4. O novo código brasileiro de proteção à propriedade industrial e seu impacto nos investimentos em P&D.

- Abstract
The purpose of this study is to empirically investigate the effect of the change in Brazilian Patent Law (Law n° 9.279/1996) in investments in R&D carried out by Brazilian companies. The change in Patent Law caused an increase in the degree of protection to intelectual property exclusively in three industries (food, pharmaceutics, and chemicals), characterizing thus a natural experiment. We estimated two difference-in-difference models using data from ECONOMATICA: pooled and Fama-MacBeth regressions. The estimates ofthe pooled model showed that stocks of firms that benefited from the new law had a 1.36% (136 basis points) increase in monthly returns superior to those firms unaffected by the legal change. This result is robust to the inclusion of several control variables such as market beta, firm size, and the book-to-market ratio, among others, and to Fama-MacBeth estimation. We conclude that the change in the law motivated firms in industries affected by the change to adopt R&D projects. [ABSTRACT FROM AUTHOR]

Non-traditional trademarks have been emerging as a new paradigm in the Industrial Property Law, since they represent an adaptation to innovation and competitiveness which has been growing among economic agents over the past years. However, the registration of these types of marks is not without problems, given the difficulty of adapting them to the registration requirements attributed to traditional trademarks, namely the graphic representation and the ability of distinguishing the source of the products and services covered by them. REGIONAL INNOVATION PROPENSITY IN PORTUGAL: AN ANALYSIS BASED ON PATENT DATA. This paper analyses the regional distribution of patents in Portugal in the period 1980-2008 using information that was recently made available. Lisbon leads the national ranking by far. However, towards the end of the period under analysis, a few regions around Oporto have increased their share in the total number of patents. This has taken place alongside an increase in the total number of patent applications from 2000 onwards, after two decades in which that number remained basically stagnant in Portugal. The main protagonists of this recent increase have been universities and other academic institutions. The paper concludes by stressing that the lack of growth in patent applications by the business sector is a cause for concern, given the gap that still separates Portugal from the countries that top the international patent rankings. The trend towards international harmonization of patents' protection and its problems. TRIPS agreement has been a milestone in the present trend towards international harmonization of intellectual property's protection (including patents' protection), where harmonization means to increase the protection level in developing countries according to the more rigorous standards of developed ones. Considering the economic theory of patents together with historical and empirical evidences, it is argued that international harmonization of patents' protection as it is settled by TRIPS agreement is not favorable to developing countries' economic development. The objective of this article is to verify if the perfectioning of the brazilian democratic institutions in what refers to the foreign affairs making process through elaboration and ampliation of the institutional ways which can make easier the interaction between policy-makers and civil society organization's actors, can better the answer to demand from the technical quality of the brazilian diplomacy during the international commercial negotiations. Agreed the selection strategic at multilateralism, we will also verify if this perfectioning can create bigger international credibility and eligibility to the Brazilian actions at WTC, inclusively making possible to the country to mold international commerce regimes which favors to its national interests. We will search demonstrate the viability of the argument, analising the patents pharmaceuticals disputes and the agricultural subsidies questions, in specific, the cotton dispute in WTO with the United States. Therefore, use the civil liability of the third party, as well as a doctrine of the external protection of the credit, for an extraction of grounds and concrete of advance of the responsibility of the third party in contributory infringement. Another important source for the study took care of the foreign legislation, as well as the Argentine, Portuguese, Spanish, German and American legislation that regulate the theme in a meticulous way. Considering an obligation, as an expected standard of conduct, that the business agent knows the branch in which it operates, it responds in an objective way for the legal violation even if it is only contributed to the infraction. On the other hand, the non-business economic agent responds in a subjective way, and therefore, in order for a responsibility to be imposed, it must show proof of its fault in the offending conduct. A presente dissertação trata de apurar a responsabilidade civil do terceiro que contribuiu à infração da titularidade da patente sob a luz da metodologia civil-constitucional. Para tanto, utilizou-se a responsabilidade civil do terceiro cúmplice, bem como a doutrina da tutela externa do crédito, para a extração de fundamentos e parâmetros concretos na apuração da responsabilidade do terceiro que contribuiu à infração da titularidade da patente. Outra fonte importante ao estudo cuidou da legislação estrangeira, tal como à argentina, portuguesa, espanhola, alemã e estadunidense que regulam a fattispecie de maneira minuciosa. Tendo em vista a obrigação, como padrão de conduta esperado, de que o agente empresário conheça o ramo no qual atua, este responderá de forma objetiva pela violação jurídica mesmo que tenha apenas contribuído à infração. Por outro lado, o agente econômico não empresário responderá de forma subjetiva e, portanto, para que incida a responsabilidade deve se demonstrar prova de sua culpa na conduta infratora.

Os desenvolvimentos verificáveis no campo da biologia sintética desafiam o regime jurídico atual, em especial, concernente ao direito de propriedade intelectual. A presente dissertação investiga possíveis formas de proteção aplicáveis às invenções da biologia sintética, partindo do pressuposto de existir no direito de propriedade intelectual um desafio em equilibrar os distintos interesses em jogo. Nesse sentido, primeiramente, busca-se compreender quais os interesses eventualmente associados à biologia sintética, constatando-se a existência de pelo menos três deles: (I) um de fundo econômico; (II) um de fundo distributivo e (III) um de fundo científico. Contata-se, ademais, uma constante tensão entre os interesses associados à utilização industrial da biologia sintética e a produção de conhecimentos básicos para o desenvolvimento dessa nascente ciência. Após, consideram-se possíveis formas de proteção das inovações da biologia sintética, em dois grupos: (I) a forma de proteção tradicional, consistente na patente de invenção e (II) possíveis formas alternativas de proteção. Evidencia-se, assim, ser possível a utilização da patente de invenção como forma de tutelar o bem imaterial decorrente da biologia sintética. Todavia, em razão dos diversos interesses associados a essa disciplina, verifica-se a importância de se buscar a utilização de formas alternativas de tutela. Developments in the field of synthetic biology challenge the current legal regime especially when it comes to intellectual property law. This dissertation considers the greater context associated with synthetic biology in order to understand a possible legal framework for the protection of inventions related to this industry/science. In this respect, at first, three main issues are identified: (I) the existence of a strong economic importance of synthetic biology inventions, (II) the existence of imperatives of distributive justice related to the use of genetic resources and (III) the existence of concerns within this scientific community, regarding an excessive use of proprietary rights over basic/essential knowledge in this field. Then, the application of patent law to synthetic biology inventions is investigated as well as the application of more recent alternatives. As a result of this investigation, it is noted that although traditional patent law can be applied to protect inventions related to synthetic biology, alternative forms of protection should be encouraged, considering the diverse interests associated with this field.

Resumo O Brasil foi um dos primeiros países a ter uma lei de patentes e um dos únicos a conceder prazos de duração da patente de acordo com a qualidade da invenção. Este trabalho analisa um banco de dados inédito com todos os 783 privilégios industriais concedidos sob a vigência da primeira lei de patentes brasileira entre 1830 e 1882. Os resultados mostram que a atividade inventiva esteve conectada à estrutura econômica e social da época e que a escassez de mão de obra incentivou a invenção de máquinas e equipamentos para o setor cafeicultor. O número de patentes apenas começou a se elevar a partir de 1870, quando a economia brasileira passou por grandes mudanças que levaram ao seu desenvolvimento, evidenciando que pouco resultado surge quando se institui uma lei de patentes em um ambiente de estagnação econômica. Mesmo assim, a lei revelou-se o mecanismo menos dispendioso para estimular a atividade inventiva no Brasil do século XIX. Abstract Brazil was one of the first countries to have a patent law and one of the only ones to grant patent length according to the quality of the invention. This paper analyzes an unpublished dataset with all the 783 industrial privileges granted under the first Brazilian patent law between 1830 and 1882. Our results show that inventive activity was linked to the economic and social structure of the time and that labor scarcity led to the invention of machines and equipment for the coffee sector. The number of patents only increased from 1870 and on, when economic conditions improved, showing how little can be achieved by a patent law in an economically stagnant environment. However, it was the least expensive mechanism to stimulate inventive activity in Brazil in the XIX century.

Rights investigação científica nas universidades é considerada como um importante factor para o desenvolvimento da ciência e do conhecimento. Demonstrou-se que as universidades evoluíram historicamente, acumulando actualmente tês missões: a de ensino, a de investigação e a de ligação à sociedade, através da qual a universidade transfere conhecimento. É nesse último ponto que é pertinente analisar o papel das patentes, principalmente o papel da patente universitária em Portugal. Sendo a patente uma protecção exclusiva de exploração comercial de uma invenção com vista ao retorno de lucros, é natural que a iniciativa privada, neste caso, as empresas tomem a dianteira na procura dessa vantagem. No entanto, em Portugal mais de 1/3 dos pedidos de patentes é realizado por universidades, como se comprova com os dados de todos os pedidos de patentes via nacional de 2000 a 2009. Nessa análise empírica, é também apresentada uma tentativa de medição da transferência de conhecimento entre a universidade e as empresas através da contabilização do número de patentes com titularidade partilhada. Embora com um resultado baixo, comprova-se a sua sustentável existência nos últimos anos. Os GAPI que se encontram sedeados nas universidades são um factor dinamizador e central. Sendo possível compreender através dos resultados de um questionário realizado aos GAPI quais as motivações e as aspirações dos investigadores e da universidade para iniciarem um processo de pedido de patente ou um processo de partilha de titularidade de uma patente. A análise dos contributos das universidades portuguesas, em termos de investigação científica, para o processo de inovação, constituí-se assim, como a questão central de análise deste estudo. Scientific research in universities is regarded as an important factor for the development of science and knowledge. It was demonstrated that universities have evolved historically, accumulating currently three missions: education, research and relationship with the society, through which the university transfers knowledge. It is this last point that is relevant to examine the role of patents, especially the role of patent university in Portugal. Since the patent is a protection of exclusive commercial exploitation of an invention in order to profits, it is natural that private initiatives, in this case, the companies, take the lead in seeking that advantage. However, in Portugal more than one third of patent applications is carried out by universities as corroborated with data from all national patent applications through 2000 to 2009. In this empirical analysis is also presented an attempt to measure the knowledge transfer between universities and companies through the accounting of the number of patents with shared ownership. Although with a low score in the lasts years, it is proven his sustainable existence. The GAPI which are domiciled in universities are a driving and central force. Being possible to understand through the results of a questionnaire given to GAPI the motivations and aspirations of researchers and the university to begin a process of patent application or a process of sharing ownership of a patent. The analysis of the contributions of Portuguese universities in terms of scientific research to the process of innovation constitutes itself as the central issue of analysis in this study.

Este artigo analisa as complexas relações estabelecidas entre as patentes farmacêuticas e a acessibilidade aos remédios no Brasil, após a aprovação da nova Lei de Patentes 9279/96, em vigor desde abril de 1997. Esta lei tornou a patente extensível às invenções químico-farmacêuticas e aos microrganismos transgênicos. O tema é considerado tendo em conta duas abordagens específicas, porém integradas: a da política de ciência e tecnologia e a da política de saúde. A autora conclui assinalando as principais futuras conseqüências das atuais tendências internacionais - legais e regulatórias -, ressaltando que o Brasil deve preparar seu arcabouço legal para enfrentar as esperadas conseqüências negativas do patenteamento do genoma sobre o fluxo da informação científica e sobre o acesso aos medicamentos. Passage of Patent Law 9279/96, in effect since April 1997, has made relations between pharmaceutical patents and accessibility to medicine in Brazil complex. Under the new law, patents may extend to chemical inventions (products and process) and transgenic microorganisms. The issue is analyzed from two specific yet inter-related approaches: science and technology policy and health-care policy. The conclusion draws attention to the main future consequences of current international trends, both legal and regulatory. Brazil should ready its legal framework to respond to the negative consequences that genome patenting can be expected to have on the flow of scientific information and on access to pharmaceutical drugs.
