Es gibt zahlreiche Gelegenheiten, um festzustellen, dass auch das eigene Selbst - entgegen jeglicher irrationalen Hoffnung - dem Alterungsprozess nicht entzogen ist. Eine Möglichkeit ist die Aufforderung, gut 25 Jahre nach seinem ersten Erscheinen ein Buch zu thematisieren, dessen Erstauflage in der eigenen akademischen Ausbildung nicht ganz unbedeutend war. Es war 1997, als mit Niklas Luhmanns "Gesellschaft der Gesellschaft" ein in mehrerlei Hinsicht schwergewichtiger Block mitten in die allgemeine Theoriediskussion hineinplumpste. Dass dieses Buch in der Erstausgabe mit schwarzem Einband daherkam, erschien mir damals durchaus folgerichtig und erinnerte an den gleichfarbigen Monolithen aus Stanley Kubricks "2001: A Space Odyssey". Ähnlich Ehrfurcht gebietend gestaltete sich die Lektüre von Luhmanns Hauptwerk, vor allem dem Novizen in Sachen Systemtheorie, der ich damals war.

Die vorliegende Arbeit schlägt eine Brücke zwischen Rechts- und Sozialwissenschaft: Unser Staats- und Rechtsdenken basiert auf dem Grundsatz der Gewaltentrennung. Demnach dürfen Gesetzgebung und -vollziehung nicht von derselben Institution ausgeübt werden. Aufbauend hierauf erklärt sich das Selbstverständnis der Jurisprudenz: Die Pri-vatrechtswissenschaft meint, Rechtsanwendung zu betreiben. Damit ist gemeint, dass Richter reale Streitigkeiten zwischen Privatrechtssubjekten nicht nach eigenem Ermes-sen, sondern gemäß dem geltenden Recht entscheiden. Zu dessen Erkenntnis gelangen Rechtsanwender mittels Rechtsdogmatik. Hierunter wird der streng methodengeleitete Umgang mit dem Gesetz verstanden. Jene konkreten Arbeitsschritte, die erforderlich sind, um Urteile fällen zu können, werden als „Juristische Methodenlehre“ bezeichnet. Die Arbeit kreist sodann um die Frage, woran Rechtsgelehrte erkennen, dass bestimmte methodische Urteilsbegründungen „richtiger“ seien als andere. Dabei zeigt sich, dass die epistemologischen Basisprämissen der Jurisprudenz sowie die daraus gezogenen Schlüs-se durchaus umstritten und alles andere als logisch bzw. zwingend sind. Mit diesem Befund wird zur Foucault’schen Diskurstheorie übergeleitet: In seinen Unter-suchungen zu Macht und Wissen gelangt Foucault zur Überzeugung, dass jede Wissen-schaft ihre Erkenntnisse ausschließlich durch Macht zu konstituieren vermag. Damit ist gemeint, dass eine Diskursgemeinschaft erfolgreich dazu bewegt wurde, bestimmte Aus-sagen als „wahr“ zu akzeptieren. Eben diese Machtdynamiken versucht die Arbeit sodann ebenso hinsichtlich des „methodischen Diskurses“ der Rechtswissenschaft nachzuwei-sen, dessen Redegegenstand die „richtige“ Anwendung des Rechts ist. Dieser interdisziplinäre Perspektivenwechsel ermöglicht es, die Tätigkeit der Jurisprudenz mit Techniken der Foucault’schen Diskursanalyse zu untersuchen. Dadurch werden Machtdynamiken sichtbar, die den Ausgang von Rechtsstreitigkeiten in der Rechtspraxis stark beeinflussen, obwohl ihnen in der Rechtstheorie kaum Bedeutung zukommt. This master thesis builds a bridge between law and social science: Our thinking on the state and law is based on the principle of the separation of powers. Accordingly, the legislative and executive branch may not be exercised by the same insti-tution. This is also the basis for the self-image of jurisprudence: Private law theory studies the application of law. This means that judges do not decide real disputes between sub-jects of private law according to their own discretion, but in accordance with the applicable law. Legal practitioners come to the understanding of law by means of legal dogmatics. This means a strictly methodical approach to the law. Those concrete steps that are nec-essary to be able to make judgments are called "legal methodology". The master thesis then revolves around the question of how legal scholars can recognize that certain methodological reasons for judgments are "more correct" than others. It is shown that the basic epistemological premises of jurisprudence and the conclusions drawn from them are controversial and anything but logical or compelling. This finding leads to Foucault's discourse theory: In his studies on power and knowledge, Foucault comes to the conviction that every science is able to constitute its knowledge exclusively through power. This means that a discourse community has been successfully made to accept certain statements as "true". It is precisely these dynamics of power that the master thesis then attempts to prove with regard to the "methodological discourse" of jurisprudence, whose subject of speech is the "correct" application of law. This interdisciplinary change of perspective makes it possible to look at the activity of ju-risprudence using techniques of Foucault's discourse analysis. Sovereignty has been characterised as a form of “organised hypocrisy”, a system governed by a set of rules that are generally recognised as binding and yet continually infringed by the most powerful actors. This idea can be extended to analyse the role of sovereignty within the Soviet Union. The latter was also nominally governed by a constitution which endowed the Union Republics with the right of secession, but there was no realistic possibility of exercising this right. One should not rush to conclude, however, that the letter of the Soviet Constitution of 1977 was entirely without relevance. As Jon Elster has argued, hypocrisy can be a “civilising force” when the need to appear impartial and retain public credibility forces actors to choose a strategy they would not have chosen otherwise. A good example of this kind of argumentative constraint is offered by the dilemma faced by the Soviet leadership after the mid-1980s, as it became reluctant to use military force to suppress independence movements within the Baltic States while, at the same time, promising to give more weight to the Soviet Constitution and respect the “sovereignty” of the Union Republics. In this setting, the ambiguity of the word “sovereignty” could be used by a whole gamut of political movements in order to further their agenda, from local communists eager to expand their autonomy within the Soviet system to those making an explicit bid for the restoration of independence. Significant legal and political changes could be justified as mere conclusions from the constitutionally recognised status of the Union Republics — a strategy which was all the more effective as Moscow struggled to formulate an alternative line of constitutional interpretation that could be used to counter the Baltic claims. This exchange of opinions escalated into a constitutional conflict in November 1988 when the Estonian Supreme Soviet responded to proposed amendments to the Soviet Constitution (that would have curbed the rights of the Union Republics) by adopting a Declaration of Sovereignty which effectively made the application of Soviet legal acts optional in the terrirory of the Estonian SR. The Soviet leadership reacted in a confused manner, as it first greeted the Declaration, then condemned it as illegal, but also admitted that it was an expression of legitimate concerns. The fact that the notion of sovereignty was an important part of the orthodox Soviet constitutional doctrine and the apprehension that the Estonian interpretative position might diffuse into other Union Republics induced the Politburo to orchestrate a highly publicised denunciation of the Declaration. But this had the paradoxical effect of casting the Declaration as something that could be discussed, i.e., as something that deserved an argued rebuttal. In a way, the Politburo thus contributed to making the Estonian Declaration into a model that was later copied by almost all the Union Republics as they started either to head towards independence or jockey for a better position in the negotiations over the new Union Treaty, drafted in haste by the part of the Soviet leadership that was willing to opt for a confederal solution. The debate over the nature of Soviet federalism and its political aftermath illustrates the fact that a constitution which lies dormant under an authoritarian regime as a document of cynical hypocrisy has the potential of becoming a focal point for the formulation of political demands when circumstances change. The options open to the Soviet leadership in responding to the steps taken by the Baltic independence movements were clearly influenced at least to some extent by the vocabulary it could draw on to justify its response, especially since it had recently vowed to take the Soviet Constitution seriously in the future. Under propitious circumstances, hypocrisy can indeed exert a civilising force on the behaviour of an authoritarian regime.

Intelektinės nuosavybės teisės, kaip santykinai jaunos ir sparčiai besivystančios teisės šakos, doktrinos arba filosofinis pagrindimas yra ypač svarbios. Intelektinės nuosavybės teisių doktrinos yra atskaitos taškas vertinant naujas intelektinės nuosavybės teisių reguliavimo iniciatyvas, nustatant, kokiam socialiniam gėriui jos reikalingos, ar jos nepažeis kitų socialinių gėrių, ilgalaikių visuomenės socialinės, ekonominės ir kultūrinės plėtros interesų. Intelektinės nuosavybės teisės jurisprudencija tradiciškai skiria keletą intelektinės nuosavybės teisių teorijų: prigimtinių teisių teoriją, ekonominę (utilitarinę) teoriją, asmenybės tąsos (moralinę) teoriją, epistemologinę teoriją. Straipsnyje analizuojamos istoriškai svarbiausios tradicinės, taip pat šiuolaikinės intelektinės nuosavybės teisių filosofinės doktrinos, siekiama atskleisti intelektinės nuosavybės teisių tikslus ir paskirtį, išanalizuoti teorijų įtaką teisėkūrai ir teisei taikyti. Dominuojančios ir svarbiausios intelektinės nuosavybės teisių doktrinos Vakarų jurisprudencijoje yra ekonominė ir epistemologinė. Autorius pateikia nuomonę, jog naujausia intelektinės nuosavybės teisėdarą pasaulyje ir Lietuvoje nukrypo nuo doktrinos, pažeidė autoriaus, teisių turėtojo ir visuomenės interesų pusiausvyrą. Lietuvoje intelektinės nuosavybės teisės teisėdaroje ir ją aiškinant įsigalintys abstraktūs teisių išimtinumo ir pažeidžiamumo bei autorių teisių prioriteto argumentai yra aiškiai ydingi ir nepagrįsti doktrina. The article revises traditional historically significant, as well as modern philosophical doctrines of intellectual property rights. The author methodically surveys the social goals and purpose of intellectual property rights, reviews the impact that philosophic doctrines have on intellectual property legislation and interpretation thereof. Natural rights, economic (utilitarian) and pcrsonhood doctrines arc analyzed in greatest detail, alongside with the modern epistcmologica! doctrine. The interpretation and criticism of all principal doctrines is provided. The author argues that lack of understanding of philosophical underpinnings causes improper interpretation and application of the law, violates the delicate balance of the authors, rightholders and social interests. This situation causes groundless subjective judgment, especially in cases when attempting to fill-in legislative gaps or decide over the social relationship not directly regulated through the statutory legislation. The intellectual property doctrine shall be the basis for evaluating new initiatives on regulating intellectual property rights by ensuring that long-term sustainable socio-economic development goals are taken into consideration. The article concludes that unsubstantiated motives of exclusivity and vulnerability of intellectual property rights, as well as prevailing of copyright over the social interest, which have been creeping into the intellectual property case law are unjustified and lack doctrinal support. Parallel to this, reactive proposals to dispose of the intellectual property rights altogether are equally unacceptable. Case law shall resort to doctrinal base when deciding difficult cases and where legislative clarity is lacking.

Thema der Arbeit ist der Zusammenhang zwischen dem verfassungsgerichtlichen Eigentumsschutz und dem dahinter stehenden politisch-philosophischem Eigentumsverständnis. Auf der Grundlage dieses "dualen Untersuchungsansatzes" wird anhand zahlreicher Urteile dargestellt, wie das neue Ungarische Verfassungsgericht (UngVerfG) nach dem Systemwechsel im Jahre 1989 den Schutz des Privateigentums ausgeformt hat. Rechtsvergleichend werden die Eigentumsrechtsprechung des Supreme Court der Vereinigten Staaten von Amerika (USA) und des deutschen Bundesverfassungsgerichts (BVerfG) beleuchtet. Das Eigentumsverständnis bewegt sich in einer Privateigentumsordnung zwischen zwei einander entgegenstehenden politisch-philosophischen Eigentumsbegriffen, dem naturrechtlich-liberalen Eigentumsbegriff und dem sozialstaatlichen Eigentumsbegriff. Ausgehend davon, daß sich nicht nur die USA und Deutschland, sondern auch Ungarn für die abstrakte Idee der Güterzuordnung einer Privateigentumsordnung (und damit für ein liberales Grundmodell) entschieden haben, wird anhand der verfassungsgerichtlichen Rechtsprechung untersucht, wie stark sich die liberalen Elemente erhalten bzw. wieweit Elemente der kollektiven (sozialistischen) Eigentumsordnung - abgeschwächt als sozialstaatliche Elemente - Eingang in den Eigentumsbegriff in der Eigentumsrechtsprechung gefunden haben. Das Eigentumsverständnis in Ungarn kann im Ergebnis als sozialstaatlich- liberal bezeichnet werden. Die Rechtsprechung des UngVerfG zum Schutzbereich und zur Rolle des Gesetzgebers ist sozialstaatlich motiviert. Der Sozialbezug des Eigentums steht im Mittelpunkt, entsprechend bestimmt der Gesetzgeber den Inhalt des Eigentums. Aber das UngVerfG behält sich bei der Prüfung der Verhältnismäßigkeit zwischen der Regulierung und der Eigentumsbelastung auch vor, die tatsächlichen Umstände, die für die Beurteilung der Zweck-Mittel- Relation ausschlaggebend sind, zu überprüfen. Dadurch verbleibt auch ein liberales Element in seiner Eigentumsrechtsprechung. In den USA gilt ein liberal-sozialstaatlicher Eigentumsbegriff: Der liberale Aspekt zeigt sich in dem Beharren des Supreme Court auf der klassischen Eigentumsdefinition und der Privilegierung des Grundstückseigentums, die dem Gesetzgeber Regulierungen erschwert. Jedoch beruht dies nicht in einem naturrechtlichen Eigentumsverständnis da die staatliche power of eminent domain keinen absoluten Bestandsschutz kennt. Das Enteignungsrecht des Staates ist originär. Der Supreme Court anerkennt vielmehr neben der klassischen Enteignung den staatlichen Regulierungsauftrag, wonach auch das Privateigentum in das Gemeinwohl eingebunden werden kann. Entsprechend übt er hinsichtlich des öffentlichen Zwecks judicial self-restraint und stellt nur die Frage, ob die Schwere der Eigentumsbelastung eine Ausgleichszahlung erforderlich macht. Das Eigentumsverständnis des BVerfG kann als sozialstaatlich-liberal bezeichnet werden. Problematisch erscheint die vom Grundgesetz vorgegebene Trennung zwischen dem Bereich der gesetzgeberischen Inhaltsbestimmungen und der formellen Enteignung, da das Grundgesetz für erstere einen sozialstaatlichen Eigentumsbegriff vorgibt, den das BVerfG mit der Anerkennung der Legaltheorie auch durchgesetzt hat, bei letzteren jedoch ganz dem liberalen Eigentumsbegriff verhaftet bleibt. Denn für die Enteignung wird der absolute Schutz des Eigentums aufrechterhalten, wenn auch nur des Eigentumswertes, nicht des Bestands. Für die Inhaltsbestimmungen dagegen gibt es keinen echten Bestandsschutz. Der positivrechtlich geschaffene Bestand des konkreten Privateigentums genießt jedoch den Schutz nach allgemeinen rechtsstaatlichen Prinzipien. Die Unübersichtlichkeit der deutschen Eigentumsdogmatik mag in dieser Zweigleisigkeit des deutschen Eigentumsverständnisses begründet sein. Die - vorwiegend in der Literatur vertrenene - Idee eines naturrechtlichen Privateigentums trifft auf die Realität des sozialstaatlichen Eigentumsbegriffs des BVerfG. Die Kontroverse in der Rechtswissenschaft zum Atomausstieg zeigt, daß die Mehrheit der deutschen Rechtswissenschaft die sozialstaatlich geprägte Rechtsprechung des BVerfG - nach welcher der Atomausstieg eine reine Inhaltsbestimmung wäre - bis heute nicht akzeptiert., This thesis is about the connection between the constitutional ownership guarantee and the political-philosophical conception of property. I portray and analyze the jurisdiction of the Hungarian Constitutional Court since the fall of Communism in 1989 in light of these two aspects and venture a comparison with the jurisdiction of the U.S.- Supreme Court and the German Federal Constitutional Court. In political and philosophical terms, there are - roughly speaking - two opposing conceptions of property in (non-socialist) property ownership systems. According to the natural-liberal understanding, property is a natural right established prior to the formation of states and binding later law makers. Property rights are unlimited in and of themselves and are traditionally understood as "the right to possess (and to exclude others from possession)", "the right to usage", and "the right to free disposition". The right to freely dispose of belongings and of one's own will is considered to be essential to the realization of personal freedom. When governing the body polity, the law maker must not violate these property rights because they are valid in an absolute sense, irrespective of societal change. In order to protect these rights, the constitutional court must review, and, if necessary, nullify, laws regulating property ownership. In contrast, the social welfare conception of property states that private ownership is not superior to the needs of the body politic. Rather, property ownership is integrally linked to the interests of the body politic owing to its role in determining the life-style of property owners and the effects of property ownership, usage, and disposition on society. The social function of property ownership determines the law maker's mandate in regulating property rights, not vice versa. Restrictions on individual property rights and social obligations of property owners are tied into the so-called "legal theory". This theory suggests that law makers can create property by defining the contents and the scope of the conception of property in the laws he passes. Since the term "property" has no absolutely valid content and it exists only insofar as law makers intend it to, rights of possession, usage, and disposition may be reduced and even withdrawn by legal means. In addition the lawmaker can give further objects and rights, which are not traditionally included in the constitutional ownership guarantee, the status of property. Where such philosophy prevails, legal review in constitutional courts is restricted to a due process examination of property laws. These two conceptions of property can be embedded in the fundamental discussion about the relationship between democracy and the rule of law currently taking place in the United States. At first glance, the Hungarian Constitutional Court appears to have adopted the social welfare conception of property in its entirety. But the examination of individual cases by the Hungarian Constitutional Court in the name of the Wesenhaltsgarantie allows the Court to check the power of the law maker. Thus the Court has added a liberal - and politically very effective - aspect. The Court's jurisdiction bears certain dangers which liberals point out and which should by no means be underestimated: the social welfare conception of property is based on the organizing principle of property assignment to individuals. In theory, law makers could give preference to the socially binding function of property to such an extent that the fundamental assignment to individuals would remain only in formal terms. In effect, this would reestablish a system of common property ownership as was known under socialist systems. In a state in which the social welfare conception of property informs the common understanding of ownership, the law maker must, in my opinion, be careful not to cross this threshold and should submit himself, so to speak, to "legislative self-restraint". Whenever the law maker does not show such restraint in Hungary, the Hungarian Constitutional Court can and will exercise power according to its far-reaching competence.
