The article "The quality of implementation of measures in probation and prison: Implementation research in tertiary prevention" emphasizes the importance of implementing measures in probation and prison. Studies show that the quality of implementation has a direct impact on the effectiveness of the measures. Various factors for successful implementation are mentioned, such as the support of all practitioners and adherence to guidelines. The text also emphasizes the importance of competencies, organizational factors, and factors at the management level for successful implementation. Various studies on the implementation of measures in probation and prison are presented, highlighting the importance of implementation quality for the success of the measures. The text deals with the need to develop support systems for measuring implementation quality in the German-speaking region. It is noted that there are international examples and developments, but they are not available in translated form for Germany. Successful establishment of implementation activities and examination of implementation outcomes in probation and criminal justice could lead to an improvement in the quality and effectiveness of services. The article deals with innovation processes in the field of criminal justice, particularly in probation. Considerations on innovations in social work and the public sector are discussed, as well as findings from innovation research and the examination of an innovation process in probation. The article describes subsidies as a funding instrument to ensure an effective and modern prison system in Switzerland. Probation in French-speaking Switzerland is conducted as a pilot project to improve practice and strengthen the identity of probation. The desistance approach is tested and evaluated, aiming to promote desistance from crime. The text addresses the question of innovation in the field of criminal justice and probation in Switzerland. It emphasizes that innovations should go beyond what is already known and bring new substantive aspects. The dissemination of innovations to other contexts and the safety and risks of innovation in criminal justice and probation are also discussed. The text discusses whether innovations in the field of criminal justice and probation can raise public awareness of these issues and lead to a change in their image. Die fehlende Einbindung von Strafgefangenen in eine Vollversicherung während einer Strafhaft in Österreich, wirkt sich auf unterschiedlichen Ebenen aus. Inhaftierte werden dadurch während und nach der Haft in Abhängigkeiten gedrängt. Diese müssen durch das Sozialsystem ausgeglichen werden. Unterschiedliche Disziplinen und Professionen thematisierten in den letzten Jahren diese Ungleichheit. Das Minister*innen-Komitee des Europarates empfahl bereits 2020 die Einführung einer umfassenden Sozialversicherung für Strafgefangene. Die Fragestellung lautet: Welche individuellen und gesellschaftlichen Konsequenzen ergeben sich für Strafgefangene durch die pensionsrechtlichen Bestimmungen in der österreichischen Strafhaft? Ziel dieser Arbeit ist es, die Ungleichheiten in der Behandlung von arbeitenden Menschen darzustellen, um abschließend Lösungsansätze vorzuschlagen. Eingang finden u. a. Lösungsvorschläge wie das Hamburger Modell, die betriebliche Vorsorge oder die Errichtung eines Fonds. The lack of inclusion of prisoners in a comprehensive insurance scheme during their incarceration in Austria has an impact on different levels. This leaves inmates dependent on the social system both during and after their imprisonment. These dependencies must be compensated by the Austrian welfare system. In recent years, different disciplines and professions have addressed this unequal treatment. In 2020, the Ministerial Committee of the Council of Europe recommended the implementation of comprehensive social insurance for prisoners. The question of the thesis is: What are the individual and social consequences of the pension regulations for prisoners in the Austrian penal system? The aim of this work is to illustrate the inequalities in the treatment of working individuals in order to present possible solutions. Proposed solutions include the Hamburger model, company pension schemes or the establishment of a fund.

The sexuality of imprisoned men was long one of the last taboo subjects within the modern penal system. In society in general, the perception of prisoners' sexuality was marked by socially distorted clichés and lack of interest in their plight. Early studies on the sexual deprivation of inmates and sexual violence within the U.S. prison system, above all J.F. Fishman‘s Sex in Prison: Revealing Sex Conditions in American Prisons (1934), D. Clemmer's The Prison Community (1940), and G.M. Sykes' The Society of Captives (1958), laid the groundwork for later research. An early German work dealing with the sexuality of prisoners is Karl Plättner's now forgotten Eros im Zuchthaus (1929), a vivid account of his own prison experience during the Weimar Republic and the consequences of sexual deprivation for inmates and their partners. Research on prison culture and sexuality among inmates was continued in the United States in the following decades. Despite the international interest in the subject, few studies were undertaken in the two post-war German states, with a resulting lack of concrete scientific data. This article reviews the early American research and Plättner's autobiographical work, then discusses several later 20th C. American studies and two German surveys. [ABSTRACT FROM AUTHOR]

18. Convicts’ Labour in Russian Penitentiary Practice of the 17th – 18th Centuries: from Punishment to Correction Remedy

The results of historical and legal research of the key characteristics of Russia’s penitentiary policy in the sphere of convicted criminals’ labour organization in the 17th – 18th centuries are presented in the article. As an information base were used original texts of Russian legal acts of the researched historical period. Also, were used science works of historians and legal scholars starting from the first half of the 19th century. The study determines the influence of the Church on the processes of law-making, execution of criminal penalties and convicts’ labour organization in the early middle ages, as well as the impact of this stage on the formation of Russian penitentiary system in the studied historical period. The features of the influence of foreign legislation on the Russian penitentiary law-making and reception processes of the Byzantine legislation in the legal system, as well as the legislation of European countries, were determined. The article analyses the initial stage of the formation of a unified penitentiary system associated with the emergence of codified legal sources and a centralized system of public administration. Features of convict’s attraction to labour as well as organizational aspects of penitentiary systems’ functioning were investigated. The socio-economic conditions that determined the directions of development of Russia’s criminal and penitentiary legislation of the studied historical period were analysed.

21. Exile on Penal Servitude in the Russian Empire in the 19th Century: Some Aspects of Applying

The results of the research of the main features of the execution of criminal penalties in the form of exile on servitude in the Russian Empire in the 19th century are presented in the article. The study was based on the use of narrative, comparative and historically-genetic methods of scientific research. The information base of the research includes acts, analytical and statistical data that concern exile on servitude in the Russian Empire, published in Russian and foreign scientific literature before 1917 and in the modern period. Main positions of the “Exile Statute” from 1882 and the appropriate law enforcement practice were analysed. The cause and consequences of the abolition of exile on servitude as a kind of penalty for criminals in the central provinces of the Russian Empire were determined. The features of the servitude organization, the discharge system of arrived to prison convicts’ classification were analysed. The legal framework and features of the regulation and organization of labour of convicts in the first half of the XIX century in the newly annexed western parts of the Russian Empire were studied. Largely, that exile on servitude in the Russian Empire in the studied period should be regarded as a significant socio-economic phenomenon that has had a great impact on the development of the country. Generally, it concerns the colonization of Siberia, the Far East and Sakhalin Island. Historical experience, gained during the development of the exile on servitude institution in pre-revolutionary Russia is essential and requires its consideration today. It was determined that a significant change of infrastructure, communications and information capabilities improve the relevance of the question of the return to the historical experience of the application of exile on servitude as one of the types of punishment, not related to incarceration.

Forensic psychologists routinely assess the violence risk of their clients and patients. Nevertheless, there is only little knowledge about which risk assessment methods are regularly used in the field. The present study provides the first insight into the clinical practice of risk assessment in Germany. Data were collected from 2,135 respondents from 44 countries as part of the International Risk Survey (IRiS). In Germany, 97 psychologists and members of other professional disciplines were surveyed about their clinical risk assessment practices. The data indicated that a majority of the respondents regularly use standardized risk assessment instruments inclinical practice. The instruments were not only perceived as useful tools for risk assessment purposes of future violence risk alone but also for developing and evaluating risk management plans. Temporary releases from prison and open prisons are elementary components of a rehabilitation-oriented prison system. This statement has remained unchanged after the federalism reform, with which the legislative competence for the prison system was transferred from the federal government to the states. The reform provides an opportunity to compare the 16 new state laws with each other and to examine the legal regulations on temporary releases from prisons and open prisons from admission to the penal institution through to discharge, taking into account normative administrative practice. In doing so, this is explored whether the federal states have maintained the standard established by the Federal German Prison Act of 1976, legitimized restorative tendencies or established innovations. The present work also makes a contribution to a constitutionally determined understanding of temporary releases from prison and open prisons.

Créé en 1947, l’hebdomadaire Der Spiegel occupe pendant les décennies suivantes une position singulière dans le champ médiatique ouest-allemand, et même au-delà en Europe. Lu par plusieurs millions d’Allemands, il est non seulement synonyme de qualité et d’indépendance, mais aussi d’un journalisme critique, sans complaisance à l’égard des élites. Respecté et redouté, c’est le journal de référence. Et comme son nom (« le miroir ») l’indique, il est censé offrir un reflet fidèle de la République fédérale, si besoin en dévoilant ses coulisses. Or, la prison constitue une zone d’ombre par excellence, un univers clos voire impénétrable, régi par le secret, l’opacité, la censure. Comment alors cet hebdomadaire fameux pour le sérieux et la portée de ses révélations a-t-il traité de la question carcérale, que la période du « miracle économique » de l’après-guerre a d’abord refoulée aux marges de l’espace public avant qu’elle n’émerge à nouveau dans la seconde moitié des années 1960 ? Afin de contribuer à l’analyse des rapports entre espace public et question carcérale, cet article, qui s’appuie sur des sources dont la plupart sont disponibles en ligne, décrit l’intérêt mais aussi les limites du regard du Spiegel sur la question carcérale ouest-allemande des années 1950-1970. Founded in 1947, Der Spiegel has occupied a unique position within the German journalistic field (and more broadly in Europe) during the following decades. Read by millions of Germans, this renowned news weekly was not only synonymous with quality and editorial independence, but also with a critical journalism that showed no leniency towards the social elites. Revered as well as feared, it was sometimes criticized, but nevertheless, definitely remained the newspaper of record, especially during the 1950’s-1970’s. As the name suggests (“The Mirror”), Der Spiegel was then expected to reflect the reality of German society, if need be, by disclosing what went on behind the visible scenes. And what was more hidden than the prison life, which meant secrecy, censorship and opacity, especially in a historical moment where the subject of prisons was pushed to the margins of the public sphere, before being back in the forefront at the end of the 1960’s? This raises the question: how has the “prison issue” been dealt with by the most respected newspaper – and famous for its important revelations – at the time? This article, which draws on sources that are for the most part online available sources, describes the relevance as well as the limits of the discourse of Der Spiegel on the prison issue in West Germany during the 1950’s-1970’s. Seit den fünfziger Jahren nimmt der 1947 gegründete Spiegel innerhalb der journalistischen Produktion in Deutschland – und darüber hinaus in Europa – eine einzigartige Stellung ein. Die Wochenzeitschrift, die von mehreren Millionen Deutschen gelesen wird, ist Synonym für kompromisslose Qualität, Unabhängigkeit und einen kritischen Blick. Respektiert, aber auch gefürchtet gilt der Spiegel als der deutsche Meinungsmacher. Wie sein Name schon sagt, will die hamburgische Zeitung ein treuer Spiegel der sozialen Realität in Deutschland sein, wenn nötig, auch ein Beobachter hinter den Kulissen. Das Gefängnissystem war mindestens bis zum Ende der sechziger Jahre eine soziale Grauzone, eine undurchsichtige Welt, in der Geheimhaltung und Zensur herrschten. Daher ist es interessant, nachzuvollziehen, wie der Spiegel, der für seine Ernsthaftigkeit und seine Enthüllungen berühmt ist, das Thema des Strafvollzugs behandelt hat, besonders während der Zeit des Wirtschaftswunders, d.h. einer Epoche, in der die „Gefängnisfrage“ verdrängt wurde. Aus diesem Grund beschreibt dieser Beitrag, der weitgehend auf Online-Quellen beruht, die Verdienste, aber auch die Grenzen und Widersprüche des Spiegel-Diskurses zum Thema Gefängnis.
