de solucionar essa questão. Por fim, adentra-se na filosofia da religião de Kant em que o conceito de Sumo Bem parece adquirir caráter antropológico, tendo em vista que ele representa o fim último da razão pura que os seres humanos racionais visam alcançar.

Through this, it was noted the importance of the role of women in society that led the images of your body dressed result in social transformations and in Visual Arts. With these questionings, I put in question the symptoms that are present in contemporary art related to the female body and I exemplify with works of women artists that discuss their own body stripped within contemporary society. To address issues on the body alive in art, the artists make questions about body art, the trivialization of women's image, sharp and seductive objects, performance and technology, placing the female body in debate. Esta pesquisa busca apresentar reflexões sobre o corpo feminino como objeto na arte contemporânea e alguns questionamentos dentro da história que levaram a esta denominação. Por meio disto, procurei ressaltar a importância do papel da mulher na sociedade, na qual teve as imagens de seu corpo vestido acarretar em transformações sociais e nas artes visuais. Com estes questionamentos, coloco em questão sintomas que estão presentes na arte contemporânea relacionados com o corpo feminino e exemplifico com obras de artistas mulheres que problematizam assim seu próprio corpo despido dentro da sociedade contemporânea. Ao tratar de questões sobre o corpo vivo na arte, as artistas tecem questões sobre a body art, a banalização da imagem da mulher, objetos cortantes e sedutores, performances e tecnologia, colocando assim o corpo feminino em debate.

Its objective is to demonstrate that the theme of Universal History possesses transcendental legitimacy, that is to say it can be seen from the horizon of the Copernican Revolution of thinking. In the first chapter, the nature of the project of a Universal History is characterized and it is sustained that the reflections about history form a unitary and coherent doctrine. In the second chapter, the transcendental legitimacy of the notion of teleology is reconstructed from the Critique of Judgement and it is shown how teleology determined the conception of history. In the last chapter, it is defended that Universal History should be seen as a response to the question what may I hope? and, consequently, as founded on a particular human interest of reason. Este trabalho de mestrado aborda o problema da fundamentação de uma História universal sobre as bases do sistema crítico-transcendental kantiano. Seu objetivo é mostrar que o tema da história possui legitimidade transcendental, isto é, que ele pode ser visto a partir do horizonte da revolução copernicana do pensamento. No primeiro capítulo, caracteriza-se a natureza do projeto de uma História universal e sustenta-se que as reflexões sobre a história formam uma doutrina unitária e coerente. No segundo capítulo, reconstrói-se, a partir da Crítica da faculdade do juízo, a legitimidade transcendental da noção de teleologia e se mostra como ela determina a concepção de história. No último capítulo, defende-se que a História universal deve ser vista como uma resposta à pertunta que me é permitido esperar? e, por conseguinte, como fundada sobre um particular interesse da razão humana.

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior This dissertation aims to present a reconstruction of the concept of happiness in the practical philosophy of Kant. This theme is not restricted to only one work in Kant, rather it appears in several: in The Critique of Practical Reason (CRPr), in The Groundwork of Metaphysics of Morals (FMC), in The Metaphysics of Morals (MC), in The Anthropology from a Pragmatic Point of View (A), and, inclusively, in The Critique of Pure Reason (CRP). The first section of the dissertation gives a brief exposition of the moral rule and the practical principles of acting, in an attempt to elucidate the concept of autonomy of will, which is fundamental for the justification of morality, and without which man could not be thought of as an end in himself. This is followed by an elaboration on the conception of happiness as empiric satisfaction, which tends to justify, on the one hand, why Kant excludes it in that which concerns the justification of moral acting; and on the other hand, why its presence or absence can assist or hinder the achievement of moral duty. Subsequently, from a criticalsystematic perspective, and based on the analysis of the concept of summum bonum, considered to be the a priori object of morality, an effort is made to show the systematic function of happiness in the context of practical Kantian philosophy. At this point, the issue that surfaces is: though happiness cannot exert any role in that which concerns moral justification, it, nevertheless, becomes an element of extreme importance in the effectuation or possible realization of morality. From there, why Kant does not exclude it definitively, although he does not give it the same focus that the philosophical tradition had given it until then. When one thinks of the perfect good for a rational being, happiness should be included as well, but under the condition of worthiness. Happiness, from this point of view, no longer consists of the satisfaction of necessities, tendencies and human impulses, but is merely a concept of the moral world. A Dissertação busca apresentar uma reconstrução do conceito de felicidade na Filosofia prática de Kant. O tema não se restringe em Kant a uma só obra, pois comparece em várias: na Crítica da razão prática (CRPr), na Fundamentação da metafísica dos costumes (FMC), na Metafísica dos costumes (MC), na Antropologia de um ponto de vista pragmático (A), e, inclusive, na Crítica da razão pura (CRP). A parte inicial da Dissertação consiste em uma breve exposição sobre a regra moral e os princípios práticos do agir, e nela se busca esclarecer o conceito de autonomia da vontade, imprescindível para a justificação da moralidade, e sem o qual o homem não poderia ser pensado como um fim em si mesmo. Na seqüência, a exposição se reporta à concepção de felicidade enquanto satisfação empírica, e tende, por um lado, a justificar por que Kant a exclui no que diz respeito à justificação do agir moral; por outro, por que a sua presença ou falta pode auxiliar ou prejudicar o cumprimento do dever moral. Num terceiro momento, dentro de uma perspectiva críticosistemática, e a partir da análise do conceito de sumo bem (summum bonum), tido como o objeto a priori da moralidade, busca-se mostrar a função sistemática da felicidade no contexto da filosofia prática kantiana. Nesse momento, a questão que se impõe é a seguinte: embora a felicidade não possa exercer papel algum no que diz respeito à justificação moral, torna-se, no entanto, um elemento de extrema importância na efetivação ou possível realização da moralidade. Daí por que Kant não a exclui definitivamente, embora não lhe dê o mesmo enfoque que a tradição filosófica lhe dera até então. Quando se pensa o bem perfeito para um ser racional, nele deve estar incluída também a felicidade, mas sob a condição de merecimento. A felicidade, por esse ponto de vista, passa então a não mais consistir na satisfação das necessidades, tendências e impulsos humanos, mas simplesmente a se constituir em um conceito do mundo moral.

During the seventies, it is possible to verify the arising of a set of works characterized by a tendency on recovering aesthetic elements and values from Romanticism in East-Germany Literature. That country lived under the Socialism imposed by force by the USSR, and the State exerted strong oppression, censorship and repression over people, and also imposed a realistically-based program to be followed by the writers, in order to consolidate the ideological principles of the regime the Socialist Realism, created departing from Georg Lukács conceptions on realism. In response to this context, some literary works can be considered as assuming the role of resistance, by the adoption of non-mimetic forms and techniques of writing. In this sense, this thesis aims at doing a comparative analysis between Christa Wolf s novel Kein Ort. Nirgends and Ulrich Plenzdorf s novel Die neuen Leiden des jungen W., focusing on the possible role of themes as subjectivity, melancholy and turn to past to the political and social aspirations proper of the writers vinculated to this literary tendency. The concept of Romanticism must be understood according to the particular historical meanings resulting with regard to the discussion on cultural and literary heritage. Christa Wolf s, Bertolt Brecht s, Theodor Adorno s, Walter Benjamin s and Anatol Rosenfeld s essays constitute the main critical and theoretical approach used to base this research Durante a década de 70, verifica-se na literatura da República Democrática Alemã (RDA) o surgimento de um conjunto de obras caracterizadas pela retomada de elementos e valores referentes ao período romântico alemão. O país vive sob o Socialismo imposto à força pela URSS, e o Estado exerce sobre o povo forte opressão, censura e repressão, além de impor um programa de base realista a ser seguido pelos escritores, com o fito de consolidar os princípios ideológicos do regime o Realismo socialista, criado a partir das concepções de realismo de Georg Lukács. Em resposta a esse contexto, pode-se considerar que algumas obras literárias funcionam como resistência, ao adotar formas e técnicas não miméticas de escrita. Neste sentido, a presente dissertação visa a realizar uma análise comparativa entre os romances Kein Ort. Nirgends, de Christa Wolf e Die neuen Leiden des jungen W., de Ulrich Plenzdorf, tendo em vista o possível papel de temas como a subjetividade, a melancolia e o voltar-se para o passado para as aspirações político-socias dos escritores vinculados à referida tendência literária. O conceito de Romantismo deve ser entendido de acordo com os significados históricos particulares resultantes em função da discussão em torno da herança cultural e literária. The aim of this dissertation is to reconstruct the concept of radical evil (das radikale Böse) treated by Kant in his writing On the radical evil in human nature (Über das radicale Böse in der menschlichen Natur), which was published in 1792. Starting from the data provided by this text, the terms in which Kant discusses both the problem of moral evil in the proper sense (conceived as radical), and the possibility of a human progress with regard to morality, are explicated. In that thematic, Kant introduces some concepts which pertain exclusively to the question of evil, among them, the concept on intention (Gesinnung), the concepts of inclination towards the evil (Hang zum Bösen) and of disposition to the good (Anlage zum Guten), also the ideas of revolution and gradual reform (as means to realize moral progress), and finally a new definition of nature. Even if it uses its proper terms, the writing on the evil keeps many basic concepts which Kant had introduced in earlier writings. For this reason, the dissertation does not limitate itself to the writing On the radical evil, but also treats of other kantian works, which serves two purposes: first, an explicative one, clarifying questions already well established in kantian philosophy; and secondly, a comparative one, both in relation with terms which receive a different meaning, and with regard to changes of the claims made, which reflect the new context and follow a different configuration. This is the horizon which the present dissertation is itended to reconstruct and within which it locates itself. Regarding the question of the evil (and its qualification as radical), various other questions are discussed in a specific manner, for instance, the origin of evil, the responsibility of man for its existence, the notions of virtue (both in the moral and in the legal sphere), the concept of evil action, the idea of moral education, and finally, the function of religion as supporting and stabilizing good moral conduct. These questions were harmonized as far as possible, and reconstructed from the point of view which caracterizes kantian philosophy: the critical-systematic point of view. A presente Dissertação é uma reconstrução do conceito de mal radical (Radicale Böse) tratado por Kant em seu artigo Sobre o mal radical na natureza humana (Über das radicale Böse in der menschlichen Natur), publicado em 1792. A partir dos dados desse texto o que se fez foi explicitar em que termos Kant aborda tanto a questão do mal moral propriamente dito (concebido posteriormente como radical), como também a da possibilidade de um progresso humano no que tange à moralidade. Nessa tratativa, Kant introduz algumas noções que são exclusivas à problemática do mal, entre elas, o conceito de intenção (Gesinnung), as noções de propensão para o mal (Hang zum Bösen) e de disposição para o bem (Anlage zum Guten), também as idéias de revolução e de reforma gradual (como meios de se alcançar o progresso moral), e, enfim, uma nova definição de natureza. Embora se sirva de termos exclusivos, o artigo sobre o mal mantém muitas das noções básicas desenvolvidas por Kant em obras anteriores. Daí porque a Dissertação não se restringe ao artigo Sobre o mal radical, mas se estende por outras obras em busca de recorrências feitas com dois objetivos bem precisos: um, elucidativo, em que se apresenta questões já plenamente consolidadas na filosofia kantiana; outro, comparativo, seja em relação a termos que adquiriram um sentido distinto, seja em vista de alterações propositivas, repensadas diante de um novo contexto e submetidas a uma nova configuração. Esse é o horizonte que esta Dissertação busca reconstruir e dentro do qual se insere. Relativo à questão do mal (e de seu qualificativo de radical), várias outras questões são tratadas de modo específico, por exemplo, a origem do mal, a imputabilidade do homem pela sua existência, as noções de virtude (concebidas tanto no domínio moral quanto no campo legal), o conceito de ação viciosa, a idéia de uma educação moral e, além dela, a função da religião como fomentadora e mantenedora de uma boa conduta moral. Essas questões, na medida do possível, foram harmonizadas entre si e reconstruídas pelo ponto de vista próprio da filosofia de Kant: o crítico-sistemático.

Probably the fundamental issue about the relation between art and beauty in the Critique of the Power of Judgment, of 1790, is the difficulty to recognize an object as a work of art (across a concept of art) and the judgment of taste, which when considered as pure cannot possess concepts that determine the object. Nevertheless, there does not seem to be another experience such as the experience of beauty for the recognition of beautiful artwork. Thus, it becomes necessary to explore the points of convergence between a production oriented to ends and the production of a beautiful object, considering, despite what has just been said, that the "concept" of work of art is different from any concept that could be considered to be an end of an intentional act. Along this dissertation we propose to explore the relations between the practice of genius and taste, as regulators of the artistic production, recognition and valuation of the works of art. We will consider for it, the possible rules of the genius, trying to isolate the formal and content aspects of the object. With this intention, we will depart from the classification of the works of art as forms of expressiveness, similar to the language, trying to show the weaknesses of any classic aesthetic norm in the establishment of rules of connection between forms and contents. Nevertheless, also we will evaluate the emphasis of Kant himself in supporting identifiable connections between the objects considered as works of art, specially the formal aspects of the same ones. From the previous analysis we will be forced to evaluate the relationship between beautiful art and nature. The failure of the arbitrariness, as a way for establish the artistic beauty in the assimilation to a form of language , leads us to recovering the theory of natural beauty, trying to find the points of contact between beauty and aesthetic the experience of art. Therefore, we will evaluate the consequences of the Kantian theory of art in relation to the aesthetic experience of the "Analytic of the Beauty ", distinguishing the difficulties that Kant might have had in mind when he developed his philosophy of art. The fundamental aim of this tour across Kant's text is the possibility of evaluating the current importance of the Kantian aesthetics, linking the exegesis of the text with two fundamental elements of the contemporary debate in philosophy of art: definition (or recognition) and valuation. We try to show that the aspects considered by Kant as necessary to support this balance (originality, relation between artists and public across the work, place of the work em the society, pleasure of the aesthetic experience, artistic tradition), still are relevant for the current debate in aesthetics and reflective human action. Provavelmente o principal problema da relação entre arte e beleza na Crítica da Faculdade de Julgar, de 1790, esteja na necessidade de reconhecer um objeto como obra de arte (através de um conceito de arte) e o juízo de gosto, que, considerado puro, não pode ter conceitos que determinem o objeto. Porém, não parece haver outra experiência além da experiência de beleza para o reconhecimento da obra de arte bela. Assim, faz-se necessário explorar os pontos de convergência entre uma produção orientada a fins e a produção de um objeto belo, considerando, contudo, que o conceito de obra de arte é diferente de qualquer conceito que possa ser colocado como fim de um ato intencional. No percurso do trabalho nos propomos a explorar as relações entre a prática do gênio e o gosto como regulador da produção artística e do reconhecimento e valoração das obras de arte. Consideraremos para isso as possíveis regras do gênio, tentando isolar os aspectos formais e os aspectos de conteúdo do objeto. Neste intento, partiremos da classificação das obras de arte como formas de expressividade, semelhantes à linguagem, visando mostrar as fraquezas de qualquer norma estética clássica no estabelecimento de regras de conexão entre formas e conteúdos. Porém, também avaliaremos a ênfase do próprio Kant em manter conexões identificáveis entre os objetos considerados obras de arte, sobretudo os aspectos formais dos mesmos. A partir da análise anterior estaremos obrigados a avaliar a relação entre arte bela e natureza. O fracasso da arbitrariedade, como forma de estabelecimento do belo artístico enquanto assimilação a uma forma de linguagem nos leva a recuperar a teoria da beleza natural, visando encontrar os pontos de contato entre beleza e experiência estética da arte. Destarte, avaliaremos as conseqüências que temos da teoria kantiana da arte em relação à experiência estética da Analítica do Belo , destacando as dificuldades de que o próprio Kant poderia ter sido consciente ao desenvolver sua filosofia da arte. O alvo fundamental deste percurso através do texto de Kant se encontra na possibilidade de avaliar a atualidade da estética kantiana, vinculando à exegese do texto dois elementos fundamentais do debate contemporâneo em filosofia da arte: definição (ou reconhecimento) e valoração. Pretendemos mostrar que os aspectos considerados por Kant como necessários para manter este equilíbrio (originalidade, relação entre artistas e público a través da obra, lugar da obra na sociedade, prazer da experiência estética, tradição artística), ainda são relevantes para o debate atual no que diz respeito à estética e ao agir humano reflexivo.

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior This dissertation sights to introduce the conceptions of ethic and right, present on Kant s Metaphysic of Morals, like two different moments of the application of the practical reason legislation. Taking knowledge from ethic and right are characterized by the autonomy of the will and the categorical imperative of reason, both spheres are include in the practical philosophy. On this way, is the same practical legislation present in ethic and right but it is distinguished according the sphere of it application, internal on the case of ethic and external on the case of right. Beyond this, what distinguished both spheres of application of the practical legislation of reason is the motive admitted in the two moments of application, on the ethic the only motive admitted is the internal motive of the respect of the moral law, and on the right the only motive admitted is the external coercion. Esta dissertação visa apresentar os conceitos de ética e direito, presentes na Metafísica dos Costumes de Kant, como dois momentos distintos de aplicação da legislação da razão pura prática. Partindo-se da constatação de que os dois âmbitos são caracterizados pela autonomia da vontade e pelo imperativo categórico da razão, tanto a ética quanto o direito estão contidos na filosofia prática. Neste sentido, embora seja a mesma legislação prática da razão que está presente tanto na ética quanto no direito ela se distingue, no entanto, de acordo com o âmbito ao qual é aplicada, a saber, na ética ela será aplicada apenas ao âmbito interno do agir, enquanto que no direito, a legislação prática se aplicará somente ao âmbito externo da ação. Além disso, o que distingue estes dois âmbitos de aplicação da legislação prática será o móbil admitido nos dois momentos de aplicação da mesma, na ética apenas o móbil interno do respeito pela lei moral poderá ser legitimamente aceito, enquanto que no direito o único móbil admitido será a coação externa.

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior This master thesis presents a reconstruction of the problem of the unity of reason in Kant s critical-transcendental philosophy. Bearing in mind that there is much disagreement in the literature, not only as to the critical answer to this problem, but also as to its specificity and systematic function within the various moments in which it is considered by Kant, this approach centers essentially on Kant s own argumentation. The aim of this research is to show that Kant s treatment of the problem follows the development of the critical-transcendental philosophy and that it can only be understood insofar as this development is presented. Therefore, a search for the systematic localization of the moments in which Kant approaches the problem of the unity of reason has been carried out, with the intention of justifying that this approach is fundamentally connected with the critical intention of establishing the boundaries that guarantee legitimacy to reason and assure its authenticity to operate in the theoretical as well as in the practical domain. The investigation is guided by the necessity to understand that both the negative results at which Kant arrives in the search of the demonstration of the unity of reason and the only critical answer admitted to this problem have their genesis in the systematic possibilities considered by the critical philosophy as a whole. Initially, in view of the argumentation that corresponds to the first period of this philosophy, an examination of Kant s search for a solution to the problem of the unity of reason from the theoretical use is carried out. Secondly, the systematic identification of the impossibility of solving the problem through this route leads to the consideration of an effort to establish the unity from the practical use and, likewise, to the discovery that the theoretical and practical uses of reason must be legitimized in two distinct domains of reason and, thus, the unity of reason cannot be guaranteed from either of its uses. Finally, faced with this situation, an exploration of the answer guaranteed to the problem of the unity of reason by the Kantian argumentation that considers the relation of the theoretical and practical domains in a regulative manner is carried out. As a result of the systematic impossibility to establish the unity of reason from one of its uses, the necessary self-sufficient validation of these uses, and, also, the fact that the relation of their domains can only be admitted as regulative, the conclusion reached is that the unity of reason is a fundamental presupposition of the critical philosophy in the articulation of its entirety, but that the critical answer to this problem consists in the justification of the impossibility of its demonstration. Este trabalho apresenta uma reconstrução do problema da unidade da razão na filosofia crítica-transcendental kantiana. Dado que a literatura discorda não apenas acerca da resposta crítica a esse problema, mas até mesmo sobre a sua especificidade e a sua função sistemática nos diversos momentos nos quais ele é considerado, a abordagem centra-se essencialmente na própria argumentação kantiana. Procura-se, outrossim, mostrar que o tratamento do mesmo problema segue o desenvolvimento da filosofia crítica-transcendental e que ele só pode ser compreendido desde que apresentado tal desenvolvimento. Assim sendo, busca-se uma localização sistemática dos momentos onde Kant aborda o problema da unidade da razão no intuito de justificar que a mesma abordagem é fundamentalmente vinculada à intenção crítica de determinar os limites que garantem legitimidade à própria razão e asseguram que esta tem autenticidade para operar tanto no domínio teórico como no domínio prático. A investigação é conduzida pela necessidade de se compreender que tanto os resultados negativos que Kant chega na busca da demonstração da unidade da razão como a única resposta crítica admitida para tal problema têm sua gênesis nas possibilidades sistemáticas consideradas pela filosofia crítica no seu todo. Tomando em consideração a argumentação que corresponde ao período do início da mesma filosofia investiga-se, primeiramente, a procura de Kant de uma solução para o problema da unidade da razão a partir do uso teórico. A identificação sistemática da impossibilidade de qualquer tentativa de resposta mediante esse percurso conduz, num segundo momento, ao apreço de uma tentativa de estabelecer a unidade a partir do uso prático e, ainda, à descoberta sistemática de que os usos teórico e prático devem ser legitimados em dois domínios distintos e, assim, a unidade da razão não pode ser garantida partindo-se de um dos seus usos. Frente a essa situação, num último momento, pondera-se a resposta ao problema da unidade da razão garantida pela argumentação kantiana que considera de modo regulativo a relação dos domínios teórico e prático. Como resultado da impossibilidade sistemática de estabelecer a unidade da razão a partir de um dos seus usos, da necessária legitimação auto-suficiente dos mesmos e, ainda, do fato de que a relação dos seus domínios só pode ser admitida como regulativa, apresenta-se a conclusão de que a unidade da razão é um pressuposto fundamental para a articulação da filosofia crítica-transcendental em todos os seus momentos, mas que a resposta crítica a esse problema consiste na justificativa da impossibilidade da sua demonstração.

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior The principal objective of this dissertation was to analyze the concepts of autonomous will and interest in the of Kant and based on his system of ethics. Our principal source of research are Kant s own books, especially Fundamentals of metaphysics and customs (FMC), Critic of Pratical Reason (CRPr) and some parts of Critic of Pure Reason (CRP), first we analyzed , from FMC, the concept of liberty and principally practical liberty. However, we perceive that in CRPr Kant arrives at only a negative notion of liberty, that is, how free will is independent of sensibility. Then we write about the concepts of will and duty in FMC and from them we see how Kant arrives at the notion of autonomous will that serves as positive concept of liberty and consequently as the supreme principal of morality. However, this principle is incompatible with acting by interest which it becomes necessary to investigate how man can take interest in morality without , however, by interest. We analyze then the concept of autonomous will with the idea of knowing how it can be valid independent of any interest. We conclude that according to Kant moral law imposes itself on human conscious as a fact, the only pure fact, a priori, denominated factum of reason . We retake the concept of interest from the perspective that this can be founded on autonomy. Finally, we observe that de feeling of respect is a valid consequence of moral law for rational and sensitive beings. Thus, we conclude that without doubt man takes interest in moral law exactly because since it s not at the service of any particular interest it reveals a maximum interest of reason and its amplification of its use. O principal objetivo desta dissertação foi analisar os conceitos de autonomia da vontade e interesse nas obras em que Kant fundamenta seu sistema ético. Sendo assim, nosso trabalho encontra suas fontes de pesquisa principalmente nos escritos do próprio autor, sobretudo, na Fundamentação da Metafísica dos Costumes (FMC), na Crítica da Razão Prática (CRPr) e em algumas partes da Crítica da Razão Pura (CRP). Primeiramente analisamos, a partir da CRP, o conceito de liberdade, principalmente da liberdade prática. Porém, percebemos que na CRP Kant chega apenas a uma noção negativa de liberdade, a saber, como independência do arbítrio frente à sensibilidade. Dissertamos, então, sobre os conceitos de vontade e dever na FMC, e, a partir deles vimos como Kant chega à noção de autonomia da vontade que serve, como conceito positivo de liberdade, e, conseqüentemente, como princípio supremo da moralidade. Contudo, tal princípio é incompatível com o agir por interesse, próprio do ser humano, de modo que, é necessário investigar como o homem pode tomar interesse pela moralidade sem, no entanto, agir por interesse. Analisamos então o conceito de autonomia da vontade com o intuito de saber como ela pode ser válida independentemente de qualquer interesse. Concluímos que, segundo Kant, a lei moral se impõe por si mesma à consciência humana como um factum, o único factum puro, a priori, denominado de factum da razão. Retomamos, então, o conceito de interesse segundo a perspectiva de que este possa ser fundamentado na autonomia. Por fim, observamos que, tal qual o sentimento de respeito, o interesse é uma conseqüência da validade da lei moral para seres racionais e sensíveis. Sendo assim, poderíamos concluir, sem dúvida que o homem toma interesse pela lei moral, justamente porque, não estando a serviço de nenhum interesse particular do sujeito ela revela o máximo interesse da razão na ampliação de seu uso.
