The halalan toyyiba is a comprehensive concept brought by Islam. According to this concept, the source of consumption must be clean and pure. Every source point, from the initial production process and methods to the final management, such as waste disposal methods, must be taken into account to meet the requirements of the halalan toyyiba. The present time sees water-based use increasingly widespread in daily life. Strictly speaking, the concept of sharia-compliant halalan toyyiba in water use, such as agriculture and farming, still needs to be seriously discussed. Therefore, the issue of sharia-compliant halalan toyyiba in water use is significant to study and draw up a sharia-compliant guide for the Malaysian community, especially the Muslims. This concept coincides with the country's national agenda, namely the National Halal Hub Policy. The main objective of this paper is to study the idea of halalan toyyiba in the management of domestic water in Malaysia. This paper is based on qualitative methods. Fatwa-based resources, scholarly publications, journals, and as such, will be analyzed and summarized descriptively to produce a conclusion that answers the paper's objectives. The findings show that the fundamental concept of sharia-compliant halalan toyyiba regarding domestic water management in Malaysia has yet to be fully implemented. The innumerable forms of human instincts could produce something positive if they are wisely handled using religious guidelines. The conflict approach has lost its justification, especially when the current global situation craves for peace. Adopting classical fatwas, beginning with the categorization of dhimmi-harbi during the Khilafah Islamiyyah era, lacks relevance to contemporary societal relations known as al-muwatinun (coalition or alliance of citizens). Therefore, when considering this current reality, Fiqh al-Tacayush could be a platform for seeking harmony in a multi-faceted or multi-ethnic society that craves for peace and goodwill. This approach frequently raises several questions because it presumptuously marginalises faith (iman), leading to the dissolution of Islamic teachings. To consecrate past fatwas by either nullifying or worshiping reality without any guidance from divine decrees and thurath (hereditary rulings), results in shortcomings. Hence, this study intended to provide a comprehensive picture about the background and the fundamentals of the Fiqh al-Tacayush concept, which includes the guidelines, challenges and its sustainability. The qualitative approach, based on a content analysis design, had carried out a library research and the documents were analysed using the descriptive analysis method. It was found that the fundamentals of Fiqh al-Tacayush are firmly established in the al-Quran and Sunnah. Realistically, the approach, which is contemporary in form and based on dawabitSyarak, should be inserted in the framework to sustain current socio-religious relations. The requires Islamic scholars to proactively consolidate the contemporary fiqh concept so that it could become a living guide for society in order to overcome the pluralistic society issue. The fatwās of zakāh on EPF in Malaysia are different from one state to another and this cause confusions which need some clarification. This article intends to analyze the fatwās to identify factors of that differences and to find juristic justification of the fatwās. This study is qualitative in nature and will be depending heavily on the fiqh literatures and the texts of fatwās. The fatwa of a companion, as one of the disputed sources of Islamic law, has its role in explaining law derived from Ijtihad that is formulated by the companion. The two main functions of this Ijtihad are to reinterpret law that is available in the legal text and to explicate something new without going against the Islamic law. This article aims to elucidate its definition and the opinion of the principles of Islamic jurisprudence scholars on matters relating thereto. The discussion is also centred on the specific cases on farā'id, which is well-known for its particular name and calculation that made it famous. Four cases have been chosen as samples - al-musharrakah case, al-kharqa' case, al-akdariyyah case and al-hamziyyah. Generally, the authority for deriving Ijtihad focuses more on the individuals who were frequently referred to in issuing a fatwa.
