W środowisku kryminalistycznym panuje zasadnicza zgoda co do faktu, że błędne rozpoznania wiodą niechlubny prym wśród przyczyn pomyłek sądowych. Fakt ten niepokoi tym bardziej, iż według szeregu badań wpływ zeznań świadka naocznego na uznanie przez sąd winy danego oskarżonego jest tak silny, że nierzadko ciężko go przełamać innymi kontrdowodami. Niniejszy artykuł stanowi studium przypadku jednej ze spraw, w której błędne rozpoznanie przez świadka naocznego niemal doprowadziło do niesłusznego skazania. Artykuł analizuje istotne elementy stanu faktycznego rzeczonej sprawy z perspektywy aktualnej wiedzy kryminalistycznej z zakresu procesu spostrzegania, zapamiętywania, przechowywania wspomnień oraz rozpoznawania. Osobna uwaga poświęcona została także wybranym aspektom prawidłowej metodyki przeprowadzania okazań. W konkluzji wskazano, że choć rozpoznanie przez świadka naocznego jest niejednokrotnie kluczowym dowodem w danej sprawie, to jego wartość dowodowa powinna być każdorazowo wnikliwie analizowana przez organ procesowy – ślady pamięciowe bywają bowiem zawodne i stosunkowo łatwo ulegają kontaminacji. W tym kontekście uwagę zwrócono na istotność rzetelnej edukacji kryminalistycznej praktyków procesu karnego w tymże zakresie. The annals of criminal law are rife with instances of mistaken eyewitness identification. Therefore, it is not surprising that eyewitness misidentification is generally acknowledged by scholars to be one of the most common contributors to wrongful convictions worldwide. Despite the fallibility of human memory and its vulnerability to inadvertent or deliberate influence, criminal investigators and judges tend to give substantial weight to eyewitness identifications. This article presents a detailed case study of a narrowly avoided miscarriage of justice. In the criminal case in question, eyewitness identification was the only evidence against the defendants; however, the conviction was almost certain. Fortunately, some unexpected pieces of evidence emerged during the trial and ultimately led to the acquittal of the defendants. The article outlines the key factors that can influence eyewitness memory and identification performance. The paper concludes by (1) arguing that human memory is prone to a variety of errors and biases. As a result, trial judges must be very meticulous while assessing the probative value of eyewitness identification evidence, and take into account various factors that could influence eyewitness memory or decision-making processes; (2) highlighting the importance of forensic education among legal professionals in preventing miscarriages of justice.

In the commented ruling, the Supreme Court considered some of the problematic aspects of the Polish photo lineup procedure, stating that improprieties in organising or conducting identification procedures do not necessarily render eyewitness identification evidence inadmissible. This commentary discusses the assessment of the probative value of identification evidence, as well as critically analyses the current laws regarding photo lineup practices in Poland. Finally, the commentary argues that significant and research-based changes in the Polish legal standards for eyewitness identification are necessary to prevent potential miscarriages of justice, briefly discussing the most urgent of them.

W artykule przedstawiono badanie nad ekwiwalencją przekładu pisemnego w kontekście oceny wiarygodności zeznań świadka. W pierwszej części omówiono psychologiczne kryteria oceny wiarygodności zeznań oraz lingwistyczne wskaźniki kłamstwa, które stanowiły podstawę teoretyczną badania. Tłumaczenia zgromadzone w toku badania poddano analizie językowej i porównano z oryginałem, aby wyodrębnić kategorie błędów popełnianych przez tłumaczy przed szkoleniem i po nim z zakresu znajomości kryteriów oceny wiarygodności zeznań. Przeprowadzono także analizę porównawczą ocen przyznanych przez sędziów kompetentnych oceniających oryginał i tłumaczenia. Analiza statystyczna wykazała, że istnieją różnice w ocenie oryginału i jego tłumaczenia, a znajomość kryteriów wiarygodności zeznań świadka ma pozytywny wpływ na ekwiwalencję tłumaczenia. This article presents a study on the equivalence of written translation in the context of the assessment of the credibility of witness testimony. Part one examines psychological criteria for assessing the credibility of testimony and linguistic indicators of deception that formed the theoretical basis of the study. Translations gathered during the study were analyzed linguistically and compared with original in order to categorize the errors and mistakes made by translators before and after learning the criteria of statements credibility assessment in training. The article also presents a comparative analysis of the assessments made by expert judges with regard to both the original testimonies and the translations thereof. The results of the statistical analysis showed that there are certain differences in the assessment of an original and its translation, and knowledge of the criteria for determining the credibility of a witness’s testimony has a positive impact on translation equivalence.

W poniższym badaniu, poprzez manipulację formą materiału pamięciowego, próbowano uzyskać lepszą zdolność do monitorowania źródła informacji u osób badanych, a co za tym idzie, zmniejszenie efektu dezinformacji w teście pamięci. Manipulację formą materiału pamięciowego stanowiło użycie innego języka obcego w materiale oryginalnym i innego w materiale następczym. Ponadto, badania były replikacją wcześniejszych badań nad efektem dezinformacji i potwierdziły powtarzalność tego efektu. Hipoteza dotycząca zmniejszenia efektu dezinformacji w grupie osób ze zmianą języka, względem grupy osób bez zmiany języka, nie potwierdziła się. Wynik okazał się jednak istotny statystycznie i przeciwny do kierunku przewidzianego w hipotezie. The aim of the following study was to manipulate the form of the memory material in a such way to obtain a better source-monitoring ability of the respondents, and hence, to reduce the misinformation effect in a memory test. The form manipulation consisted of changing the language between the two memory materials. Moreover, the study was a replication of some previous research on the misinformation effect. The reproducibility of the effect was confirmed. The hypothesis of reducing the misinformation effect in a group with a language change vs. a group without language change, was not confirmed. The result, however, turned out to be statistically significant and opposite to the direction predicted in the hypothesis.

Przegląd badań dotyczących ostrzeżenia jako metody redukowania efektu dezinformacji w kontekście zeznań świadka. Ogólnie, badania wskazują, że metoda ta jest skuteczna.

Efekt dezinformacji jest zjawiskiem polegającym na włączaniu przez świadka pewnego zdarzenia do relacji o nim elementów niezgodnych z jego przebiegiem, pochodzących z innych źródeł niż samo zdarzenie. W typowej procedurze badani oglądają film, następnie czytają tekst, który w grupie eksperymentalnej zawiera szczegóły niezgodne z filmem, a następnie wykonują test pamięci materiału oryginalnego. Badani z grupy eksperymentalnej zwykle wykonują test pamięci filmu gorzej. Celem niniejszego badania była próba sprawdzenia, jak - wprowadzone bezpośrednio przed manipulacją dezinformacją - przeciążenie poznawcze, skutkujące rozgrzaniem poznawczym modyfikuje podatność na efekt dezinformacji. Stwierdzono, że rozgrzanie poznawcze powoduje wzrost odporności na efekt dezinformacji. Dowiedziono także, zgodnie z oczekiwaniami, iż rozgrzanie poznawcze polepsza odpamiętywanie materiału niedezinformowanego. The misinformation effect is defined as a distortion of an eyewitness testimony, resulting from introducing to this testimony incorrect details, stemming from sources other than the original event. In a typical experiment the participant first watches a film. Afterwards, he/she reads a description of the film, which in the experimental group contains some incorrect details, and finally answers questions concerning the film, including questions relating to the misled details. The memory performance of misled participants is usually poorer than of non-misled ones. The aim of the presented experiment was to verify whether susceptibility to the misinformation effect is influenced by cognitive overload introduced just before presentation of the misinformation, resulting in cognitive warm-up. Warmed-up subjects were more resistant to misinformation, compared to non-warmed ones. Warmed-up subjects were also better than non-warmed in remembering non-misinformed material.

Warning against warnings: Alerted subjects may perform worse. Misinformation, involvement and warning as determinants of witness testimony The article presents experiments exploring the memory misinformation effect. Subjects heard a recording and afterwards read a description of it, which included, in the misled group, some details inconsistent with the recording; finally thay answered questions about the recording. The aim of the research was to replicate the tainted truth effect, consisting in poor memory functioning of non-misled warned subjects and to check whether a subject's involvement in the issue moderates this effect. Highly involved subjects were more resistant to the misinformation effect than those lowly involved. In the case of highly involved participants, warning was effective in reducing the misinformation effect, but it also caused more errors in the case of non-misled subjects. Thus, warning witnesses about nonexising discrepancies between what they saw/heard and what they were told, might lead to less accurate testimony.
