武力紛争法上の環境保護義務の具体的内容を明らかにするため、共に環境を保護対象とする国際環境法上の「相当の注意」義務に着目し、武力紛争法上の同種の義務と比較検討を行った。検討は、文脈の本質的違いがある場合を除き、武力紛争法上も国際環境法と同様の「相当の注意」を行う義務があることを明らかにした。ただし、国際環境法上の環境保護義務が開発と衡量されるように、武力紛争法では軍事的必要性と環境保護が衡量されることに留意が必要である。, This article clarifies the practical content of environmental protection under the law of armed conflict. Because of the law of armed conflict and the international environmental law share the environment as an object of protection, the study adopted a comparative analysis of the respective contents of 'due diligence' as a research methodology. The study shows that, except where a fundamental difference exists, the law of armed conflict has similar 'due diligence' as of the international environmental law. 武力紛争における環境保護の手段に紛争当事者間の合意による場所的保護がありうることから、本稿では海洋生物多様性保護の場合に合意に基づくMPAが同様に機能するかを検討した。研究は、IMOによるPSSAを含むいかなる既存のMPAであっても、武力紛争時の保護区域として実効的に機能しないであろうことを明らかにした。他方で、MPAの設定が海域の重要性・脆弱性を示すことで、間接的に当該海域の保護に資する可能性もまた明らかとなった。, There is an agreement-based environmental protection measure for armed conflict. Therefore, in case of armed conflict at sea, agreement-based MPA is possible to operate as a maritime biodiversity protection measure during armed conflict. However, this research shows that any existing MPA, including the PSSA, does not meet the requirement of an effective environmental protection measure for armed conflict. 投稿論文, Refereed Article, Lethal Autonomous Weapons Systems (LAWS) are a type of autonomous military robotic systems that can independently search for and engage targets, controlled by artificial intelligence (AI) without human intervention. The chief concern is whether LAWS would violate the laws of armed conflict, especially the principle of distinction and the principle of proportionality. States, international and regional organizations and civil society have consistently discussed about LAWS over the past 5 years under the framework of the Convention on Prohibitions or Restrictions on the Use of Certain Conventional Weapons which may be deemed to be Excessively Injurious or to have Indiscriminate Effects (CCW). The year 2019 is the third year since the inception of the discussion at the Group of Governmental Experts (GGE) on LAWS, and took place in March and from 20 to 21 August. GGE is mandated to examine issues related to emerging technologies in the area of LAWS in the context of the objectives and purposes of the CCW. The author took part in GGE in August 2019 as an academia, and based upon his experience, this Article examines the latest discussion by the GGE for LAWS and considers international legal aspects of such weapons systems.

非国際的武力紛争における海上での武力衝突の実際と、法執行と敵対行為でパラダイムの重複する非国際的武力紛争の特徴を踏まえ、複数の候補の比較検討から妥当する法的枠組みの解明に取り組んだ。研究はLTTEのように叛徒が国家と同様に海上での武力闘争を戦う能力を有している場合には敵対行為パラダイムの適用を通して捕獲法を除く武力紛争法に基づいた外国船舶を含む海上の目標への攻撃や干渉が行われうることを明らかにした。, This article clarifies the appropriate legal framework that applies to armed confrontation at sea in non-international armed conflict. Non-international armed conflict has the dual nature of law enforcement and hostilities. Nevertheless, the law enforcement paradigm is not competent for armed confrontation at sea with non-international armed conflict with such insurgents, because of some insurgents, like LTTE, have advanced capabilities to fight naval warfare. 本稿は軍事作戦の遂行において指揮・統制のツールとして用いられているROEについて、国際法上の位置づけを研究するものである。ROEは敵対行為から法執行に至る様々な軍事作戦の遂行における制限要素を規定するもので、軍事的、政治的、法的な考慮のもと策定される。従来、国際法上の制限を反映するのみとされてきたROEについて、本研究はROEが人道法や人権法上の手続的義務に該当することから、より積極的に国際法と関連していることを明らかにした。, The object of this article is assessing the position of ROE which is a tool of command and control used in military operations under international law. ROE prescribes limitations that apply to the carrying out of a variety of military operations from hostility to law enforcement, taking into consideration military, political, legal factors. ROE was considered hitherto to only reflects regulations under international law. Nevertheless, this article revealed that ROE corresponds with procedural duty under international human rights law and international humanitarian law. 本論文は全ての形態の武力紛争における海上経済戦についての国際法による規律を取り扱う。国際的武力紛争において、海上経済戦は慣習海上経済戦規則に基づく交戦国の一方的行為として、第三国船舶に対する干渉が許容される。他方で、慣習海上経済戦規則はその性質及び慣行から非国際的武力紛争には適用できない。従って、非国際的武力紛争における海上経済戦を既存の法的枠組みにおいて正当化できない。, This thesis deals with the rule of maritime economic warfare by international law in all forms of armed conflict. In international armed conflict, maritime economic warfare is authorized by customary rule of maritime economic warfare as a unilateral act by belligerent state. On the other hand, customary rule of maritime economic warfare cannot apply to non-international armed conflict because of its nature and practice.
