Village autonomy is one of the urgencies for village government. This is in line with the reform mandate which emphasizes the spirit of regional autonomy. Village autonomy is expected to increase village independence. The legal issue in this research is the legal vacuum related to the regulation of village autonomy. This study aims to construct the idea of regional autonomy within the framework of the Unitary State of the Republic of Indonesia. This research is a juridical-normative research with three legal materials, namely primary legal materials including: the 1945 Constitution of the Republic of Indonesia, the Village Law, and the Regional Government Law. Secondary legal materials include books, websites, and journal articles related to legal issues. Non-legal materials include language dictionaries and legal dictionaries. The results of this study confirm that the idea of village autonomy in the Unitary State of the Republic of Indonesia must be positioned that village autonomy is "original autonomy" that must be given by the state to villages. Legal construction related to the idea of village autonomy is carried out by amending the 1945 Constitution of the Republic of Indonesia by including the term village autonomy in the constitution, including village autonomy in the revision of the Village Law, as well as harmonizing and constructing village autonomy laws mutatis mutandis with the concept regional autonomy.

Abstrak Perubahan Undang-Undang Nomor 32 Tahun 2004 menjadi Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah semakin menegaskan hubungan yang sentralistik antara pemerintah pusat dan pemerintah daerah, yang selama pasca kemerdekaan mengalami dinamika yang tinggi, terutama dalam hal konsep dominasi kekuasaan antara keduanya. Salah satu dampak yang signifikan dari perubahan itu terletak pada kewenangan pengawasan pemerintah pusat terhadap peratuan daerah yang dibentuk oleh pemerintah daerah. Kondisi itu semakin memperkuat posisi pemerintah pusat terhadap pemerintah daerah. Di satu sisi, hal tersebut mempertegas konsep negara kesatuan, tetapi, di sisi lain semakin membatasi kewenangan pemerintah daerah dalam melaksanakan otonomi daerah. Keduanya merupakan amanat dari Undang-Undang Dasar 1945. Kewenangan pengawasan juga berdampak kepada kewenangan pembatalan peraturan daerah oleh pemerintah pusat. Hal itu tidak bisa sekedar dilihat dari aspek hubungan antara pemerintah pusat dan daerah, tetapi juga berkaitan dengan perspektif perundang-undangan. Dengan adanya pembatalan, maka penting untuk melihat upaya hukum yang tersedia apabila ada yang tidak berkenan dengan pelaksanaan kewenangan pembatalan tersebut. Abstract The amendment of Law Number 23 of 2004 with Law Number 23 of 2014 on Local Government has underlined the centralistic relationship between Central and Regional Governments—both of which have undergone numerous changes throughout the post-independence period, specifically concerning authority domination. Among these changes is the central government’s authority to supervise regional government in formulating local regulations; this reinforces the authority that the central government has over the regional governments. While this reaffirms the notion of unitary state, it also effectively limits the capacity of Regional Government in implementing regional autonomy, both of which are crucial to the 1945 Constitution. This supervisory authority consequently leads also to the central government’s authority to cancel local regulations. By considering not only the matter of authority but also legislation, it is clear that the imposition of such great limitation over the Regional Governments is an issue. Thus, it is important to identify any available legal tools that can be used to counter the central government’s nullification of local regulations.

This article aims to find out the national da'wah carried out by A.R. Baswedan. This research uses a character study approach with a literature study method. The results showed that the national da'wah carried out by A.R. Baswedan broadly fits the indicators of the national mission. The indicators of national preaching carried out by A.R. Baswedan can be seen from the aspects used in da'wah, namely; based on Pancasila, UUD 1945, Bhineka Tunggal Ika, and adherence to the Unitary State of the Republic of Indonesia. In addition, da'wah also accommodates differences in background, gender, ethnicity and class. This paper suggests the need for inclusive preaching carried out massively by preachers throughout the archipelago, so that the cultivation of a strong ideology, especially related to the preaching of rahmatan lil 'alaimin and soothing the Indonesian nation and not clashing with political interests.

State of Indonesia is a very large country. It can be seen from many tribes, nations, cultures, languages, and others who are in Indonesia. As a unitary state with extensive autonomy, takes the concept of the relationship of authority between the central government and local governments. Administratively, the pattern of the relationship of authority between the central government and regional governments born of the delegation of authority. Who was born on the theory of delegation, supervision concept embraced by local governments in Indonesia are more inclined to form Hybrid variations (supervision), transfer of power from central to local government could be said to embrace open-end arrangement or general competence. therefore, a new paradigm in central and local relations should be established with the pattern of center-periphery relations towards a more harmonious, it's time developed progressive thinking that is based on relations that are complementary and interdependent.

Birth of Special Region Nanggroe Aceh Darussalam based on Law No. 18/2001 on Special Autonomy for Aceh as Nanggroe Aceh Darussalam that changed through Law No. 11 of 2006 on the Governing of Aceh is an attempt to realize a democratic government and prosperous (welfare state). The implication of the birth of NAD is the application of Islamic law as a tool of law and governance NAD, which also puts the Shariah Court as the main pillar of Islamic sharia enforcement in NAD. The existence of the Shariah Court as an instrument of law enforcement in NAD institutionally and functionally problematic. The first, related to the position of the Shariah Court that institutionally a part of the religious court, but has a broader scope of authority. Second, related to aspects of Islamic sharia holding capacity is possible to be imposed on non-Muslims, were both these problems can ultimately hurt the Unitary Republic of Indonesia principles and protection of human rights. Framework of the Unitary Republic of Indonesia of the concepts embodied in the provisions of Article 18 paragraph (1) of the Constitution of the Republic of Indonesia in 1945, the Republic of Indonesia is divided into provincial regions and districts are divided into, each province, district government gets, the regulated by law. Local authorities at provincial and district levels have different strengths according to the level. Local autonomy based on the Act No. 22 Year 1999 about Local Autonomy (amended by the Act No. 32 Year 2004 about Local Governance) has delivered broad autonomy to local governance to add its local revenue through cllection, local tax and local retribution. The impementation of local autonomy should be in the line with the unitary state of Indnesia as attached in the Constitution 1945 and other supporting rules in legislation. The formation of Local Procedures by Local Governance should not only partially benefit local governance but also they need pay attention to their functions in public services. Retribution withdrawal by Gresik Regency towards 8 ports for own interests should be based on the hierarchy of the regulations.
